Abstract

Peripheral areas such as Indonesia are in necessity to have more understanding of hadith content (matn) than on knowledge of hadith in its complexity. The long distance of knowledge dissemination, development and codification of hadith period in Indonesia, than in the Arabian Peninsula, caused many scholars to prioritize hadith studies in its understandable form, which is more practical, than in its theoretical one. Based on the study of hadith of maulid nabi (prophet’s birthday) in Indonesia, it strongly suggests that understanding and practicing hadith are more important than studying of hadith knowledge. Popular hadith of maulid consists of several hadiths and several comments (sharh}). Those hadiths are then compiled and summarized to be one simple sentence. This sentence is then considered as hadith, and people could be easily understand and memorize it. The same method is also applied in the writing and teaching of hadith books. This compilation and summary seem to be an inverted proof of isnâd-cum-matn, which argues that the transmission of hadith is an ongoing process of oral words along the times.

Abstract

The purpose of this study is to find information about the law of a wife to be a migrant worker from the perspective of fiqh. This study is qualitative research using library research and uses the fiqh approach. Data sources come from primary and secondary sources. The primary source functions as the main source, obtained by tracing the book of jurisprudence by analyzing the content (content analysis). Secondary sources function to support primary sources obtained through books, journals, and other important documents. The result is that the husband must rethink to permit wives who want to become migrant workers. Changes in Islamic law against migrant workers can occur if they meet the requirements including time, place, intention, and custom. The proof of sadd al-dhari'ah serves to inhibit the rate of sending women migrant workers.

Abstract

The fuqahâ’ (Legal Scholars) and muḥadditsûn (Hadith experts) have constructed theepistemology of Sharḥ Hadith in al-Andalus by its use and application. Interpreting Hadithby understanding the reality and context in al-Andalus provides a comparative understandingfor society to better get the messages of the Hadith, rather than focus on its transmission andvalidity rules. Such approach is taken considering the situation and condition in al-Andalusdemand the dissemination of practical knowledge, not theoretical knowledge as in Masyriq (theEast) where the people have achieved deeper knowledge. The epistemology developed by ‘Abdal-Malik bin Ḥabîb (d. 238/852) in the second to the third century AH gives an illustration thatSharḥ Hadith is developed in its epistemic corridor. Basically, the study of Sharḥ Hadith in Al-Andalus does not only have a passive role in the domination of Islamic centrist in the Masyriq,but also play an active role in interpreting various situations and conditions in the region.The relation of power between the Mâlik School and local knowledge in the epistemology ofSharḥ Hadith hadith are productive, producing practical and principle-based knowledge forthe people in al-Andalus

Abstract

Kajian al-Quran dan Hadis yang berkembang pada masa sekarang banyak yang mengalami persoalan epistemologi maupun metodologi. Persoalan ini harus segera diselesaikan sebelum melakukan dialog dan rekonsiliasi dengan ilmu sosial dan ilmu alam modern. Tidak adanya inovasi dalam kajian keagamaan menyebabkan munculnya berbagai pemikiran yang repetitif, statis dan tertinggal jauh dari kajian keilmuan yang lain. Dominasi epistemologi bay?n? dan irf?n? atas epistemologi burh?n? dalam kajian al-Quran dan Hadis menyebabkan tidak adanya inovasi dalam ilmu keagamaan. Dalam diskursus al-Quran dan Hadis dengan ilmu sosial modern, terdapat banyak perdebatan dan perbedaan dalam aplikasi dan teorinya. Di sisi yang lain, al-Quran dan Hadis dengan ilmu alam modern mendapatkan tempat yang baik walaupun terdapat berbagai persoalan di dalamnya. Ada empat pendekatan dalam dialog dan rekonsiliasi al-Quran dan Hadis dengan ilmu sosial dan ilmu alam modern, yaitu pendekatan konflik, kontras, kontak dan konfirmasi. Pendekatan yang lebih cocok dan sesuai dengan watak pengetahuan modern adalah pendekatan konfirmasi. Langkah untuk melakukan pendekatan konfirmasi adalah studi historisitas dan lokalitas agama, filsafat ilmu, pemahaman yang komprehensif dan terbuka serta melakukan kajian empiris dan eksperimental. Abstract

