Abstract

At this time, many cases of insurance companies have defaulted so that policyholders have difficulty getting compensation payments when an uncertain event occurs. Moreover, this default case occurs in large insurance companies which makes public trust in insurance companies reduced. Of these various cases, one of the causes is the weak supervision and law enforcement in the financial services sector carried out by the Financial Services Authority (OJK). The purpose of this study is to analyze the enforcement of criminal acts in the financial services sector in the case of insurance companies that have defaulted. This research is normative juridical research that examines positive legal norms that apply in the form of laws and regulations regarding criminal acts in the financial services sector. This research is expected to provide input to OJK to immediately make improvements to the legal structure and legal culture in criminal law enforcement in the financial services sector to protect policyholders, create a healthy insurance company, and restore public trust in the insurance industry in Indonesia. In normative juridical research, the data studied are only secondary data that include primary, secondary, and tertiary legal materials. The results showed that law enforcement of criminal acts in the financial services sector in the case of insurance companies that defaulted could not be optimal due to the limited number of OJK investigator personnel, lack of knowledge and technical skills regarding criminal investigations in the financial services sector, lack of facilities, infrastructure, and funds, as well as low legal culture from insurance company managers, OJK investigators, and the public.

Abstract

The development of the world of tourism is currently experiencing high growth. With repairs and increasing the quality of tourist spots, it has succeeded in encouraging and increasing public interest in visiting. Traveling at this time has also been carried out in various ways both by individuals and groups. One of the quite existing tourist groups in Jakarta is the Backpacker Jakarta Community (BPJ), which offers low-cost travel packages with the Backpacker pattern. In this study, the authors conducted a survey of BPJ’s members/members by distributing questionnaires containing personal data and also regarding the interest of the members in the trips or trips they had participated in so far. From this process the researcher obtained feedback and analyzed the answers from 96 respondents, using the clustering method with K-means clustering analysis, and then determined 7 clusters to get an overview of the variations in the interest of BPJ’s members. Of the 7 clusters, the researcher chose one of the potential clusters to develop travel tour package products, namely BPJ’s Member Mountaineering Lover Cluster which contains quite young groups between 22-35 years old. Furthermore, the researcher determines the Value Proposition of the cluster to determine the strategic steps for the marketing mix strategy with the 8P.

This study analyzes the influence of recruitment, placement, training, job design, and work ethics variables on employee performance. This study used total sampling for permanent employees because the overall object of research amounted to 42 employees. The results of multiple linear regression analysis showed the positive influence of recruitment (b1=0.573), training (b3=0.309), and work ethics (b5=0.235), as well as the negative influence of placement (b2=-0.221) and job design (b4=-0.222) on employee performance. The partial hypothesis test showed the significance of the variables recruitment (t = 7.994), training (t = 3.155), and work ethics (t = 2.629), while placement (t = -2.463) and job design (t = -2.206) were not significant. Test F shows overall significance (F = 40.504, p <0.05), with a coefficient of determination (R2) of 84.9%, indicating that employee performance is jointly influenced by the variables studied. This research is expected to provide consideration and as policy material related to recruitment, placement, training, job design, and work ethics to improve employee performance.

The imbalance between job seekers and job recipients makes it difficult for some Indonesians to find work. This study aims to determine the handling of the crime of begging in public based on Article 504 Paragraph (1) of the Criminal Code and also to determine the termination of the crime of begging in public in connection with the Tulungagung District Court Decision Number 69/Pid.C/2022/PN. The research method used in this study is descriptive-analytical with a normative juridical approach. The conclusion of this study is that the handling of the crime of begging in public based on Article 504 paragraph 1 of the Criminal Code associated with the Tulungagung District Court Decision Number 69/Pid.C/2022/PN Tlg has been implemented appropriately. This is manifested in Tulungagung District Court Decision Number 69/Pid.C/2022/PN Plg where the judge ruled that the perpetrators of the crime of begging in public are punishable in Article 504, article 1 (one) of the Criminal Code. So that Article 504 paragraph 1 (one) has not been effectively implemented in the community and the punishment is in accordance with applicable laws and regulations. To reduce similar crimes, the government must intervene to deal with the poverty rate in Indonesia so that the level of begging in Indonesia is reduced.
