Abstract

the obstacle faced by Micro-Small Business Enterprises called as MMBE having strong engagement with business bureaucracy or business organization was barriers the business expansion, credit facilities, and mutual-business cooperation. the existence of PT Perorangan/ PT MMBE was an effective solution to respond and to stimulate the development of PT itself. easy to doing business are indicated from build-up business organization (PT Peorangan) only himself as a founder of legal entity (personal statement) and the model of business-organization management is used one-tier board system (director and commissioner are one board). Mixed-legal research methodologies are selected for this research, secondary data are compulsory (online-library research) while primary data is complementary (field research, used non-probability to determine the population, and purposive sampling is selected for respondents). the data analyzed used the statute approach (primary legal material) and conceptual approach (secondary legal material), the conclusion of this research used the inductive technique and all of the results have been described descriptively. Indonesian government used an economic approach to law for determining the regulation of a one-tier board system in the business-organization management in PT Perorangan/PT MMBE as a media and stimulus for MMBE resilience purposing in Indonesia. one-tier board system is in-line with the PT Perorangan/PT MMBE, it has a correlation to good corporate governance principles that were already regulated in Article 153 Law Number 6 of 2023 on Cipta Kerja

Abstract

Smoking exposure among pregnant women is correlated with the risk of low birth weight. The policy factors are believed to contribute to the rate or prevalence of smoking activities. This study aims to simultaneously portray the incidence of low-birth-weight newborns correlated with smoking exposure. The samples were 160 respondents, with 57 and 103 respondents in Hospital A and G respectively. A mixed-method analysis was utilized by combining a retrospective approach to identify the key findings and be equipped with a narrative analysis of the socio-demographic - law enforcement process. The Spearman correlation analysis was used for investigating correlation among variables. Spearman correlation test smoking exposure per day in minutes (rho= -0.595, p<0.001) and the number of smokers (rho= -0.621, p<0.001) for Hospital A, and smoking exposure per day in minutes (rho= -0.681, p<0.001) and the number of smokers (rho= -0.613, p<0.001) for Hospital G. It implied a strong correlation of inverse relationship among those variables. Smoke-free law enforcement is a key point to address, aiming at vulnerable group protection, including pregnant mothers and babies. The local government should consider the effects affected by smoking behavior in the community.

Abstract

Among the efforts to overcome the obstacles that hinder Indonesia's future is by implementing the Merdeka Belajar Kampus Merdeka (MBKM, Independent Education Independent Campus) program, in which one of these activities is to improve interpersonal skills (soft skills) and technical skills (hard skills) in order to provide bargaining power for prospective workers in the global job market. Currently, Indonesia does not lack intelligent (literate) people or lack of skills as labor capital but is actually lacking in terms of integrity, thus the fundamental problem of the MBKM program is how to contribute in the development of the students' integrity by mapping the activity design that is deemed relevant for students with integrity within the framework of the MBKM programs. A mixed legal research methodology was chosen for this study, with secondary data serving as a complement to primary data. Primary legal materials consist of laws and regulations, supplemented by field data obtained through interviews with key informants. All data collected will be analyzed using legal and conceptual approaches. First, there are four problems with the MBKM activities in an effort to shape students with integrity, namely problems with learning outcomes which in several MBKM programs are disoriented as the MBKM program is not fully in line with the RPJMN on (HR); the other problem is the fact that the MBKM program has not been integrated with the student program related to Pancasila. Second, the design of the integrity student program in MBKM activities, namely: a) the integrity student program is added to become one of the MBKM programs; b) the integrity student program is mainstreamed in the higher education curriculum by including the public integrity learning that is collaborated on civic education, ethics, history, and business courses; and integrated with learning outcomes.Keywords: Students with Integrity, Independent Campus, MBKM AbstrakMenyelesaikan kendala yang mengikat masa depan Indonesia salah satunya caranya dengan penerapan program Merdeka Belajar Kampus Merdeka (MBKM), salah satu dari kegiatan tersebut meningkatkan kemampuan interpersonal (soft skill) dan secara teknis (hardskill) untuk memberikan dorongan daya tawar bagi calon pekerja di pasar/bursa kerja global. Saat ini Indonesia tidak kekurangan masyarakat yang cerdas (literat) atau kurangnya kemampuan sebagai modal tenaga kerja namun sejatinya kurang dalam aspek integritas, permasalahan mendasar dari program MBKM adalah bagaimana memberikan kontribusi terhadap integritas pelajar dan desain kegiatan seperti apa yang relevan antara pelajar berintegritas dalam kegiatan MBKM. Metodologi penelitian hukum campuran dipilih dalam penelitian ini, data sekunder menjadi data pelengkap dari data primer, bahan hukum primer beruapa peraturan perundang-undangan, dilengkapi dengan data lapangan melalui wawancara kepada narasumber sebagai informan kunci (key informant), semua data yang telah diperoleh akan dianalisis menggunakan pendekatan perundang-undangan dan konseptual. hasil penelitian Pertama, terdapat empat permasalahan kegiatan BKM dalam upaya menciptakan pelajar berintegritas yaitu: adanya problematika terhadap luaran pembelajaran; beberapa program MBKM disorientasi; program MBKM tidak sepenuhnya sejalan dengan RPJMN tentang SDM; program MBKM belum terintegrasi dengan program pelajar Pancasila. Kedua, desain program pelajar berintegritas dalam kegiatan MBKM yaitu: a) program pelajar berintegritas ditambah menjadi salah satu program MBKM; b) program pelajar berintegritas di arus utamakan dalam kurikulum pendidikan tinggi dengan memasukkan pembelajaran integritas publik yang dikolaborasikan pada matakuliah pendidikan kewarganegaraan, etika, sejarah, dan bisnis; dan diintegrasikan dengan learning outcomes.Kata Kunci: Pelajar Berintegritas, Kampus Merdeka, MBKM

