Abstract

Dalam rangka mewujudkan tujuan perkawinan yang sakinah, mawaddah dan rahmah, Islam telah memberikan arahan dengan adanya penjelasan persyaratan untuk memiliki kemampuan menikah (al-Ba’ah). Namun, terdapat masalah yang menghalangi seseorang ingin menikah dalam lingkup psikis yaitu Wounded inner child. Penelitian ini bertujuan untuk mengetahui konsep al-Ba’ah perspektif Mazhab Syafi’i dan menganalisis tentang Wounded inner child yang ditinjau berdasarkan konsep al-Ba’ah perspektif Fikih Munakahat Mazhab Syafi’i. Penelitian ini menggunakan metode penelitian kualitatif dengan jenis studi kepustakaan (library research). Teknik pengumpulan data yang dipakai ialah studi dokumentasi. Hasil penelitian yang didapatkan, ditemukan adanya dua pendapat dari para ulama Mazhab Syafi’i mengenai konsep al-Ba’ah/kemampuan menikah sebagai berikut: pertama, kemampuan non material yang meliputi kemampuan melakukan hubungan biologis (Jima’). Kedua ialah kemampuan material yaitu kemampuan memenuhi biaya nikah yang terdiri dari kemampuan membayar mahar dan nafkah, disamping itu kemampuan-kemampuan lainnya yang mendukung keberlangsungan pernikahan itu sendiri. Kemudian, bagi penderita Wounded inner child ini dibolehkan menikah sesuai pendapat pertama, sedangkan pendapat kedua memandang tidak diperbolehkannya untuk menikah bagi penderita Wounded inner child yang tidak memenuhi kemampuan-kemampuan yang termasuk dalam konsep al-Ba’ah karena banyaknya mudharat yang akan timbul dari pernikahan tersebut.

Abstract

In Islam, giving maintenance is the husband's obligation, while being obedient and obedient is the wife's obligation. If the husband does not carry out his obligations, problems will arise such as a wife who is disobedient to her husband. This study aims to find out : How husbands should support their wives according to the Syafi'i Madzab, How should the wife's obedience to her husband according to the Syafi'i Madzab, How is the review of Islamic law towards a wife who is disobedient to her husband because not supported according to the Shafi'i Madzab. This study used a qualitative research method with a type of library research (Library Research). The data collection technique used is a documentation study. Based on the data that has been studied in the book of the Syafi'i Madzab, it is concluded that it is obligatory for the husband to give a living to his wife in the form of material and non-material (inner) income. The level of maintenance is two mud for rich husbands, one mud for poor husbands, and one and a half mud for middle husbands every day. Then provide shelter, clothing and servants to the wife if they are usually served. In addition, it is obligatory for the husband to have intercourse with his wife with ma'ruf. The wife is obliged to carry out all the husband's orders as long as they do not contain disobedience, because the obedience and obedience of a wife to her husband is obligatory. If a husband does not carry out his obligations in providing a living to his wife, then the wife is given two choices, namely to be patient and remain with her husband under these circumstances, or to enter into a marriage. And disobeying your husband because you don't get a living is permissible.

Abstract

This study examines the Maqashid Sharia Analysis of the Wife's Iddah Income After Her Husband Divorced Based on Article 8 PP No. 10 of 1983 Jo PP 45 of 1990. The formulation of the problem from this research is how is the concept of Iddah's livelihood in article 8 of PP No. 10 of 1983 Jo PP 45 of 1990 and how to analyze the concept of Maqashid Syariah against article 8 PP No.10 of 1983 Jo PP 45 of 1990. The method used in this research is a type of qualitative research, with the type of research used is library research (Library Research) or indirect observation. This research has the following results: Whereas in the PP it is stated that civil servant husbands must provide maintenance to their divorced wives, in which this income is provided according to established regulations. Meanwhile, in Maqashid Syariah, the maintenance given by the ex-husband to the ex-wife is as long as the ex-wife is carrying out the iddah period in talak raj'i.

