Abstract

This paper discusses the Islamic inheritance system, especially substitute heirs by focusing on The Determination of PA Makassar No. 3 / Pdt.P / 2011 / PA. Mks. The discussion will focus on two things, are: (1) the position of grandchildren as substitute heirs in the Islamic inheritance system according to the Compilation of Islamic Law, and (2) judicial legal considerations in determining substitute heirs in accordance with Compilation of Islamic Law. At the end of the paper, there are two things are concluded. First, Article 185 KHI explains that grandchildren can occupy the position of substitute heirs and change the position of their parents, and will receive the inheritance portion of a number of shares obtained by their parents if he were still alive. Second, distribution of inheritance, normatively, can only be done according to the provisions contained in the Qur'an and hadith. But in fact often the people in the distribution of inheritance do it peacefully, and have been accommodated by Article 183 Compilation of Islamic Law.

Abstract

The criminal acts that often happen in people's lives are related to a violent crime, one of which occurred in Duduk Sampean Gresik, which has the court decision. This paper aims to analyze the decision of the Gresik district court regarding the violent crime that occurred in Duduk Sampean. This paper concludes three things in this research, namely: (1) the three individuals are Muslims and they are mukallaf who are responsible for their jari>mah (Illegal act or ommission), their action is classified as jari>mah tawa>fuq so that each one is only responsible for their owns actions; (2) the imprisonment imposed by the Gresik District Court is classified as a ta'zi>r sentence which falls under the authority of ulil amri or the government even though it has been freed from the qis}a>s punishment and diyah for getting forgiveness; and (3) the restitution received by the victim constitutes the realization of the legal liability of the offender for obtaining forgiveness.

Abstract

Perubahan adalah sebuah keniscayaan, yang harus disikapi oleh hukum Islam dalam bentuk ijtiha>d. Akan tetapi dalam kondisi seperti ini justru muncul sikap taqli>d, yang menghasilkan “masa jumud”. Tulisan ini hadir berusaha mencari pemahaman secara komprehensif tentang “taqli>d dan ijtiha>d” dalam prespektif historis, atau lintasan sejarah pemikiran hukum Islam. Di akhir tulisan disimpulkan bahwa “masa jumud” hukum Islam dikarenakan: (1) wilayah kekuasaan Islam yang semakin luas, (2) perpecahan pemerintahan Islam, (3) asumsi Hukum Islam sudah terkodifikasi secara mapan, dan (4) munculnya kelompok pemberi fatwa yang serampangan. Sebagai respon maka pada masa modern para pemikir muslim kontemporer menggalakkkan adanya reaktualisasi ajaran Islam dan reinterpretasi terhadap nas}s}-nas}s} yang sudah ada, dengan harapan akan akan diperoleh konklusi hukum yang lebih akomodatif (mampu menjawab tantangan zaman), yang ditandai dengan ragam munculnya problematika aktual yang membutuhkan legitimasi dari hukum Islam.

Abstract

This article is based on field research aims to answer the question of the influence of Islamic Law on prohibiting liquor (Tuak) towards community behavior of Boto Village in Semanding district of Tuban Regency. It also strives to analyze the factors that contribute to mold people's behavior. The approach of this research is combining a quantitative survey and qualitative research methods, with data analysis techniques in the form of analytical descriptive. The results of the study conclude that Islamic law is incapable of fashioning the actual behavior of its adherents, especially in the village of Boto. The prohibitions of liquor (tuak) failed to stimulate the behavior of rural communities under Islamic legal norms. This is indicated by the lack of community response to Islamic legal norms. On the contrary, it is conclusively found that the behavior of the majority of people deviates from the Islamic provisions of legal norms about the prohibition of liquor (tuak).

