Abstract

In the digital age, the rapid dissemination of information often exceeds legal boundaries, making defamation on social media a complex social issue. This study aims to evaluate the implementation of laws on defamation cases on social media, particularly the effectiveness of the Electronic Information and Transaction Law (EIT Law) and the challenges in its application. The method used is a normative juridical approach with analysis of legislation, court decisions, and related legal literature. The results of the study show that, although the ITE Law has a strong legal framework, its implementation is hampered by difficulties in proving cases, lengthy court proceedings, and low public awareness of the limits of expression in cyberspace. These findings highlight the need for improvements in the reporting system, enhanced law enforcement capabilities, and digital education. This research increases understanding of legal changes in the digital age that affect public policy and the protection of human rights.

Abstract

Social conflicts often exacerbate violations of women's rights, including gender-based violence and discrimination, which require changes in the law enforcement system to provide better protection. This study explores various obstacles in the existing legal system, such as systemic bias and the lack of mechanisms to respond quickly, and proposes a reform model that focuses on a gender-responsive approach. By applying qualitative analysis methods to various cases of social conflict in Indonesia, this study found that incorporating a gender perspective into legal policy can improve women's access to justice. The results show that this reform not only helps reduce women's vulnerability but also strengthens overall social stability.

Abstract

The digital era is revolutionising online transactions in Indonesia, valued at hundreds of trillions of rupiah, but it also poses risks of fraud, product discrepancies, and difficulties in proving civil disputes due to doubts about the integrity of electronic deeds. The purpose of this research is to analyse the legal consumer protection framework based on Law No. 8/1999 on Consumer Protection and Government Regulation No. 80/2019, as well as the evidentiary strength of electronic deeds in accordance with Law No. 11/2008 on Electronic Information and Transactions jo. No. 19/2016, in order to identify challenges and solutions for legal certainty. Using a normative legal approach with secondary analysis of regulations, journals, books, and court decisions through literature review. The results show that regulations recognise electronic deeds as valid evidence if their integrity is guaranteed via digital certification, but challenges in metadata verification and e-commerce oversight hinder effectiveness; strengthening SEMA MA, blockchain, and judicial education is needed.

Abstract

Current developments can bring about changes in society, where crimes are no longer committed by humans but can also be committed by corporations. Corporate activities in the mining sector can cause various impacts, namely environmental damage due to mining activities. This study aims to determine corporate responsibility and the sanctions imposed due to mining activities that cause damage and losses to the community. This study is normative in nature by reviewing various literature related to this research. The results of this study are that corporate criminal responsibility is obliged to provide compensation to the community who suffers losses due to illegal mining business activities. Then, based on the theoryvicarious liabilitywhich considers vicarious liability. In addition, corporations may be subject to sanctions under Law Number 3 of 2020 concerning Amendments to Law Number 4 of 2009 concerning Mineral and Coal Mining. The principal sanctions include imprisonment, detention, and fines. Additional sanctions include confiscation of goods used in the crime, confiscation of profits obtained from the crime, and the obligation to pay costs incurred as a result of the crime.
