ACADEMOS Jurnal Hukum dan Tatanan Sosial is a journal in the field of Law managed and developed by Students, Faculty of Law, University of Muhammadiyah Surabaya, Indonesia. Since it was first published in 2022, the journal is intended to facilitate and provide a legal study development forum for lecturer, Researchers, and students. This journal publishes articles in the field of law with a theme specific to each problem. The specialty of this journal is to publish articles in contemporary legal studies with an interdisciplinary approach. The journal is also intended to publish a variety of studies on social justice and crime in a broad perspective. ACADEMOS Jurnal Hukum dan Tatanan Sosial publishes fallen theoretical contributions in the field of social-law, as well as contributions that are the result of empirical and interdisciplinary research. ACADEMOS journal is published twice a year (in February and August) by the Faculty of Law, University of Muhammadiyah Surabaya.

Abstract

The blocking of accounts by the Financial Transaction Reports and Analysis Center (PPATK) is a crucial step in preventing money laundering and terrorism financing. While aimed at maintaining the integrity of the financial system, this practice is often carried out without a transparent legal process, potentially harming customers uninvolved in illegal activities. This article examines the dynamics between the preventive measures taken by PPATK and their implications for human rights. Using a qualitative approach, this study analyzes existing regulations and identifies gaps in the protection of individual rights. The findings indicate the need for better coordination between PPATK and the Financial Services Authority (OJK) and for strengthening regulations to ensure transparency in the account blocking process. Recommendations are also proposed to enhance the appeal mechanisms for affected customers

Abstract

Ronald Tannur has emerged as a public figure reflecting the inequality in Indonesia's criminal justice system. This case highlights alleged preferential treatment of perpetrators from elite political backgrounds, potentially violating the principle of equality before the law. This study aims to analyze how the legal process in this case reflects structural, cultural, and institutional inequality in the criminal justice system. The research method used is a sociological juridical approach with a case study approach. The results show strong indications of bias in the legal process, both in terms of treatment by law enforcement officers and media exposure. This study recommends the need for reform of the criminal justice system to ensure independence, transparency, and equality for all citizens.

Abstract

This research aims to identify the elements of plagiarism, analyze the legal protection for alternative universe novel writers who are victims of plagiarism, and find out the legal consequences for the perpetrators and the application of the law in practice. The method used is normative and empirical juridical with doctrinal legal research specifications. Data is collected through literature studies and online platforms, then analyzed narratively. The results of the study show that plagiarism in AU novels can be seen from the similarity of plot, dialogue, characterization, and story structure. Legal protection is regulated in Article 1 of Law No. 28 of 2014 concerning Copyright, including moral rights and economic rights regulated by Article 5 and Article 9, and the term of copyright protection is regulated by Article 58. The author can file civil and criminal lawsuits in accordance with Article 113 of the UUHC. For digital plagiarism, Law No. 11 of 2008 concerning Electronic Information and Transactions (UUITE) also provides protection regulated in Article 35. In practice, dispute resolution is more often carried out through non-litigation channels such as mediation and negotiation on digital platforms. In addition, publishers play an important role in helping authors protect their copyrights

Abstract

The National Strategic Program is part of the national interest in terms of economic and infrastructure development, regulated through Presidential Regulation No.03/2016 on the Acceleration of the Implementation of National Strategic Projects. However, this National Strategic Project scheme faces polemics related to the denial of the privileges of indigenous peoples, as happened in Merauke. So that the problems that occur have legal implications, namely violating the customary rights of the people in the Papua region. This study formulates the problem, namely how the government's authority in managing customary land for development in Indonesia and how the ideal regulation of customary land management in Papua for development in the National Strategic Program based on the Responsive Law perspective. This type of research is Normative Juridical and uses a statute approach and conceptual approach. The results of the study show that government policies are still Repressive law and override the rights of indigenous Papuans.

Abstract

Penelitian ini bertujuan untuk menganalisis dan merekonstruksi tata kelola pengadaan barang dan jasa dalam proyek digitalisasi pendidikan agar selaras dengan prinsip akuntabilitas dan pencegahan tindak pidana korupsi. Fokus utama penelitian adalah mengkaji peran Komisi Pemberantasan Korupsi (KPK) dalam pengawasan proyek pengadaan berbasis teknologi di sektor pendidikan, urgensi pengaturan dalam Undang-Undang Pemberantasan Tindak Pidana Korupsi (UU Tipikor), serta mengkaji pembelajaran hukum dari kasus pengadaan laptop Chromebook pada masa kepemimpinan Menteri Pendidikan Nadiem Makarim. Metode penelitian yang digunakan adalah penelitian yuridis normatif dengan pendekatan perundang-undangan dan studi kasus, yang dilengkapi dengan studi pustaka dari jurnal nasional dan internasional dalam sepuluh tahun terakhir. Hasil penelitian menunjukkan bahwa sistem pengadaan proyek digitalisasi pendidikan masih memiliki celah korupsi akibat lemahnya transparansi, konflik kepentingan, dan kurang optimalnya integrasi pengawasan KPK pada tahap perencanaan dan pelaksanaan. Temuan juga menunjukkan bahwa UU Tipikor memiliki urgensi yang sangat kuat untuk diterapkan secara progresif dalam sektor pengadaan digital, khususnya dalam konteks mark-up anggaran, pengkondisian spesifikasi teknis, dan pengaturan penyedia barang. Kesimpulan penelitian ini menegaskan perlunya rekonstruksi tata kelola pengadaan melalui penguatan peran KPK, digitalisasi pengawasan berbasis risiko, serta reformulasi regulasi teknis agar proyek digitalisasi pendidikan berjalan akuntabel dan bebas dari korupsi.

Abstract

This research analyzes the legal implications of issuing banking covernotes without authentic deeds, focusing on notary responsibility and consumer protection in Indonesia. Using a normative juridical method, this study examines regulations, legal principles, and relevant case studies to address the normative vacuum surrounding covernotes. The findings indicate that while covernotes function to expedite credit disbursement pending the completion of mortgage certificates, they lack the executory legal force of authentic deeds. Consequently, covernotes serve primarily as moral guarantees, leaving banks vulnerable during debtor defaults and exposing debtors to legal uncertainty regarding collateral status. The absence of specific regulations in the Notary Law (UUJN) creates significant risks for all parties. The study highlights that notaries bear full liability for the content of covernotes; negligence or falsification of information can lead to civil lawsuits for unlawful acts, administrative sanctions, and criminal charges for forgery. From a consumer protection perspective, the current reliance on covernotes places debtors in a weak position due to information asymmetry and a lack of binding legal protection. The research concludes that specific regulations are urgently needed to clarify the legal standing of covernotes, ensuring that the efficiency of banking transactions does not compromise legal certainty and justice for consumers and creditors alike
