Abstract

This research aims to analyze the effectiveness of the implementation of the Decree of the Minister of Law and Human Rights M.HH-01.HN.03.03 of 2021 concerning the amount of legal aid fees for litigation and non-litigation for impoverished communities. Employing a socio-legal (yuridis empiris) approach, this study examines the prevailing legal provisions while also investigating actual legal events in society, with field research conducted in Gorontalo Province. The objective is to determine the extent to which this policy is effective in providing legal assistance to impoverished communities. The research findings indicate that although the Ministerial Decree has provided a crucial legal basis for the provision of legal aid, its implementation has not yet reached an optimal level from a technical execution perspective. Various obstacles were encountered in the field, including a mismatch between the stipulated fee amounts and the actual operational needs of legal aid provider organizations. This potentially hinders the quality and scope of services that can be provided to impoverished communities. To enhance the effectiveness of this policy, this research proposes several optimization strategies. These strategies include the necessity of periodically revising the amount of legal aid fees, taking into account factors such as inflation rates and the complexity of the cases handled. Furthermore, strengthening the capacity of legal aid institutions is essential, which can be achieved through continuous training for advocates and paralegals, the utilization of information technology to improve administrative and reporting efficiency, and the strengthening of collaborative networks among related institutions. A comparative study with other regions, such as DKI Jakarta, suggests that the adoption of administrative innovations and the utilization of digital technology have significant potential in increasing the efficiency and expanding the reach of legal aid services. Therefore, this research recommends several concrete steps: (1) Conducting periodic revisions of the legal aid fee amounts, considering economic conditions and the characteristics of the cases. (2) Encouraging local governments to allocate supporting budgets in the Regional Revenue and Expenditure Budget (APBD) to support the sustainability of legal aid programs at the local level. (3) Enhancing the institutional capacity of Legal Aid Organizations (OBH) through continuous training programs, the utilization of technology in operations, and the strengthening of collaboration with various relevant parties. With the comprehensive implementation of these optimization strategies, it is expected that legal aid programs can reach impoverished communities more effectively and contribute to the realization of the principle of social justice in Indonesia.

Abstract

Security strategy in correctional facilities is a crucial aspect in preventing potential threats to safety and order. This study aims to analyze the implementation of Crime Prevention Through Environmental Design (CPTED) as a strategic approach to security at Class IIB Krui Detention Center. CPTED emphasizes the role of physical environment design and management in reducing crime opportunities and enhancing natural surveillance. This research uses a descriptive qualitative method with data collected through observation, interviews, and documentation. The results show that the security strategy at Class IIB Krui Detention Center has adopted CPTED principles such as natural surveillance, access control, and maintenance to create a secure and orderly environment. However, several challenges remain, including infrastructure limitations, human resource shortages, and budget constraints, which affect the effectiveness of the implementation. The study recommends capacity building for officers, utilizing surveillance technology, and improving spatial arrangements and physical facilities to optimally support CPTED principles. When properly applied, CPTED can serve as a strategic solution in creating a more preventive and efficient security system within correctional settings.

Abstract

Homosexual behavior and prostitution are social phenomena often encountered in correctional facilities, including Cipinang Class I Penitentiary. This study aims to examine the relationship between homosexual behavior and the reality of prostitution occurring within the prison environment. The research uses a qualitative approach with in-depth interviews with inmates and prison staff. The findings show that environmental factors, loneliness, and economic needs are the primary causes of homosexual behavior and prostitution in Cipinang Prison. The limited conditions in prison create social dynamics that affect sexual behavior, both among inmates and with outsiders. Furthermore, economic factors also drive prostitution, where some inmates engage in such activities for financial gain. This study is expected to provide new insights into the social dynamics within correctional facilities and contribute to policy development to address prostitution and homosexual behavior in prisons.

Abstract

This research analyzes the effectiveness of Gorontalo Province Regional Regulation No. 10 of 2014 concerning Smoke-Free Areas (KTR), identifies influencing factors, and formulates improvement efforts. Employing a normative empirical method with a sociology of law approach, the study examines the regulation's implementation in society. The findings indicate that the implementation of the KTR Regional Regulation is not yet effective. Smoking activities persist in KTR areas without significant action from authorities, despite stipulated sanctions. Factors hindering effectiveness include low public awareness, insufficient support from the government and law enforcement, minimal public participation, and limited funding and infrastructure. To enhance the effectiveness of the KTR Regional Regulation, the research recommends socialization efforts, inter-agency coordination, the establishment of a supervisory team, strict law enforcement, and clear sanctions for violators. Furthermore, it is crucial to increase public education and guidance regarding the dangers of smoking and the urgency of KTR. Recommendations for the public include complying with the KTR Regional Regulation, particularly in health facilities and schools. The Regional Government is expected to continue its socialization efforts. Effective enforcement of the KTR Regional Regulation is anticipated to improve the community's quality of life by making it healthier and free from cigarette smoke.

