Abstract

AbstractReligious freedom is one type of human rights which caused major resistance to the universalism claim of human rights in Muslim countries. This article attempted to describe why that resistance arose and how Islam should reconceptualize religious freedom. The religious freedom issues are important to be explored in the context of contemporary Islamic studies because its value and scope tended to be limited in the Islamic conservatism discourse. One of the issues is the fallacy in categorizing the apostasy (riddah)—a non-derogable right—verdicted as a blasphemy in Islam. By reconceptualizing the Islamic meaning of religious freedom, this study applied document analysis to enrich the contemporary Islamist studies, especially to postulate the significant relationship between Islam and human rights and to argue that Islam actually legitimized religious freedom as one of the non-derogable rights.

Abstract

The Shi’a minority encounters different kind of treatments from the Sunni majority in several regions in Indonesia; some falls into series of violent discriminative conflicts, while the other live in peace. The Sampang Shi’a community has encountered the first kind of treatments, whereas the Shi’a community in Yogyakarta is able to get a safe environment. The disjuncture comes from the different policies enacted by the respective regional governments. This study tries to describe the differences of the policies from the regional governments and uncover the factors structuring them. In doing so, this qualitative study approaches the issue through a case study using the theory of conflict proposed by Ralf Dahrendorf and functional theory of Lewis A. Coser. This study finds some factors leading to the different form of treatments of Sunnī majority towards the Shi’a minorities of Sampang and Yogyakarta, including: social, cultural, political, economic, and some other external factors. Furthermore, it also suggets that to cope with the discrimination issue towards the minority, the government could consider to implement the politics of multiculturalism proposed by Charles Taylor.

Abstract

This article aims at explaining the difference between sunan ilāhiyya ijtimāʿiyya and sunan kawniyya ṭabīʿiyya; two complicated concepts that are not easy to comprehend. Furthermore, as a means to help comprehension upon the concepts, this study also investigates their influences in Qurʾān commentaries. In doing so, this qualitative research employs analytical-comparative approaches upon Tafsīr al-Manār of Muḥammad Rashīd Riḍā and al-Jawāhir fī Tafsīr al-Qurʿān al-Karīm of Ṭanṭawī al-Jawharī. It is through both commentaries this article seeks to explain the difference between sunan ilāhiyya ijtimāʿiyya and sunan kawniyya ṭabīʿiyya. The result of the research is as follow: sunan ilāhiyya ṭabīʿiyya is a concept that is related to human and its intentionality and will, whereas sunan ṭabī’iyya is related to human but not in its intentionality but physicality. Sunan ijtimāʿiyya is reflected by Tafsīr al-Manār of Rashīd Riḍā, whereas sunan kawniyya ṭabīʿiyya is reflected by Tafsīr al-Jawāhir of Ṭanṭawī Jawharī. أوضح هذا البحث الفرق بين السنن الإلهية في المجتمع والسنن الكونية في الطبيعة وأثرهما في كتب التفسير. وقد استخدم هذا البحث الكيفي منهج التحليل والمقارنة بين تفسير المنار لمحمد رشيد رضا وكتاب الجواهر في تفسير القرآن الكريم لطنطاوي جوهري. ونتائج هذا البحث أن السنن الإلهية في المجتمع تتعلق بعزيمة وقدرة الإنسان. وأما السنن الكونية في الطبيعة لم تتعلق بالإنسان، لكن بالأحكام الطبيعية والعالمية. السنن الإلهية في المجتمع متضمنة في تفسير المنار لمحمد رشيد رضا، وأما السنن الكونية في الطبيعة متضمنة في كتاب الجواهر في تفسير القرآن الكريم لطنطاوي جوهري.

Abstract

The Indonesian socio-religious circumstances have been complicated lately, especially since the reformation era. This situation is marked by turmoils, horizontal conflicts, and unfriendly political dynamics involving radical religious and political ideology (henceforth: radical Islamic groups). Against this backdrop, this research is an attempt at getting a comprehensive understanding of radical islamic movements as well as the strategy of coping with them. The method employed is participatory action research, with Surabaya is selected as its setting. This study finds that re-upholding local tradition framed with religious moderation concept that have for years been the trademark of Indonesian Islam, which is manifested through distinctive local practices labelled as Islam Nusantara (henceforth: Islam wasatiyya), is capable of minimises the radical Islamic movements that has growth as a threat for the nation.

