Abstract

The registration of Citayam Fashion Week trademark rights in mid-2022 by famous artist Baim Wong triggered a public reaction that considered him as immoral, because it was considered that he was not the one who popularized the Citayam Fashion Week brand. The purpose of this article is to examine who is entitled to the Citayam Fashion Week trademark according to law number 20 of 2016 concerning trademarks and geographical indications,and whether the registration made by Baim Wong has been in accordance with the provisions of the first to file system stipulated in the Trademark Law. The results of the this article are based on the Trademark Act, the subject entitled to the trademark is the subject who first registered the trademark rights to the Ministry of law and human rights without violating the provisions of the trademark can not be registered and the trademark must be rejected. Baim Wong's actions in registering the Citayam Fashion Week trademark are in accordance with the provisions of the first registrant system or First to file, and do not violate the provisions of the trademark cannot be registered and rejected as stipulated in Law Number 20 of 2016 Trademarks and Geographical Indications, and therefore although Baim Wong is morally unfit but because the trademark law does not recognize the term moral, then Baim Wong is entitled to register the Citayam Fashion Week trademark.

Abstract

Korupsi tidak hanya menyangkut kerusakan dan perusakan standar kehidupan politik tetapi juga menyangkut kerusakan dan perusakan standar kehidupan ekonomi, sosial, kultural, dan sebagainya. Apa yang membuat suatu tindakan, praktik, atau kondisi kerusakan dan perusakan disebut korupsi? Mungkin terdengar sederhana, namun pertanyaan ini sentral mengingat hanya jenis tertentu tindakan atau praktik perusakan dipahami sebagai korupsi, sedangkan jenis tindakan atau praktik perusakan lain tidak diartikan sebagai korupsi. Ada banyak cara memahami persoalan itu. Beberapa strategi yang mungkin berguna, diantaranya adalah memahaminya dari soal penetapan hukum tetang korupsi yang wajib menetapkan objek penerapannya dengan presisi rumusan hukum. Itulah keniscayaan yang sekaligus juga kelemahan definisi korupsi dalam lingkungan pelaksanaan kebijakan publik dan juga memahaminya dalam kaitannya dengan manusia khususnya manusia yang korup (homo corruptus). Namun untuk tujuan kajian serius mengenai korupsi, penetapan hukum itu tidak sanggup menjawab pertanyaan ini : apa yang membuat tindakan/praktik suap, gratifikasi, penggelapan, pemalsuan disebut korupsi dan tidak dapat diterima? Tentu pertanyaan itu dengan mudah dijawab dengan mengasalkan pada otoritas kedaulatan tata-negara Indonesia (sovereignty): otoritas berdaulat negara Indonesia nenetapkan semua itu sebagai korupsi. Tapi cara menjawab itu merupakan cara menjawab dengan menghindari pokok persoalannya yaitu mengapa semuanya itu disebut korupsi dan tidak dapat diterima. Korupsi terjadi karena manusia-manusia yang atas dasar motif-motif tertentu melakukan korupsi. Tanpa manusia-manusia dengan logika dan prilaku koruptif mustahil korupsi dapat terus berkembang dan bertahan bahkan kini semakin merajalela di Indonesia. Dengan demikian, bagi penulis, pokok terpenting dalam mewujudkan strategi anti-korupsi ialah dengan memperhatikan aspek manusia yang melakukan korupsi (homo corruptus) baru kemudian merambah pada instrumen-instrumen hukum yang lebih luas dan kompleks.

Abstract

This research aims to analyze the implications of investment in the Omnibus law Undang-Undang Cipta Kerja on the competition of micro, small, and medium enterprises (UMKM) sector in Indonesia. The method used is a literature study by collecting data from various reliable sources. The results show that the Omnibus law Undang-Undang Cipta Kerja has significant implications for business and investment in Indonesia, including for the UMKM sector. The law aims to create a quality business and investment climate for businesses, including UMKM and foreign investors. However, some critics argue that the law may lead to a concentration of economic power in the hands of large corporations and reduce opportunities for small and medium-sized businesses. The implications of investment in the Omnibus law Undang-Undang Cipta Kerja need to be carefully considered to ensure that the UMKM sector can compete fairly and sustainably in an increasingly competitive market.

Abstract

This research aims to analyze the impact of Domestic Component Level (DCL) on the investment climate in the solar energy industry in Indonesia, with a focus on the regulatory framework set forth by the Ministry of Industry Regulation No. 23 2023. As the global solar energy industry grows, Indonesia has committed to developing solar energy as part of efforts to achieve clean and sustainable energy targets. Ministry of Industry Regulation No. 23 2023 plays a crucial role in setting the DCL requirements that stakeholders in the solar energy industry must meet. This research will delve into the impact of compliance with DCL requirements in terms of investment, local production, and the growth of the solar energy industry in Indonesia. Furthermore, we will evaluate the extent to which these regulations align with national goals to reduce dependence on fossil fuels and support the development of renewable energy sources.

Abstract

Hak Pensiun merupakah salah satu hak dari pegawai, karyawan, pekerja yang dijamin oleh undang-undang di bidang ketenagakerjaan. Hak Pensiun memberikan jaminan bagi pegawai yang memasuki usia pensiun dan tidak bekerja lagi untuk tetap menerima manfaat bagi pegawai setelah tidak bekerja lagi. Adanya perbedaan penghitungan hak pensiun dalam UU Nomor 13 Tahun 2003 dengan Peraturan Pemerintah Nomor 35 Tahun 2021 mengakibatkan ketidakadilan bagi pegawai yang pensiun. Tulisan akan membahas bagaimana konsep keadilan dalam hukum dan pengaturan pensiun menurut peraturan ketenagakerjaan di Indonesia.

