Jurnal Hukum dan Peradilan (JHP) is published by the Research Center for Law and Judiciary of the Supreme Court of the Republic of Indonesia. JHP aimed to be a peer-reviewed platform and an authoritative source of information on legal and judiciary studies. The scope of JHP is analytical, objective, empirical, and contributive literature on the dynamics and development of legal studies, specifically in Indonesia. JHP welcomes scientific papers on a range of topics from research studies, judicial decisions, theoretical studies, literature reviews, philosophical and critical consultations that are analytical, objective, and systematic. However, from a wide range of topics that researchers can choose from, JHP puts more attention to the papers focusing on the sociology of law, living law, legal philosophy, history of national law, customary law, literature studies, international law, interdisciplinary, and empirical studies. Jurnal Hukum dan Peradilan (JHP) is a media dedicated to judicial personnel, academician, practitioners, and law expertise in actualizing the idea of research, development, and analysis of law and judiciary. Jurnal Hukum dan Peradilan comes out three times a year in March, July, and November.

Abstract

The existence of Judicial Commission, a state institution function as an external control for ethic code and judges code of conduct, often collide with an internal control function which carried out by Supreme Court. Both institutions were overlapping so that many energy been wasted for handling the problem raised. Both parties have to realize each position and area. Abstract

The fundamental purpose of law is to create justice, legal certainty and utility. The contradiction between justice and legal certainty are dilemmatic for law enforcement officer. The legal certainty side is easier to be applied so that it neglect the justice itself. The law principle is unhierarchical, thus there is no superior principle which can ignore the other principle. The relevance of the application of legal principles is based on the situation in legal issues. Responding to these challenges appear paradigm of progressive law that the law is a scheme that is not final, it continues to move, to change, it follows the dynamics of human life. Therefore, the law is not seen as something that lives in a stagnation. Law is born from provision living in the society (ibi societas ibi ius). On that basis, the law must continue to be dissected and explored through progressive efforts to reach the ultimate truth for the sake of justice.Keywords : Rechtsvinding, Progressive Law

Abstract

The Justice must be firmly maintained. This demand can not be modified due to it was closely related to the rights enforcement. The common paradigm in civil code perception makes judges passively work in civil cases handling. It can be seen in Article 119 HIR when the general court chief judge give a support as advice and help related to the formality or the terms of the lawsuit for the strike to be acceptable and meets the requirements of formality lawsuit against the plaintiff or attorney. Moreover , Article 130 HIR/RBG Article 154, required that general court chief judge attempted to reconcile the two parties litigant. Furthermore, in Article 132 HIR/RBG Article 156, the Judge has an active role to inform both litigants and provide an explanation to the litigants of their rights to take legal actions and the right to submit evidence on the court.Keywords : active judges, civil case

Abstract

This article aimed to criticize the juridical basis of the scope of crime mentioned on Law Number 37 of 2004, focuses on the criminal responsibility of a Curator based on independence principle of Bankruptcy Law. Essentially, bankruptcy is a part of Civil Law. However, some bankruptcy cases eventually evolve into criminal matters when a Bankruptcy Curator who is responsible for handling and administering bankruptcy case is positioned as Defendant charged with conducting criminal acts. As stated in Article 234 verse (2) of Law Number 37 of 2004, a Curator who is proven not independent during bankruptcy court may be charged with Criminal Law.Keywords: Curator, Bankruptcy, Principle of Independency, Criminal Responsibility

Abstract

There were appeal legal effort, cassation and judicial review on Administrative Court. After the Supreme Court Act article 45A paragraph (2) letter c was applied, it was determined that not all administrative settlement dispute can be filled to cassation legal effort. The setting restriction poses legal problems to justice seekers. This article aims to study the solution of cassation rights setting restrictions so that it can be mutual for administrative justice seekers. Based on the analysis that has been done it can be concluded that the regulation on Supreme Court Act article 45A paragraph (2) letter c Act number 5 2014 was not clear in procedures and substantive. Abstract

Court trials always refer to the rules contained in Law No. 8 1981 of the Criminal Code, which seem underdeveloped, mainly about the arrangements regarding evidence which can be used in the court. This paper outlines the use of a few electronic documents as evidence in the trial. Abstract

There are some provisions of Bill on the Religious Courts’ Material Law on marriage that need to be formulated in accordance with the current conditions. In this way, the Islamic Marriage Law in Indonesia will become progressive and not discriminative against women. This article is the continuation of the article entitled “Menuju Hukum Perkawinan Islam Progresif” which is published in Jurnal Hukum dan Peradilan volume 3, number 1, March 2014. In this article, the author tries to offer reinterpretation on the provision of waiting period (‘iddah) in accordance with the current context. Abstract

Political parties act stipulates that a political party dispute resolved internally by the Mahkamah Partai or other designation of that and externally resolved by the District Court and the Supreme Court. The dispute substance in Mahkamah Partai which is final and binding is about organization dispute, the other can be settled in District Court and the Supreme Court. In practice, that arrangement makes the decision apart from the sense of justice, legal certainty and utility. Therefore, these rules should be revised so that the regulation of PAW, violations of the rights of members of political parties, abuse of authority, financial liability, or an objection to the decision of political parties (including the decision not to decide on something) is final and binding through Mahkamah Partai decision. Abstract

A law (written law) was never full, clear and complete set of community life, so it is always lagging behind follows the development of society. To keep abreast of it, the law should always be developed in order to remain update and relevant to the times. Implementation and development of legislation going through the verdict (jurisprudence) in the judicial process. In other words, jurisprudence intended as legal development, to meet the legal needs of justice seeker. Implementation of the functions of law enforcement and justice as well as the function of legal discovery (rechtsvinding) embodied in a verdict (jurisprudence), should refer to Pancasila as the norm of fundamental state (staatsfundamentalnorm) or wisdom / genius of the national (national wisdom / national genius) and 1945 as the basic law of the state, so that the decision reflects the sense of justice of the nation and the people of Indonesia as well. Abstract

Biodiversity is one of the components of the environment which plays an important role in shaping the ecosystem that provides life support on Earth. For that reason, the efforts to provide protection is necessary. Islam is very much aware of the important role of biodiversity, therefore Islam have participated in biodiversity protection through Islamic law. The protection of biodiversity in Islamic law demonstrated by the various rules derived from the Quran, hadith and fatwas of the scholars as well as demonstrated by the existence of conservation institution known as Hima and Zone Harim. Indonesia as the country with the second greatest biodiversity in the world and a country with a largest Muslim majority population in the world have an important role to develop and utilize the Islamic legal tradition in the protection of biodiversity in the scope of the provisions of national in order to increase the participation of Muslims globally in protection and preservation activities of the environment, especially biodiversity.Keyword : protection, biodiversity, islamic law, hima, harim zone