Abstract

The Islamic world which was formerly strong and glorious has become one of the colonies of Western nations. This unquestionably impacts many countries that they are no longer want to use Islam as a form of their government, but prefer the concept of the nation (nation-state). Even among Muslims scholars, the concept of Islamic governance is still debatable and questionable. One of the Muslim scholars who concur with the idea of the Islamic government is Muhammad Yusuf Musa, a lecturer at Al-Azhar Egypt, a graduate on Philosophy at the Faculty of Humanities at the University of Paris. This paper aims to find out Muhammad Yusuf Musa's thoughts about the Islamic government. The research found that according to Muhammad Yusuf Musa, the objectives of the Islamic government are (1) maintaining God's message on earth, and (2) improving human welfare by maintaining the unity and integrity of the people, helping each other and protecting the country from aggression and tyranny. Furthermore, the administration of the Islamic government demands two things, namely justice and shura. According to Musa, a leader must be chosen by the people, not by the appointment of the previous leader.

Abstract

The tide of democratization in Indonesia has radically changed the structure of Indonesian politics since the overthrown of New Order government by the reform movement in 1998. One important change is the essential vitality of parliamentary politics in Indonesia. In the era of Abdurrahman Wahid's government, the DPR's role was more independent and had a loud voice constraining the executive's running. As a result, the Indonesian constitution which is based on the Presidential system seems to have deviated to being a Parliamentary System. An example of tension is the birth of a memorandum. This paper seeks to examine the "Memorandum during the Government of Abdurrahman Wahid" from the perspective of Islamic State Administration Law. This paper concludes based on the Islamic State Administration Law that the Abdurrahman Wahid's Government Memorandum is invalid because the warning or redressal requirements for a president must be preceded by evidence of deviation from religion.

Abstract

Health is a basic right of the people of Indonesia, as stated in Article 28 (h) of the 1945 Constitution. In practice, efforts to improve the well-being in the health sector are not only exercised in modern ways but also with alternative medicine efforts, by using various kinds of unconventional treatment, both medical and treatment products. This paper aims to find out the pattern of legal relations between the parties in the operation of alternative medical clinics without permission. it is found that the establishment of illegal clinics is against the law No. 8 of 1999, thus subject to administrative sanctions in the form of payment up to Rp. 200,000,000.00 (two hundred million rupiah). Furthermore, the trade law has occurred since the consumer decides to seek alternative treatment so that both parties must exercise their respective rights and obligations. It is suggested that consumers should be vigilant in consulting alternative medicine, and it would be better for the Health administrator to conduct surveillance on alternative medicine businesses.

Abstract

Abstract: The discourse between Islam and the State in Indonesia is almost dominated by symbiotic-mutualistic relations. Islam considers State enforcement is one of the means for bringing people closer to Allah Almighty. One of the Indonesian prominent figures of this idea is Zainal Abidin Ahmad of Minangkabau Sumatra, a disciple of Hamka, a politician, a former deputy chairman of the House of Representatives. This paper aims to answer the question of how is the Islamic Conception of State and its Implementation in the Indonesian Territories being adjusted. At the end of the paper it is explained that the Concept of the Islamic State, according to Zainal Abidin shows three basic principles, namely (1) there is a government of the people conducted in consultation (h}uku>mah al-ummah shu>riyah), (2) it has the sources of law (us}u>l al-tashri>’), and (3) there is a demarcation of power in the State’s authority (taqsi>m al-sult}at). Furthermore, based on fiqh siyasah: in the time of the Prophet and al-Khulafa al-Rasyidin, the life of Muslims as a community (nation) is entirely discretional to the rules of the pattern that they will adopt in governing themself. But there is a set of moral and ethical principles and values that should be abided for the well-being of human life.

Abstract

The economic crises that hit Indonesia for a long time were caused by corruption. Corruption itself was the result of the absence of integrated control. Corruption is a crime, it is an abuse of authority. It has been known that the perpetrators are state officials who have "authority", and recognized as Civil Servants. This research aims to determine and analyze the philosophical aim of punishments for perpetrators of corruption by Civil Servants in Islamic law tradition. The results of the study are that: firstly, the corruption in Islamic law can be drawn from the words ghulu>l and rishwah as well as from the verses of the qor'an including QS. al-Baqarah (2) 188, al-Mut}affifi>n (83) 1-2, and al-A'ra>f (7) 33. Secondly, that the sanctions contained in Law No.20 of 2001 Article 8 already felt appropriate and fair, if viewed in terms of the minimum and maximum sentence.
