Asas wa Tandhim: Jurnal Hukum, Pendidikan, dan Sosial Keagamaan (AwTJHPSA) is a peer-reviewed, open access scholarly journal published by Fakultas Agama Islam Universitas Cokroaminoto Yogyakarta. Abstract

This study examines patterns of corrupt behavior in Indonesia using criminological theories such as anomie, social control, differential association, and crime opportunity. Corruption in Indonesia is categorized as an extraordinary crime involving abuse of power for personal gain,with widespread political, economic, and socio-cultural impacts. This study uses a juridical-empirical method with a normative approach to understand the causes of corruption through analysis of legal and criminological literature. There are several main factors that cause high rates of corruption in Indonesia, namely internal factors such as individual personality and personal behavior, and external factors such as the social and cultural environment, and weaknesses in the legal system. This study shows that corruption cannot only be overcome with repressive measures but also requires preventive measures through the control of criminogenic factors.

Abstract

The construction services sector holds a strategic position in Indonesia’s national development. Nevertheless, the practical execution of government construction projects often encounters legal issues, including ambiguous contracts, unilateral design changes without addenda, and delays in payment. In the sphere of state financial oversight, two key institutions perform crucial functions: Badan Pengawasan Keuangan dan Pembangunan (BPKP) and Badan Pemeriksa Keuangan (BPK) as the external auditor. Both bodies possess the legal authority to audit construction projects and assess potential state financial losses. However, overlapping authority in determining losses and issuing recommendations frequently occurs. This study employs normative legal and sociological approaches to analyze the respective roles and mandates of BPKP and BPK, as well as the implications of dual audit authority for contractors’ legal certainty. Data were gathered through literature review, regulatory analysis, and examination of audit findings. The results demonstrate that dual authority contributes to legal uncertainty, particularly concerning the valuation of state losses and follow-up actions arising from audit reports. Furthermore, contractors are often confronted with conflicting findings that create inefficiency, confusion, and heightened legal risk. The study suggests the need for regulatory harmonization and improved coordination mechanisms between audit institutions to enhance transparency, accountability, and legal certainty in construction project implementation.

Abstract

Although the Ayat al-Kursi carries profound theological meaning, many Muslims tend to focus primarily on its virtues and practical benefits while paying less attention to its conceptual link with the belief in Allah’s constant supervision. This study aims to explore how Muslims understand Ayat al-Kursi and how such understanding influences their awareness of divine supervision in daily life. Using a qualitative approach through literature review and interviews, the research reveals that while many Muslims appreciate the functional benefits of Ayat al-Kursi, they do not always associate it with moral and ethical dimensions such as self-regulation, honesty, and caution in actions. These findings highlight the need to strengthen a more comprehensive understanding of Ayat al-Kursi so that the value of divine surveillance can be more fully internalized within the spiritual and social behavior of the Muslim community.

Abstract

The change of agricultural land for food production into small plots threatens the sustainability of agriculture and food security. This study discusses the legal protection and effectiveness of its application in preventing land use change. The research uses a normative legal approach with legal and conceptual methods. The findings show that the legal rules are sufficient, but their implementation is not effective due to weak oversight and economic pressures. The conclusion is that there is a need to strengthen legal enforcement and support for farmers.

Abstract

The Sunda Wiwitan community in Cimahi faces the challenge of preserving cultural values ​​and identity in a multicultural urban environment. This research uses a qualitative case study approach to examine the mechanisms of value transmission and the influence of multiculturalism on socio-religious life. The results show that values ​​are inherited through families and traditional communities, while multiculturalism encourages adaptation without eliminating core teachings. Furthermore, urban life strengthens tolerance and inclusive religious practices.

Abstract

The Complete Systematic Land Registration Program (PTSL), which is a program initiated by President Jokowi, faces various obstacles in its implementation, especially in customary regions of Minangkabau, the registration of ulayat land. Minangkabau customary law considers land categorized as Harta pusako tinggi to be indivisible and non-transferable to others. The realization of the complete systematic land registration requires complex requirements, such as genealogical records (ranji) or full agreement from all members of the clan (kaum). For issuing land certificates of pusako tinggi, there is a mandatory rule requiring the inclusion of a ranji or clan genealogy listing the names of clan members covering four generations. In Minangkabau, the preparation of a ranji or genealogy must include at least five levels (upward and downward) from the applicant, and not a single clan member may be omitted. This research is a normative legal study that employs a statutory approach and a case approach.

Abstract

Juvenile delinquency is a problem. Children who receive insufficient attention tend to commit criminal acts, ranging from theft to serious violence, which harm both themselves and society. Indonesia’s juvenile justice system emphasizes protection and rehabilitation, particularly for children under 14 who can only be subjected to non-penal measures, while children aged 14–17 undergo diversion processes and juvenile court proceedings. Nevertheless, serious crimes create tension between child protection and the demands for justice for victims. Sentencing of children must consider age, the severity of the offense, and ethical legal principles, including preventive, retributive, and reformative objectives. This study employs normative legal research using statutory and case approaches to analyze the implications of a child’s age on the type and form of sanctions. The results highlight that age significantly influences sanction application, ensuring justice while encouraging children to improve themselves and develop optimally.

Abstract

Nominee agreements, also known as name-lending agreements, are sometimes used as a means of legal circumvention. They are misused by providing opportunities for foreigners to evade the law and acquire land in Indonesia. This study aims to examine the legal position of nominee agreements from the perspective of contract law and national agrarian law, as well as to compare them with regulations in several other countries. The normative legal research method was used in this investigation. The results show that nominee agreements are legally invalid because they violate the provisions of the Basic Agrarian Law and do not meet the requirements for a valid agreement, especially in relation to the element of valid causa. Therefore, strict regulations are needed to ensure legal certainty and protect national agrarian sovereignty.

Abstract

The regulation of accountability and sanctions for children aged 12–14 years in the juvenile criminal justice system in Indonesia raises normative issues, particularly regarding the unclear position of children as subjects of legal accountability who cannot be punished as stipulated in Law Number 11 of 2012 concerning the Juvenile Criminal Justice System. This study aims to analyze the regulation of sanctions against children aged 12–14 years and formulate a direction for fair child accountability regulations. The research method used is normative juridical with a legislative, conceptual, and case approach. The results of the study indicate that there is ambiguity in the norms of the SPPA Law, which requires reformulation through a tiered accountability model and harmonization with the National Criminal Code to ensure child protection, legal certainty, and proportional justice.

Abstract

This study aims to determine the development of adolescent Quran recitation based on da'wah management in Marindal II Village, Patumbak District, Deli Serdang Regency. The research method used was qualitative with a descriptive approach. Data were obtained through interviews, observations, and documentation with one of the administrators of the Quran recitation group. Using the da'wah management approach, adolescent Quran recitation skills can be developed in a more structured and effective manner. This paper discusses strategies, models, and programs for effective Quran recitation development for adolescents. The results show that the da'wah management approach can significantly improve adolescent Quran recitation skills. This paper is also expected to serve as a reference for educators, preachers, and da'wah practitioners in developing Quran recitation skills.
