Abstract

Cooperatives (Koperasi) as a nature of business culture based on the concept of Indonesian society of mutual 'gotong royong' presence is still needed for the recent and imminent. Basic rules governing the cooperatives created during more than 10 years ago, although its execu1ive regulations made after much until now. The concept of law as the basis of the Cooperative Law of 1992 has much to be updated if the Indonesia cooperative as one of the enterprises is still expected to compete with other business entities in Indonesia and the international sphere. Some description has been offered in this article, shows that still so many things that are conceptually still need more studies in considering the existence of Act No.25 of 1992 on Cooperatives has lasted for about 18 years. Although government has issued implementing regulations and implementation of various rules, but as long as the basic provisions of the Law has not been a4justed to the wishes of the changes in the economy generally and the provisions of the particular business entity, the cooperative movement as a business entity is still insuffiCient and its existence cannot be thought to stand in line with other business entities either in Indonesia or, international community. ABSTRAK Penelitian ini bertujuan untuk mengetahui konsep hukum koperasi modern bagi koperasi sebagai organisasi perusahaan berstatus badan hukum sempurna. Metode yang digunakan dalam penelitian ini adalah metode penelitian hukum normatif serta menggunakan pendekatan secara perundang-undangan (statue approach) dan pendekatan secara analisis (analytical approach). Hasil penelitian menunjukkan bahwa koperasi sebagai salah satu hakikat budaya usaha yang berlandaskan konsep masyarakat Indonesia yang saling gotong royong keberadaannya masih diperlukan untuk saat ini dan yang akan datang. Peraturan dasar yang mengatur tentang koperasi dibuat selama lebih dari 10 tahun yang lalu, meskipun peraturan pelaksananya dibuat setelah jauh sampai sekarang. Konsep hukum sebagai dasar UU Koperasi 1992 banyak yang harus diperbarui jika koperasi Indonesia sebagai salah satu badan usaha masih diharapkan mampu bersaing dengan badan usaha lain di Indonesia dan dunia internasional. Beberapa uraian yang telah dikemukakan dalam artikel ini, menunjukkan bahwa masih banyak hal yang secara konseptual masih memerlukan kajian lebih lanjut mengingat keberadaan UU No.25 Tahun 1992 tentang Perkoperasian telah berlangsung selama kurang lebih 18 tahun. Walaupun pemerintah telah mengeluarkan peraturan pelaksanaan dan pelaksanaan berbagai aturan, namun selama ketentuan-ketentuan pokok Undang-Undang tersebut belum disesuaikan dengan keinginan perubahan perekonomian pada umumnya dan ketentuan badan usaha tertentu, maka gerakan koperasi sebagai suatu badan usaha masih belum memadai dan keberadaannya belum dapat dikatakan sejajar dengan badan usaha lain baik di Indonesia maupun dunia internasional. Abstract

The study's objective is to examine the evidence that can be used to prove cases of crimes revealed verbally in the criminal process. The normative research method used in this research focuses on literature reviews such as books, articles in scientific journals, explaining the applicable rules and regulations verbally. In this research, the author implemented legal product design by researching various types of legal provisions, especially regulations in the Criminal Code and Criminal Procedure Code. The results of the research show that verbal sexual understanding (catcalling) in everyday life still often occurs because there is normalization and patriarchal culture and a lack of public knowledge about verbal sexual disclosure. Everyone, both those directly affected and those who observe it, must have the courage to report acts of disclosing sexual verbal acts so that the public will be more alert and avoid worse criminal legal action. Reports on understanding verbal sexuality should be adjusted to evidence that can be accounted for based on Article 184 of the Criminal Procedure Code. The application of evidence that can be accounted for in accordance with the Criminal Procedure Law in catcalling cases can be in the form of witness statements, video recordings and screenshot evidence of comments that indicate verbal sexual disclosure. Abstrak Tujuan dari penelitian ini adalah untuk mengkaji alat bukti untuk dapat digunakan dalam pembuktian kasus kejahatan pelecehan seksual verbal dalam proses peradilan pidana. Metode penelitian normatif yang digunakan dalam penelitian ini yang berfokus terhadap kajian pustaka seperti buku-buku, artikel pada jurnal ilmiah peraturan dan ketentuan yang berlaku pelecehan seksual verbal. Dalam penelitian ini, penulis mengimplementasikan perancangan produk hukum dengan cara meneliti mengenai berbagai jenis ketentuan UU terutama peraturan dalam KUHP dan KUHAP. Hasil studi menunjukkan bahwa pemahaman seksual verbal (catcalling) dalam sehari-hari masih sering terjadi karena terdapat normalisasi serta budaya patriarki dan kurangnya pengetahuan masyarakat akan pelecehan seksual verbal. Setiap orang baik pihak yang terkena dampak langsung maupun pihak yang mengamatinya harus berani melaporkan tindakan pelecehan seksual verbal agar masyarakat lebih waspada dan menghindari terjadinya tindak hukum kejahatan yang lebih buruk. Laporan pelecehan seksual verbal sebaiknya disesuaikan dengan alat bukti yang dapat dipertanggungjawabkan berdasarkan Pasal 184 KUHAP. Penerapan alat bukti yang dapat dipertanggungjawabkan sesuai dengan Hukum Acara Pidana terhadap kasus catcalling dapat berupa keterangan saksi, rekaman video dan bukti screenshot dari komentar yang berindikasi pelecehan seksual verbal. Abstract

