Abstract

The development of blockchain technology has led to the emergence of cryptocurrency as a new form of digital property. This has sparked discussions regarding its legal status and suitability as an object of muʿāmalah (transactions) within Islamic jurisprudence. The lack of a physical form (al-wujūd al-ḥissī) in crypto-assets raises questions about whether these digital entities meet the criteria for al-māl (property) as defined by Sharīʿah. This study aims to evaluate the legal status of cryptocurrency by examining its digital existence (al-wujūd al-ḥukmī). Furthermore, it assesses cryptocurrency’s compliance with classical fiqh principles and contemporary accounting standards. The research employs a qualitative methodology, utilizing a descriptive-analytical, library-based approach. The analysis integrates classical fiqh criteria—such as taqawwum (value), intifāʿ (benefit), imkān al-taslīm (possibility of delivery), and ḍamān (guarantee)—with asset-recognition parameters found in IFRS and US-GAAP, including identifiability, control, and future economic benefits. Data were gathered from fiqh literature, academic publications on crypto-assets, and international accounting standards. The findings indicate that cryptocurrency possesses legal existence (al-wujūd al-ḥukmī) through mechanisms of digital control, blockchain verification, and its ability to be reliably owned, transferred, and measured. These characteristics fulfill the essential elements of property in fiqh, particularly utility, transferability, and the guarantee of value. Additionally, the adoption of cryptocurrency offers socio-economic benefits, including financial inclusion, more efficient remittances, individual economic empowerment, and increased transactional transparency.

Abstract

The development of the modern legal system, which is moving towards positivism, has created a need for an approach that combines moral and spiritual dimensions to achieve justice. This study aims to evaluate the position of Tauhid as an epistemological foundation for sustainable legal development and to examine its application in the Indonesian legal system, incorporating an empirical sociological field study from Kampus Bertauhid Universitas Djuanda. The method employed is empirical sociological research combined with normative juridical analysis, utilising a philosophical and comparative approach. The findings indicate that Tauhid comprises three main epistemological dimensions: ontological, axiological, and praxeological, which serve as the foundation for creating a just legal system. The integration of monotheistic values has begun to be applied in several areas of national law, particularly in family law and Islamic economics, although it is still not evenly distributed across all legal aspects. This study develops a model of Sustainable Integrated Tauhidic Justice (STIJ), encompassing substantive, procedural, institutional, and cultural dimensions as a comprehensive analytical framework. The empirical study demonstrates that a legal approach based on Tauhid significantly strengthens inclusive and sustainable social justice within the Indonesian legal framework, particularly when supported by campus-based community awareness.

Abstract

This article examines the legal complexities of apartment units constructed on Building Rights (Hak Guna Bangunan, HGB) land in Indonesia, especially where HGB overlays State Land (Hak Pengelolaan Lahan, HPL). The current legal regime, grounded in Law No. 20 of 2011 on Flats and Government Regulation No. 18 of 2021, exposes vulnerabilities in the Horizontal Ownership of Strata Rights System (HMSRS) due to HGB’s temporal limitations. These constraints undermine strata ownership security, complicate land administration, and erode investor and occupant confidence. Using doctrinal and comparative methods, the study analyzes statutory frameworks, including Government Regulations No. 4 of 1988 and No. 40 of 1996, alongside post-Omnibus reforms. It situates the discussion within Indonesian agrarian law, property theory, and international apartment scholarship, highlighting tensions with constitutional mandates on social justice and equitable land use (Articles 28D(1), 28H, 33(3), and 34, 1945 Constitution). The article proposes a legal reconstruction model separating apartment units from underlying building rights via independent building certificates and a dedicated cadaster, enhancing legal certainty and aligning with modern land administration principles. This framework addresses gaps in strata governance, promoting legal resilience, investor protection, and social equity amid Indonesia’s agrarian reforms and urbanization.

Abstract

Islamic values constitute an essential foundation in shaping the character and behavior of Muslims. However, many members of society have limited understanding and practice of these values in their daily lives, a condition exacerbated by restricted access to formal religious education such as madrasahs. This study aims to explore the process of internalizing Islamic values through the Majlis Gerakan Shalat Berjamaah (GSB), the factors influencing its effectiveness, and the implications of participation in GSB for the appreciation and practice of Islamic values among members and the wider community. This study employs a descriptive qualitative approach. Data were collected through observation, in-depth interviews, and document analysis tailored to field phenomena. The internalization of Islamic values within GSB is carried out through invitations to perform congregational dawn prayers (Shalat Subuh berjamaah), followed by spiritual studies led by Kiai, and implemented consistently (istiqomah). Factors influencing the effectiveness of this internalization include the role of GSB leaders and the enthusiasm of the congregation. The positive impact of participation in GSB is reflected in increased worship motivation among members and a growing number of congregants attending the mosque.

Abstract

This study aims to describe the model of internalizing prophetic leadership values in Islamic Religious Education learning through the “Morning Kultum” activity at SMA Al-Furqon Jember. The research is grounded in the school’s need to develop students who are not only academically competent but also possess Islamic character and leadership skills relevant to contemporary challenges. Using a descriptive qualitative approach, data were collected through observations, interviews, and documentation, then analyzed through data reduction, data display, and conclusion drawing, with validity ensured through triangulation. The findings indicate that the morning kultum serves as an effective medium for internalizing prophetic leadership values including trustworthiness, exemplary conduct, moral courage, discipline, and character building by engaging students directly in preparing, delivering, and reflecting on kultum material. Teachers act as facilitators who provide guidance, direction, and motivational support, enabling the internalization process to occur naturally and continuously. This activity enhances students’ communication skills, confidence, religious character, and visionary mindset aligned with the principles of rahmatan lil ‘alamin. The study recommends the development of varied themes, methods, and evaluation mechanisms to strengthen the morning kultum as a sustainable and adaptive model for Islamic character formation in schools.
