Abstract

This study aims to analyze the concept of justice in Human Rights Courts through the integration of Islamic judicial principles and international legal norms. The research employs a normative-comparative juridical approach by examining primary and secondary legal sources, including international human rights instruments, Islamic legal provisions, and jurisprudential practices of national and international human rights courts. The analysis applies a qualitative and hermeneutic legal method to identify the points of convergence between the two systems in achieving substantive justice. The findings reveal that both Islamic and international legal systems share an ethical foundation centered on human dignity and moral accountability for human rights violations. The integration of these legal traditions strengthens the moral legitimacy and effectiveness of human rights adjudication, particularly in Muslim-majority countries. This research highlights the importance of cross-system legal dialogue in developing a universal paradigm of justice that transcends formal legality and embodies deeper humanistic and spiritual values

Abstract

A career woman is an individual who actively participates in the workforce, fulfilling professional roles while managing family responsibilities. The career woman phenomenon has evolved in line with social and economic changes that have opened up more job opportunities for women. Women's primary motivations for pursuing a career include achieving financial independence, self-development, and fulfilling professional ambitions. Support from partners, family, and flexible workplace policies can play a significant role in helping career women achieve a balance between their professional and personal lives. This research employed a qualitative approach. The sample population was career women in Malawili Village. Data collection methods used observation, interviews, documentation, and data analysis, including data reduction, data display, and conclusion drawing. The results of this study indicate that a wife's responsibilities as a career woman often face unique challenges, including time management, the pressure to balance dual roles as worker and caregiver, and confronting gender norms and stereotypes. The Sakinah family is a family concept in Islam that describes a harmonious, peaceful, and prosperous household.

Abstract

The death penalty is the most severe and controversial punishment in Indonesia’s criminal justice system, still applied to extraordinary crimes such as narcotics, premeditated murder, and terrorism. Its existence continues to provoke debate between retentionist and abolitionist groups, particularly concerning the violation of the right to life as a non-derogable right. This article critically examines the effectiveness and morality of capital punishment from the perspectives of human rights and substantive justice. The findings indicate that the death penalty has not been proven to significantly reduce crime rates compared to life imprisonment and carries an irreversible risk of judicial error. In practice, it is often marked by social discrimination, political pressure, and psychological suffering during the prolonged waiting period before execution. Although the new National Criminal Code (Law No. 1 of 2023) restricts the death penalty as a conditional punishment, this policy should still be reevaluated toward a moratorium and total abolition to uphold human dignity and promote a more humane sense of justice.
