Abstract

ABSTRACT: Pasca amandemen UUD 1945 selama empat kali (1999-2002), konstitusi Indonesia mengalami perubahan secara prinsipil. Salah satunya kekuasan judicial (kehakiman) sebelumnya dijalankan sepenuhnya oleh Mahkamah Agung (MA). Namun, saat ini sebagian kekuasaan kehakiman dilaksanakan oleh lembaga baru, Mahkamah Konstitusi (MK) sebagai pengawal konstitusi (the guardian of constitution). Berdasarkan norma Pasal 24C ayat (1) UUD 1945, perubahan ketiga, 2001 joncto UU No.24 Tahun 2003 tentang Mahkamah Konstitusi, joncto Pasal 29 ayat (1) dan (2) UU No.48 Tahun 2009 tentang Kekuasaan Kehakiman, maka secara eksplisit lembaga negara yang bewenang untuk menguji konstitusionalitas tidaknya suatu undang-undang adalah MK. Proses dan sifat dari kewenangan MK dalam menguji undang-undang terhadap UUD 1945 dilakukan sejak dari mengadili pada tingkat pertama hingga tingkat teakhir yang putusannya bersifat final dan mengikat (final and binding). Artinya, tidak ada upaya hukum lainnya terhadap putusan tersebut.  Pascaputusan MK yang menyatakan suatu undang-undang tidak berlaku mengikat karena kontradiksi dengan UUD, maka dengan sendirinya putusan tersebut juga sekaligus menciptakan suatu keadaan hukum yang baru. Namun, sebagai syarat untuk diketahui oleh umum, sebagaimana Pasal 57 ayat (3) UU No.24 Tahun 2003 disebutkan: Putusan Mahkamah Konstitusi yang mengabulkan permohonan wajib dimuat dalam Berita Negara dalam jangka waktu paling lambat 30 (tiga puluh) hari kerja sejak putusan diucapkan. The Legal Implications Constitutional Court Decision

Abstract

ABSTRACT: Arbitration is a forum for dispute resolution outside of court that has been chosen by the businesses. One of benefits and advantages has by the arbitration body is the force of law from a final decition (a decition the final level) and binding (binding both parties to the dispute). In the implementation of international award, Indonesia has ratified New York Convention in 1958 through Presidential Decree No. 34 of 1981 that authorizing the execution of foreign arbitration in Indonesia. In addition, through Act No. 30 of 1999, requires that the courts play an important role in the enforcement of international arbitration. Abstract

ABSTRACT: Special courts are the courts having the authority o access, judge, and decide special cases that can only be established in one of the courts types under the supervision of the Indonesia’s Supreme Courts as regulated in the laws. Abstract

ABSTRACT: Keputusan yang dikeluarkan oleh badan peradilan dapat ditempuh upaya hukum sampai tingkat kasasi ke Mahkamah Agung. Sedangkan dalam perkara perdata di Pengadilan Negeri pihak yang dikalahkan cenderung melakukan upaya hukum baik banding maupun kasasi dengan alasannya masing-masing. Terwujudnya peradilan yang cepat, sederhana dan biaya ringan merupakan dambaan dari setiap pencari keadilan dimanapun. Asas tersebut terkandung dalam Undang-Undang No. 14 tahun 1970 jo. Undang-Undang No. 35 tahun 1999 yang kemudian diganti dengan undang-undang No. 4 tahun 2004 tentang Kekuasaan Kehakiman, permasalahannya apakah hal tersebut dapat dicapai mengingat panjangnya proses yang harus dilalui oleh pencari keadilan, di sisi lain hak-hak pihak yang digugat pun harus dilindungi sepenuhnya dengan cara memberikan kesempatan yang seluas-luasnya untuk membuktikan sebaliknya? Dalam proses, memungkinkan dilakukan mediasi, yang didahului oleh kehadiran kedua pihak yang berperkara, penyampaian prosuder mediasi oleh majelis hakim, pemilihan mediator, Penetapan mediator dan hakim pemeriksa perkara wajib menunda pemeriksaan perkaranya. Abstract

ABSTRACT: The exixting of Islamic law regulations are the rule regulated in the sharia law and a small number are found in the decision of the National Sharia Board and in the Indonesia Bank Regulation. In terms of settling the dispute between Islamic bank and its problem, the board applies two different approaches; namely the decision of the board and the Indonesian Civil Law. Therefore, this paper explores the dispute in the Islamic economic law outside the court in accordance to sharia law. The method applied is analysis content from the relevant sources. The non-litigation dispute settlement ruled in the holy book of Quran are very that can be applied in solving the disputes of economy and finance. A part from Quran and the saying the prophet, there are some sources such as Sunan al Daruquthni, Ibnu Khuzaimah Musnad Abu Ya’la al Musili, Musnad Abu, Awanah, Musnad Abu Daud al Yayalisi, Musnad al Bazzar, etc which are the sources of Islamic law that can be applied in solving the disputes. The Non Litigation Settlement of Islamic Economy Practice Dispute Based on Islamic Law

