Abstract

Abstract Law Number 3 of 2022 concerning the State Capital was established to realize the goals of the state as stated in the Preamble to the 1945 Constitution of the Republic of Indonesia. This study aims to determine the procedure for acquiring land in the IKN area and to analyze whether the regulations governing land acquisition in the IKN area have accommodated protection of local people's human rights. This research is a type of normative legal research, namely legal research conducted by researching and reviewing laws and regulations, using a statute approach and a conceptual approach. Data collection techniques are carried out by collecting primary legal data and secondary legal data. The results showed that the land acquisition procedure in the IKN area consisted of 2 (two) mechanisms, namely by releasing forest areas and through land acquisition mechanisms. The regulations governing the acquisition of land have not fully accommodated the human rights protection of the local community.

Abstract

Perkembangan kajian fiqh tentu berkaitan erat dengan pemahaman dalil hukum yang bersumber dari Alquran dan Sunnah/hadis. Adakalanya dalil satu hukum ketika dihadapkan dengan sebuah persoalan akan menemukan jawaban pada masalah tersebut. Begitupun, tidak sedikit dalil hukum yang bersumber dari Alquran khususnya berbeda ketentuan dan maksud dengan dalil lainnya yang pada akhirnya memunculkan perbedaan argumen. Disinilah pertentangan (ta’arudh) dalil terjadi dan saling berbenturan. Agar hal ini tidak miss persepsi, diperlukan metode memahami dalil secara spesifik agar persoalan suatu hukum tidak ditetapkan sembarangan. Mengingat perkembangan hukum Islam yang bergerak dinamis, maka pemahaman atas suatu hukum harus benar-benar sesuai prosedur agar ketentuan hukum pada satu dalil dengan dalil lainnya terdapat titik temu dan titik perbedaan yang signifikan yang memberi penyelesaian persoalan hukum.

Abstract

Setiap Negara bebas untuk melakukan kerjasama dalam bidang perdagangan dengan Negara mana pun guna meningkatkan perekonomiannya yang didasarkan pada kesepakatan World Trade Organization (WTO). Indonesia sebagai Negara anggota WTO juga telah mengikuti berbagai perjanjian perdagangan internasional baik yang bersifat bilateral maupun multilateral, salah satunya adalah Asean-China Free Trade Agreement (ACFTA). Banyaknya produk China yang masuk ke pasar Indonesia membuat Pemerintah Indonesia harus menjaga kepentingan nasional dengan memberlakukan standardisasi melalui Standar Nasional Indonesia (SNI). Penelitian ini membahas tentang bagaimana standar internasional atas produk barang dalam kerangka kesepakatan WTO, bagaimana kebijakan pemerintah tentang standardisasi barang dalam menghadapi ACFTA, dan bagaimana harmonisasi SNI dengan standar internasional berdasarkan kesepakatan WTO dalam rangka ACFTA. Penelitian ini merupakan penelitian yuridis normatif dengan menggunakan data sekunder dengan pendekatan peraturan perundang-undangan (statute approach) yang dianalisis melalui analisis kualitatif. Standar internasional atas barang melalui kesepakatan WTO kaitannya dengan ACFTA mengacu kepada perjanjian internasional yang telah disepakati melalui kesepakatan WTO yakni Agreement on the Application of Sanitary and Phyto-sanitary Measures (SPS) dan Agreement on Technical Barriers To Trade (TBT). Kebijakan Pemerintah Republik Indonesia tentang standardisasi barang dalam menyikapi ACFTA yakni membuat Undang-Undang mengenai Standardisasi dan Penilaian Kesesuaian Nomor 20 Tahun 2014 serta melakukan kerjasama dengan lembaga eksternal. Harmonisasi SNI dengan standar internasional dilakukan dengan menerapkan prinsip-prinsip Technical Barriers to Trade baik melalui adopsi maupun modifikasi.

Abstract

Pornography has such a negative impact on human life that there needs to be a concerted effort against pornography across society so that it does not lead to a denial of what it means to be human. In preparing this paper, secondary sources were examined using library search methods by analyzing Case No. 2661/Pid.Sus/2020/PN. The conclusion of the oral debate was that the legal regulation against the offense of distributing pornographic videos uploaded via social media was incorporated into the Criminal Code, then Law No. 11 of 2008 on Information and Electronic Transactions and Law No. 44 of 2008. is to be incorporated into Pornography is regulated. The implementation of prosecution for the offense of distributing pornographic videos uploaded via social media is based on the provisions of the Criminal Code, Article 27(1) of the Information and Electronic Transactions Law No. 19 of 2016. Distribution of pornographic videos uploaded via social media under Decision No. 2661/Pid.Sus/2020/PN. Mdn meets all elements of Section 29 of RI Act No. 44 of 2008 regarding Pornography.

Abstract

Indonesia has introduced a development planning system in which communities and stakeholders are directly involved in development agencies. This system is known as Musyawarah Rencana Pembangunan or MUSRENBANG. It reflects the national form of Indonesia as the democratic state; thus, all stakeholders are directly involved in the development planning process at village, sub-district, district, city and state level. Indonesia has introduced consultation on development planning as a form of participatory planning and has become a mandatory agenda item for all local governments. Participation from various stakeholders, including the community, is expected, but obstacles still face. On the one hand, the plans that are implemented tend to prioritize the physical needs of the area over improving the economy of the community. While many comments have been made regarding the implementation of MUSRENBANG, maximum community involvement can increase public confidence in local government.

