Abstract

Abstract: This study explains the concept of Mahram for Muslim women who wish to perform the pilgrimage. This research method uses a qualitative description approach. Collection of data from the sources of the books of the Shafi'i school of thought by reading, interpreting, observing, analyzing to be used as data for research purposes on the concept of mahram for women who perform the pilgrimage in Saudi Arabia in terms of the Shafi'i school. This type of thesis research is descriptive analysis and literature research. The process in this research found that, First, the government of Saudi Arabia allows women to go on pilgrimage without a mahram if a trusted travel agent shades the trip. Second, the application of the concept of mahram for women who perform the pilgrimage according to the Shafi'iyyah school is mandatory. Keywords: Mahram; Shafi’i School; Saudi Arabia; Pilgrimage Abstrak: Penelitian ini menejelaskan konsep Mahram bagi perempuan muslimah yang hendak menunaikan ibadah haji. Metode penelitian ini menggunakan pendekatan deskripsi kualitatif. Pengumpulan data-data dari sumber kitab-kitab mazhab Syafi’i dengan membaca, mengartikan, mencermati, menelaah untuk dijadikan data keperluan penelitian penerapan  law bagi wanita yang menunaikan ibadah haji di Arab Saudi ditinjau dari mazhab Syafi’i. Jenis penelitian skripsi ini adalah deskriptif analisis dan penelitian pustaka. Proses dalam penelitian ini menemukan bahwa, Pertama, pemerintah Arab Saudi memperbolehkan haji perempuan tanpa mahram jika perjalanannya dinaungi oleh travel agent yang terpercaya. Kedua, penerapan konsep mahram  bagi wanita yang menunaikan ibadah haji menurut mazhab Shāfi’iyyah adalah wajib adanya. Kata Kunci: Mahram; Madhhab Syafi’i; Arab Saudi; Haji

Abstract

Abstract: During the COVID-19 pandemic, many economic obstacles were inevitable in the Banjarmasin City area of South Kalimantan province. Various efforts are made to maintain the course of the economy in this region, and all strategies are implemented. However, one contract system can still survive, namely the Bahaupan contract system, owned by Banjar community in Banjarmasin. This is empirical research with a legal sociology approach through observation media and direct interviews with economic entrepreneurs during the COVID-19 pandemic. As for some of the results found, the Bahaupan contract can still be used during the pandemic; entrepreneurs use the latest ways to manage their businesses during the Pandemic and still always increase caution in carrying out economic activities. Keywords: Jurisprudence; Bahaupan Contract System; Covid-19 Abstrak: Di masa pandemi Covid-19 banyak sekali terjadi kendala dalam perekonomian, tidak terelakkan juga pada wilayah Kota Banjarmasin Provinsi Kalimantan Selatan. Berbagai upaya dilakukan untuk mempertahankan jalannya perekonomian di wilayah ini semua strategi dijalankan. Akan tetapi, tampaknya masih ada satu sistem akad yang masih dapat bertahan, yaitu sistem akad Bahaupan yang merupakan sistem akad yang dimiliki oleh masyarakat Banjar di Kota Banjarmasin. Penelitian ini bersifat penelitian empiris dengan pendekatan sosilogi hukum, melalui media observasi dan wawancara langsung di lapangan kepada para pengusaha ekonomi dimasa pandemi Covid-19. Adapun beberapa hasil yang ditemukan adalah akad Bahaupan masih bisa digunakan di masa Pandemi, para pengusaha menggunakan cara-cara terbaru dalam mengelola usahannya di masa Pandemi, dan tetap selalu meningkatkan kehati-hatian dalam melangsungkan kegiatan perekonomian. Kata Kunci: Hukum; Akad Bahaupan; Covid-19.

Abstract

Abstract: This article discusses Nadirsyah Hosen's thoughts on democracy and leadership. This research is of the literature research type, and the data is analysed descriptively. The results of the study concluded that according to Nadirsyah Hosen, the democratic system is one way to return society to the Khilafah 'ala Minhaj an-nubuwwah (leadership based on what has been outlined by the Prophet). Regarding the requirements for leaders, Nadirsyah stated that leaders do not have to be from certain groups as long as they meet the requirements in accordance with the constitution of a country. If it is valid according to the constitution, it is also valid according to Islamic law. Nadirshah used maqashid as-shari'ah and the Intiqa'i method to determine statehood views. His opinion contributed to the reform of constitutional law in Islam. Keywords: Democracy, leadership, Islamic law, constitution. Abstrak: Artikel ini membahas tentang pemikiran Nadirsyah Hosen tentang demokrasi dan kepemimpinan. Penelitian ini berjenis Penelitian Pustaka dan data dianalisis secara deskriptif. Hasil Penelitian menyimpulkan bahwa menurut Nadirsyah Hosen sistem demokrasi merupakan salah satu cara untuk mengembalikan masyarakat kepada Khilafah ‘ala Minhaj an-nubuwwah (kepeminpinan berdasarkan apa yang telah digariskan oleh Nabi). Berkaitan dengan syarat pemimpin, Nadirsyah menyatakan bahwa pemimpin tidak harus dari golongan tertentu asalkan memenuhi syarat sesuai dengan konstitusi suatu negara. Jika sudah sah menurut konstitusi maka sah juga menurut hukum Islam. Nadirsyah menggunakan maqashid as-syari’ah dan metode Intiqa’i dalam menentukan padangannya mengenai ketatanegaraan. Pendapatnya tersebut memberikan kontribusi dalam pembaruan hukum ketatanegaraan dalam Islam. Kata Kunci: Demokrasi, kepemimpinan, hukum Islam, ketatanegaraan.

