Abstract

This study aims to provide an overview of the power of law in the delegation of authority from the doctor to ners both in writing and not written. In performing health services, especially in performing medical acts, it is necessary to transfer the authority of medical personnel to health personnel in order to create a comprehensive and quality health service, this has been regulated in related legislation. Ners is a profession professional and independent, in carrying out its professional duties ners work in accordance with service standards, standard operating procedures and the provisions of the Act-legislation. As a health worker, the ners may receive a delegation of authority only in writing from the doctor to him or her so that the delegate has the force of law. With the delegation of authority in health services, if there is a loss or legal problems in the future, doctors as authors and recipients of authority can be held accountable both criminal and civil.

Abstract

Indonesia is an archipelago with massive oceans. In 1982, the United Nations Convention on the Law of the Sea (UNCLOS) was signed in Jamaica. In 1983 the Indonesian government passed Law Number 5 of 1983 concerning Exclusive Economic Zone, and UNCLOS 1982 was set as one of the fundamental considerations in the Law. However, the issue is what is the legal basis of including the UNCLOS 1982 as one of the basic considerations and how these two laws are related. This research employed a normative method aiming to study one of the fundamental considerations of the making of Law Number 5 of 1983 concerning the Exclusive Economic Zone in Indonesia. The results of the discussion show that the inclusion of UNCLOS 1982 as a basis for consideration in making Law Number 5 of 1983 concerning Indonesia's EEZ is problematic from the legal position of the rules. Law Number 5 of 1983 concerning the EEZ of Indonesia needs to be revised by referring to Law Number 17 of 1985 concerning the Ratification of the Convention of The Law of the Sea. This revision is intended to improve the regulation concerning the implementation of sovereign rights and jurisdiction and related regulatory provisions regarding the EEZ of Indonesia in terms of the interest of security on the sea.

Abstract

Perwujudan jaminan sosial bagi warga negara dilaksanakan oleh negara dalam Sistem Jaminan Sosial Nasional. Salah satu jaminan sosial yang diberikana oleh negara adalah jaminan sosuial kesehatan. Pemenuhan jaminan sosial kesehatan juga menjadi kewajiban bagi perusahaan terhadap tenaga kerja. Namun pada prakteknya masih ada tenaga kerja yang tidak didaftarkan oleh perusahaan sebagai peserta jaminan sosial kesehatan.Jaminan sosial kesehatan merupakan hak tenaga kerja, sehingga tidak didaftarkannya tenaga kerja dalam jaminan sosial kesehatan menimbulkan permasalahan perlindungan hukum bagi tenaga kerja ketika mengalami sakit atau pun kecelakaan kerja. Sementara di satu sisi perusahaan yang telah sengaja atau lalai tidak mengikutsertakan tenaga kerja dalam kepesertaan jaminan sosial kesehatan secara hukum dapat dimintai pertanggungjawaban baik melalui jalur perdata, adsministrasi atau bahkan secara pidana bedasarkan peraturan perundang-undangan yang berlaku.

Abstract

The existence of related regulations regarding validity of Electronic Medical Record (EMR) in proving a case explained that it requires a signature in proving an EMR. The use of a personal identification number (PIN) only performs a verification function, not someone's authentication.UU No. 29 of 2004 regarding Medical Practice states that it is sufficient to replace the obligation to sign an EMR with a Personal Identification Number (PIN), while in Permenkes Medical Records 2022, it is expanded by granting access rights to certain people where the security system depends on the decision of the leadership of each health care facility and can be equipped with an Electronic Signature. The use of a PIN alone is considered insufficient form EMR authentication functions, so other options need to be raised such as Electronic Signature which carry out both verification and authentication functions.  The aims of research were to find out how the legality and strength of evidence of PIN and Electronic Signature as substitution of doctor’s signature on electronic medical records. This study used a normative juridical method, with two approaches, namely statutory and conceptual approaches.  The results showed that PIN and Electronic Signature could legally replace a doctor’s signature on EMR, but hada different strength as evidence. The strength of EMR as evidence depends on the judge’s point of view which is influenced by validity of EMR evidence, namely the presence/absence of a PIN and electronic signature as a function of verification and authentication.

Abstract

The purpose of study were the application of the doctrine of vicarious liability to hospitals in the event of medical personnel negligence. This study used the statute approach and conceptual approach methods. The results of study can be concluded as follows: (1) The basis for the hospital's responsibility for medical personnel negligence can be seen from the aspect of the condition of the therapeutic relationship between the patient and the hospital. If the pattern of therapeutic relationship between the patient and the hospital, then the position of the hospital as the party that provides the achievement, while the doctor only functions as an employee or task executor. With this therapeutic relationship pattern, if there is a patient loss due to medical personnel negligence, then in this case the hospital is responsible. 2) Law Number 44 of 2009 concerning Hospitals was created to provide more certainty in the provision of health services, as well as providing protection for the community and protection for resources in the hospital. The Hospital Law has determined that the hospital will be legally responsible if there is medical personnel negligence that causes losses to the community or patients

Abstract

The research aims to analyze the obligations of orthodontists in independent practice regarding waste management and their legal responsibilities for environmental pollution caused by the waste from orthodontic treatment materials.The study focuses on the legal responsibilities of orthodontists in managing waste to prevent pollution arising from the disposal of materials used in orthodontic treatments. This research employs a legal research method with a statutory approach and a conceptual approach. The results of the study indicate Independent practice orthodontists, in addition to working to provide health services and as managers of independent practices, have a legal obligation to manage the waste of orthodontic treatment materials produced in accordance with applicable regulations in Indonesia. the obligation to manage the waste produced includes the obligation to reduce, sort, temporarily store and cooperate with other parties for waste transportation and treatment. Independent practice orthodontists are legally responsible for environmental pollution arising from the impact of poor management of orthodontic treatment material waste, where legal responsibility includes administrative responsibility if independent practice orthodontists intersect with the problem of violation of permits and waste management procedures. Civil law liability, namely in the form of compensation and recovery of damage to the aggrieved party, and criminal law liability, namely if the orthodontist commits an unlawful act.

