Abstract

Attention to Islamic architectural monuments built and rebuilt in Turkestan in the early XIX–XX centuries is increasing. Along with the demolition of mosques, madrassahs, tombs, and tombs in the territory of Turkestan at that time, the issue of their preservation was on the agenda. Study, the transfer to the next generations of the scientific and spiritual heritage related to the Islamic religion and its influence on the formation of the architectural culture inherent in the way of life, customs and traditions of the peoples of the world for millennia, is one of the most urgent tasks of today. Abstract

Fenomena membolos sekolah di kalangan pelajar SMA di Kota Bontang menunjukkan kompleksitas sosial yang tidak bisa dipahami hanya sebagai bentuk pelanggaran disiplin semata. Kota industri ini, dengan ritme kerja orang tua yang tinggi dan minimnya interaksi keluarga, menjadi konteks penting dalam memahami tumbuhnya perilaku menyimpang remaja. Penelitian ini berangkat dari rumusan masalah: bagaimana interaksi sosial, desain ruang publik, dan struktur kelompok sebaya mempengaruhi perilaku membolos? Dengan menggunakan pendekatan kualitatif deskriptif, penelitian ini mengacu pada teori asosiasi diferensial dari Edwin Sutherland. Data dikumpulkan melalui wawancara mendalam terhadap pelajar SMA Negeri 3 Bontang, guru BK, orang tua, Satpol PP, dan pelaku lingkungan sekitar Pujasera BSD—lokasi utama remaja membolos. Temuan menunjukkan bahwa perilaku membolos tidak bersifat individual, melainkan terorganisasi melalui grup WhatsApp yang memiliki norma internal sendiri, memperkuat identitas sosial sebagai “anak pembolos”. Desain ruang publik yang permisif, lemahnya kontrol sosial, serta tekanan kelompok sebaya berkontribusi besar dalam melanggengkan perilaku tersebut. Penelitian ini menyarankan perlunya pendekatan restoratif yang berbasis pada pemulihan relasi siswa dengan sekolah dan keluarga, serta intervensi lintas sektor dalam mengelola ruang sosial remaja.

Abstract

Penelitian ini membahas keadilan dalam perjanjian royalti antara penulis lagu dan penyanyi di industri musik Indonesia. Dalam praktiknya, penulis lagu seringkali berada dalam posisi yang lemah secara kontraktual, sehingga hak ekonominya tidak terdistribusi secara adil. Studi ini menggunakan pendekatan yuridis normatif dengan analisis terhadap peraturan perundang-undangan, teori keadilan distributif John Rawls, serta teori kontrak. Hasil penelitian menunjukkan bahwa perjanjian royalti umumnya disusun tanpa proses negosiasi yang setara, di mana posisi tawar penyanyi atau produser lebih dominan dibanding pencipta lagu. Hal ini mengakibatkan ketidakseimbangan dalam pembagian royalti, meskipun Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta secara normatif menjamin hak ekonomi pencipta. Kelemahan struktural juga tampak pada peran Lembaga Manajemen Kolektif (LMK) yang belum optimal dalam melindungi kepentingan penulis lagu. Selain itu, minimnya standar baku dalam perjanjian turut memperbesar potensi penyalahgunaan kekuasaan kontraktual. Penelitian ini merekomendasikan perlunya penguatan regulasi terkait mekanisme pembagian royalti, pembuatan standar perjanjian yang adil, serta peningkatan kapasitas LMK sebagai aktor pelindung hak pencipta. Upaya tersebut diharapkan dapat menciptakan sistem kontraktual yang lebih berkeadilan dan mendukung ekosistem musik yang inklusif dan berkelanjutan.