Abstract

ABSTRACT: Based on Article 19 (2) of the Act Number 5, 1960 nd Article 32 of the Government Regulation Number 24, 1997 state that in registering land, the certificate of land functioning as a strong evidence. Whether a freehold right can only be proved by a certificate, and to that extent of such evidence in judicial process. In terms of obtaining the answers from the questions, library research is conducted by exploring, discussing and analysing the laws, research reports and relevant experts views. The findings show that such freehold right certificate is issued by National Land Authority by registration process. If there is a land without certificate hence it can be proved through witnesses statements, prediction, acknowledgemen and oath. The certificate has the strong and complete power of proving can only be admitted if there is no challenge before the court. The challenge towards the certificate can be done if there are a defect on issuing it, good faith of the holder and/or the right holder does not really own the land. A Certificate of Land as an Evidence of Land in Judicial System

Abstract

ABSTRACT: The existence and authority Syar'iyah Courts regulated in Qanun Number 10 of 2002 on the Islamic Syari'ah Courts. Since the Year 2007 to Year 2010, the Syar’iyah Court Bireun has examined on jinayah case as many as 27 cases. Although the Court's decision in the case already have permanent legal force, yet one of the case is conducted or executed by the State Attorney Bireun. The results showed that there are some things that cause no or not execution judgement of judge Syar'iyah Court  Bireun, Syar'iyah Court Bireun and the State Attorney Bireun have no special budget to carry out additional tasks as implementing agencies in the implementation of Islamic Law in Aceh, Qanun Aceh does not give authority to the institutions of law enforcement to make arrests of suspects, accused and convicted in the case jinayah. The Constraints of Execution on the Conviction of Syariah Law Case Held by Syar’iyah Court Bireuen

Abstract

ABSTRACT: This research aims to explore the domestic dispute of husband and wife and how to solve it through non litigated settlement based on sharia law. The method applied is content analysis fro the relevant sources of the research. The dispute results from the lack of understanding of the couple regarding the value of marriage based on Islamic law. The divorce might be resulted from economy, infidelity, and education background factors, whil the percentage is 90% whil domestic violence, drinking and gambling factors have te percentage of 10%. The settlement could be coducted through peaceful way by appointing one mediator both from husband and wife sides. This concept based on the 35, An-Nisa Chapter of the holy Quran suggesting that it is recommended the family dispute could be solved peacefully and accepted by both parties. The mediaton phase conducted by hakam is the second phase while the parties themselves solve the first one. Abstract

ABSTRACT: Rigth to information in one of the human right regulated in he 1945 Constitution. The implementation of such right for the citizen is further regulated in the Act Number 14, 2008 regarding the Openness of Public Information. This paper explores the information openness of the judicial intitution as a public institution. Basically, such openness is not the new thing in Indonesian justice procedure system. Article 195 f the Indonesian Penal Law states that all decision are valid and enforcable if it is stated in te open trial for the public. Aticle 13 (1) of the Act Number 48, 2009 regarding the Justice Authority also provides that each trial process is open for public unless he Act states conversely. Article 20 of he Act Number 4, 2004 regarding the Justice Power also states the same thing as the Act Number 48, 2009. however, the decision that is more accessible to public is the decision of the Supreme Court. Contrastly, the decision of the first instance court and the court of appeal have not been able to be accessed yet. Therefore, in the era of public information openness, such information should be easily and quickly accessed by the public through electronic and printed media court official websites, started from the court of the first intance. Abstract

ABSTRACT: This is the research explaining the legal status of and the existence of the Islamic Law Court in national judicial system, the authority of Aceh Government in enacting the local law derived from Islamic rules as a regulation for the court in acting in national judicial system. The rules would be a guidance for the court in fulfilling the justice for Moslems in Aceh thus the court would be more effective in holding its functions and the constraints faced by the Aceh Government and the court in implementing Islamic Law as a concrete action to fulfil the needed justice in society. The data are gathered by conducting library research and interview with the Islamic Law experts and the experts of criminal justice procedure and civil procedure law which then the data are discussed through.  In order to complete the data gathered from library research, field research is also conducted. The gathered data both from library and field research is analysed by qualitative normative approach then described descriptively.  The findings shows that the Act Number 11, 2006 regarding Aceh Governance has strengthened the legal status and the existence of the court as an Islamic Judicial Court inAceh Province that is apart of the national judicial system. Unlike, the Act Number 18, 2001, the authority that has been conferred to enact substantive and procedural law of the court has not been applied seriously even this is not priority. Therefore, it has not been able to give law certainty and protect the society from undue law process.  The main obstacles faced the practitioners are an unavailable of process law, especially criminal Islamic process law. The Authority of Aceh Government Towards the Conduct of Mahkamah Syar’iyah  in National Judicial System  (A Study on a Judicial Authority in the Context of Special Autonomy)