Abstract

In Indonesia, abortion is still a major and contentious legal and health issue, especially when it is carried out beyond the bounds of the law. Illegal abortion practices have increased as a result of the growing number of unintended pregnancies, which are mostly caused by premarital sex, a lack of information, and adolescent-free association. Criminal culpability for persons, including women who knowingly have abortions and others who help or facilitate the procedure, is the focus of this article. This paper analyzes statutory rules, court rulings, and legal principles using a normative legal research approach, with a special emphasis on Decision No. 1977/Pid.Sus/2019/PN.Sby. The results show that under Articles 20 and 21 of the Criminal Code and Article 194 of the Health Law, the lady who conducted the abortion as well as those who supplied the means, money, or instructions are criminally culpable. The case illustrates how accomplices are also subject to legal culpability in addition to the principal perpetrator. It emphasizes the value of education and regulation in preventing the abuse of abortion-inducing medications and reaffirms the significance of legal clarity in abortion situations. To address the risks of unsafe, illegal abortions in Indonesia, this research advances health law and advocates for stronger legal enforcement as well as more public awareness

Abstract

Pengelolaan obat di Puskesmas menjadi aspek kritis yang mempengaruhi kualitas pelayanan kesehatan, khususnya terkait pemusnahan obat tidak layak guna yang berpotensi membahayakan keselamatan pasien. Permasalahan utama yang dihadapi adalah belum adanya regulasi yang mengatur secara jelas prosedur dan pertanggungjawaban dalam pemusnahan obat tidak layak guna di Puskesmas, serta ketidakjelasan peran dan tanggung jawab kepala Puskesmas dalam proses tersebut. Penelitian ini bertujuan untuk menganalisis standar pemusnahan obat tidak layak guna di puskesmas berdasarkan peraturan perundang-undangan dan mengkaji pertanggungjawaban kepala puskesmas dalam pemusnahan obat tidak layak guna sebagai bentuk keamanan dan keselamatan pasien. Metode penelitian menggunakan pendekatan hukum normatif dengan analisis peraturan perundang-undangan (statute approach) dan pendekatan konseptual (conceptual approach). Hasil penelitian menunjukkan bahwa standar pemusnahan obat tidak layak guna diatur dalam Peraturan Menteri Kesehatan Nomor 26 Tahun 2020 dan Peraturan BPOM Nomor 14 Tahun 2022, namun belum mengatur secara jelas siapa penanggungjawab pemusnahan obat di puskesmas. Pertanggungjawaban kepala puskesmas dalam pemusnahan obat tidak layak guna meliputi tiga aspek: perdata (Pasal 1365 KUHPerdata), pidana (Pasal 360 KUHP), dan administrasi. Kepala puskesmas memiliki kewenangan atribusi untuk mengawasi dan melakukan pemusnahan obat tidak layak guna sebagai upaya perlindungan keselamatan pasien. Implikasi penelitian menunjukkan perlunya regulasi yang lebih spesifik mengatur prosedur dan tanggung jawab pemusnahan obat tidak layak guna di Puskesmas untuk memastikan keselamatan pasien dan kepastian hukum bagi pengelola Puskesmas.

Abstract

This dissertation analyzed for real about characteristics of an entity, either a legal or the nonlegal "entity'' which all were discussed in the same outline of corporate crime responsibility. It was often, though, in several laws aside from the Penal Code of Indonesia (KUHP), both in Criminal Law and Administrative Law with criminal sanction, that corporate is defined as a collection of organized people and or wealth, either as a legal or the nonlegal entity. The definitions in those laws are really different from those of law experts, especially those of criminal law who basically identify corporate as a legal entity, however the same is not true for those of the nonlegal entity. Such differences of the legal and nonlegal entities would bring their own legal consequences, therefore they could not and would not be treated the same referring to corporate criminal responsibility.Keywords: corporate criminal responsibility, characteristics, legal entity,nonlegal entity

Abstract

Kebutuhan akan air bersih dan layak konsumsi di Indonesia meningkat seiring dengan bertambahnya populasi. Studi ini menyelidiki perlindungan konsumen dari bahaya pembelian air minum isi ulang yang tercemar bakteri E-Coli, sekaligus mengeksplorasi kewajiban hukum penjual. Melalui pemanfaatan penelitian yuridis normatif yang meliputi metodologi perundang-undangan, konseptual, dan komparatif, ditemukan temuan bahwa penjual menanggung tanggung jawab perdata, pidana, dan administratif. Hal ini mencakup kewajiban untuk menawarkan restitusi, mematuhi peraturan kesehatan, dan melakukan penilaian rutin terhadap kemurnian air. Pelanggaran terhadap standar kesehatan ini berdampak serius pada kesehatan konsumen, menurunkan kepercayaan masyarakat, dan mengindikasikan perlunya pengawasan yang lebih ketat. Kesimpulannya, perlindungan hukum konsumen dan penegakan regulasi yang ketat sangat diperlukan. Penelitian selanjutnya disarankan untuk mengevaluasi efektivitas pengawasan dan penegakan hukum serta mengembangkan model edukasi konsumen yang lebih efektif.
