Abstract

Syariah Financial Institution means that the financial institution is run based on the Islamic teaching that refers to Qur’an and the Sunnah. Practically, it began in early history of islam, then was developed into Syariah Financial Institution. So, the purpose of Syariah Financial Institution is not merely for profit orientation. Further, it should be in accordance with Islamic value and the human philantrophy. Most of Syariah Financial Institution’s financing is for busines sector and its ability to reach the micro business, that can’t be done by commercial banks. The financing for small business is funded by islamic institutions due to Grameen Bank effect. Previously, Grameen Bank was built in mid-decade of 1970. The Financing of Syariah Financial Institution, in any sort, including cooperative union or BMT (Baitul Maal wa Tamwil), increased overtimein both Institution Revenue and the Financing Rate. According to Financial Service Authority, most of financing of Syariah Banking is for the Micro, Small, Medium Enterprises that is very important for the nation economy, because it is engaged in the real sector of economy.

Abstract

In terms of the economic development of a nation it cannot be separated from economic activities that are stable in a country, on the other hand it is undeniable that now the world is struggling against the Covid-19 pandemic which is known together with all countries is intensively making movements aimed at Minimizing the spread of the corona virus, recorded based on data from the Google news site related to the development of Covid-19 cases throughout the country, the total cases worldwide were recorded at 50,794,593 with cases of patients dying as many as 1,262,199 Various policies were created by the government in order to attract the attention of foreign investors to enter Indonesia to invest, one of which is the open door policy to improve the country's economy after the Covid-19 pandemic in the future.

Abstract

Penelitian ini dilatar belakangi oleh adanya kenaikan pada pertumbuhan transaksi mobile banking dari tahun 2019 (15,4 juta), 2020 (33,8 juta), 2021 (46,4 juta), 2022 (124,54 juta). Penelitian ini bertujuan untuk menganalisis Pengaruh Citra Merek, Kualitas Pelayanan Dan Kepercayaan Terhadap Loyalitas Nasabah Pengguna Mobile Banking (Studi Kasus Pada Bank Syariah Indonesia). Responden dalam penelitian ini adalah Nasabah Bank Syariah Indonesia yang menggunakan aplikasi mobile banking. Metode pengumpulan data dilakukan dengan metode purposive sampling, total sampel yang diambil dari penelitian ini adalah 100 responden nasabah Bank Syariah Indonesia. Data yang diperoleh kemudian diolah dengan menggunakan alat bantu SPSS versi 22 dan dianalisis dengan analisis regresi linier beganda. Analisis ini meliputi uji validitas, uji reliabilitas, uji multikolinieritas, uji heteroskedastisitas, uji normalitas, uji Ttest, uji Ftest, analisis regresi linier berganda, uji R (koefisien determinasi).adapun hasil dari penelitian ini adalah ada 3 faktor yang mempengaruhi loyalitas nasabah  yakni citra merk,kualitas pelayanan, dan kepercayaan.

Abstract

This study aims to find out about MLM (Multi Level Marketing) in Islamic view (Islamic law). This research is qualitative descriptive. This study included literary research to examine the written sources such as scientific journals, book references, literature, encyclopedias, scientific articles, scientific papers and other sources that are relevant and related to the object which is being studied. As for the object of study of this research is form of texts or writings that describe and explain about MLM that be popular in Indonesia. Results of this study is Islamic law permit MLM as long as not contrary with Islamic law. However, if it is contrary with Islamic law, so MLM is forbiden. Islam has principles on the development of business systems that must be free of elements dharar (danger), jahalah (vagueness) and zhulm (detrimental or unfair to one party). The system of bonuses to be fair, do not oppress and do not only benefit the people. Businesses also must be free from the element of gambling, oppression, fraud, unclean, riba (interest), vanity etc. If we want to develop a MLM business, it should be free from those elements above. Therefore, the goods or services are commercialized and ordinances sales must be halal, no haram and doubtful, and not in conflict with the principles of Shari'ah above.

Abstract

Sertifikasi halal merupakan hal yang urgent ditengah begitu banyaknya produk makanan dan minuman yang beredar dimasyarakat. Pencantuman sertifikasi halal dalam kemasan produk oleh pelaku usaha adalah salah satu bentuk perlindungan hukum terhadap konsumen dan dukungan kepada perkembangan industri pangan halal. Sertifikasi halal mengalami perubahan sifat, yang pada awalnya bersifat sukarela menjadi wajib (mandatory) setelah adanya Undang-Undang Republlik Indonesia Nomor 33 Tahun 2014 tentang Jaminan Produk Halal. Masyarakat Indonesia yang mayoritas muslim wajib memperoleh perlindungan hukum atas beredarnya makanan dan minuman yang akan dikonsumsi. Oleh karena itu lembaga Majelis Ulama Indonesia (MUI) dan Badan Penyelenggara Jaminan Produk Halal (BPJPH) sebagai lembaga yang berwenang dalam penerbitan sertifikat halal harus lebih presisi dan pruden dalam proses verifikasi produk yang akan disertifikasi. Penelitian ini mengkaji tentang bagaimana pertanggungjawaban hukum MUI dan BPJPH sebagai lembaga yang diberikan kewenangan oleh undang-undang terhadap penerbitan sertifikat halal pada produk yang haram dan terlanjur beredar serta sudah dikonsumsi oleh masyarakat. Jenis penelitian yang digunakan adalah yuridis normatif dan studi kepustakaan dengan melakukan pengkajian terhadap peraturan perundang-undangan, jurnal, buku, maupun karya ilmiah yang lain seperti skripsi, tesis dan disertasi yang relevan dengan penelitian ini. Penelitian ini bersifat deskriptif-analitis yaitu suatu metode yang mengambarkan dan menjelaskan secara sistematis, dapat diartikan sebagai prosedur pemecahan masalah yang diteliti berdasarkan fakta-fakta yang tampak sebagaimana adanya. Kesimpulan dari penelitian ini bahwa jika terjadi kesalahan atau kelalaian yang dilakukan oleh oknum-oknum yang ada di MUI dan BPJPH sebagai lembaga yang berkompeten dalam urusan sertifikasi halal tidak bisa selesai hanya dengan meminta maaf kepada masyarakat tetapi harus ada sangsi pidana maupun sangsi perdata yang diimplementasikan dalam rumusan norma hukum yang jelas karena bisa berpotensi terulang kembali apalagi jika ada unsur kesengajaan dalam penerbitan sertifikat halal produk haram yang sangat merugikan masyarakat umum dan muslim khususnya.
