Abstract

Polygamy, according to the Indonesian Dictionary, is understood as a form of marriage in which one partner has more than one partner simultaneously. The requirements and provisions regarding permission to have more than one wife for state civil servants are strictly regulated in Government Regulation Number 45 of 1990 concerning marriage and divorce permits for civil servants. This research examines the legality of the issuance of polygamy licences by the Regent of South Bolaang Mongondow to fellow State Civil Servants. The focus of the research is directed at the suitability of the issuance of the permit letter with Government Regulation Number 45 of 1990 concerning Marriage and Divorce Permits for Civil Servants, which expressly prohibits female Civil Servants from becoming a second, third, or fourth wife. This research uses a normative juridical method with a descriptive-analytical approach. The result and conclusion shows that the regent's action exceeds legal authority (ultra vires) and violates the principle of legality and the substance of civil service law. It can be concluded that the issuance of the permit causes administrative sanctions and can be cancelled through a lawsuit at the State Administrative Court because it is substantively legally flawed.

Abstract

The Human Resources Development Agency  plays a strategic role in improving the quality the State Civil Apparatus within the Jakarta Provincial Government In this research the problem formulation is. Is the implementation of the Jakcorpu program  BPSDM in accordance with Governor's Decree Number 1211 of 2021. This program designed provide structured competency-based training and development to answer the challenges of dynamic public service.  Implementation of BPSDM's functions in organizing Jakcorpu, effectiveness of the program in meeting ASN competency standards, and normative constraints related to policy implementation. The research method used is normative legal research, the nature of descriptive writing, the type of data using secondary data, and conclusions drawn using deductive logic. The result shows that Jakcorpu has become an innovative platform that integrates ASN development needs with regional policies, although challenges are still found, especially in aligning regulations and program financing. The conclusion discussion confirms that BPSDM through Jakcorpu plays an important role in forming professional and adaptive ASN. This program is not only relevant to increasing ASN capacity, but also a model HR development in other regional governments.

Abstract

Perdagangan Pengaruh (Trading in Influence) adalah salah satu jenis tindak pidana korupsi sebagaimana tercantum dalam United Nations Convention Against Corruption (UNCAC). Pasal 18 UNCAC menegaskan pentingnya kriminalisasi perdagangan pengaruh untuk menjaga integritas sistem hukum di negara-negara anggotanya. Namun, meskipun Indonesia telah meratifikasi UNCAC melalui Undang-Undang Nomor 7 Tahun 2006, belum memiliki ketentuan khusus yang mengatur perdagangan pengaruh dalam kerangka hukum nasional. Penelitian ini bertujuan untuk menganalisis keabsahan tindakan perdagangan pengaruh berdasarkan UNCAC dan Undang-Undang Tindak Pidana Korupsi di Indonesia. Metode yang digunakan adalah penelitian normatif dengan pendekatan peraturan perundang-undangan, studi kasus pada putusan pengadilan terkait, serta analisis dokumen hukum lainnya. Hasil penelitian menunjukkan bahwa tindakan perdagangan pengaruh tidak hanya melanggar hukum, tetapi juga menimbulkan dampak serius, seperti menciptakan ketidakpastian hukum, dan mengurangi kepercayaan masyarakat terhadap integritas institusi publik. Oleh karena itu, Undang-Undang Tindak Pidana Korupsi perlu merumuskan pasal mengenai Tindak Pidana Pengaruh.

Abstract

Regency or city governments have an important role in supervising mining activities in accordance with the Regional Government Law and the Mineral and Coal Law. However, with the enactment of the new Minerba Law, this role has undergone significant changes. This research aims to analyze the role of district or city governments in mining supervision before and after the enactment of the new Minerba Law, which revoked some regional authorities. The research results show that previously, regional governments had the authority to grant permits and supervise mining activities. However, with the presence of the new Minerba Law, this authority shifted to the central government, causing district/city governments to lose most of their responsibilities. However, local governments still play a role in aspects of environmental monitoring and law enforcement at the local level.

Abstract

This study examines the application of the 5C financing principles in providing undergraduate higher education loans, comparing the advantages, disadvantages, and default resolution mechanisms in Indonesia and the United States. Indonesia refers to the Banking Act, while the U.S. follows the Higher Education Act and its derivatives. A normative legal method with a descriptive-qualitative approach was used. The findings show that both countries apply the 5C principles. However, Indonesia lacks specific regulations and institutions as found in the U.S. Therefore, establishing a dedicated legal framework is essential to prevent legal uncertainty in educational financing.

