Abstract

The development and advancement of technology brings about changes in people's lives that give rise to legal actions. In line with this, in anticipation of unlawful acts, namely misuse of personal data in obtaining information and conducting electronic transactions, it must provide protection of personal data with the need for legal products in order to strengthen protection and can provide security and protection of everyone's personal data. Therefore, the existence of Law No. 19 of 2016 on ITE should be in accordance with the expectations of Indonesian citizens, namely to provide guarantees of security and legal certainty with regard to the protection of personal data and in accordance with the criteria and political objectives of the law.

Abstract

Artikel ini mengkaji dan menelaah tentang perlindungan hukum bagi pekerja perempuan di sektor Pariwisata Bali. Perlindungan hukum bagi pekerja perempuan di sektor pariwisata Bali merupakan topik yang penting dalam konteks pembangunan pariwisata di Indonesia, sehingga menharuskan perempuan untuk bekerja siang dan malam. Studi ini bertujuan untuk menganalisis perlindungan hukum dan pemebrdayaan pekerja perempuan di sektor pariwisata Bali, termasuk faktor-faktor yang mempengaruhi perlindungan hukum dan pemberdayaan pekerja perempuan, strategi yang digunakan untuk meningkatkan partisipasi pekerja perempuan dalam sektor pariwisata, dan dampak dari pemberdayaan pekerja perempuan terhadap pembangunan ekonomi dan sosial di Bali. Metode penelitian yang digunakan ialah normatif research, yaitu adalah studi literatur peraturan perundang-undangan dan bahan-bahan hukum yang lain. Hasil penelitian menunjukan bahwa perlindungan hukum bagi Perlindungan hukum bagi pekerja perempuan dalam sektor pariwisata Bali yang merupakan bagian integral dari upaya untuk mencapai pembangunan ekonomi yang inklusif dan berkelanjutan.

Abstract

This study discusses law enforcement and obstacles in enforcing criminal law against student brawls in the city of Yogyakarta. This type of research is empirical legal research with a sociological approach. The data sources consist of primary data in the form of interviews and secondary data in the form of primary, secondary and tertiary legal materials. Methods of collecting data by interview and literature study. The results of this study are, first, the DIY Education, Youth and Sports Office and the Yogyakarta City Resort Police have taken steps to enforce criminal law in the form of increasing coordination between the police and the school regarding security and student safety; as well as Conducting counseling related to the dangers of student brawls and narcotics abuse by students. Second, the obstacles faced by the DIY Education, Youth and Sports Office and the Yogyakarta City Resort Police are the lack of involvement of parents in raising and teaching their children to behave positively and not harm others; Lack of prevention efforts made by the school, such as facilitating permission to leave lessons or school; Parents who don't pay much attention to their children and seem to let their children go unsupervised; In carrying out law enforcement, the investigation process is not carried out by child investigators because the number of child investigators is small.

Abstract

This research aims to examine how Law No. 13 of 2003 year applies gender equality in the workplace. The main focus of this research is how the law is applied in terms of gender equality in various industries. The research method used is the Normative research method. Data was collected through articles, scientific journals, theses, Law Number 13 on labor, and Laws relating to Employment. Research shows that although awareness and implementation of gender equality principles have increased, there are still problems to effectively implement them in the workplace. As the government, companies, and society must continue to support gender equality in the workplace.

Abstract

The enforcement of human rights is a fundamental aspect of a democratic state that upholds the principles of justice and the welfare of its citizens. In Indonesia, human rights are guaranteed by the 1945 Constitution and various laws and regulations, but their implementation in practice faces numerous challenges. The aim of this research is to analyze the implementation of human rights enforcement within Indonesia's positive law, focusing on the obstacles, challenges, and efforts made by the state and relevant institutions. The methodology used in this study is a qualitative approach with descriptive analysis that explores the applicable regulations, law enforcement mechanisms, and human rights violations occurring in Indonesia. This study finds that although Indonesia has various legal instruments to protect human rights, these instruments are hindered by several factors, including inconsistencies between laws and practices in this area, weak law enforcement, and the ongoing occurrence of human rights violations. It is clear that the enforcement of human rights continues to be obstructed by widespread discrimination and impunity within the legal system. The study concludes that to create a better environment for the enforcement of human rights in Indonesia, improvements are needed in the legal system, the enhancement of law enforcement agencies' capacities, and an increase in public awareness and participation.