This article examines the rights and impacts of the acquisition of Hajj University on STIKes Nurliana workers so that the formulation of the problems raised include: what are the rights obtained by STIKes Nurliana workers after being transferred by Hajj University and how the positive and negative impacts obtained by STIKes Nurliana workers after being transferred by Hajj University. The method in this research uses empirical juridical methods with a qualitative approach. Collecting data and legal materials in this research using interviews, non-participant observation, and documentation. This research results in the conclusion that STIKes Nurliana workers have obtained their rights and obligations in accordance with PP No. 35 of 2021 and the Statute of Hajj University and the negative impact obtained by workers, namely increased workload and demands, but the negative impact is in line with the positive impact, namely promotion, income, and a better management environment. Abstrak Artikel ini mengkaji hak-hak dan dampak akuisisi Universitas Haji terhadap pekerja STIKes Nurliana sehingga rumusan masalah yang diangkat diantaranya: apa saja hak-hak yang didapatkan pekerja STIKes Nurliana setelah dialihkelola oleh Universitas haji dan bagaimana dampak positif dan negatif yang didapatkan oleh pekerja STIKes Nurliana setelah dialihkelola oleh Universitas haji. Metode dalam penelitian ini menggunakan metode yuridis empiris dengan pendekatan kualitatif. Pengumpulan data dan bahan hukum penelitian ini menggunakan metode wawancara, observasi nonpartisipan, dan dokumentasi. Penelitian ini menghasilkan kesimpulan yaitu para pekerja STIKes Nurliana telah mendapatkan hak dan kewajibannya sesuai dengan PP Nomor 35 tahun 2021 dan Statuta Universitas Haji serta dampak negatif yang didapatkan oleh pekerja yaitu pertambahan beban dan tuntutan kerja, akan tetapi dampak negatif tersebut sejalan dengan dampak positifnya yaitu kenaikan jabatan, pendapatan, dan lingkungan manajemen yang lebih baik.

Abstract

The use of e-commerce platforms for transactions involving buying and selling is gaining significant popularity in today's commerce. However, this development also raises a number of concerns regarding the legal protection provided to consumers and the obligations of the various parties involved. This study intends to shed light on the accountability of participants in online transactions as well as the legal recourse options open to customers who have lost money due to fraud or fraud. Research that uses normative juridical research means reviewing legal literature and conducting investigations using a normative framework. The extent to which the parties comply with the principle of freedom of contract determines the level of consumer protection and legal responsibility, based on practical realities. The liability of online business actors can be resolved in court by filing a lawsuit for the losses incurred. Penggunaan platform e-commerce untuk transaksi yang melibatkan pembelian dan penjualan semakin populer secara signifikan dalam perdagangan saat ini. Namun perkembangan ini juga menimbulkan sejumlah kekhawatiran mengenai perlindungan hukum yang diberikan kepada konsumen serta kewajiban berbagai pihak yang terlibat. Studi ini bermaksud untuk menjelaskan akuntabilitas peserta dalam transaksi online serta pilihan jalan hukum yang terbuka bagi pelanggan yang kehilangan uang akibat penipuan atau penipuan. Penelitian yang menggunakan penelitian yuridis normatif, artinya mengkaji literatur hukum dan melakukan penyelidikannya dengan menggunakan kerangka normatif. Sejauh mana para pihak mematuhi prinsip kebebasan berkontrak menentukan tingkat perlindungan dan tanggung jawab hukum konsumen, berdasarkan kenyataan praktis. Pertanggungjawaban pelaku usaha online dapat diselesaikan di pengadilan dengan mengajukan gugatan atas kerugian yang ditimbulkan. Abstract

The principle of Amicus Curiae or "Friend of the Court" is a legal concept that allows third parties to provide legal opinions to the court in a case, even though they are not directly involved. This principle has long been applied in the common law legal system, but is starting to be adopted in the civil law legal system, including in Indonesia. This research aims to understand the regulation of Amicus Curiae in the criminal justice system and its role in influencing judges' considerations in deciding cases in Indonesia. The method used is normative legal research with statutory, conceptual and comparative approaches. The research results show that even though it does not yet have an explicit legal basis in the Indonesian criminal justice system, Amicus Curiae has been used several times in important cases, such as the case of Prita Mulyasari and Richard Eliezer. The judge considers the opinion of the Amicus Curiae in the aspects of justice and social impact of a decision. In criminal procedural law, the existence of Amicus Curiae can enrich legal considerations with additional perspectives from experts or organizations that have an interest in the case. Even though it does not yet have strict regulations, Amicus Curiae is increasingly recognized as an important instrument in the Indonesian criminal justice system to achieve more objective and transparent justice. Further regulations are needed so that its use can be more optimal in the Indonesian legal system.

