Abstract

The protection of the rights of life of humans is part of the category of non-derogable rights, namely rights that cannot be reduced. the existence of a separatist movement or KKB in Papua is considered an act of human rights violation, but in handling it through law enforcement officials resulted in not a few KKB members losing their lives, which for these actions is also a gross human rights violation.  To analyze and find out about gross human rights violations by law enforcement officials against KKB members in Papua and the role and existence of the Human Rights Court in handling gross human rights violations. This research uses normative juridical legal research methods, because the topic studied can be resolved through analysis of secondary data or literature sources, without requiring primary data collection. The right to life in its regulation is contained in the provisions of the 1945 Indonesian Constitution, Law Number 39 of 1999 and Law Number 12 of 2005. The existence of the KKB in Papua is in fact a violation of human rights, but its handling by law enforcement officials, in fact, is not carried out through legal procedures, namely through the process of investigation, prosecution and court hearings, but unscrupulous law enforcement officials have in fact taken action to violate human rights by eliminating the lives of several KKB members. the existence of a human rights court until now has not optimally carried out its function to take action and prosecute the perpetrators of human rights violations both KKB members and law enforcement officials involved in eliminating the lives of several KKB members.

Abstract

Kebebasan beragama merupakan hak konstitusional yang dijamin oleh Pasal 29 ayat (2) Undang-Undang Dasar 1945, namun implementasinya di Indonesia masih menghadapi berbagai tantangan, khususnya bagi pemeluk agama minoritas. Latar belakang penelitian ini berangkat dari realitas bahwa meskipun norma hukum telah menjamin kebebasan tersebut, dalam praktiknya masih terjadi diskriminasi, kekerasan berbasis agama, hingga pembatasan dalam pembangunan tempat ibadah bagi kelompok minoritas seperti umat Kristen, Hindu, Buddha, dan kepercayaan lokal. Penelitian ini bertujuan untuk mengkaji efektivitas konstitusi dalam menjamin hak kebebasan beragama dan menilai peran negara dalam menegakkan hak tersebut melalui pendekatan teori rule of law dan kontrak sosial. Metode yang digunakan adalah yuridis normatif dan yuridis empiris, dengan mengkaji norma hukum serta studi kasus pelanggaran terhadap minoritas agama di Indonesia. Hasil kajian menunjukkan bahwa meskipun terdapat perlindungan formal melalui konstitusi dan berbagai undang-undang, implementasinya belum sepenuhnya menjamin keadilan dan perlindungan bagi kelompok minoritas. Diperlukan reformasi kebijakan, penegakan hukum yang tegas, serta pendekatan multikultural dan pendidikan toleransi agar kebebasan beragama benar-benar dapat dinikmati oleh seluruh warga negara tanpa diskriminasi.

Abstract

Konflik Palestina menjadi simbol kompleksitas antara prinsip universalitas hak asasi manusia (HAM) dan realitas geopolitik global. Jurnal ini mengkaji bagaimana pelanggaran HAM yang sistemik di wilayah Palestina menantang efektivitas dan konsistensi penerapan prinsip-prinsip HAM internasional. Melalui pendekatan yuridis-normatif dan analisis politik global, artikel ini menyoroti ketimpangan respons internasional, baik dari negara-negara besar, organisasi internasional, maupun lembaga HAM. Hasil kajian menunjukkan bahwa universalitas HAM kerap tereduksi oleh kepentingan politik dan ekonomi, sehingga menimbulkan krisis legitimasi dalam penegakan hukum HAM internasional. Studi ini merekomendasikan perumusan ulang pendekatan multilateral yang lebih independen dan berkeadilan dalam menghadapi kasus-kasus pelanggaran HAM berat, terutama di kawasan konflik berkepanjangan seperti Palestina.

Abstract

The non-international armed conflict (NIAC) between the Sudan Armed Forces (SAF) and the Rapid Support Forces (RSF) is currently one of the world’s largest humanitarian crisis. Allegations of support from the United Arab Emirates (UAE) to the RSF raise legal issues concerning the violation of the principle of third-state neutrality under international humanitarian law. This research applies the theories of international humanitarian law, neutrality, and state responsibility to analyze whether the alleged support provided by the UAE in Sudan’s internal conflict has breached international obligations and may influence the transformation of the conflict’s status into an international armed conflict (IAC). The findings show that the UAE’s involvement can be categorized as an internationally wrongful act, potentially triggering state responsibility. This study recommends strengthening international monitoring mechanisms to uphold and ensure the application of third-state neutrality in non-international armed conflicts.

Abstract

This research examines the impact of the military approach which is considered not to be a solution to the conflict that occurred in Nduga Regency, Papua. The increasing number of refugees is one of the impacts of the prolonged conflict that has not been resolved. Through this research, the author describes the increasing number of refugees exacerbated by the fall of victims as evidence of the lack of effectiveness of the military approach in order to resolve the TPNPB-OPM conflict in Nduga Regency, Papua. This incident is contrary to the implementation of the principle of proportionality based on international humanitarian law as stipulated in the 1949 Geneva Convention. This type of research is qualitative research. The method used is descriptive juridical analytical, namely problem identification using data sources in the form of primary legal materials, secondary legal materials, and tertiary legal materials. The result of this research is that the military approach to the TPNPB-OPM conflict in Nduga Regency, Papua is not effective enough to stop the conflict and has an impact on the increasing number of refugees which causes more civilian casualties so that it is contrary to the principle of proportionality.
