Abstract

Patent protection arises when the discovery or invention is registered. In this registration there is an administrative and substantive examination process. If the application meets the requirements, then the application for registration of the invention is accepted. During the registration process, inventors can also submit corrections to their patent claims to be corrected if the patent claim contains errors in the description of the patent claim. However, sometimes applications for correction of patent claims are rejected by the Patent Appeals Commission because they do not meet the administrative or substantive requirements in the application. This article will discuss the legal consequences of rejecting an application for correcting patent claims for an invention, using normative research methods. The result and conclution of this article shows that the legal consequence of rejecting a claim correction is that a patent claim that has been submitted and accepted remains valid in its original form, without any changes or corrections, the patent holder loses the opportunity to correct errors or ambiguities in the claim which could lead to disputes in future.

Abstract

The imposition of criminal sanctions against the perpetrator of the pornographic model of the defendant by the name of Yuli Hertina live streaming herself naked and the defendant received benefits from these actions. The judge decided with Article 27 paragraph (1) of Law Number 11 of 2008 concerning Electronic Information and Transactions. As with the study of decision number 459/Pid.Sus/2023/PN JKT.SEL, the main problem is whether the imposition of criminal sanctions on the perpetrators of criminal acts of pornography is included in the category in Article 27 paragraph (1) of the Electronic Information and Transactions Law. This research method uses normative juridical, using primary and secondary data, qualitative approach data collection techniques, descriptive data analysis. The results and conclusions of the discussion indicate that the perpetrator's actions of committing pornography by displaying nudity and masturbation via live streaming fall under the category of pornography. Therefore, the judge should have applied Article 27(1) of the ITE Law in conjunction with Article 8 of the Pornography Law. The imposition of criminal sanctions by the judge against the perpetrator of pornography is inappropriate because it does not fall under the category of Article 27(1) of the ITE Law.

Abstract

The desire to fulfill life's needs can encourage a person to commit acts that violate the law, so nowadays there are many people who commit multiple criminal offenses simultaneously. In Decision No. 231/Pid.B/2021/PN.Gdt. there is a concursus realis, where the defendant committed two criminal acts at once: embezzlement for livelihood and forgery of letters. The identification of the problem in this study is the act of the employee of the Veteran Cooperative Centre of the Republic of Indonesia in Decision No. 231/Pid.B/2021/PN.Gdt. a concursus realis according to the Criminal Code? This research is a normative legal research, descriptive in nature, using secondary data, and analysed qualitatively. The results of the discussion and conclusions show that the employees of the Veterans Cooperative Centre of the Republic of Indonesia did not only commit the crime of embezzlement for livelihood in accordance with Article 374 of the Criminal Code, but also fulfilled the elements of the crime of mail fraud in accordance with Article 263 of the Criminal Code which constitutes concursus realis.

Abstract

The board of directors’ decisions must comply with Law No. 40 of 2007 and the company’s Articles of Association. Article 4 of Law No. 40 of 2007 stipulates that a company is obliged to adhere to statutory regulations and its Articles of Association. The case of PT “M” shows a violation of the Articles of Association as the board’s decision was taken without fulfilling the quorum requirements, thus raising doubts over its validity. The legal issues in this study are the validity of board decisions made without meeting the quorum as stipulated in the Articles of Association and the resulting legal consequences for the company. The legal research method used is normative legal research with an approach based on legislation, the company’s Articles of Association, and related documents. Based on the results of the discussion, it is concluded that board decisions without the required quorum are legally invalid, and such violations may trigger legal disputes with adverse effects on the company’s reputation, finances, and operational stability.

Abstract

The rejection of the PKPU (Postponement of Debt Payment Obligations) petition against PT Karya Cipta Agung Persada, as decided in Case Number 71/Pdt.Sus-PKPU/2024/PN Niaga Jakarta Pusat, was based on the considerations of Supreme Court Circular Letter (SEMA) No. 3 of 2023. This rejection is deemed inconsistent with the formal requirements stipulated in Article 222 of Law No. 37 of 2004 concerning Bankruptcy and PKPU, particularly regarding the existence of due and collectible debt and the element of simple proof. The rejection raises legal concerns for creditors in obtaining certainty over the fulfillment of their rights. This research aims to examine: the legal basis for the court’s rejection of the PKPU petition in the aforementioned decision, and the legal remedies available to creditors following such rejection. The research employs a normative juridical method, relying on secondary data through literature review. Based on the analysis, it is concluded that the petition fulfilled the substantive requirements of PKPU, the court rejected it solely based on SEMA No. 3 of 2023, thereby limiting access to PKPU and bankruptcy proceedings for developers. Creditors, in response, may pursue legal remedies through a cassation appeal to the Supreme Court or by filing a breach of contract lawsuit before the District Court.

