Abstract

Satpol PP as a regional apparatus has a very strategic role in strengthening regional autonomy and public services in the regions. To guarantee the implementation of Satpol PP’s duties in the enforcement of Regional Regulations and Regional Regulation, the implementation of public order and peace and community protection needs to be improved, both in terms of institutional and human resources. In addition, the existence of Satpol PP in the administration of regional government is expected to help ensure legal certainty and facilitate the development process in the regions. This research method uses a type of normative and descriptive juridical research that aims to describe the relationship of the main tasks and authorities and obligations between the Civil Service Police Unit and the Regional Government Police in upholding order in society. The purpose of this research is to ϔind out and describe the synergy between Satpol PP, the Police and Local Government in carrying out their duties or obligations to maintain public security and order in accordance with the main task of Satpol PP No. 16 of 2018, the police as stipulated in Article 13 of Law No. 2 of 2002 concerning the National Police of the Republic of Indonesia and the obligations of the Regional Government based on Article 43 of Law No. No. 23 of 2014 concerning Regional Government. Abstract

The objective of this transcription is to elaborate informal law of criminal (law which living into society and natural law) which apparently acknowledge pluralism of law in system developmental of Indonesia’s law of criminal. The opportunity is which given by RKUHP to the judge for implementing informal law in the fact opposite whit legality principles and the interest create law assurance and non-discrimination prohibition. The another alternative which offered is adopting informal law norms into formal law of criminal, that is used whole citizen, the judge obligation is excavate, follow, and understand law values and justice sense which live in the society, it should be entered in yurisprudential developmental frame work.Keywords: Informal law of criminal, law assurance, yurisprudential.

Abstract

This paper describes a juridical review of the government’s attitude in dealing with the Covid 19 plague in terms of Articles Number 39 of 1999 concerning Human Rights. In this case the economic protection of the people affected by the economy. This is the duty of the state in pursuing all forms of policies and budgets in implementing guarantees regarding protection (to protect), respect (to respect), and fulϔillment (to fulfill) of basic human rights, especially the right to life and the right to health inherent to its citizens as mandated by the Universal Declaration of Human Rights in 1948, the 1945 Constitution of the Republic of Indonesia, Law No. 39 of 1999 concerning Human Rights, and Law 39 of 2009 concerning Health. This scientiϔic paper uses a normative research method using the statutory approach. It should be highlighted in the implementation of the policies determined in the face of the covid outbreak 19 namely in its implementation by not ignoring a series of community rights such as the right to obtain basic health services according to medical needs, food needs, and other daily necessities during the establishment of the policy.Keywords: juridical review, attitude, government, plague, covid 19, human rights

Abstract

The Covid-19 pandemic has an impact on the obstruction of all life activities, one of which is the implementation of regional elections which was originally to be held simultaneously in September 2020 and then based on PERPPU Number 2 of 2020 has been postponed to December 2020. But until now there have been no signs that this pandemic will disappear. in the near future, because from day to day instead of decreasing, it is increasing. Then will the simultaneous regional elections be held on December 9 2020 in the midst of the Covid-19 pandemic? Or will the government further delay the simultaneous regional elections until the Covid-19 pandemic is declared gone?

Abstract

The making of this journal aims to ϔind out about (1) How to regulate human rights in Indonesian laws and regulations (2) What is the form of the protection and application of human rights in the criminal justice system according to Law No. 8 of 1981 (KUHAP). To answer this problem, the writer uses normative research methods; comprehensive analytical study of primary and secondary legal materials. The results of the study show that the basis for regulating human rights has been formulated in the Criminal Procedure Code and has brought renewal in regulating human rights as stipulated in articles on the rights of suspects / defendants and also regulates the principles that support human rights Humans such as the Pre-Guilty Principle Principle, and also presuppose a very fundamental legal principle, the principle of Equality in Law is known as Equality Before The Law. Theoretically, from the stage of investigation, prosecution and examination before a court hearing. But in reality there are still violations committed by individual law enforcement officers. Abstract

Sometimes Municipal Police acts reactively or repressively without heed to civil rights in doing their operation. Then, Bandar Lampung government has to provide a proper place for street vendors as per local Regulation (The Law Number 8 of 2009). In order to prevent any clashes between civil service police and people in society, especially street vendors, there are several things which need to be done: (1) quality of human resource in municipal police unit need to be improved; (2) Municipal Police need to use persuasive approach in performing their job; (3) local regulation needs to be aligned; (4) local regulation has to be enforced continuously and appropriately. Abstract

