Abstract

In Islamic perspective, money is merely a means of economic transaction.  It is not a commodity, but a means to achieve added value. Such a concept is contradictory to the interest-based banking system in which money “makes” money regardless its productivity. To gain profit money should be employed in basic economic activity, be it is directly channeled such as trading, leasing and so forth, or indirectly conducted through capital partnership to carry out an aspect or several aspects of an economic activity. One crucial solution that the government must consider in recovering Indonesian economy is the implementation of shari’ah economy. Shari’ah economy has strong commitment in poverty alleviation, law enforcement, economic growth, interest abolition, and the prohibition of currency speculation to create economic stability. Shari;ah economy which is founded upon justice shows excellent concept in facing monetary upheavals compared to interest-based system. It is a fact that global economists agree on. In the future, government must pay more attention to Islamic economy system which has been proven resistant in crisis time.   Islamic economy system, which is represented by shari’ah financial institution have shown its vigor and survided because of its profit sharing principle so that it did not undergo negative spread as those interest-based banks did. In fact, the Islamic banking immensely grows in those rainy days whereas some interest-based banks surged down and collapsed and some other banks were recapped by the government with 650 zillion rupiahs. Every year, Indonesian national budget is drained to pay that recap obligation interest which it should be allocated to poverty alleviation programs. It is the cost that we have to pay if we keep hanging on capitalistic economy which revolves around interest.

Abstract

This article explores the concept of muslim community empowerment through Baitul Mal wat-Tamwil (BMT) or community treasury. The potentials of this economy institution is often undermined, even by muslims.  BMT is considered out of dtae to tackle nowadays community’s economic challenges. The profile and business of BMT Nurul Jannah is uncovered to illustrate muslim community empowerment in Gresik. It turns out that the BMT which was established by the Nurul Jannah mosque foundation is designed to increase the role of the mosque in improving economic empowerment of the surrounding muslim community. BMT has two functions; it collects and distributes zakat (alms). In adition, it also channels credits for economic activities of muslim community in its surrounding.

Abstract

The law Number 23 of 2004 on the elimination of violence in household outlaws violence occurred within domestic sphere or is committed by relatives such as husband. The law acknowledges violence within domestic sphere as a punishable crime. It covers physical, psychological, economic and sexual violence. The law is enacted due to concern on high occurrence of domestic violence and the absence of law specifically addresses the problem. Even though the law can be considered an improvement in gender discourse within Indonesia, there are still many flaws to be put forward, especially from gender perspective. On the other side, the law encounters controversy since some Muslims regard it a violation to Islamic values. This paper analyzes the law from two perspectives; gender and Islam. From gender perspective, this law is a gender-aware policy and therefore can be regarded as a positive development in struggles over women’s rights. Moreover, this law also acknowledges that denying women’s access from economic sources including the right to work outside the house is also violence in term of economic limitatiton. On the other hand, the law is not a gender redistributive policy since it does not deconstruct division of roles between husband and wife. From Islamic perspective, the law actually is actually in accordance to principles and values in Islam. Islam prohibits violence and ensures protection on women’s rights in all aspects; physical, physcological, sexual and economic. To sum up, in spite of certain shortcomings, the law is actually a remarkable achievement in struggles over the improvement of women condition. In addition, with a good understanding on more just interpretation on some related religious texts, Islam actually promotes a peaceful and just relation in a household in particular and between man and women in general.

Abstract

This article discusses the view of al-Shafi’iy on al-Sunnah using historical analysis to uncover the significance of al-sunnah for al-Shafi’iy’s legal theory. This historical study is conducted by tracing al-Shafi’iy’s thought on the concept of al-sunnah in the period prior to him which Schacht labels as Ancient Schools of Law. Al-Shafi’iy had made radical change in understanding the concept of al-sunnah upheld by those early schools by criticizing the Ijma’ doctrines and limiting it to the aspects of basic r eligious duties. Al-Shafi’iy’s idea simply puts aside al-sunnah from the existing schools of law. For him, al-sunnah, which is transmitted from the Prophet in form of hadith though chains of trustworthy transmitters, is a source of Islamic law in its own right regardless whether it is widely accepted or otherwise. Further, it is remain a valid source even if it is only an isolated transmission (ahad).