Abstract

The growth of start-ups in Indonesia in the GIG economic era brings new challenges related to social security protection for workers. This study aims to examine the legal protection of start-up workers in obtaining social security and decent working conditions, especially in the context of the risk of losing their job. The main problem raised is the lack of optimal regulations that protect startup workers who are generally informal and do not have formal employment relationships. The research method used is a normative legal method with a statute and conceptual approach, using primary, secondary, and tertiary legal materials. The results show that startup workers face high vulnerability to termination of employment (PHK) without adequate social security protection. Although there is a unemployment benefits program through the Job Creation Law, its implementation is not inclusive of non-formal workers. This study concludes the need for regulatory changes to be more inclusive, as well as the need to recognize the status of startup workers in the social protection system. Collaborative efforts between governments, startups, and digital platforms are essential to expand social security coverage, to ensure decent working conditions for all workers in the digital age and GIG economy.

Abstract

This paper investigates the legal and ethical implications of deviating from the equal (50:50) distribution of marital property in Indonesian divorce cases, particularly when one spouse acts in bad faith. While Indonesian law—namely Article 35 of the Marriage Law and Article 97 of the Compilation of Islamic Law—generally upholds equal division of joint property, this study highlights how courts may apply the contra legem principle to achieve substantive justice. Using a normative legal method, the research examines regulations and judicial discretion in reallocating marital assets when faced with evidence of misconduct, unequal contributions, or financial manipulation. The study draws from comparative legal systems and landmark court decisions to illustrate how contra legem serves not as a defiance of law, but as a mechanism to protect vulnerable spouses and promote fairness. It concludes that flexible, contribution-based distribution, supported by judicial transparency and evidentiary standards, better reflects the realities of modern marriages and ensures just outcomes within Indonesia’s dual legal framework.

Abstract

This article explores the dual procedural character of divorce trials in Indonesia, wherein court examinations are mandated to be private while the final judgment must be publicly announced. Triggered by the controversy in the divorce case of Baim Wong and Paula Verhoeven, the study emphasizes the urgency of reinforcing judicial compliance with both transparency and privacy protections. Employing a normative juridical method based on secondary data, including statutory regulations and doctrinal analysis, the research assesses the intersection between Law No. 48 of 2009 on Judicial Power and Law No. 14 of 2008 on Public Information Disclosure. The findings indicate that while judicial decisions are inherently public, sensitive personal information revealed during closed hearings must be exempted from disclosure. The case underscores the necessity for clearer procedural boundaries to ensure that the judiciary maintains both public accountability and the protection of individual rights in family law cases.

Abstract

This study aims to analyze the legal protection of health workers in Indonesia, particularly in light of the enactment of Law No. 17 of 2023 concerning Health. Using a normative juridical approach with statutory and conceptual analyses, the research examines the extent to which existing legal frameworks uphold the principles of legal certainty, due process, and the protection of human rights in the health sector. Legal materials include primary (laws and regulations), secondary (legal literature and expert opinions), and tertiary sources (legal dictionaries and encyclopedias). The findings indicate that Law No. 17 of 2023 offers significant normative progress by explicitly mandating state responsibility for the welfare, safety, and professional development of health workers. It encompasses both preventive and repressive legal protections, aligning with Philipus M. Hadjon’s theory of legal protection. However, practical implementation remains uneven, particularly during health crises such as the COVID-19 pandemic, where health workers experienced verbal abuse, legal threats, and inadequate support. The research concludes that while the legal substance has been improved, the effectiveness of protection depends on concrete implementation mechanisms, such as detailed regulations, supervisory systems, reporting mechanisms, and institutional support at local levels. It recommends the issuance of derivative regulations granting limited legal immunity in emergencies, establishment of legal aid units in health facilities, legal literacy training for health professionals, and a stronger culture of state and societal protection. These steps are essential to ensure that health workers can fulfill their roles safely and ethically, especially during increasingly complex public health emergencies.