Abstract

Abstract: This article discusses the views of Quraish Shihab and Faqihuddin Abdul Kodir on nusyuz law. This research uses literature research methods. Research data is collected through literature collection and then analyzed by comparative techniques. The study results concluded that according to Quraish Shihab, the concept of Nusyuz is defiance and disobedience to the rights of Allah and the rights of the husband. While the concept of Nusyuz in the view of Faqihuddin Abdul Kodir is, Nusyuz is the opposite of obedience. That is, all negative actions in husband and wife relationships weaken the pair bond between husband and wife so that they become far from the conditions of sakinah, mawaddah, and rahmah. Either done by the wife to the husband or done by the husband to the wife. Keywords: Nushuz, Islamic law, husband, wife. Abstrak: Artikel ini membahas pandangan Quraish Shihab dan Faqihuddin Abdul Kodir mengenai hukum nusyuz. Penelitian ini menggunakan metode penelitian kepustakaan. Data dikumpulkan melalui pengumpulan bahan pustaka dan kemudian dianalisis dengan teknik perbandingan. Hasil penelitian menunjukkan bahwa dalam pandangan Quraish Shihab, konsep nusyuz merujuk pada tindakan pembangkangan dan ketidakpatuhan terhadap hak-hak Allah dan hak-hak suami. Di sisi lain, dalam pandangan Faqihuddin Abdul Kodir, konsep nusyuz didefinisikan sebagai tindakan negatif dalam hubungan suami-istri yang merusak ikatan antara keduanya, sehingga menjauhkan mereka dari keadaan sakinah, mawaddah, dan rahmah. Hal ini bisa terjadi baik dari pihak istri terhadap suami maupun sebaliknya, yaitu suami terhadap istri. Kata Kunci: Nusyuz, Hukum Islam, Suami, Istri.

Abstract

Abstract:  In this article, the researcher presents the development of the Islamic world in Libya and beginning by talking about the entry of Islam into Libya and focusing on the Maliki school, which is one of the most prominent elements of this development, and then presents the role of the Senussi movement. It turns out that the entry of Islam to Libya and its development was early since the Islamic conquest of it in the first century AH and the seventh AD in the time of Caliph Omar bin Al-Khattab, and Libya embraced in the period of the Islamic conquest has the remains of some companions, may God be pleased with them, who were martyred in order to spread Islam in this country, the most famous of which are Al-Munaidher Al-Afriqi in the city of Tripoli, Ruwaifa Al-Ansari in the city of Al-Bayda, Abu Sajeef bin Qais in the city of Misrata, Zuhair Al-Balawi, Abu Mansour Al-Farsi and Abdullah bin Righteousness and both three in the city of Derna, and the development of Islam with the spread of the Maliki school and the emergence of scholars who contributed to its dissemination not only in Libya but in all countries of the Arab Maghreb, such as Sheikh Ali bin Ziyad Trabelsi, where the Maliki school was among the foundations in the development of Islam in Libya, and was associated with various aspects and formed an identity for Libyans throughout the ages, and the Senussi method formed a significant role in the development of Islam in Libya and played an essential role in spreading Maliki jurisprudence and the pure Sufi way far away On heresies and superstitions and in the dissemination of Maliki jurisprudence, as well as in the jihad movement against the Italian colonizer. Keywords: evolution, world, sect, Islam, Libya. الملخص: في هذه المقالة يعرض الباحث لتطور العالم الإسلامي في ليبيا والبداية بالحديث عن دخول الإسلام لليبيا ومركزا على المذهب المالكي الذي يعد من أبرز عناصر هذا التطور ثم يعرض لدور الحركة السنوسية. يتبين أن دخول الإسلام لليبيا وتطوره بها كان مبكرا منذ الفتح الإسلامي لها في القرن الهجري الأول السابع الميلادي في زمن الخليفة عمر بن الخطاب ، واحتضنت ليبيا في فترة الفتح الإسلامي لها رفات بعض الصحابة رضي الله عنهم الذين استشهدوا في سبيل نشر الإسلام في هذا البلد من أشهرهم المنيذر الأفريقي في مدينة طرابلس، ورويفع الأنصاري في مدينة البيضاء، وأبو سجيف بن قيس في مدينة مصراته، وزهير البلوي وأبو منصور الفارسي وعبد الله بن بر وكلا الثلاثة في مدينة درنة، وتطور الإسلام بانتشار المذهب المالكي وبروز علماء ساهموا في نشره ليس في ليبيا فقط بل في كل أقطار المغرب العربي مثل الشيخ علي بن زياد الطرابلسي، حيث كان المذهب المالكي من بين الأسس في تطور الإسلام في ليبيا، وارتبط بالنواحي المختلفة وشكل هوية لليبيين على مر العصور، كما شكلت الطريقة السنوسية دورا كبيرا في تطور الإسلام في ليبيا ولعبت أدورا مهما في نشر الفقه المالكي والطريقة الصوفية النقية البعيدة عن البدع والخرفات وفي نشر الفقه المالكي وكذلك في حركة الجهاد ضد المستعمر الإيطالي. الكلمات المفتاحية: تطور، العالم، المذهب، الإسلام، ليبيا.
