Abstract

The Drug Clean Village Program (Bersinar) is a program that implements advocacy and dissemination activities. Advocacy here is to provide understanding to the public about the adverse effects of narcotics abuse through outreach in the community. This activity was carried out by a team of Field Line officers as described above and also involved important figures as resource persons, such as the BNNK and the Police. The targets and objectives of this activity are all elements in the village, both for the village community and village officials. Continuing the Dissemination activity, this activity contains coaching and empowerment activities for the Village community. This activity is carried out by a team of Recovery Agents. The targets of this activity are victims of narcotics abuse who have attended community-based rehabilitation and/or recovery services, youth and families who have problems with drug use disorders in one of their members.

Abstract

Agencies engaged in the field of public services under the government, especially in paying taxes, should provide good performance and service, so as to provide good organizational effectiveness as well, bearing in mind that taxes are one of the major revenues of the State. Where, if the government improves services in paying taxes, it will increase public interest in paying taxes.

Abstract

Legal online loan services (Pindar) are growing rapidly in Indonesia as an alternative financing solution that is easily accessible to the public. However, along with this growth, various violations have emerged by licensed operators, especially in billing practices that are not in accordance with the provisions of the Financial Services Authority (OJK). This research aims to analyze the regulations that must be complied with by legal pindar operators in accordance with POJK Number 40 of 2024 and examine the sanctions that can be imposed for violations of these regulations. The method used for this research are normative juridical with a statutory approach and a case approach. Data was obtained through literature studies from various regulations and legal literature. The results of the study show that the organizer is obliged to comply with the operational, administrative, and ethical billing provisions set by the OJK. In the event of a violation, the OJK can impose administrative sanctions, ranging from written warnings, freezing or restricting business activities, to the revocation of operational licenses. This research provides a theoretical contribution by clarifying the legal obligations of the organizer and adding to the legal literature regarding the supervision of the fintech lending sector. Practically, the results of this study are important for regulators in enforcing compliance and improving protection for the pindar service user community. The results of the study show that there are still rampant violations committed by the organizers, despite administrative sanctions given by the OJK, ranging from written warnings, freezing of business activities, fines, to revocation of operational permits. This shows that the strengthening of regulations has not been fully accompanied by the discipline of business actors in complying with the rules.

Abstract

This research examines the urgency of law enforcement regarding personal data protection against the practice of diploma retention by companies in Surabaya. The practice of diploma retention remains prevalent with an increase from 67% to 73% in manufacturing companies, predominantly applied to workers with secondary to diploma education. This study aims to analyze diploma retention practices from the perspective of Law Number 27 of 2022 on Personal Data Protection and its implications for Indonesia's constitutional system. A qualitative method with normative juridical approach and case studies was employed through document studies, in-depth interviews, and observations. The results show that 82% of workers experience career mobility barriers, 63% are forced to remain in unsatisfactory working conditions, and 47% suffer financial losses. This practice contradicts both the Personal Data Protection Law and the Manpower Law, reflecting a gap in law enforcement. Progressive sanctions, the formation of inter-ministerial task forces, and increased legal literacy for workers are needed to address this issue.

Abstract

The 24-hour operation of dining establishments during Ramadan requires special attention due to consumer demand for meal services during sahur and iftar, as well as government regulations regarding business operating hours. This study employs a case study method by examining the operational permits of dining establishments in a major city in Indonesia that enforces specific policies during Ramadan. The focus of this research is to analyze how these policies are implemented, their impact on business owners, and consumer reactions to the prevailing regulations. On the other hand, government policies restricting the operating hours of restaurants and food stalls during fasting hours in Ramadan aim to respect the practice of fasting and maintain social order. This study seeks to analyze how Mie Gacoan responds to these policies and adjusts its operations to meet consumer needs while complying with the applicable regulations. The findings indicate that Mie Gacoan’s success in managing operational permits during Ramadan heavily depends on its strategies for adjusting opening hours and providing services that consider social sensitivities.

Abstract

This research analyzes The increase in business transactions in the digital era has led to the birth of complex business disputes that require quick and efficient resolution. This study aims to analyze the urgency of regulating Online Dispute Resolution (ODR) in Indonesia, its potential benefits, and implementation challenges. Using a normative juridical approach and descriptive-qualitative analysis, this study focuses on national regulations, such as Law No. 30/1999 on Arbitration and Alternative Dispute Resolution and ITE Law, which although relevant, have not regulated the technical implementation of ODR in detail. The results show that ODR offers cost and time efficiency, accessibility without location restrictions, and flexibility in choosing a dispute resolution forum. However, challenges such as legal disparities between countries, limited technological infrastructure, and personal data protection are significant obstacles. This research confirms that specific ODR regulations are needed to provide legal certainty and support effective online dispute resolution, especially in the context of cross-border e-commerce. With proper regulation, ODR can become an innovative and competitive alternative to dispute resolution in Indonesia.

Abstract

This study analyzes the legal protection of children of Indonesian Migrant Workers (TKI) who become victims of theft in Blitar Regency. These children are particularly vulnerable and require adequate protection to ensure their rights and safety. Using an empirical legal method with a descriptive approach, data were collected through interviews, analysis of relevant laws, and case document reviews. The findings indicate that despite existing legal frameworks, implementation remains weak due to limited public awareness and inadequate law enforcement. Challenges also arise from the lack of cooperation among institutions and insufficient resources. The study recommends strengthening legal education on children's rights, enhancing institutional collaboration, and improving the capacity of legal authorities in handling cases involving TKI children. These efforts are essential to ensure more effective legal protection and to prevent further victimization of children in similar situations.

Abstract

This study examines the legal enforcement aspects of land rights registration management as a fundamental requirement for ensuring legal certainty and protection for rights holders. Under Law Number 4 of 1996 on Mortgage Rights, only registered land rights may legally serve as collateral for debt. The focus of this research is to analyze the implementation of use rights registration in Malang City and its impact on the enforcement of mortgage rights. The research employs both normative and empirical legal approaches, with data collected through literature review and interviews with relevant stakeholders. The findings reveal that a significant portion of the population has yet to register their use rights, rendering those rights ineligible as legal collateral. Contributing factors include limited public awareness, administrative obstacles, and insufficient outreach from responsible agencies. This study highlights the urgent need to enhance legal awareness and improve land administration services to support the effective and legitimate implementation of mortgage rights.

Abstract

The aim of this research is to provide information to every actor buying and selling land regarding the binding agreement between the parties regarding the price and land used as the object of sale and purchase and to provide information to each actor buying and selling land regarding the rights and obligations inherent after the price and land used as the object of sale and purchase are agreed upon. This research uses a qualitative approach, researchers not only collect data in terms of quality, but also want to gain a deeper understanding behind the phenomena obtained. This is because qualitative research has a close relationship with social reality and human behavior. The qualitative approach aims to explore or build a proposition or explain the meaning behind reality. The word agreement or agreement as one of the conditions regulated, determined and contained in Article 1320 which is realized and created by the Seller and the Buyer in the sale and purchase of privately owned land, is not carried out at random, but must fulfill the conditions, one of which is regulated, determined and contained in Article 1321 of the Civil Code.