Abstract

Health is a fundamental human right that must be protected by the state. This presents a significant challenge for countries like Indonesia and the Netherlands in upholding human rights, particularly regarding the provision of proper medical care for suspects/defendants. This study addresses main issue: the regulation of the right of suspects/defendants to receive adequate medical care in Indonesia and the Netherlands.The research aims to identify and analyze the legal framework governing this right. A normative approach with a descriptive-analytical method is used, based on literature review and comparative legal analysis. Data sources include primary and secondary legal materials. The result and the conclusion show that Indonesia regulates this right through the Criminal Procedure Code (KUHAP) and Undang-Undang Nomor 22 of 2022, while the Netherlands addresses it in the Penitentiaire Beginselenwet (Penitentiary Principles Act). Although both countries have legal provisions, they face challenges in implementation, particularly in safeguarding human rights and the presumption of innocence. This research is expected to serve as a reference for strengthening the protection of suspects’/defendants’ rights in Indonesia and to offer insights into international practices.

Abstract

This study compares the rights and obligations of foreign nationals (FNs) holding a Permanent Stay Permit (KITAP) in Indonesia and those holding a Green Card in the United States, with the problem on the legal implications for their family members. The research is based on increasing global mobility, which demands a clear and fair immigration system. Using a normative juridical method and comparative approach, the study analyzes immigration laws and relevant legal literature in both countries. The result and conclusion show that KITAP grants limited residency and work rights with strict administrative obligations, such as periodic reporting and tax compliance. In contrast, the U.S. Green Card offers permanent residency, employment rights, and a path to naturalization without routine reporting. Regarding families, KITAP holders may apply for residence visas and access public services under administrative requirements as regulated in Ministry Regulation No. 22 of 2023. These differences reflect each country’s immigration policy orientation in balancing sovereignty with legal protection for FNs.

Abstract

The regulation of polemics regarding the division of post-divorce joint property is different in the jurisdictions of Indonesia and Malaysia. This study discusses the procedure and the advantages and disadvantages of executing marital property in both legal systems. Using a normative legal research method with a comparative legal approach, this study qualitatively analyzes secondary data to produce descriptive data and draw deductive conclusions. The results show that Indonesia has a structured execution procedure in the Religious Court, though it is constrained by the complexity of customary land practices and issues. Meanwhile, Malaysia's Syariah Court offers diverse enforcement mechanisms and emphasizes mediation; however, it faces jurisdictional fragmentation and difficulties proving non-financial contributions. In conclusion, both systems have unique advantages and challenges in ensuring the fairness of post-divorce property division.

Abstract

Termination of Employment is due to circumstances that have arisen, resulting in the termination of all rights and obligations between the employee and the employer. The implication of PHK in this case is the elimination of rights and obligations arising from the employment relationship between workers and employers. The action of PT. OM to unilaterally stop payment of wages is concluded that the employer is trying to end the employment relationship by violating regulations on employment. The consideration of the Panel of Judges; PT OM has not paid wages to C.I and friends for December 2010, January 2021 and February 2021. The formulation of the problem in this study is whether the normative rights received by C.I and friends are in accordance with Law Number 13 of 2003? The research method is normative and descriptive analytical, secondary data and deductive conclusion drawing. The results of the discussion and conclusion are that the normative rights received by C.I and friends are not in accordance with the decision, because in the case, the decision granted some of the demands of C.I and friends, which means there are normative rights that have not been fulfilled by PT. OM.

Abstract

The advancement of digital technology has significantly impacted the distribution and consumption of creative works, including music and songs. Digital platforms such as music streaming services, social media, and websites have become the primary mediums for creators to widely publish their works. While providing benefits like promotion and economic income, digitalization also presents new challenges, such as increasingly complex copyright infringements. This study aims to explore the challenges and opportunities of copyright protection in the digital era, focusing on the implementation of Law Number 28 of 2014 on Copyright in the context of digital music platforms. A normative research method with a descriptive-analytical approach was employed, analyzing primary, secondary, and tertiary legal materials. The findings highlight the importance of strengthening copyright protection mechanisms through collaboration between the government, electronic system providers, and the community. This study recommends strategic steps to enhance copyright protection, including optimizing the role of digital music aggregators in supporting creators and effectively resolving copyright disputes.