Abstract

It is hoped that the crime of persecution, both severe and light persecution, can be resolved by using approaches that are capable of resolving the criminal act of persecution in the jurisdiction of the Barumun Tengah Police. For example, 3 (three) cases of persecution have been successfully resolved using a restorative justice approach. Currently, the settlement of criminal acts of persecution has prioritized the principle of restorative justice by mediating and paying compensation and medical expenses to victims. The problems in this study, namely: the legal regulation of a restorative justice approach in resolving criminal acts of persecution; the process of settlement with restorative justice against criminal acts of persecution at the Barumun Tengah Police; obstacles and efforts of investigators in resolving criminal acts of persecution through restorative justice at the Barumun Tengah Police. This research is a study of the legal theory of justice which is carried out by applying a scientific analytical process. The data used is secondary data which is supported by empirical data. The data used in legal research is sourced from primary, secondary, and tertiary legal materials. Secondary data collection was carried out using library research techniques and data collection tools in the form of document studies. Empirical data were collected using field study techniques and data were collected through in-depth interviews. Data analysis used qualitative methods. Conclusions are drawn using the inductive method. The results of the study show that: The legal arrangement of a restorative justice approach in resolving criminal acts of persecution to date, starting from the level of investigation, prosecution, to trial; The process of resolving with restorative justice against criminal acts of persecution at the Barumun Tengah Police, starting from the pre-restorative justice stage, restorative justice stage, and post-restorative justice stage; The most conspicuous obstacle is the legal culture barrier related to requests for compensation by the victim's family which the perpetrators cannot fulfill.

Abstract

The study demonstrates a correlation between the law in e-commerce consumer sale of goods with competition law, consumer welfare, and e-commerce. Because the existing underlying competition law theory is exclusively based on economic theory, there are several challenges in presenting some indicators of the distinct market of e-commerce for consumer sales of goods and using consumer welfare-based consumerism that promotes social justice and equity. The most important part of the e-commerce system, process, and structure is aided by highly advanced technological innovation from all supply, distribution, and information exchange processes towards the demand chain, which is the consumers. There are several dimensions with distinct stakeholders and actors at various levels to enable, support, perform, and produce multiple income streams from e-commerce. Sales of customer data often occur in e-commerce competition. This results in inconvenience to consumers who have transacted at an online store. Competition law needs to be tightened in order to provide comfort from the customer and seller side.

Abstract

One of the primary causes of traffic jams in Daerah Khusus Ibu kota (DKI) Jakarta is the high number of private vehicle ownership. The DKI Jakarta government has implemented a number of measures to reduce motorized vehicles, such as the "ganjil-genap" policy, progressive tariffs, and the provision of various forms of public transit as an alternative, to alleviate congestion. However, these efforts have not been able to reduce the number of private vehicle ownership in DKI JakartaThis study adopted qualitative research approach by utilizing the literature study methodology. The results shows that the high rate of private vehicle ownership in DKI Jakarta is caused by several factors: first, there are still loopholes for committing violations in every policy implemented by the DKI Jakarta government. Second, that private vehicle ownership is not just a means of transportation, but also a way of showing social class in people's lives. Third, the DKI Jakarta administration has not been able to offer public transportation that satisfies people's needs: safe, able to integrate all modes of transportation, as well as simple accessibility and the capacity to send passengers to their final destination.

Abstract

The passing of the Job Creation Law by the government is considered to show more partiality to investors or entrepreneurs and marginalizes labor rights, especially in terms of wages, Indonesia's goal to create and guarantee community welfare in accordance with the concept of the Welfare State (Welfare State) adopted becomes blurred.  This article focuses on the discussion related to the first the determination of the minimum wage submitted to the authority of the Governor and by referring to the economic growth of the Regions and inflation conditions of each Region. Second, the Decent Living Needs (KHL) is no longer an indicator of determining the minimum wage for workers. Third, the abolition of sectoral minimum wages previously in the Manpower Law. This article uses the Juridical-Normative research method. This article found that the Economic growth and inflation rate of each region / province vary. Thus the Minimum Wage cannot be equated between people in each region. In an effort to realize equality of position for employers, Law No. 6 of 2023 has denied the state's obligation to protect workers' rights, thus clashing with Article 27 paragraph (2) of the 1945 Constitution. The policy of abolishing the sectoral minimum wage in the Job Creation Law will cause inequality between sectors and cause a sense of injustice for workers.

Abstract

Despite Indonesia's ratification of the United Nations Convention against Corruption, 2003 (UNCAC, 2003), there are still some norms that have not been adequately accommodated by national anti-corruption laws, particularly concerning illicit enrichment. This legal study aims to examine the practical implementation of illicit enrichment as a corruption offense in Indonesia and propose the criminalization of illicit enrichment as a future corruption offense. The research methodology employed is normative juridical, which involves analyzing secondary data, with a focus on literature reviews and relevant legislation. The research findings and discussions indicate that the practice of illicit enrichment has been increasingly prevalent, as evidenced by cases involving defendants Bahasyim Assifie and Dhana Widyatmika, who were charged under different articles, namely Article 12 of the Anti-Corruption Law and Article 3 of the Anti-Money Laundering Law, which differ from the essence of illicit enrichment as outlined in UNCAC, 2003. Considering the enforcement practices, it is imperative to criminalize the act of unlawful enrichment or illicit enrichment through the revision of the Anti-Corruption Law or the Criminal Code.