Abstract

LGBT acts are difficult for most people to accept, but along with the development of the era, LGBT groups are increasingly widespread even in Indonesia. Of course, it requires special attention in the field of law related to the existence of the group, therefore it is necessary to have legal regulations related to LGBT acts as an act or as a criminal act, taking into account that the law in Indonesia uphold Customary Law based on legal norms in the community. Regulations related to LGBT acts have not been specifically regulated by legislation in Indonesia, but it does not rule out cases related to LGBT acts that ultimately demand settlement through legal channels. Likewise, within the military sphere, LGBT acts in Indonesian legislation have not been specifically regulated so that elements that can be imposed as a criminal act cannot be subject to a criminal act itself (LGBT acts singly).

Abstract

Based on article 15 paragraph 1 of the Law on the Position of Notaries, article 1313 of the Civil Code and article 1320 of the Civil Code and also the principle of freedom of contract, a notarial deed can also be called an agreement with perfect evidentiary power. The legal consequences that arise if there is a violation in the formation of a notarial deed can be seen from two sides. Firstly, the legal consequences are seen in terms of the formal and material requirements of a notarial deed based on Law on the Position of Notaries Number 2 of 2014 concerning amendments to Law Number 30 of 2004 concerning the Position of Notaries. Of all the legal consequences listed in the UUJN, it only reduces the quality of an authentic notarial deed, turning it into a deed that has the power of proof as a private deed. Second, look at the conditions required in Article 1320 of the Civil Code. If the category of subjective requirements is not fulfilled, the result can be cancelled, which means that the cancellation must be requested before a judge. The category of objective requirements means that if they are not met, the legal consequences will make the agreement null and void. In this way, a notarial deed as an authentic deed can turn into a private deed and can also become null and void. The methodology used is normative with a statutory approach and a conceptual approach. The purpose of this writing is to determine the legal consequences of notarial deeds that are not made in accordance with legal provisions.

Abstract

Every high state institution in the Republic of Indonesia has the authority contained in the 1945 Constitution of the Republic of Indonesia. The authority granted by the constitution is a binding authority for high state institutions. The strengths and weaknesses of the authority of high state institutions influence the constitutional law system in Indonesia. Authority between high state institutions is a reflection of the checks and balances in the democratic system in Indonesia. The People's Consultative Assembly (MPR) of the Republic of Indonesia has become the highest state institution after the 1945 Constitution of the Republic of Indonesia, where this institution is called the highest state institution. As a high state institution, the MPR has the authority to amend and enact the constitution. The MPR's authority is also stated in Law No. 17 of 2014 concerning MD3 in article 4, which is more ceremonial in nature. Strengthening the authority of the MPR is very necessary as a high state institution to create balance and corrections between state institutions. It is hoped that the MPR institution will not be a complementary high institution in the Indonesian constitutional system.

Abstract

Indonesia is in the fourth of most populous country in the world with a population of around 266,872,775 people (BPS, 2017), which has an impact on the emergence of social problems, crime and others. Central Bureau of Statistics data also illustrates in the period 2014 to 2016 the number of crimes in Indonesia tended to increase significantly in detail years: 2014: 325,317 cases, 2015: 352,936 cases, 2016: 357,197 cases. Meanwhile the number of recidivists also increased significantly. The current legal process, from the beginning to the results of the court rulings, to the correctional stage is deemed not optimal in fostering criminals to reduce recidivist rates. Besides the problem of the accumulation of case files and an overflowing number of prison inmates which have an impact on waste of the state budget. Recently, there has been a punishment paradigm known as restorative justice which encourages perpetrators to repair the losses they have caused to victims, their families and also the community. (Makarao, 2013). However, in the Justice Restoration process, law enforcement officials still need a real and objective format not only based on analogy and legal interpretation. To achieve this real, objective format, the use of forensic psychology is very much needed in the criminal justice process not only assisting during the examination at the police, at the prosecutor's office, in court and when the convict is in a correctional facility, but forensic psychology is utilized independently and optimally both at the level and level of collaborative technical applications, accompanied by a more futuristic understanding. Thus, it is hoped that this profession will help realize the supremacy of the legal system under a constitution that is effective and responsive, professional and with integrity in order to achieve the objectives of the law.

Abstract

This article examines the role of Business Competition Regulation in curbing unhealthy practices within Securities Crowdfunding (SCF). It seeks to assess the efficacy of current legal regulations regarding business competition in preventing such malpractices in SCF. The regulations set forth by the Indonesia Financial Services Authority (Peraturan Otoritas Jasa Keuangan - POJK), which oversee SCF, necessitate an effective harmonization with Business Competition Law or anti-monopoly legislation to ensure the integrity and efficiency of the financial market. The synergy between SCF regulations and Law No. 5/1999, concerning the Prohibition of Monopoly Practices and Unhealthy Business Competition, is crucial for establishing a fair and transparent capital market. The consistent application and enforcement of this law are anticipated to reinforce Indonesia's economic foundation, facilitate more efficient economic growth, and foster a reliable investment climate for business entities. Therefore, the advancement of SCF in contributing to economic progress hinges on meticulous regulatory harmonization and stringent law enforcement, thus positioning Indonesia as a key player in the dynamic global economy.
