Jurnal Hukum dan Peradilan (JHP) is published by the Research Center for Law and Judiciary of the Supreme Court of the Republic of Indonesia. JHP aimed to be a peer-reviewed platform and an authoritative source of information on legal and judiciary studies. The scope of JHP is analytical, objective, empirical, and contributive literature on the dynamics and development of legal studies, specifically in Indonesia. JHP welcomes scientific papers on a range of topics from research studies, judicial decisions, theoretical studies, literature reviews, philosophical and critical consultations that are analytical, objective, and systematic. However, from a wide range of topics that researchers can choose from, JHP puts more attention to the papers focusing on the sociology of law, living law, legal philosophy, history of national law, customary law, literature studies, international law, interdisciplinary, and empirical studies. Jurnal Hukum dan Peradilan (JHP) is a media dedicated to judicial personnel, academician, practitioners, and law expertise in actualizing the idea of research, development, and analysis of law and judiciary. Jurnal Hukum dan Peradilan comes out three times a year in March, July, and November.

Abstract

This dissertation analyzed for real about characteristics of an entity, either a legal or the nonlegal "entity'' which all were discussed in the same outline of corporate crime responsibility. It was often, though, in several laws aside from the Penal Code of Indonesia (KUHP), both in Criminal Law and Administrative Law with criminal sanction, that corporate is defined as a collection of organized people and or wealth, either as a legal or the nonlegal entity. The definitions in those laws are really different from those of law experts, especially those of criminal law who basically identify corporate as a legal entity, however the same is not true for those of the nonlegal entity. Such differences of the legal and nonlegal entities would bring their own legal consequences, therefore they could not and would not be treated the same referring to corporate criminal responsibility.Keywords: corporate criminal responsibility, characteristics, legal entity,nonlegal entity

Abstract

Confidentiality ICSID arbitration award already started breached by the transparency award on the opportunity provided by Article 48 paragraph (5) of the ICSID Convention and Rule 48 paragraph (4) of the ICSID Arbitration Rules. Changes in the legal norms of confidentiality to transparency of ICSID arbitration award by comparing its application in Indonesia, Malaysia, Singapore and Japan, are expected to provide great benefits for society include ICSID member countries. This dissertation research results prove that the ICSID arbitration ruling required transparency rather than confidentiality award for several important reasons and not cause problems. Even it helped realize the implementation of good governance principles. the article will note the need for unification of the laws regarding the responsibility of publication award and the need to amend the Arbitration Law in Indonesia.Keywords : principles of transparency, arbitration award, ICSID, state.

Abstract

In the context of Law Number 30 of 2014 concerning Government Administration the competence of administrative court was not only the decision of the Administration but also has the competence to judge the actions of Administration. In addition administrative court also have competence to decide an application for assessment to determine whether there are elements of authority abuse as well as the application for a fictitious positive decision. However to determine the application for approval of a person or body of civil law are not automatically, but must first be tested through administrative courts. The Government's Administration Law regulates the material law and formal law. For the Government's Administration Law should be amended to load any material law and the need for changes to the Administrative Law to accommodate the enforcement of material law.Keywords: administrative court, competence, material law, formal law.

Abstract

Pengadilan Pajak merupakan pengadilan pajak murni (administratief rechtspraak) yang memenuhi unsur-unsur sebagai lembaga peradilan, bukan pengadilan internal administrasi murni (administratif beroep) di bidang perpajakan. Pengadilan pajak merupakan pengadilan khusus dalam lingkungan peradilan tata usaha negara di Mahkamah Agung.7 Dengan demikian secara kelembagaan Pengadilan Pajak berkedudukan sebagai bagian dari Mahkamah Agung sebagai pelaku kekuasaan kehakiman sebagaimana dimaksud dalam Pasal 24 Ayat (2) UUD 1945.

Abstract

The authority abuse is a concept that is always develop behind the realm of public law. This concept is an important measurement, for the wheels of the government. The actions and/or decisions of the agency and/or government officials are not unlimited authority. It is important for restriction or agency that oversees the actions and/or decisions of the government. The institution in question is the judiciary. Post the normalization of authority abuse in the Act No.30 of 2014 About Administration (particularly Article 21), there are different views in dealing with law enforcement. This is related to the absolute competence of the judiciary, namely the Administrative Court and the General Court (Criminal/Corruption). In that case, there needs to be clarity of meaning in the norms that regulate the abuse of authority. To avoid confusion in its implementation. Therefore, the need for understanding the meaning of abuse of authority by evaluating them in terms of the development of thinking and the settings from the perspective of administrative law.Keywords: Meaning, Authority, Law Enforcement

Abstract

The sustainable business principles that is defined broadly and underlying the norm of bankruptcy law and the suspension payment of debt. Implementation of the principle of sustainable business is not limited to the texts that is legally regulated, but has a broader meaning which also include the whole process of bankruptcy judgement as well as payment suspension of the debt. Abstract

The Government Administration Act has expanded the access to justice for justice seekers in Administrative Court by opening the "empty spaces" that were not previously accessible for justice seekers. Hence Government Administration Act has opened access to justice, the Judge as the central figure of law enforcement should also committed to changes and developments, including changes and legal developments in the field of Government Administration. Access to justice is a human right that must be guaranteed, not just move the absolute power of the other judicial authority to the Administrative Court. His attempt is to cover the empty space/ vacuum which cannot be filled by the Administrative Court and other courts. The Administrative Court Judge are no longer narrow the authorization of Administrative Court on the pretext object of the dispute is not individual, not final, civil disputes especially since the disputed a declarative decision. The judge would have to implement the content of Government Administration Act along with the Supreme Court Regulation No. 4 of 2015 and the Supreme Court Regulation No. 5 Year 2015. To avoid disagreement of the law, the new law is applied with some implementation strategies that really understood what the intent and purpose of the Government Administration Act, including the rules of procedure. However, if in the Rules of the Supreme Court felt there are things that are not in accordance with the Law or the needs of the practice of the trial, the judge can make an effort constitutional question to the Constitutional Court or temporarily set it aside pending the revision of the Rules of the Supreme Court No. 4 of 2015 and the Supreme Court Regulation No. 5 in 2015.Keywords: Administrative Court, Government Administration Act, Access to Justice

Inside RKUHAP contain new institution, that is commissioner judge, regarding the commissioner judge to be diversification opinion, that is to be must the commissioner judge as consequences ratification ICCPR convention. And then to be needn’t because of competence the commissioner judge to be done deep institution prior to judicature. Nevertheless when we see interest victims not yet including with fine on the KUHAP and the KUHP, writer to see inside RKUHAP necessary to be need interest victims and interest community take place criminal act. Abstract

There is a difference between regulatory opinion of the Telecommunications Regulator/Ministry of Communications with the Corruption Court Judge on act did by PT. IM2 in collaboration with PT. Indosat. Title of cooperation between this service providers and network operators are "Internet access via cellular networks Indosat". In view of the regulator, this cooperation is in conformity with the regulations, even obligatory upon network operators to cooperate with the service provider. However, in view of the prosecutor and the judge, this cooperation violates the regulations. A difference of views between regulatory enforcement versus law enforcement is certainly very noteworthy because it will has very big impact to telecommunication development as the backbone of the national economy and the development of national legal systems and culture.