Covid Handling Policy 19 in West Java Province, the Governor of West Java in the implementation of its handling always refers to what is the policy of the central government, the policy of budget recorfusing carried out by the government towards the 2020 state budget, the provincial government also recofuses the provincial and regency / regional budgets City, so that the policies undertaken to overcome the response of Covid 19 always rests on policies made by the central government. Because of the 19th Impact in Indonesia, it has been very serious and has spread in 34 provinces in Indonesia, and nearly 400 districts / cities in Indonesia. The policy of implementing phase 1 PSBB in Depok, Bogor and Bekasi, is an early stage PSBB, because in that area, is a buffer for the Capital City area of DKI Jakarta, where DKI Jakarta is the highest pendemic cluster in Indonesia, and most of the people of West Java, earn a living in Capital of DKI Jakarta. Relocating a budget for handling Covid 19 in West Java is budgeted to reach almost 8 trillion, and added budget relocation in several regencies / cities in West Java, to cope with handling Covid 19, is the seriousness of the local government in handling the Covid 19 problem in West Java. For this reason, researchers are interested in conducting research with the title “Policy Analysis of the Government of West Java Province in handling Covid 19” This study uses descriptive qualitative methods, by studying and analyzing and describing secondary data obtained by researchers and the results achieved are the Implementation of Government Policy West Java Province in handling Covid 19, went very well, and originally West Java was included in a group of 4 (four) major, now getting better and entering the ranks of the top 10 spread of Covid 19 in Indonesia, and some areas have entered the yellow zone and green zone , as well as the blue zone (this paper was released in early July 2020).Keywords: Policy analysis, Government, West Java, Covid 19

Abstract

This paper aims to get an overview of how far the Government’s policies are for the protection and safety of the community against the impact of the Covid 19 pandemic, which is currently endemic throughout the world, even in Indonesia. The transmission of covid 19 in Indonesia, for almost 10 months, has infected part of the population in Indonesia, especially in areas in almost all provinces, districts/ cities in Indonesia. The confirmed transmission rate up to the beginning of February 2021, has reached a number above 1 million positive people are confirmed positive, and those who died have reached over 30,000 people, and those who recovered have reached above 900,000 people. As a result of the increasing number of confirmed positives, the impact on the availability of treatment isolation rooms is already approaching the acceptable threshold according to WHO standards, the number of people who have died, resulting in the increasingly limited land for burials. The method used in this paper is to use aqualitative descriptive study method, by obtaining data from print media, electronic media and other literature related to government policies in handling Covid 19. The conclusion that is found is, the Government has carried out various policies in handling of covid 19, in particular with the stipulation of Perpu 1 of 2020, concerning State Financial Policy and State Financial System Stabilization (facing Covid 19) in Indonesia, with this policy providing social assistance for people affected by Covid 19. And providing assistance to MSMEs who affected by covid 19, as well as PPh 21 incentives for affected entrepreneurs, and providing assistance to people with salaries below 5 million each month. As well as providing basic food assistance to the wider community affected by Covid 19 in 2020 and continuing in the 2021 budget year, as a top priority.Keywords: Policy, Protection, Community Safety, Covid Pandemic 19

Abstract

This study aims to analyze and explain the policies of the local government of the island of Java and the island of Bali in dealing with Covid-19. Local governments play a significant role in deciding the most appropriate policies for their regions. Local governments are required to carefully identify the problem of handling Covid-19, quickly decide on relevant policies, and ensure that their policies work in dealing with Covid-19 effectively. local governments need to continuously monitor and observe policies for handling COVID-19. Policy improvements regarding the handling of Covid-19 are always required at all times to adapt to the new challenges that are present in the process. In this case, the Regional Governments of Java and Bali Island in preventing Covid-19 have been responsive and responsive. This can be seen when the Central Government instructed local governments, especially Java and Bali islands to carry out handling of Covid-19 such as Large-Scale Social Restrictions (PSBB) and Micro-Scale Social Restrictions (PSBM/PPKM) as well as the implementation of health protocols for wearing masks, washing hands and maintain a minimum distance of 1 meter, each Regional Government issues policies quickly and then socializes them well.Keywords: Local Government, West Java, Covid-19 Pandemi