Abstract

Freedom is defined as a fundamental human right and is guaranteed in the Indonesian constitution, including in the realm of social media. In the digital era, social media has become a broad space for expression, but it also presents challenges such as hate, hatred, defamation and the spread of misinformation. This research aims to analyze the legal protection of freedoms put forward in accordance with Law Number 19 of 2016 concerning ITE, which still focuses on prohibitions without providing clear protection for users. The research method uses a normative approach with analysis of statutory regulations and legal doctrine. The research results show that regulations related to freedom of expression on social media do not fully protect users’ rights. As a rule of law, Indonesia is obliged to provide concrete and balanced regulations to ensure freedom of expression remains responsible, maintains social ethics, and supports healthy democracy.

Abstract

Perlindungan hukum terhadap anak-anak dapat menjadi perspektif yang sangat penting dalam kerangka hukum suatu negara, Undang-Undang Nomor 35 Tahun 2014 atas perubahan Undang-Undang Nomor 23 Tahun 2002 Tentang Perlindungan Anak di Indonesia bertujuan untuk menjamin hak-hak anak dan menjamin kesejahteraannya. Penelitian ini bertujuan untuk melakukan analisis terhadap perlindungan hukum terhadap anak dalam Undang-Undang Nomor 35 Tahun 2014. Metode penelitian yang digunakan oleh penulis adalah metode penelitian hukum dengan menganalisa literasi dan dokumen dokumen terkait seperti Undang-Undang Nomor 35 Tahun 2014 dan dipelajari secara sistematis untuk kemudian ditarik kesimpulan dari masalah yang diteliti. Data akan dianalisa melalui metode kualitatif dan disajikan secara deskriptif. Dari hasil penelitian terlihat bahwa meskipun Undang-Undang Nomor 35 Tahun 2014 telah memberikan landasan hukum yang sangat penting bagi perlindungan anak, namun masih terdapat beberapa kekurangan dalam pelaksanaannya. Komponen-komponen seperti kurangnya kesadaran akan hak-hak anak, kebutuhan akan aset, dan tantangan dalam persyaratan hukum merupakan hambatan terbesar dalam mencapai tujuan perlindungan anak yang ideal.

Abstract

This study examines the implementation of human rights court decisions in the Trisakti case, highlighting significant challenges and opportunities for achieving transitional justice. The Trisakti incident, marked by mass student protests against Suharto's authoritarian regime, involved severe human rights violations, including unlawful shootings and repression of dissent. Despite the legal framework established by Law No. 26/2000 on Human Rights Courts, the implementation of court decisions remains riddled with obstacles, such as legal ambiguities, lack of cooperation from military authorities, and inadequate investigation processes. This study emphasizes the need for a collaborative approach involving the government, civil society, and international organizations to ensure justice for the victims and their families. Furthermore, it underscores the importance of educating law enforcement officials about human rights issues to foster a culture of respect for human rights in Indonesia. Ultimately, this research advocates for collective responsibility among all elements of society to realize transitional justice and uphold the rule of law.

Abstract

This study discusses legal protection for users of Rupiah Digital Money in sale and purchase agreements and the responsibility of Bank Indonesia as regulator of the circulation of Rupiah Digital Money in sale and purchase agreements. This type of research is normative legal research, the approach method used is a statutory approach. The primary data collection technique is data collection that is carried out through the basis of library research and document studies. The results of this study are, first, the Digital Rupiah Money  Development will be directed at efforts to mitigate various risks. Assessment and identification of emerging risks based on the aspects of people, process and technology will be carried out in a measurable manner to produce a design and technology for Rupiah Digital Money that is safe, reliable and robust. Second, the implementation of supervision of payment system operators by Bank Indonesia, among others, refers to the Principles For Financial Market Infrastructures (PFMI) issued by the Bank For International Settlements (BIS).

Abstract

Early marriage is still a phenomenon that is difficult to eliminate in Indonesia even though there are stricter regulations. This study aims to analyze the challenges faced in preventing early marriage and its impact on individuals and society. With a normative legal approach, this study examines the applicable legal policies and examines the challenges of their implementation. The results of the study indicate that although Law Number 16 of 2019 has increased the age limit for marriage to 19 years, there are still legal loopholes in the form of dispensations that allow early marriage to continue to occur. In addition, social, economic, cultural factors, and lack of public awareness are still the main obstacles in preventing early marriage. Government efforts such as socialization, data collection, and supervision of the KUA still need to be strengthened with stricter sanctions and a community-based approach so that prevention is more effective. Therefore, a more comprehensive strategy is needed that not only emphasizes the legal aspect, but also involves public education and improving economic welfare to reduce the number of early marriages in Indonesia.
