Abstract

This study aims to understand how the Ijarah contract is implemented in Umrah services at PT Al Fajr Travelindo Wonosobo branch based on the DSN-MUI fatwa No. 112/DSN-MUI/IX/2017 concerning the Ijarah Contract. This research approach is qualitative based on field research. Primary data was obtained through observation and interviews with stakeholders. Data analysis was carried out using a descriptive method to describe the practice of implementing the Ijarah contract in Umrah services in the view of the DSN-MUI fatwa. The research findings reveal that the implementation of the Ijarah Contract at PT Al Fajr Travelindo Wonosobo Branch is in accordance with the DSN-MUI Fatwa both in terms of the form of the contract, pillars and conditions consisting of aspects of shighat, 'aqidain, ujrah, manfaah, and other important aspects in the Ijarah contract, namely time and the work of the ajir. However, transparency regarding additional costs needs to be explained from the outset to avoid elements of gharar (unlawful belief), which could undermine the validity of the contract.

Abstract

The Constitutional Court Decision No. 69/PUU-XII/2015 marked a significant legal reform in Indonesia’s marriage law by amending Article 29 of Law No. 1 of 1974 concerning Marriage, which previously restricted the making of prenuptial agreements to before or at the time of marriage. Following this decision, spouses are now permitted to create or amend marital agreements during the course of their marriage. This study aims to examine the normative implications of this ruling, particularly in relation to the protection and management of joint marital property. Using a normative juridical method with statutory and conceptual approaches, this research analyzes how the decision reshapes the legal framework governing marital property arrangements and enhances the protection of individual and joint ownership rights within marriage. The findings reveal that the Constitutional Court’s interpretation expands the legal meaning of marital agreements, providing greater flexibility and legal certainty for married couples in managing their assets. Nevertheless, challenges remain in its practical implementation, particularly concerning the registration process, the recognition of third-party rights, and the potential emergence of legal uncertainty if not properly regulated. Therefore, additional technical and procedural guidelines are necessary to ensure that the objectives of fairness, legal certainty, and protection of property rights can be effectively realized in accordance with the spirit of the Constitutional Court’s decision.

Abstract

Akad merupakan dasar transaksi keuangan syariah, namun kompleksitas praktik modern mendorong penggunaan hybrid contract (al-‘uq ūd al murakkabah) yang memadukan dua atau lebih akad dalam satu produk, sebagaimana difatwakan DSN-MUI. Model hybrid seperti mujtami‘ah dan muta‘addidah digunakan karena akad tunggal tidak lagi memadai untuk produk perbankan dan asuransi syariah. Penelitian ini adalah studi kepustakaan yang menelaah aspek normatif dan historis hukum terkait penerapan akad hybrid dalam asuransi syariah. Akad hybrid (al-‘uqud al-murakkabah) adalah akad ganda yang memadukan lebih dari satu kontrak, terdiri dari lima jenis, dan menimbulkan perbedaan pendapat antara ulama yang membolehkan dan yang melarang. Namun kompleksitas kebutuhan mu‘amalah mendorong lahirnya berbagai produk berbasis akad hybrid, termasuk dalam asuransi syariah. Asuransi berasal dari kata Latin assecurare awal masuk ke dunia Islam abad ke-19 dan dianggap haram karena unsur gharar, maysir, riba, dan kezaliman. Kebutuhan akan perlindungan risiko kemudian mendorong lahirnya asuransi syariah (takaful) yang menghilangkan unsur terlarang tersebut. Keabsahan akad hybrid dalam asuransi syariah dapat dinilai dengan meneliti unsur-unsur akad dan proses transaksinya, dan berdasarkan lima batasan akad hybrid yang dibolehkan menurut Al-Imrani, produk asuransi syariah dinilai sah digunakan oleh umat Islam.

Abstract

The development of Islamic economics requires a comprehensive conceptual understanding of the legal foundations of muʿāmalāt to ensure that economic practices do not become confined to mere contractual formalism. This article aims to provide a comprehensive analysis of the concepts of wealth (al-māl), ownership (al-milkiyyah), and contracts, as well as their integrative relationship within the framework of Islamic economic law. The study employs a qualitative method with a normative–conceptual approach, drawing on a literature review of primary sources of Islamic law and relevant contemporary academic scholarship. The findings indicate that wealth in Islam is understood as a trust (amānah) encompassing economic, social, and moral dimensions; ownership functions as legal legitimacy for the utilization of wealth within Sharīʿa constraints and social responsibility; while contracts serve as legal instruments that lawfully and equitably connect wealth and ownership in a benefit-oriented manner. The study’s main contribution affirms that these three concepts are systemic and inseparable. Reducing contracts to mere formal agreements risks obscuring the objectives of maqāṣid al-sharīʿa. Therefore, the conceptual integration of wealth, ownership, and contracts constitutes an essential prerequisite for the development of Islamic economic practices that are not only legally compliant but also reflective of justice, ethical values, and social welfare in the contemporary economic context.

Abstract

The development of the digital economy has given rise to a new business model known as platform capitalism, namely an economic system based on digital platforms that connects service providers and consumers via algorithms. This model drives the growth of the gig economy, but also raises issues regarding the distribution of risk between platforms and workers. In practice, platforms tend to generate profits through transaction fees, whilst workers bear the operational costs, face income uncertainty, and have minimal social protection. This article aims to analyse the inequity in risk distribution within the gig economy and to propose a system based on Islamic economic law as an alternative model for risk distribution. The research employs a qualitative method with a conceptual and legal-normative approach. The research findings indicate that the current platform model is characterised by ‘risk shifting’, namely the transfer of business risks to workers. The principle of Profit and Loss Sharing (PLS) in Islamic economics, through the mudharabah and musyarakah contracts, offers a fairer risk distribution system as profits and losses are shared proportionally between the parties. Consequently, PLS has the potential to serve as a new regulatory framework for building a socially just digital economy.

Abstract

The core problem of this research is how Sharia Economic Law views the practice of cooperation agreements for Micro, Small and Medium Enterprises on the Shopee Marketplace. The aim of this research is to find out and examine the practice of cooperation agreements for Micro, Small and Medium Enterprises on the Shopee Marketplace in terms of sharia economic law.The type of research used is field research using a qualitative approach, namely describing phenomena that occur in the field according to existing reality. The research location is in Tanah Datar Regency. The primary data source that the author uses is through interviews with MSME actors in Parak Juar. The data collection technique is by conducting interviews and documentation. The data analysis technique that the researcher carried out was qualitative analysis in order to collect data sources related to the problem being studied. The cooperation agreement between MSMEs and the Shopee marketplace regulates the rights and obligations of both parties in running an online business, in the form of an obligatory agreement and subject to the Civil Code (KUHPerdata). MSMEs are obliged to provide products, maintain quality and arrange delivery of goods, while Shopee provides the platform, payment system and technical support. The contract used in this collaboration is the ijarah bi al-manfa'ah agreement, where Shopee leases digital platforms and services to MSMEs. In practice, although Shopee provides various facilities that support MSMEs, such as promotions and training, there are challenges related to transaction uncertainty, such as problems with products that do not match orders or delivery. This shows that even though this collaboration is permitted under sharia law, it is important to ensure that transactions are still carried out in accordance with sharia principles, by prioritizing honesty, transparency and fulfilling the obligations of each party.
