Abstract

Indonesia's political party reporting especially during the election period is not yet accountable, transparent, and leads directly to corruption. And preventive and repressive measures to detect fraudulent reporting have not been done with the maximum on a cadre of both the political and the political party themselves. Such a situation would require the government to devise a strategy for the political party's financial checkups through forensic audits as applied in several countries, including Nigeria. The study aims to examine the model against the corruption of the political party done by Nigeria through its forensic audits and compartmentalizing its application in Indonesia. The author used normative-approach juridical methods with two approaches: the statute approach and comparative approach. The study raised two major issues. First, how is the corruption of political parties that occurred in Indonesia and Nigeria during the election period? Second, how does the forensic audit in Indonesia and Nigeria help to stop the corruption of the political party? Studies have shown that political corruption in both Indonesia and Nigeria consists mainly of bribery, votes buying, and cheating in reporting on party campaigns. The forensic audit is one of the most effective efforts to prevent and treat the political party's corruption through fraud detection coupled with increased independent forensic audit team to ensure healthy political finances.

Abstract

In Indonesia although marital rape is not specifically definedm there are laws and regulations that govern this issue. Similarly Singapore regulated rape in a broader sense. In singapore, rape is a crime for which an arrest can be made without a warrant. Under the singapore penal code prior to its amandment, rape by a husband against his wife was not recognized as a crime except under certain conditions. The research problem formulated in this study is the regulation of the crime of marital rape under Indonesia and singapore penal code. The research method used to discuss and analyze this issue is normative legal research whit a statutory approach and comparative approach. The results of the study show that the regulation of marital rape in Indonesia can be found in the law on the elimination of domestic violance (uu pkdrt), law on sexual violance crimes (uu tpks), and the national criminal code. Meanwhile, singapore regulation regarding marital rape can be found in section 375 act 15 of 2019 of the singapore penal code. The fundamental difference in the regulation of marital rape between the two countries lies in the subjects and objects related to the crime. In Indonesia, there is generally no distinction between the subject and object based on gender. In contrast, Singapore recognizes only males as potential perpetrators and females as potential victims. Neother ondonesia nor singapore provides a clear definition of marital rape, however, both countries recognize that forced sexual intercourse contitutes a crime

Abstract

Sentencing disparities are not confined to general courts but are also evident within the Mahkamah Syar’iyah. Notable inconsistencies can be seen in several cases adjudicated by the Mahkamah Syar’iyah Lhokseumawe. In Case No. 10/JN/2018/MS.Lsm, the defendant was sentenced to 20 lashes; in Case No. 9/JN/2018/MS.Lsm, to 25 lashes; and in Case No. 1/JN/2020/MS.Lsm, to a fine of 25 grams of pure gold. All cases were prosecuted under Article 16(1) of Aceh Qanun No. 6 of 2014 on Jinayat Law. This article investigates judicial approaches to sentencing in cases involving jarimah (criminal acts) related to the sale and storage of alcoholic beverages (Khamar) in the Mahkamah Syar’iyah Lhokseumawe. Employing an empirical juridical method, the study draws on document analysis and interviews, using a descriptive-analytical framework. Both primary and secondary data are used to depict the legal reality and are subsequently analysed with reference to statutory regulations and legal theories. The findings indicate that disparities in sentencing arise due to the Qanun’s provision of only maximum penalties, granting judges broad discretion in determining sentences. Factors such as the defendant’s background influence judicial reasoning and may lead to divergence in punishment. These differences often generate debate within judicial panels prior to verdicts. Therefore, judges must ensure objectivity by thoroughly considering all evidentiary elements including witness testimonies, documents, and physical evidence, based on facts established during the trial

Abstract

Anak harus dilindungi karena dalam dirinya melekat harkat, martabat, dan hak-hak yang harus dihormati. Salah satu bentuk perlindungan tersebut adalah menjamin kerahasiaan identitas anak yang berhadapan dengan hukum. Perlindungan ini telah diatur secara tegas dalam Undang-Undang Nomor 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak dan Undang-Undang Nomor 35 Tahun 2014 tentang Perlindungan Anak. Namun, dalam praktiknya masih ditemukan putusan pengadilan yang memuat identitas anak, seperti nama dan alamat, dalam Direktori Putusan Mahkamah Agung. Penelitian ini bertujuan untuk mengetahui perlindungan hukum terhadap anak terkait pengungkapan identitas dalam proses persidangan serta konsekuensi hukum bagi pihak yang mempublikasikannya. Metode penelitian yang digunakan adalah yuridis empiris dengan pendekatan kualitatif. Hasil penelitian menunjukkan bahwa perlindungan hukum terhadap identitas anak belum sepenuhnya dilaksanakan karena gangguan sistem dan kurangnya pengawasan dari pihak pengadilan. Diperlukan pembenahan sistem dan penguatan pengawasan agar identitas anak tetap terlindungi. Pihak yang mempublikasikan identitas anak dapat dikenai sanksi pidana berdasarkan Pasal 19 dan Pasal 97 Undang-Undang Nomor 11 Tahun 2012 serta sanksi administratif sesuai peraturan perundang-undangan yang berlaku

