Abstract

Keluarnya Perpres No. 10 Tahun 2021 tentang Bidang Usaha Penanaman Modal yang memberikan legitimasi terhadap distribusi miras melahirkan gejolak dan polemik pro kontra di masyarakat. Sehingga Perpres tersebut dicabut, namun berbagai masyarakat kontra terhadap pencabutan tersebut khususnya di daerah minoritas. Sedangkan dalam Islam konteks jual beli khamar terdapat ulama yang membolehkan salah satunya Syekh Ali Jum’ah. Oleh karena itu, Penelitian ini menguraikan 1) Bagaimana hukum Khamar perspektif Hukum Islam; 2) Bagaimana hukum jual beli khamar menurut Syekh Ali Jum’ah; dan 3) Bagaimana legalisasi jual beli khmar di Indonesia menurut fatwa Syekh Ali Jum’ah. Jenis penelitian yang digunakan adalah normatif (liblary research) dengan pendekatan yuridis normatif dan teologis normatif syar’i. Sumber data primer berasal dari buku, jurnal yang membahas secara khusus hukum khamar dan sumber sekunder berasal dari literatur dan data pendukung penelitian. Adapun analisis yang digunakan adalah analisis data kualitatif deskriptif. Hasil penelitian menunjukan bahwa 1) dalam Islam hukum khamar adalah haram secara mutlak; 2) Menurut Syekh Ali Jum’ah dalam fatwahnya bahwa hukum jual beli khamar boleh bagi masyarakat muslim di wilayah negara non-muslim; 3) Leglitas jual beli khamar di Indonesia menurut fatwa Syekh Ali Jum’ah dapat diterapkan namun khusus bagi wilayah atau daerah yang minoritas Muslim. Oleh karena itu sebaiknya pemerintah membuat regulasi secara khusus untuk pendistribusian atau jual beli khamar bagi daerah yang minoritas muslim.

Abstract

Indonesia has a democratic form of government where the government system is from the people, by the people, and for the people (Kristina, 2021). Democracy as a means of people's sovereignty is realized by holding Legislative Elections and Regional Head Elections. Of course, the implementation of elections or regional elections cannot be separated from the violations that occur. These violations are divided into administrative violations, violations of the code of ethics, and violations of electoral crimes. The handling of each violation varies. Administrative violations are forwarded to the KPU, violations of the code of conduct are forwarded to the DKPP, and violations of electoral crimes are forwarded to the Sentra Gakkumdu (Integrated Law Enforcement Center). A concrete example of the violation of electoral crime is money politics regulated in Article 187A of the Regional Head Election Law. The purpose of this paper is to find out the problems in handling money politics in the Regional Head Election by the Sentra Gakkumdu Kabupaten Kendal so as to minimize the occurrence of money political practices in the Regional Head Election and the implementation of handling election violations in accordance with the rules so that the holding of elections is carried out in accordance with applicable regulations. This research is an empirical or non-doctrinal legal research with a qualitative approach. The techniques used in collecting legal materials in this study are observation, interviews, and documentation. The results of the study show that there are still several problems or obstacles faced by Sentra Gakkumdu, including community factors, law enforcement officials, and statutory factors..

Abstract

The right to a healthy environment is enshrined in Article 28H paragraph (1) and Article 33 paragraph (4) of the 1945 Constitution of the Republic of Indonesia. These provisions assert the entitlement of every individual to a favorable living environment grounded in environmental understanding. Nonetheless, this principle stands in stark contrast to the prevailing reality. Within WALHI's documented records, three instances of ecocide crimes have occurred in Indonesia, encompassing the Lapindo mudflow, forest and peatland fires in Central Kalimantan, and the development of hydropower plants in Koto Panjang. Ecocide serves as a glaring testament to the classification of environmental offenses as extraordinary crimes, given their capacity to erode the fundamental tranquility of human existence. This composition adopts a normative juridical approach, employing legislative, comparative, conceptual, and analytical dimensions. The focal aim of this discourse is to scrutinize the ecocide threat, its incorporation within a framework of conscientiousness, and its correlation with Pancasila as a responsive measure against environmental perils. Recommendations set forth encompass: a) the formulation of definitive legislation in Indonesia concerning ecocide; and b) a comprehensive legal examination, entailing an in-depth analysis of the scope, regulatory orientation, and content, taking into profound account philosophical, sociological, and juridical facets.

Abstract

This study aims to examine the implementation of the supervisory function of the Surakarta City Environment Service (DLH) on the Management of Hazardous and Toxic Waste (B3) RSUD Dr. Moewardi and obstacles in implementing the supervisory function. This research is an empirical legal research and is descriptive in nature. This study uses a qualitative approach with data sources in the form of primary data sources and secondary data sources. Data collection techniques used were document studies and interviews. The data analysis technique used is qualitative data analysis. The results of the study show that the implementation of the supervisory function of the Surakarta City Environmental Service (DLH) on B3 Waste Management at RSUD Dr. Moewardi has not been carried out optimally because DLH Surakarta in carrying out field supervision is not carried out completely and thoroughly according to Standard Operating Procedures (SOP) because supervision is only based on glimpses of the waste storage location and questions and answers only so there is concern that there will be discrepancies in the results of the written report with the actual situation in field. The obstacles faced by DLH Surakarta in carrying out the supervisory function are due to a lack of human resources making it difficult to divide schedules and supervise many agencies so that there are agencies that do not receive maximum supervision, the budget is very minimal so it is difficult to finance supervisory activities, and the facilities and infrastructure are inadequate.

Abstract

This research analyzes the passing of regulations imposing a tax on carbon, discusses the effectiveness of implementing a carbon tax as well as the knowledge and opinions of tax judges regarding these regulations. Carbon emissions have a big influence on climate change, the more carbon emissions increase, the worse the environment becomes and is detrimental to all creatures on earth, therefore it is important to immediately reduce carbon emissions and control climate change. Seeing that Finland, Sweden and other countries have succeeded in reducing carbon gas emissions by implementing a carbon tax, the government decided to implement a carbon tax in Indonesia in the hope that it will reach the point of net zero emissions in accordance with the agreement in the Paris Agreement. In implementing a policy there must be regulations, for carbon taxes, the law enforcement will be enforced by the tax court. Tax judges must understand about Carbon Tax. By conducting this research, it is known that the differences in opinion of each judge mean that not all judges agree with the implementation of the carbon tax.
