Abstract

Crime is a problem that people experience from time to time. This shows that crime occurs and evolves in the environment of human life. One of the evils that continue to develop is a criminal act of persecution. This paper describes a criminal act of persecution in Islamic criminal law. This paper concludes with four conclusions. First, that the elements of jarimah of the forehead are: (1) causing pain or injury, (2) not with proper intent and purpose, and (3) accompanied by the intention of harming others. Second, that sanction of persecution is qisas or ta'zir. Thirdly, that if a criminal act of persecution is imposed a sanction of qisas on the limbs then it is required (1) not exaggerated, (2) the existence of similarity in name and location, and (3) the similarity between the two criminals and the victim in terms of health and perfection. Fourthly, that in addition to it can also be imposed sanctions diyah, the fine instead of qisas and penalties other than qisas.

Abstract

Differences in punishing something happen among Muslim scholars. This is not only because of the way of view in terms of dalalah al-lafd -to understand the meaning contained in the word-, but the factor has not reached nass by the others or the other's way of view that’s the nass is invalid, also because of the problem of tark al-nabi -the attitude of the Prophet pbuh. which leaves doing something-is a vast field that also greatly supports the differences between moslems. This Terma of al-tark is one of the ways we understand and act on legal differences among Muslims. The author is interested in studying this term by library so that the results of this study could be one additional reading reference in drawing the conclusions of phenomena that occur today especially since there is a conservative dakwah disturbing spread in many social media. So we will know that the Prophet’s attitude of not doing in some cases not necessarily haram or even makhruh either in the realm of worship or culture if not supported with the other theorems.

Abstract

In the past decade, there have been several Notaries involved in legal cases. One of them is a case of abuse of trust, in the form of using the money payment of tax on the sale of land entrusted by the client to the Notary, as in the Decision of PN Denpasar Number: 300 / Pid.B / 2015 / PN.Dps. dated 04 August 2015, that the Notary is declared as the defendant a criminal act of embezzlement. This paper aims to analyze: (1) the authority of Notary to receive and pay the tax on the sale and purchase of land, namely PPh and BPHTB, to the state treasury; and (2) the criminal sanction against the Notary. The results of this paper conclude: first, that the authority of Notary in accepting and paying the tax on the sale and purchase of land, namely PPh and BPHTB, to the state treasury is not regulated in legislation. However, a Notary has the authority if the client authorizes him. Secondly, that the Notary who is involved in the crime of embezzlement of the tax on the sale and purchase of land has fulfilled the formulation of Article 372 of the Criminal Code, thus being sentenced to 6 months imprisonment. However, this criminal sanctions does not need to be served by the Defendant, unless within 10 months there is a Judge Decision that the defendant has committed a crime.

Abstract

The background of this paper is the recognition of The Customary Rights of land (Hak Ulayat) in Article 3 of Law no. 5 of 1960 on The Basic Regulations of Agrarian Principles (UUPA). The purpose of this paper is to know the legal certainty of communal rights based on Ministerial Regulation ATR/Head of BPNRI No. 10 Year 2016, with a view of the land law of Indonesia. The conclusion of this paper is that there is no legal certainty for indigenous and tribal peoples within certain areas, ie in forest areas or plantations that will propose communal rights to the land. Ministerial Regulation ATR/Head of BPNRI No. 10 Year 2016, has no legal umbrella, due to communal rights to land regulated by Ministerial Regulation ATR/Head of BPNRI No. 10 Year 2016, is not in accordance with Article 16 paragraph (1) letter h of The Basic Regulations of Agrarian Principles (UUPA), where The Basic Regulations of Agrarian Principles (UUPA) as the legal basis of Ministerial Regulation ATR/Head of BPNRI No. 10 Year 2016. In addition, the implementation of registration of communal land rights is also not in accordance with Article 9 paragraph (1) of Government Regulation no. 24/1997. Ministerial Regulation ATR/Head of BPNRI No. 10 Year 2016, which does not have a legal umbrella, of course, contradicts Hans Kelsen's theory of the level of legal norms (stufentheorie) and Adolf Merkl's Theory of legal norms always have two faces (das Doppelte Rechstanilitz)

Abstract

Road as one of the social functions of the land controlled by the state of its arrangement is divided into of Law no. 5 of 1960 on The Basic Regulations of Agrarian Principles (UUPA) and the Road Law. As a form of proof that roads of a certain size have been controlled by the state, the government carries out the process of certifying the land of the road. The road soil certification aims to protect its social function as a means of land transportation, as provided for in the Road Law. The certification of road soil is not easily carried out, but it can lead to new problems, in the form of a dikoktomi on roads that have been certified with land that has not been certified. This dichotomy indicates that the control of land by the state is very weak -on one side- and -on the other side- it is as if the parties can easily master the social function of the land used as the road. therefore the recommendation is made that the Government is expected to make a law which regulates the land so that it is not bound to The Basic Regulations of Agrarian Principles (UUPA), due to its different functions, so it is not necessary to be certified on the road, but only with documents about the size of the road that is not in the form of a certificate of rights.