Abstract

The aim of this study is to examine how copyright is protected for spiritual songs used in online worship on YouTube media and what legal measures can be taken to protect the copyright of spiritual songs if there is a legal violation against them. This study uses normative legal research methods with a statutory approach. The results of the study show that Law of the Republic of Indonesia Number 28 of 2014 concerning Copyright regulates that Rohani songs are also creations that must be protected. A creator has the right to receive royalties if his work is used commercially by another party. Regarding the mechanism for withdrawing song royalties, it is regulated more clearly in Government Regulation (PP) Number 56 of 2021 concerning Management of Song and/or Music Copyright Royalties. There are two types of legal measures to overcome copyright violations of Rohani songs, namely preventive legal measures and repressive legal measures. ABSTRAK Tujuan studi ini adalah untuk mengkaji bagaimana Perlindungan Hak Cipta atas lagu Rohani yang dipakai dalam ibadah online pada media Youtube serta bagaimana upaya hukum yang dapat dilakukan untuk melindungi Hak Cipta lagu Rohani apabila terjadi pelanggaran hukum terhadapnya. Studi ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan. Hasil studi menunjukkan bahwa Undang-Undang Republik Indonesia Nomor 28 Tahun 2014 tentang Hak Cipta mengatur bahwa lagu Rohani juga merupakan suatu ciptaan yang harus dilindungi. Seorang pencipta berhak mendapatkan royalty apabila karya ciptaannya digunakan secara komersial oleh pihak lain. Mengenai mekanisme penarikan royalty lagu diatur secara lebih jelas di dalam Peraturan Pemerintah (PP) Nomor 56 Tahun 2021 tentang Pengelolaan Royalti Hak Cipta Lagu dan/atau Musik. Ada dua jenis upaya hukum untuk mengatasi pelanggaran hak cipta lagu Rohani yaitu upaya hukum preventif dan upaya hukum represif. Abstract

The goal of this study is to determine the responsibility of the expedition company for the missing of customer products and raise awareness about the legal protections for customers of expedition services who incur losses from lost property resulting from the carelessness of the expedition company, as well as to give clients a sense of security and comfort when using the services offered by the company. The main focus is how consumers feel their rights are fulfilled in the case of omissions committed of the shipping group. In the sphere of trade, the expedition group is crucial. Regarding the technology and information system utilized for transportation-related activities, shipping companies play an important role in society as a measure of the progress of life and civilization. On the other hand, freight forwarders often shirk their obligation to deliver merchandise to customers. A normative approach, or collecting and analyzing data through literature study, is used in writing this academic paper. Specifically, data relevant to the highlighted issues were obtained through literature study. The main sources of primary data for the preparation of this paper are academic papers related to regulations and legislation. Per Law No. 8 of 1999, companies must reimburse customers for damages they cause or for goods and services that do not meet established criteria. Restitution, replacement, or both may be required as part of the duty. ABSTRAK Tujuan dari penelitian ini adalah untuk mengetahui pertanggungjawaban perusahaan ekspedisi atas hilangnya barang konsumen dan meningkatkan kesadaran atas perlindungan hukum bagi pelanggan jasa ekspedisi yang mendapatkan kerugian akibat kehilangan barang yang diakibatkan oleh kecerobohan perusahaan ekspedisi, serta mempersembahkan rasa aman dan nyaman bagi pelanggan saat menggunakan jasa ekspedisi yang ditawarkan oleh perusahaan. Fokus utama adalah bagaimana konsumen merasa hak-nya terpenuhi apabila terjadi kelalaian yang disebabkan oleh perusahaan ekspedisi. Perusahaan ekspedisi memiliki kontribusi yang amat berarti dalam bidang perdagangan. Berkaitan tentang sistem informasi dan teknologi yang dimanfaatkan pada aktivitas yang berhubungan dengan transportasi, perusahaan ekspedisi memainkan peran penting dalam masyarakat sebagai pengukur kemajuan kehidupan dan peradaban. Di sisi lain, perusahaan ekspedisi sering kali melalaikan kewajiban mereka untuk mengirimkan barang dagangan kepada pelanggan. Pendekatan normatif, atau mengumpulkan dan menganalisis data melalui studi kepustakaan, digunakan dalam penulisan naskah akademis ini. Secara khusus, data yang relevan dengan masalah yang disoroti diperoleh melalui studi literatur. Sumber utama data primer untuk penyusunan makalah ini adalah naskah akademis yang terkait peraturan dan hukum. Perusahaan diwajibkan oleh UU No. 8 Tahun 1999 untuk mengganti kerugian yang mereka sebabkan terhadap pelanggan atau barang dan jasa yang tidak konsisten dengan pesanan. Restitusi, penggantian, atau keduanya mungkin diperlukan sebagai bagian dari kewajiban tersebut. Kata Kunci: Perusahaan Ekspedisi, Konsumen, Pertanggungjawaban
