Abstract

This study explores the integration of national legal policies with local wisdom values as a strategic approach to realizing optimal basic public services and ensuring social justice in Indonesia. It highlights challenges in policy implementation, including centralistic legal frameworks that often overlook indigenous cultural values, leading to social resistance and conflicts.. The research emphasizes the importance of harmonizing national laws with local wisdom through adaptive, pluralistic legal mechanisms and participatory governance models. Case studies demonstrate how local legal products, customary dispute resolutions, and community-based governance strengthen social cohesion and legitimacy of law. The paper further recommends enhancing legal literacy, capacity building for local actors, and multi-stakeholder collaboration involving government, customary institutions, academia, and civil society to foster inclusive, responsive, and sustainable legal frameworks. Innovative public service models rooted in local cultural practices are shown to improve accountability, participation, and resilience. This integrative approach not only protects constitutional rights and indigenous heritage but also supports environmentally sustainable development and equitable public service delivery, contributing to national cohesion and governance effectiveness.

Abstract

This research is motivated by the phenomenon of religious conversion to obtain legal marriages that occurs in the Ngadirejo Village community. In response to the prohibition of interfaith marriages in positive law and Islamic law in Indonesia, couples of different religions choose to convert so that their marriages can be legally recognized temporarily. While Islamic jurisprudence (fiqh) has regulated invalid marriages, it has not explicitly explained the provisions for couples who convert to obtain legal marriages. The results of this study indicate that the phenomenon of religious conversion in Ngadirejo Village involves temporarily converting to obtain legal marriage, then returning to the original religion after the marriage is consummated. This decision is made due to religious differences between couples, local customs that require men to follow women, and the need for practical solutions to overcome administrative obstacles. And the phenomenon of changing religions to obtain legal marriage in Ngadirejo Village is contrary to the maqāṣid al-sharī’ah of Asy-Syathibi because it is not in accordance with the objectives of sharia, namely ḥifẓ al-dīn, ḥifẓ al-nafs, ḥifẓ al-'aql, ḥifẓ al-naṣl, and ḥifẓ al-māl.

Abstract

The relationship among family members ideally should be based on love, mutual respect, and the fulfillment of rights and obligations. However, in reality, an imbalance in the execution of rights and obligations often triggers conflicts that can lead to domestic violence (DV). This violence not only impacts the victims physically and psychologically, but it can also have legal consequences in the form of criminal acts. Therefore, understanding the rights and obligations of family members is important to reduce the potential for violence within the family. The research method used in this study is a literature review related to the rights and obligations of family members. The rights and obligations of family members are the fundamental basis for building resilience and harmony in households. Every member has complementary roles which create balance in family relationships. With the synergy between family awareness, community support, and state law enforcement, violations of rights and obligations can decrease and diminish. Ultimately, the balance in the implementation of the rights and obligations of family members not only prevents criminal acts within the family but also strengthens the foundation of a just, prosperous, and civilized society.

Abstract

Indonesian criminal law, as reflected in the Criminal Code (WvS), adheres to the principle of universitas delinquere non potest or societas delinquere non potest. This principle asserts that legal entities (corporations) cannot commit crimes; only natural persons (natuurlijke persoon) can be held criminally liable. With economic development and industrialization, corporations are no longer viewed as passive business entities, but rather as key actors with the potential to cause massive losses to the state, society, and the environment. This situation forces criminal law to evolve by recognizing corporations as legal subjects. The enactment of Law Number 1 of 2023 concerning the Criminal Code (National Criminal Code) marks a significant milestone in Indonesian criminal law reform. One fundamental change is the explicit inclusion of corporations as subjects of criminal law in general provisions. This regulation is crucial for creating legal certainty and justice. With this recognition, law enforcement officials now have a stronger and more uniform legal basis for prosecuting corporations that commit crimes.

Abstract

The dynamics of society continue to develop, legal problems thus always accompany it in line with the development of culture, science and technology. The actions of some faqih in responding to contemporary dynamics are often only defensive-apologetic in nature, not solution-oriented and even counterproductive. Actually, the fuqaha are not not doing ujtihad at all, they have done it, but limited to repeated readings of the results of previous ijtihad. And actually what needs to be reconstructed is not Islamic law, but the means of making Islamic law, namely ushul fiqh, in this case maqashid sharia. In the classical era, there was already a theory about maqashid sharia, but it was considered inadequate in terms of methodology. From that the author makes a conclusion about how the thinking of Asy-Syatibi and Jasser Auda in the maqashid syariah? This study uses a qualitative approach. The results show that asy-Syatibi has transformed the maqashid syariah by releasing the maqasid from the material of law to the principles of law, changing the wisdom from behind the rules to the basis of the rules, and induction to the verses of the Qur'an. While the maqashid offered by Jasser Auda is an approach to Islamic philosophy that accumulates in; the cognitive character of the system, the whole system, openness, hierarchical interplay, multidimensionality, and intentionality