From an epistemological perspective, the environment creates knowledge and meaning of life for society. Knowledge is used to achieve people's goals and expectations. This article examines the epistemology of Islamic law in Indonesia, particularly on the north coast of Java, in the context of its social and cultural background. To that end, this study investigated the works of KH. Bisri Musthofa, namely Tafsīr al-Ibrīz li Ma'rifa Tafsīr al-Qur'ān al-'Azīz and al-Azwād al-Musṭafawiyya fī Tarjama al-Arba'īn al-Nawawiyya. Many have already discussed the works of KH. Bisri Musthofa, but only a few touch on the issue of Islamic law in these works. This study argues that cultural context influences the authors of qur'anic and hadith interpretations to negotiate their understanding of customs and traditions, including in Java. Thus, the understanding of Islamic sharia on the north coast of Java is not passive, imitative and follows the thinking in the Arabian peninsula. The interpretation of the Qur'an and the understanding of hadith in Java indicate an active, creative and sustainable negotiation process related to the reality of society, social and cultural. This process then reconciles the two sources of law, between religious texts and cultural and social realities, and between sharia and haqiqa. Reconciliation shows that Islamic law was in its epistemic space on the north coast of Java in the 20th century.

Abstract

The lack of understanding of religious texts, anthropocentric views and lack of integral human consciousness in the universe is one of the causes of environmental destruction. Understanding of environmental prophetic message in ḥādīth is one way to solve the problem. The sentences relating to maintaining the environment in the ḥādīth are ḥafiẓa and ra'ā, while those pertaining to corrupting are fasada and halaka. Using the thematic approach to the sentence in various editorials of the ḥādīth, I found the basic ideas about the prophetic message of the circulation conveyed by the Prophet Muhammad. In keeping with the environment, prophetic messages cover maintenance goals, inclusive ownership, positive contributions, use-based usage, sustainable programs, limited utilization and jointly controlled use. The environmental destruction includes exploitative goals, exclusive ownership, negative contributions, incorrect use, and unsustainable, unlimited and self-supervised programs. The religious texts on the environment in the ḥādīth are not dead texts. This text should always be turned on to bring a new interpretation of the existing environmental phenomenon.

Abstract

Some researchers claim that Muslim scholars do not emphasize the importance of Bayt al-Maqdis as strongly as they do upon the two holy cities of Islam, Makkah and Madinah. Even when they do, their writings are mixed with weak and forged narrations. Additionally, their efforts aimed to strengthen the political position of certain caliphs. In the current regional situation, some Muslims radically and literally interpret the hadith out of context to support the liberation of Bayt al-Maqdis. They believe that participating in jihadi group is a noble effort, even if it involves suicide bombings. Based on these issues, this article explores the efforts of scholars in hadith scholarship related to Bayt al-Maqdis. Specifically, it examines the perspective of a prominent hadith scholar, Imam al-Bukhari, in his initiative to compile hadiths, which he placed in different chapters of his book al-Jāmi’ al-Ṣaḥīḥ. This study employs a library research approach involving content analysis. The findings of this study reveal that numerous Muslim scholars have contributed significantly to Islamic scholarship in Bayt al-Maqdis through writing and the dissemination of knowledge. Specifically, they compiled hadiths about Bayt al-Maqdis in certain books and chapters. Imam al-Bukhari documented 12 narrations related to Bayt al-Maqdis in 9 books and 13 chapters. This study selected one hadith that is almost identical but is placed under four different chapters. This illustrates the unique way a single narration, both textually and contextually, can explain the significance and position of Bayt al-Maqdis in Islam from diverse and interesting perspectives. This study recommends continuing the exploration of hadiths related to Bayt al-Maqdis to examine various other forms of Tarājim. This will help the Muslim community, in particular, to understand the hadith texts comprehensively while simultaneously refuting the argument that Islam neglects this third holy city.