Abstract

The status of children is an urgent and serious problem in life in society. In addition to having direct contact with lineage, inheritance, even the matter of guardianship if the child is a girl. In the decision on case Number 740/Pdt.G/2020/PA.Kng, the researcher found that there was no decision regarding the child. This study aims to determine the status of the child as a result of marriage annulment and to find out a comparison between the Compilation of Islamic Law (KHI) and Positive Law in cases of annulment. marriage at the Kuningan Religious Court Number 740/Pdt.G/2020/PA.Kng. The research method used by researchers is qualitative research by combining two types of data, namely data obtained from field research in the form of interviews and documentation at the Kuningan Religious Court and supplemented by library research data in the form of a judge's determination document regarding the case. The data that the researchers obtained were then reduced, presented, and concluded using descriptive-comparative analysis techniques. Based on the research conducted, a conclusion was obtained that the status of a child due to the annulment of a marriage in decision number 740/Pdt.G/2020/PA.Kng is an illegitimate child because he was born in an illegitimate marriage, but regarding civil relations it can be related to his biological father.

Abstract

In the household, the phenomenon that occurs in society is that it is not only the husband who makes a living, but also a wife. In general, a wife earns a living by becoming a female worker. This is like what happened in Ancaran Village, Kuningan District. This study aims to determine and analyze the Maqahsid Syariah review of the inheritance rights of non-working husbands' wives in terms of inheritance distribution for the people of Ancaran Village, Kuningan District, Kuningan Regency. The research method used is a qualitative method. This research includes the type of field research or field research. Data collection techniques used are interviews and documentation. The results of the author's interviews with the interviewees in Ancaran Village, they got all of the husband's inheritance and half of it for those whose husbands have 2 wives, because the 4 interviewees belong to an underprivileged community because the inheritance of her husband's death is only a house that they live. This is permissible with the record of obtaining permission and approval from other heirs, either voluntarily or receiving wages, because the maqasid al-shari'ah distribution of inheritance is more dominated by protection of offspring (hifdh al-nasl) than protection of assets (hifdh al-mal), and even then no one is at the dlaruriyyat (primary) level, but all are at the hajiyyat (secondary) or tahsiniyyat (tertiary) rank.

Abstract

Abstract : Nusyuz is an attitude of disobedience by a wife against her husband and does not fulfill its obligations as a wife in the family. In the Qur'an, it has been explained unequivocally that when a wife does nusyuz, she should be addressed by providing advice, separating beds and hitting without injuring. In carrying out these stages, sometimes a lot of people do not understand; then this is where the need to understand what the real intention of nusyuz according to the implemented Islamic Law Compilation in Indonesia. This study was a library research; so that type of the needed data was entirely qualitative data which are obtained from various written sources (classical and contemporary) that talk about the investigated problem. Data analysis technique was the content analysis or descriptive analysis. Descriptive, as this study starts from the concepts based on the texts of syara’ (law), the opinion of jurists and regulations that exist as a norm of positive law (tasyri'iyyah). The data were classified into three types of data, namely primary data source as the basic source that included chapters of KHI (Islamic Law Compilation), Law No. 23 of 2004, and books directly related on nusyuz and domestic violence. The secondary data source was as the supporting source obtained from various sources, such as the books of fiqh like al-Um, Bidayah al-Mujtahid, Fathulmuin, etc. While the tertiary data sources were obtained from journals, newspapers, internet, dictionary and related data on the topic of discussion. The conclusions of the discussed issues are, first, to understand the concept nusyuz in KHI we have to go back to fiqh books as a translation of the KHI’s articles. Second, to deal with a wife who is nusyuz, Islam does not legalize the Muslims to commit domestic violence (physical or psychological), even abandoned, but Islam set it very wisely as a way to solve nusyuz. Third, the relevance between nusyuz in KHI and Law No. 23 of 2004 is especially relevant when it can be understood and implemented properly, if not, then there will be abuse of the wife because she felt being very protected by the state, although it is wrong in the religious perspective.

Abstract

Nambut panganten is a tradition in traditional marriages that occur in the community where the reception or wedding invitation is held at the prospective groom first. Meanwhile, in practice, the bride-to-be is borrowed to be presented and sits side by side in the aisle with the groom-to-be at the reception which is held one day before the wedding contract. The fact is that in the teachings of Islam it is not accordance with the shari’a because they are not yet legally husband and wife. The purpose of the problem in this study is to find out how the prictice of the Nambut Panganten tradition is in Sembawa village, Kuningan West Java and to examine how Islamic law views the Nambut Panganten tradition in Sembawa village, Kuningan West Java. This study uses qualitative research methods. The type of this research and data collection techniques using interviews and documentation. The results of the study show that the practice of Nambut Panganten in Sembawa village, Kuningan West Java, when viewed from Islamic law, is not permissible because it is against the shari’a which contains elements of ikhtilat and khalwat.