Abstract

One of the orientalists’ objects in learning Islam is hadis as the second source of law in Islam. Ignaz Goldziher is the most representative and notable orientalist to talk and criticize hadis as rather scientific research of the second and third century of Hijriyah than originally steamed from the original source, he is prophet Muhammad. On the other hands, most of Muslim scholars strongly objected to such viewpoint. One of those who disagreed to the accusation is Mustafa al-Siba’iy. He proved the authenticity of hadis by conveying the historical approach argumentations. He had a conclusion that historically, hadis transmission had been started since the prophet Muhammad’s period though he never officially assigned to his companions but they intensively wrote hadis as a self-documentation. To strengthen his theory, he offered some rational argumentations; (1) traveling (rihlah) tradition (2) tracing isnad (link) of hadis (3) authenticity of hadis (tauthiq al-hadith) (4) narrator criticism methodology.

Abstract

The article discusses political authority, especially in enacting laws and regulations, from the perspective of Islam and Indonesian positive law. There are two reasons for human to making law. The first is to establish order in the society. The second is to keep up with dynamics and social changes. On the other hand, Islam has legal stipulations which determine rights and duties of every Muslim. However, such regulations will not be effective without power to implement them. Thus, the interaction between religion and state is inevitable. The separation between the two as it happens in the West is not the issue. State matters in principle is also Islamic matters because the goal is a perfect implementation of divine law on earth, be it the law concerning worldly affairs or here after.

Abstract

في هذه المقالة كتبت الباحثة عن حكم رعاية الطفل بين الدين الإسلامي و القانون الوضعي في إندونيسيا. إن الطفل في الإسلام يولد على الفطرة. فهو طاهر لا ذنب له، و لكونه جيل المستقبل اهتمه الإسلام اهتماما عظيما. فأمر الإسلام أن يربيه والداه تربية جيدة لكي نشأ الطفل في أسرة جيدة و بيئة طيبة. ولكن الأسف كان أكثر عملية العنف التي تصيب الطفل وقعت في الأسرة، فهذا يؤثر طبيعة الطفل في حياته، مع أن التربية مهمة و لكن التربية بالعنف هي شيء آخر. ففي إندونيسيا وضعت الحكومة قانونا لرعاية حقوق الطفل. يرجى بهذا القانون، يهتم الآباء حقوق طفلهم اهتماما جيدا و لا يصيبون العنف لطفلهم. من نتيجة هذا البحث، أن القانون الإندونيسي عن رعاية الطفل يطابق قاعدة الإسلام في تربية الطفل و هي أن يربي الآباء طفلهم بالمحبة و المودة حتى تكون الأسرة مكانا آمنا للطفل.

Abstract

After the end of the Cold War, the global issue has shifted from communism and the contestation of West and East to new issue; human rights. The majority of the western countries considers Muslim world as the major violator of human rights, especially when Islamic law is concerned. As the impact, the opinion that there are abundant human rights violations in Islamic law emerges. However, this is not true, in theory or in practice. In theory, the dictums and stipulations of Islamic law contain values, rationales, aims, objectives, and effectiveness of penalty. In practice, Muslim world have own way in upholding rule of law in a sense that even if it is different from its western counterpart, it essentially has identical aims; the upholding of human rights.

Abstract

Business activities are always perceived as an effort to gain as much as possible profit even if to achieve those steep profits certain unethical or even illegal activities must be done. Examples of such activities are selling low quality merchandises, ignoring customer services, selling merchandises which are not the same to those in advertisements, forcing acquisition of other companies, doing fraud business and s forth.It turns out that those unethical means may results in the collapse of a business or at least no lasting for long time. Therefore, professionalism and business ethic are necessary. Among important aspects of professionalism and business ethics are doing business seriously to produce good quality products, commitment and responsibility without any intention to harm others. In addition, a good businessman should maintain good relationship with distributors, partners, consumers, suppliers, share holders, social workers, media, foreign governments, local governments, local community and so on. This approach is known as stakeholder approach in business ethics.

Abstract

The debate whether interest is riba or not remains a hot issue up until today. Various interpretation of riba in relation to interest results from the ratio legis (‘illat) proposed by the medieval jurists seems to be no longer inaccurate within the discourse of contemporary Islamic law.Meanwhile, several trends concerning current economic activities such as the role of bank as financial intermediation had not been discussed in medieval jurisprudence although simple form of riba with all of its nature and impact had been understood.According to contemporary Islamic jurists, the relevance of riba to interest is viewed from various perspectives which lead to different legal status. There are at least two paradigm as a reference in viewing this issue: (1) legal formal  which inductively understands interest employing qiyas. (2) contextual paradigm which deductively sees interest within a given context and situation.