Abstract

Tulisan ini dalam rangka mengkaji dua hal, pertama, kekuatan hukum sertifikat ha katas tanah dikaitkan dengan kepastian hukum dalam pendaftran tanah, dan, kedua, upaya hukum yang dilakukan guna menjamin Kepastian Hukum di bidang Pertanahan. Di akhir tulisan ini disimpulkan, bahwa: pertama, kekuatan hukum sertifikat hak atas tanah merupakan jaminan kepastian hukum dari sertifikat sebagai alat bukti kepemilikan yang bersifat kuat, dengan syarat sepanjang tidak dibuktikan sebaliknya oleh pihak lain yang merasa berhak dan mempunyai alat bukti untuk membuktikannya. Dan, kedua, upaya yang harus dilakukan untuk mejamin kepastian hukum dalam bidang pertanahan yang dilakukan oleh Pemerintah -dalam hal ini Kementerian Negara Agraria dan Tata Ruang-, yaitu menerbitkan sertifikat hak atas tanah yang didasari oleh tiga asas, yaitu: (1) asas kepastian hukum, (2) asas kecermatan, dan (3) asas aman, demi terjaminya kekuatan hukum dan kepastian hukum dari sertifikat yang diterbitkan.

Abstract

Akta roya mortgages rights are usually made by the Land Office which indicates that the creditor's receivable has been paid or the certificate of liability is removed because it has been deleted. However, because the certificate of mortgage that is controlled by creditors is lost, then in the case of the right of liability delete can not be deleted in the certificate of mortgage. In this case the creditor requires a notarize deed of notarial deed or notarized deed or deed made by a notary. Akta roya hak tanggungan is one of the authentic deeds made by a notary at the request of the creditor as the party containing the statement of the creditor that the certificate of debtor's right of debt in his power has been lost. The existence of notarial deeds within the scope of the mortgage rights has not been explicitly regulated in UUJN, UUHT and other regulations, but the notary may make this deed based on the authority of a notary as meant in Article 15 paragraph (1) UUJN. In that provision there is a blurred norm regarding the authority of a notary to create a deed of the rights of the dependent. The issues raised in this research are about the authority of a notary to make deed roya mortgages, and position aka roya mortgages made by a notary. The results of this study indicate that in general the notary has the authority to make a notarial deed in the form of the deed of the right of the death based on Article 15 paragraph (1) UUJN, as long as there is no other rule more specifically regulate it. Abstract

The legal assistance provided to the suspect or the defendant is essentially a defense of the law and the protection provided to the suspect or the defendant to be protected by rights. Often, abandonment and abuses in practice when a suspect is arrested and interrogated, an investigator rarely informs him of the right to legal aid. Whereas this provision has been regulated in Article 114 of the Criminal Procedure Code. This paper concludes with three conclusions. First, the constitution guarantees the right of every citizen to the equitable recognition, guarantee, protection and legal certainty and equal treatment before the law, including the right to access justice through the provision of legal assistance. Second, Some forms of legal guarantees against the perpetrators of serious criminal offenses who are provided with legal assistance, among others, accompanied by legal counsel provided by the state through legal aid providers that have been registered with the Ministry of Justice and Human Rights of the Republic of Indonesia. Third, there have been many judicial decisions which have had permanent legal force and become jurisprudence which contains the unauthorized report of the hearing if the suspect's rights are not submitted / met by the investigator, especially the rights related to legal aid.

Abstract

In this paper will be presented the concept of land ownership, the discussion not only in the perspective of Indonesian positive law, but also in the perspective of Customary Law and Islamic Law. The aim is intended as a legal comparison to broaden the concept of land ownership. Because with the comparison of legal system will be obtained equations and differences, so it can find the best. At the end of this paper, three things are concluded. First, that the concept of land ownership in positive law in Indonesia is (1) the government in various policies seeks to regulate the utilization, appropriation and use of land for the benefit of mankind in Indonesia, and (2) known the concept of ownership there is a communal religious element. Secondly, the concept of land ownership in customary law is: (1) the existence of Ulayat rights, (2) the subject is customary law community, and (3) the object is covering all the land of customary law community. Third, that the concept of land ownership in Islamic law is: (1) everything belongs to Allah SWT. which is empowered to human beings, so as to use the law of God, (2) to apply the property of individuals and the public equally, (3) unknown to the landlord system.

Abstract

Ownership of apartment is protected by law, so according to the concept of property rights, such ownership may be transferred and imposed warranty rights. The owner of Sarusun may sell the property to another party, or make it as collateral for the debt to the bank or other financial institution. Although the apartment is built on Hak Milik, Hak Guna Bangunan, and Hak Pakai on state land, the certificate still uses the name Certificate of Hak Milik Atas Satuan Rumah Susun, in contrast to the land title certificate in general which uses the name according to the status of the land right, such as Certificate of Hak Milik, Certificate of Hak Guna Bangunan, Certificate of Hak Guna Usaha, or Certificate of Hak Pakai