Abstract

Aturan perkawinan di Indonesia dalam bentuk hukum positif dirumuskan dalam Undang-Undang Nomor 1 Tahun 1974 (UU Perkawinan) tentang Perkawinan yang terdiri dari 14 bab dan 67 pasal dan dikemas dalam bentuk pasal•pasal (perundang-undangan) dengan tujuan untuk memberikan kemudahan pemahaman pada masyarakat Muslim Indonesia. Di samping UU Perkawinan, terdapat pula Kompilasi Hukum Islam (KHI) yang oleh sebagian sarjana hukum dikatakan sebagai hukum positif dengan berdasarkan Inpres No. 1 Tahun 1991 dan merupakan bagian hukum materiil yang mengatur perkawinan bagi masyarakat Muslim di Indonesia. Dalam praktikknya, perkawinan tidak hanya melibatkan manusia seagama dan satu kewarganegaraan. Terdapat kasus-kasus di mana suami-isteri berasal dari latar belakang agama atau kewarganegaraan yang berbeda. Mereka berdalih atas nama demokrasi dan Hak Asasi Manusia yang dijadikan dasar dalam membenarkan tindakan mereka melakukan perkawinan campuran, meskipun harus mengesampingkan kewajiban dan aturan-aturan lain yang seharusnya diaati.

Abstract

Marriage is something very sacred in Islam. In the Qur'an, Allah defines marriage as Mitsaqan Ghalidzan which means a strong agreement. In the process of marriage can not be separated from problems in the household. One of the problems that often occurs in the household is the intervention of parents. This study aims to determine: (1) the forms of parental intervention in the child's household, (2) a review of Islamic law on the forms of parental interference in the child's household. The data in this study are primary data obtained from interviews with resource persons who married at a young age and experienced parental intervention in their household. This type of research is a case study qualitative research. This research was conducted using semi-structured interview data collection techniques, so as to be able to develop answers from sources. The data analysis technique used is descriptive analysis. Based on the results of the analysis, by combining the results of interviews and theories, it is concluded that the view of Islamic law on parents who interfere in determining the place of residence for children's households is permissible

Abstract

Marriage dispensation is the granting of leeway to carry out marriage to prospective brides who have not reached the age requirements for marriage in accordance with the provisions of the Act. The judge in determining the decision of a case requesting a marriage dispensation is sometimes still difficult to understand the basis and considerations for the peoples. This study aims to determine the basis and considerations of the judge in the process of determining the application for a marriage dispensation, and to find out the comparison of the review of Islamic Law and Positive Law on the judge's decision in the case of the application for marriage dispensation at the Religious Court of Purbalingga Regency No. 0505/Pdt.P/2020/PA.Pbg and No. 102/Pdt.P/2021/PA.Pbg. The research method used by the author is qualitative research by combining two types of data, namely data obtained from field research in the form of observations, interviews and documentation at the Purbalingga Religious Court and added to library research in the form of judges' determination documents. About the dispensation of marriage. The data that the author obtained were then reduced, presented, and concluded using descriptive-comparative analysis techniques. Based on the research conducted, it is concluded that the basis of legal sources used by judges in the process of determining the application for marriage dispensation at the Religious Courts of Purbalingga Regency is Islamic law which is sourced from the Qur'an, Hadith, fiqh principles, and opinions of the fuqaha about the age limit for marriage. And Positive Law which is sourced from Law No. 50 of 2009, Law No. 16 of 2019, Perma No. 5 of 2019, Law no. 35 of 2014. The considerations used by the judge are based on the pillars and conditions of marriage, mental and physical readiness of the prospective bride and groom, the absence of obstacles / prohibitions on marriage, urgency, benefit for all parties, as well as the readiness of parents from both parties to guide the child. dispensation for marriage in the household. Based on the comparison, the determination of No. 0505/Pdt.P/2020/PA.Pbg is in accordance with applicable Islamic Law and Positive Law. While in the determination of case No. 102/Pdt.P/2021/PA.Pbg, the Positive Law used is appropriate, but if viewed from Islamic Law, the judge's decision on this case is still not appropriate because the two brides who will be married due to adultery have not received punishment (had) , and has not expressed repentance and regret for his actions.