Abstract

This present research aims to explore the meaning of jihad among Muslim youths in the context of junior high school students in Padang. Muslim youths at this level are considered to have unique characteristics in expressing diversity, including in the interpretation of jihad. As a qualitative research, it gathered the relevant data through series of survey of the perception of students on jihad and its rationale, as well as their sources of knowledge on the issue. The interlocutors include students in several junior high school in Padang, including Thawalib Boarding School, MTsN 5, SMP 24, MTSs Tarbiyah Islamiyah, MTSs Bustanul Ulum, and SLTP Muhammadiyah 7. This research discovered that there were five types of definitions of the meaning of jihad proposed by the respondents of the research. First, jihad was seen as earnest in worship, secondly; jihad was meant as being committed to work, third; jihad was interpreted as devotion to parents, fourth; jihad was interpreted as an effort to spread Islamic teachings and the fifth; Jihad was defined as a war against infidels. There were several sources which affected the way respondents interpreted the meaning of jihad, for instance, Islamic teacher (ustāż) around 85%, Quran teacher 73%, parents 59%, religion teacher in elementary school 54%, and junior high school teacher for 51%.

Abstract

From an epistemological perspective, the environment creates knowledge and meaning of life for society. Knowledge is used to achieve people's goals and expectations. This article examines the epistemology of Islamic law in Indonesia, particularly on the north coast of Java, in the context of its social and cultural background. To that end, this study investigated the works of KH. Bisri Musthofa, namely Tafsīr al-Ibrīz li Ma'rifa Tafsīr al-Qur'ān al-'Azīz and al-Azwād al-Musṭafawiyya fī Tarjama al-Arba'īn al-Nawawiyya. Many have already discussed the works of KH. Bisri Musthofa, but only a few touch on the issue of Islamic law in these works. This study argues that cultural context influences the authors of qur'anic and hadith interpretations to negotiate their understanding of customs and traditions, including in Java. Thus, the understanding of Islamic sharia on the north coast of Java is not passive, imitative and follows the thinking in the Arabian peninsula. The interpretation of the Qur'an and the understanding of hadith in Java indicate an active, creative and sustainable negotiation process related to the reality of society, social and cultural. This process then reconciles the two sources of law, between religious texts and cultural and social realities, and between sharia and haqiqa. Reconciliation shows that Islamic law was in its epistemic space on the north coast of Java in the 20th century.

Abstract

Legal subjectivity, particularly that of the majnūn, is an understudied topic that is often only glossed over or nominaly referenced in academic scholarship on Islamic jurisprudence. In attempting to fill this gap in scholarship, this article aims at examining the epistemological and ethical dimensions of legal subjectivity, particulary as it relates to the insane. The article takes the the concept of taklif in classical Ash'arite works of jurisprudence as the center of its analysis of legal subjectivity. Taklif, it characteristics, the relationship between the law giver and the legal subject, and the host of epistemological and ethical assumptions embedded in assigning legal subjectivity to certain individuals and excluding others from it, were among the main issues that classical Muslim jurists grappled with. Understanding the concept of taklif as a form of prescriptive speech, Ash'arite jurist-theologians went on to articulate a theory of legal subjectivity that emphasized the mental capability of the legal subject to comprehend the moral import of  divine prescriptive address and to respond to it with cognizant and intentional obedience. In stressing the value of cognitive ability, Muslim jurists contended that the comprehension of insane individuals fell short of the level necessary to acquire legal subjectivity. Beyond the issue of the legal subjectivity of the insane, this study of the concept of taklif allows us to understand some of the ways Muslim jurists conceived of reason/rationality, the relationship between intentionality, knowledge and action, and the nature of divine speech and its normative value.

Abstract

This paper aims to study the integration of eco-feminism and Islam conducted by women activist of pesantren Ath-Thariq, Garut, West Java, in their attempt to conserve the nature. They are highly concerned with this issue as a response towards environmental crisis in Indonesia, especially in Garut. Additionally, there are only a few Muslimah activists that have so far been involved in such a movement. Against this backdrop, this study portrays the ways and results of the integration of eco-feminism and Islam as conducted by women activists of the respective pesantren. In doing so, this qualitative study employs feminism method. The subject of research includes women activists of pesantren Ath-Tariq. It finds the following. Through ontology, the women activist of the pesantren believe that there is no dualism of human being and nature. They protect, preserve, and love nature with a concept of rahmatan li al-‘ālamīn. Through epistemological approach, they integrate local knowledge and Islam to interact with nature. They also implement the principles of heterogenity, human-nature inter-dependability, and the holiness of nature. They believe that caring for nature is a form of religious piety and an alm. Thus, the novelty of this research is a new model of integration between Islam and eco-femism through ontological and epistemological approaches based on empirical experiences of women. It is hoped that women activists could apply this model in protecting and conserving the environment in other places.