Abstract

Determining the beginning of the Hijri month is a vital aspect of Muslim religious practice in Malaysia, which has undergone a significant paradigm shift in recent decades. The traditional method of crescent moon sighting (rukyatul hilal), which relied on direct observation, has transformed into an integrated astronomical hisab method. This study aims to analyze this paradigm shift, using a qualitative approach with a literature review of books, journals, and articles related to the method of determining the beginning of the month in Malaysia. The analysis utilizes Thomas Kuhn's paradigm shift theoretical framework to understand the ongoing scientific-religious transformation. The results show that the integration of rukyat and hisab, according to the MABIMS criteria (minimum altitude of 3 degrees and elongation of 6.4 degrees), can improve the accuracy, consistency, and harmonization of the beginning of the month. However, the new paradigm faces sociocultural resistance, particularly from traditionalist groups, and challenges related to the uneven distribution of observation infrastructure. The conclusion confirms that this transformation is not merely a technical change, but a scientific-cultural revolution that requires education, dialogue between stakeholders, and religious legitimacy for the sustainable implementation of modern methods for determining the beginning of the Hijri month in Malaysia.

Abstract

This study examines investor protection in Initial Public Offerings (IPOs) on the Indonesian Capital Market as a mechanism for raising capital that is fraught with information asymmetry and the risk of prospectus misinformation for retail investors. The method used is normative legal research with a legislative and conceptual approach to the Capital Market Law, POJK, IDX provisions, and literature on the principles of full disclosure, due diligence, and law enforcement by the OJK. Normatively, protection is realized through the obligation to provide accurate and non-misleading prospectuses, professional responsibility, OJK supervision, and the right to sue and mechanisms for recovery of losses as preventive and repressive instruments. However, major problems were found in the form of weak consistency in law enforcement, regulatory fragmentation, the heavy burden of proof for investors, the limited effectiveness of class actions, and the lack of clarity in determining the responsible subjects, so that legal certainty and investor confidence are not yet optimal compared to more mature jurisdictions. This study recommends strengthening the design of sanctions, harmonizing regulations, facilitating evidence

Abstract

Social and economic transformations in contemporary Muslim societies have influenced the understanding of the concept of maintenance (nafkah) in Islamic family law. Classical fiqh constructions that position the husband as the sole provider emerged from specific patriarchal social contexts and often encounter tension when confronted with the realities of modern, more egalitarian family structures. This study aims to examine the substance of the concept of nafkah in Islamic family law and to explain its relevance in responding to contemporary social dynamics. This research employs a normative-conceptual approach with a thematic-holistic analysis of scriptural texts and a maqāṣid al-syarī‘ah perspective. Data were collected through library research and analyzed using qualitative descriptive methods. The findings indicate that the substance of nafkah lies not in who performs the role of breadwinner, but in its function as an economic responsibility to ensure family welfare and sustainability. The relevance of the concept of nafkah in the modern context is reflected in the flexibility of economic role distribution between husband and wife based on the principles of reciprocity, justice, and public interest, in accordance with the objectives of maqāṣid al-syarī‘ah.

Abstract

This paper aims to analyze the tradition of distributing zakat al-fitr to Quranic teachers and midwives from an Islamic perspective in Tamangapa Village, Makassar City. By conducting a descriptive field study, obtained through observation, interviews, and documentation, it is possible to describe the social reality of the Tamangapa Village community, Makassar City, in distributing their zakat al-fitr to midwives and Quranic teachers. The results of the study indicate that in general, Tamangapa Village residents who use the services of midwives in addition to midwives distribute their children's zakat al-fitr to them from infancy until the age of three. Furthermore, if the child is four years old or older and has been registered at the Quranic Education Center (TPA), the distribution of zakat al-fitr is transferred to the Quranic teacher until he or she has successfully completed the Quran (approximately three years). The community's habit of distributing zakat al-fitr only to these two parties is due to following their parents' traditions. However, Islamic law does not permit the distribution of zakat al-fitr solely based on "tradition." Therefore, there must be other legal basis (Quran, Hadith, and ijtihad). In this regard, it is recommended that Tamangapa Village establish a village-level Zakat Collection Institution so that the community can distribute their zakat al-fitr through this official institution.

Abstract

Throughout the history of Islamic civilization, Sufi circles have often been the target of criticism from certain factions of scholars, particularly jurists. This is fueled by the perception that Sufis tend to set aside the external aspects of Sharia law in favor of prioritizing the inner dimension and abandoning worldly attachments. However, this opinion is not always true. With Morocco as the object of this research, the land of the setting sun can serve as an example and a mecca for the application of Sufism from its inception to the modern era. The modern Sufism of Sheik Junayd Al Baghdadi in Morocco has become an icon and is deeply rooted. The Sufi teachings and assemblies that developed in Morocco eventually became a distinctive Moroccan Islamic tradition and an inseparable part of royal life. The kingdom even officially made Sufi teachings and assemblies a solution to address the problem of religious extremism. Modern Sufism, or neo-Sufism, emerged as an alternative for modern humans and represents a renewal of classical Sufism, which was considered inconsistent with Sharia law. Through its moderate and humanist practice, Sufism is no longer considered a backward religious teaching.
