Abstract

This study examines the environmental and criminal law policies in force in Indonesia, as well as the effectiveness of law enforcement in dealing with organized crime related to the trade in endangered fauna. Although existing regulations such as Law Number 5 of 1990 concerning Conservation of Natural Resources and Ecosystems and Law Number 32 of 2009 concerning Protection and Management of the Environment have regulated the protection of endangered fauna, this study found that its implementation in the field still faces various challenges, including weak coordination between law enforcement agencies, lack of human resources and technology, and limitations in enforcing criminal sanctions. Using the “deterrence theory” and “collaborative governance theory” approaches, this study analyzes how criminal sanctions and cross-sectoral cooperation can improve the effectiveness of law enforcement against organized crime. The results of the study show that although the criminal sanctions regulated are quite strict, their effectiveness is still weak due to the lack of certainty of enforcement and low collaboration between agencies. This study also highlights the importance of the role of local communities (Customary Institutions) and monitoring technology to support efforts to conserve endangered fauna in the TNKS area. This study provides strategic recommendations to strengthen law enforcement through increased inter-agency coordination, the use of more sophisticated monitoring technology, and expanding international cooperation to address organized crime networks operating across borders.

Abstract

This research aims to analyze the legal considerations that prevent a person from being convicted when accessing pornographic content and identify the implications that arise from the consumption of such content. The main focus of this research is how legal regulations in various countries, including Indonesia, regulate access to pornography and the extent of the application of criminal law. The research method used is a normative juridical method with a statute approach and conceptual approach. Data is obtained through literature study, including rules and regulations, court decisions, academic literature, and social media. The results show that the non-criminalization of individuals who access pornography is based on the principle of no crime without a clear legal basis and the right to individual privacy. Most regulations place more emphasis on criminalizing the production, distribution, and dissemination of pornographic content than personal consumption. However, some countries apply exceptions in some instances, such as the consumption of child pornography, which is expressly prohibited.

Abstract

The objective of this research is to analyze the implementation of the Regional Spatial Planning in North Lampung, focusing on the strategies for monitoring and controlling spatial planning that involve community participation. The research employs a qualitative methodology, with data collection conducted through interviews, observations, and literature studies. The findings indicate that although the local government has made efforts to involve the community in the decision-making process, the existing participation remains limited and tends to be procedural in nature. This results in a lack of transparency and adequate access to information for the community, which adversely affects the effectiveness of spatial planning. Constraints such as the quality of human resources and the availability of infrastructure also hinder the enhancement of community participation. This study recommends the necessity of strategic measures to actively engage the community at every stage of spatial planning, as well as to improve the community's capacity to understand the importance of their role in spatial management. It is hoped that these findings will contribute to the development of more inclusive and responsive policies that address community needs, while also fostering synergy among the government, the community, and the private sector in achieving sustainable development in North Lampung

Abstract

This study analyzes the application of the death penalty for drug traffickers in Indonesia from the perspective of Human Rights (HR). The research employs a qualitative approach, utilizing document analysis and interviews with legal experts, human rights activists, and policymakers to gather comprehensive insights into the implications of the death penalty. The findings indicate that although the death penalty is viewed as a stringent measure to combat drug-related crimes, its implementation often contradicts the principles of human rights guaranteed by the 1945 Constitution and international instruments. This research identifies the discrepancies between the death penalty policy and humanitarian values, highlighting that the death penalty has not proven effective in reducing drug crime rates. Furthermore, this study recommends policy reforms that focus more on rehabilitation and the protection of human rights. The results of this research are expected to contribute to the development of more humane and effective legal policies in addressing drug-related issues in Indonesia.

Abstract

This study aims to analyze the urgency of juvenile sentencing within the justice system, focusing on Decision No. 7/Pid.Sus-Anak/2023/PN.Kbu. The research employs a qualitative approach, specifically legal decision analysis, to examine the case. The findings indicate that criminal responsibility for perpetrators of sexual offenses against minors must consider various factors, both internal and external. In this case, the judge determined that the defendant was guilty of attempted sexual assault and imposed a two-year prison sentence at the Child Special Development Institution (LPKA). This decision reflects a rehabilitative approach that aligns with the child's right to education and social reintegration. Furthermore, the study identifies the lack of sex education and the influence of an unhealthy environment as contributing factors to the occurrence of sexual offenses. The study contributes to juvenile justice policy by highlighting the importance of integrating comprehensive sex education and family communication into legal frameworks to prevent juvenile delinquency. Therefore, a holistic approach is necessary, involving comprehensive sex education, open communication within families, and supervision of media influences and peer environments to prevent deviant behavior among children

Abstract

In the era of digitalization, transparency and accountability in public budget management are the main demands in realizing good governance. The Palangka Raya City Government seeks to improve the effectiveness and efficiency of budget governance by implementing a website-based information system. This system aims to facilitate access to financial information, increase public participation, and minimize the potential for budget abuse. This research uses an empirical juridical approach to evaluate the effectiveness of SIMTEPRA in improving transparency and accountability of budget management in Palangka Raya City. Data were collected through interviews, direct observation and literature review, and analyzed descriptively-qualitatively to link existing regulations with field findings and identify implementation constraints and opportunities. With this system, it is expected that public budget management can be more transparent, accountable, and responsive to community needs. However, the successful implementation of this information system is highly dependent on supporting regulations, the readiness of human resources, and adequate technological infrastructure. Therefore, further studies are needed to assess the extent to which this system has been effective in supporting the principles of good governance in Palangka Raya City. The results of this study have implications for strengthening budget digitization regulations, increasing human resource capacity, building IT infrastructure, and optimizing e-government to support transparency, accountability, and data-based policies