Abstract

This study seeks to assess the implementation of preventive measures by correctional officers through repressive actions toward inmates, with a focus on analyzing Article 466 of the Indonesian Penal Code (KUHP) within the framework of rehabilitation and crime prevention. Preventive approaches aim to mitigate the risk of future criminal behavior, while repressive measures are designed to deter recidivism by imposing consequences. This research adopts a qualitative methodology, utilizing data collection techniques such as literature reviews and in-depth interviews involving inmates and correctional officers. The findings reveal that the enforcement of Article 466 KUHP significantly contributes to inmate rehabilitation and crime prevention efforts, despite several challenges in its practical application. Consistent enforcement of regulations, coupled with a more humanistic approach, can help balance the protection of inmate rights with the overarching goals of rehabilitation. This study recommends enhancing the capacity of correctional officers through continuous training programs and periodic evaluations to improve the effectiveness of preventive approaches and repressive measures in reducing recidivism rates.

Abstract

This study aims to analyze the urgency of criminal reform against perpetrators of narcotics crimes, especially users, with a focus on the Gorontalo Province area. In practice, the criminal justice system in this area still tends to impose prison sentences on narcotics users, although Law Number 35 of 2009 on Narcotics opens up space for a rehabilitation approach. This study uses an empirical juridical method with a qualitative approach, involving interviews with law enforcement officials, rehabilitation officers, and observations at correctional institutions and BNNP Gorontalo. The results of the study show that the implementation of rehabilitation is still limited due to weak coordination between agencies, limited resources, and the non-optimal implementation of integrated assessments. As a result, many users are overcriminalized and lose the opportunity to recover socially and medically. This study emphasizes the need for criminal policy reform through a more humanistic, public health-based, and rehabilitative-oriented approach, not just punishment

Abstract

This study aims to examine and analyze the role of Legal Aid Organizations (OBH) in providing legal aid services to the poor in Gorontalo Province, as well as identifying the obstacles faced in its implementation. The background of this study is based on the principle of a state of law that guarantees the right to protection and access to justice for every citizen without discrimination, as regulated in Law Number 16 of 2011 concerning Legal Aid. This study uses an empirical legal method, with data collection techniques through observation, interviews, and documentation of OBHs active in the Gorontalo Province. The results of the study show that the role of OBHs is very significant in providing litigation and non-litigation legal assistance, as well as legal counseling to the poor. During the period 2022 to 2024, the number of cases handled and the budget absorbed showed a high increase and effectiveness, with a budget absorption rate of above 99%. However, there are several obstacles that hinder the effectiveness of services, such as budget limitations, lack of professional human resources, low legal literacy of the community, geographical constraints, administrative bureaucracy, and minimal support from local governments. Therefore, synergy is needed between the government, OBHs, and the community in strengthening an inclusive and equitable legal aid system.

Abstract

Perkembangan Generative artificial intelligence (AI) telah menimbulkan persoalan hukum baru terkait status perlindungan hak cipta atas karya yang dihasilkannya. Sistem hukum Indonesia belum memberikan kepastian hukum mengenai posisi karya AI, karena peraturan yang berlaku masih mengasumsikan manusia sebagai satu-satunya subjek hukum hak cipta. Rumusan masalah dalam penelitian ini diarahkan untuk menjawab pertanyaan mengenai apakah karya yang dihasilkan oleh sistem Generative AI dapat dikualifikasikan sebagai ciptaan yang dilindungi oleh hak cipta menurut peraturan perundang-undangan di Indonesia, serta bagaimana posisi hukum pengguna (user) terhadap karya tersebut, khususnya dalam kaitannya dengan klaim kepemilikan dan hak pemanfaatan karya hasil teknologi Generative AI. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan studi kepustakaan. Hasil analisis menunjukkan bahwa karya yang sepenuhnya dihasilkan AI belum memenuhi syarat perlindungan hak cipta, kecuali terdapat kontribusi kreatif manusia. Oleh karena itu, diperlukan reformasi regulasi untuk memberikan kepastian hukum yang adaptif terhadap perkembangan teknologi.

Abstract

This study aims to evaluate the implementation of the principle of legal certainty in the land certification process carried out by the Land Office of Buol Regency. The principle of legal certainty is a fundamental concept in a rule-of-law state that guarantees land rights in a fair, equitable, and transparent manner. The method used is normative legal research with statutory and conceptual approaches. Data were obtained through a literature review of laws and regulations as well as relevant legal literature. The research findings indicate that although the regulations regarding land certification are already available in a complete and clear form, their implementation at the local level still encounters various obstacles. These include inconsistencies in procedural application, lack of legal understanding among the public, weak protection for vulnerable groups, and the suboptimal state of land administration systems. Therefore, a comprehensive reform of land policies, capacity-building for government apparatus, and a participatory approach that ensures service inclusiveness are urgently needed. This evaluation is expected to contribute to the development of a more just land certification system that upholds legal certainty for all citizens.

Abstract

The development of digital technology has driven the increasing use of cryptocurrency in cybercrime in Indonesia. Cryptocurrencies such as Bitcoin and Ethereum offer anonymity and ease of global transfers without a central authority, making them attractive to cybercriminals. Unfortunately, regulations in Indonesia remain weak due to the absence of a strong legal framework, making it difficult to identify and track misuse. Law enforcement and the general public also lack understanding of how cryptocurrency works. This article uses a normative method by examining existing regulations and highlights the need for stricter rules and inter-agency cooperation to prevent the misuse of cryptocurrency in cybercrime.