Abstract

This study aims to legally analyze the judge's decision in an immoral case committed by a military member, with a case study on Military Court Decision Number 26-K/PM.I-05/AD/VII/2024. Thus, the problem of this study is whether the perpetrator's actions meet the qualifications of a combined crime against morality and pornography so that Article 281 point 1 of the Criminal Code that was imposed can be juxtaposed with Article 4 paragraph (1) of Law Number 44 of 2008 concerning Pornography? This study uses a normative legal research method with a descriptive-analytical approach. The data used consists of primary and secondary legal materials collected through literature studies. The analysis is carried out qualitatively and conclusions are drawn deductively. The results and conclusion of the study show that the perpetrator's actions can be categorized as a combined criminal act, namely violating Article 281 point 1 of the Criminal Code, Article 285 of the Criminal Code, and Article 4 paragraph (1) in conjunction with Article 35 in conjunction with Article 9 of Law Number 44 of 2008 concerning Pornography, so that the perpetrator can be said to fulfill the qualifications for a combined criminal act.

Abstract

This study discusses the issuance of Government Regulation in Lieu of Law Number 2 of 2022 on Job Creation, which sparked debates regarding the fulfillment of the "compelling urgency" requirement based on Article 22 of the 1945 Constitution of the Republic of Indonesia and Constitutional Court Decision Number 138/PUU-VII/2009. The research focuses on the urgency of the regulation's issuance and the potential for a legal vacuum, the research question in this study is whether the issuance of Government Regulation in Lieu of Law (Perppu) Number 2 of 2022 concerning Job Creation can be considered a deviation from the proper legislative mechanism for amending Law Number 11 of 2020?   The findings indicate that the issuance of the Government Regulation in Lieu of Law did not meet constitutional requirements, as the Job Creation Law remained in effect despite being conditionally unconstitutional. The government is considered to have neglected its obligation to revise the law through legislative mechanisms. This study employs a normative juridical approach with a descriptive-analytical method. In conclusion, the issuance of this regulation was not based on an urgent situation and has led to legal uncertainty.

Abstract

Pretrial is a legal mechanism that serves as a means of control over the actions of law enforcement officials, especially in the process of investigation and detention. In Indonesia, pretrial authority is regulated in the Criminal Procedure Code (KUHAP) and Constitutional Court Decision No. 21/PUU-XII/2014, which focuses on procedural testing, such as the legality of arrest, detention, confiscation, termination of investigation, termination of prosecution, and determination of suspects. On the other hand, Italian pretrial is regulated in the Codice di Procedura Penale, which grants broader authority to the Giudice per le Indagini Preliminari to oversee both of the procedural aspects and the substance of investigations and prosecutions. The results show that the Italian pretrial institution provides relatively responsive protection to the human rights of suspects or defendants, because structurally the investigative judge has the authority to examine procedural aspects from the beginning of the investigation. Indonesia's pretrial institutions have relatively limited authority to examine the formal procedural aspects of actions taken by investigators and public prosecutors. This comparison suggests that there is an opportunity for Indonesia to improve pretrial effectiveness by adopting the checks and balances principles applied in Italy.

Abstract

The Jakarta Provincial Government has granted authority to the Regional Government to manage waste comprehensively, including in the Pasar Minggu District, South Jakarta. This article how law enforcement regarding waste management in Pasar Minggu District is implemented in accordance with Regional Regulation Number 3 of 2013 concerning Waste Management. The research problem focuses on identifying the obstacles in enforcing sanctions for violations of waste disposal regulations in Pasar Minggu District, South Jakarta. This study is normative juridical in nature and descriptive in character, with conclusions drawn using deductive reasoning. The findings indicate that the enforcement of sanctions often faces obstacles due to a lack of human resources, inadequate supporting facilities, and community resistance to waste management. Therefore, the Regional Government needs to optimize waste management by strengthening education, enhancing supervisory capacity, providing adequate facilities, and adopting a holistic approach to increase community participation and the effectiveness of law enforcement, in order to achieve sustainable waste management and a cleaner environment in Pasar Minggu District.

Abstract

The iIIegal trade in protected wiIdIife poses a serious threat to biodiversity conservation in Indonesia. For the case study used is the North Jakarta District Court Number 436/Pid.Sus/2023/PN Jkt.Utr. The question how the roIe of Law Number 5 of 1990 concerning the Conservation of NaturaI Resources and Ecosystems prevents the trade on protected wiIdIife?. This research uses normative IegaI method with descriptive-anaIyticaI approach based on secondary data. The resuIts show that the KSDAE Law provides a strong IegaI roIe in prohibiting the iIIegaI trade of wiIdIife, with criminaI penaIties stipuIating severe sanctions to provide a deterrent effect. In addition, this Iaw pIays a roIe in encouraging pubIic awareness through conservation education, but the roIe of the KSDAE Law faces chaIIenges in the form of weak Iaw enforcement, Iack of supervision, and its oId age. ConcuIsion, there shouId be IegaI reforms and more pubIic participation to support wiIdIife conservation and sustainabiIity in Indonesia.