Abstract

Diskresi merupakan kewenangan yang diberikan oleh Undang-Undang terhadap aparat penegak hukum, untuk bertindak dan mengambil keputusan menurut penilaiannya sendiri, telah diatur dalam Pasal 18 Undang-Undang No 2 Tahun 2002 tentang Kepolisian. Kewenangan diskresi diberikan untuk memudahkan aparat penegak hukum mengatasi permasalahan yang tidak diatur, atau tidak diatur secara terperinci dalam peraturan perundang-undangan. Di Polresta Padang, perkara KDRT merupakan perkara yang paling banyak diselesaikan dengan diskresi. Permasalahan yang dibahas adalah, faktor apa saja yang mempengaruhi pelaksanaan diskresi pada perkara KDRT dan apa kendala serta upaya mengatasi kendala pada saat pelaksanaan diskresi pada penyelesaian perkara KDRT di Polresta Padang. Metode penelitian yang digunakan dalam penelitian ini yaitu Yuridis Empiris. Dari hasil penelitian, pelaksanaan diskresi pada perkara KDRT dipengaruhi oleh faktor internal dan faktor eksternal. Faktor internal yaitu: faktor substansi hukum, faktor petugas yang menangani perkara, dan faktor fasilitas. Faktor eksternal, yaitu: persetujuan dari pelapor agar perkara didiskresikan, dan faktor ekonomi. Hambatan yang ditemukan pada pelaksanaan diskresi oleh tim penyidik, diantaranya: adanya intervensi dari pihak ketiga, sulit untuk mendapatkan bukti, emosi dan trauma yang dihadapi oleh korban, stigma negative dari masyarakat terhadap aparat penegak hukum. Upaya yang dilakukan penyidik kepolisian untuk mengatasi kendala, yaitu: memberikan penjelasan kepada korban terkait alasan mengapa penggunaan diskresi disarankan pada perkara yang sedang dihadapi, mengidentifikasi bukti/saksi yang diduga mengetahui permasalahan para pihak yang berperkara, memberikan kenyamanan dan rasa aman terhadap korban, serta memberikan sosialisasi dan edukasi kepada masyarakat terkait dengan penanganan perkara KDRT dan penggunaan diskresi oleh kepolisian.

Abstract

Children Victims of Physical Violence are children who experience violence with pain, illness or serious injury. In Indonesia, physical violence against children is the second most common form of violence after sexual violence. However, seeing the surge in cases that continue to increase, especially cases of physical violence against children, raises a question regarding the role of this the PPA Unit of the Payakumbuh Police. Therefore, the formulation of the problem that will be discussed in this study is how is the role of the PPA unit of the Payakumbuh Police in providing protection for children victims of physical violence This research uses a sociological juridical method with the nature of descriptive research analysis. The results of the study show that the role of the Payakumbuh Police PPA Unit in an effort to provide protection, namely through mentoring, providing motivation and cooperating with related parties. Assistance to children victims of physical crimes at the Payakumbuh Police has been carried out since the report and/or complaint was received by the PPA Unit. This is mandatory to provide protection for victims both in prevention, mentoring, medical rehabilitation and social rehabilitation efforts which are the rights of children victims of physical violence. The obstacles experienced by this unit are in terms of victims, personnel, facilities, and the Special Service Room. The solution carried out by the Payakumbuh Police is to synergize between PPA personnel and the Payakumbuh Police, approach the victim, provide knowledge to personnel and utilize existing facilities

Abstract

Deforestation in Indonesia is a serious issue that has broad impacts on both environmental and legal aspects. One of the main contributing factors is the conversion of forest areas into plantation land without official permits. This act is regulated under Law Number 18 of 2013 concerning the Prevention and Eradication of Forest Destruction and Law Number 6 of 2023 concerning the Job Creation Law. One notable case reflecting this issue is the Timbul Hasibuan case in Nagari Air Bangis, West Pasaman Regency, decided through the Padang District Court Decision Number 789/Pid.B/LH/2023/PN.Pdg, in which the defendant was found guilty of conducting plantation activities within a forest area without a business permit. This study aims to identify the legal considerations of the judges in rendering their decision and to analyze the evidentiary process applied in the case. The research employs a normative juridical method with a descriptive-analytical approach, using both case and statute approaches. Secondary data were used and processed through a legal data editing technique. The results indicate that the panel of judges based their decision on juridical considerations, including the indictment, witness testimonies, evidence, and criminal law provisions, as well as non-juridical considerations such as the defendant’s background and personal condition. However, it was found that relevant facts, such as the defendant’s tax payments and the selective enforcement of law by authorities were not fully considered. Moreover, the ultimum remedium principle in forestry criminal law after the enactment of the Job Creation Law has not been optimally implemented. Therefore, this study emphasizes the need for a more selective, objective, proportional, and equitable enforcement of forestry criminal law to ensure justice for communities living around forest areas.

Abstract

This study examines the function of judex facti exercised by the High Court in narcotics criminal cases, with a particular focus on the appellate decision Number 130/PID.SUS/2023/PT DKI involving a high-ranking law enforcement officer. Within the Indonesian legal system, the High Court is mandated to perform a substantive corrective role by re-evaluating facts and evidentiary materials, including digital evidence, to ensure both procedural and substantive justice. Employing a normative juridical approach, this research analyzes statutory regulations, legal doctrines, and relevant judicial decisions. The findings reveal that the High Court failed to exercise its corrective function effectively: no forensic verification was conducted on digital evidence, the defendant's confession was accepted without independent corroboration, and the standards for digital evidence as stipulated in Supreme Court Regulation No. 4 of 2020 were disregarded. As a result, the appellate ruling merely confirmed the first-instance judgment without substantive reconsideration. This study recommends an amendment to the Indonesian Code of Criminal Procedure (KUHAP) to explicitly regulate digital evidence, alongside the development of technical guidelines and capacity building for judges in assessing electronic evidence. Such reforms are essential to reinforce judicial accountability and safeguard impartial justice in narcotics cases involving institutional actors.
