Abstract

A husband or wife who has been abandoned by their spouse without knowing their whereabouts has the right to file a lawsuit or request permission for a divorce decree to the Religious Court according to their domicile or place of residence. Filing for divorce through this scheme requires an administrative requirement in the form of a letter of absence issued by the village/sub-district office where the defendant last resided. However, not all village or sub-district offices have standard operating procedures (SOPs) for issuing these certificates, which can potentially hinder the rights of the Plaintiff/Applicant for Permission to Announce Divorce. This study aims to determine the procedure for issuing a certificate of absence and its implications for the rights of those seeking justice. This study uses a normative empirical approach, which is a research method based on the empirical experience of the author while practicing as an advocate at the Purwokerto Religious Court Legal Aid Post throughout 2018. The results of the study show that the process of issuing a certificate of absence is hampered by the absence of standard operating procedures, which leads to allegations of maladministration in the form of prolonged delays. In turn, those seeking justice are unable to file for divorce at the Purwokerto Religious Court.

Abstract

Kasus Perbuatan Melawan Hukum (PMH) sering muncul dalam praktik peradilan di Indonesia dan berdampak besar terhadap kerugian pihak yang berkaitan baik kerugian materill maupun immateriil. Penelitian ini bertujuan untuk menganalisis dasar Pertimbangan Hakim dan Pertanggung Jawaban Hukum terhadap pihak yang mengalami kerugian, berdasarkan Putusan Nomor 15/Pdt.G/2024/PN Pwr. Metode penelitian yang digunakan adalah yuridis normatif, yang menitikberatkan pada telaah terhadap norma-norma hukum, peraturan perundang-undangan terkait, serta literatur hukum yang relevan dengan pendekatan perundang undangan dan studi kasus melalui analisis atas Putusan Nomor 15/Pdt.G/2024/PN Pwr, yang berfungsi sebagai data empiris untuk menggambarkan penerapan norma hukum dalam praktik peradilan. Pendekatan ini memungkinkan peneliti untuk mengkaji secara mendalam dan kritisch mengenai dasar pertimbangan hakim serta pertanggungjawaban hukum terhadap pihak yang mengalami kerugian. Hasil penelitian menunjukkan bahwa hakim dalam memutus perkara perbuatan melawan hukum melakukan kesalahan interpresentasi terhadap yuridiksi, terutama terkait perkara perbuatan melawan hukum akibat dari gugurnya pra-peradilan dan ketentuan bahwa perkara tersebut termasuk kewenangan PTUN yang tidak sesuai dengan Pasal 1365 KUH Perdata  dan ketentuan Undang-Undang Nomor 5 Tahun 1986.

Abstract

Disputes between employers and employees are a common occurrence in industrial relations. Law Number 2 of 2004 concerning the Settlement of Industrial Relations Disputes stipulates that bipartite settlement must be attempted before resorting to litigation. The results of bipartite agreements are outlined in a Collective Agreement, which is binding and must be registered with the Industrial Relations Court. This article aims to examine the urgency of registering Collective Agreements to strengthen legal certainty and protect both parties. This research uses a normative juridical method with a statutory and conceptual approach. The study shows that registering a Collective Agreement has important legal consequences in streamlining the implementation of the agreement and serving as a basis for enforcement in the event of default. Therefore, fulfilling this registration obligation is a strategic step in creating legal certainty in industrial relations.

Abstract

The involvement of adolescents in drug trafficking networks has become an alarming trend in Indonesia. Adolescents are frequently exploited as couriers by drug dealers due to the relatively lenient legal consequences they face under the juvenile justice system. This phenomenon arises from legal gaps within Law No. 11 of 2012 on the Juvenile Criminal Justice System and Law No. 35 of 2009 on Narcotics, which prioritize restorative justice approaches such as diversion. While these laws aim to protect children’s rights, in practice they are often misused by adult perpetrators to avoid harsher penalties by using minors as proxies. This study aims to analyze how these legal gaps are exploited and evaluate the challenges in enforcing narcotics law involving minors. A normative legal research method is used, focusing on statutory and conceptual approaches. The findings reveal that adolescents become involved as drug couriers due to social and psychological vulnerabilities such as peer pressure, lack of parental supervision, economic incentives, and low awareness of legal consequences.

Abstract

PENERAPAN PRINSIP KEHATI-HATIAN DALAM VALUASI HAK KEKAYAAN INTELEKTUAL SEBAGAI JAMINAN FIDUSIAThe Indonesian government passed Government Regulation No. 24 of 2022 concerning implementing regulations for Law No. 24 of 2019 on the Creative economy regulating Intellectual Property Rights (IPR) holders can apply for loans to banking institutions is a potential utilization of the creative economy. Banking institutions before providing capital analyze prospective debtors for loan approval. This research is a solution for banking institutions to apply IPR as a fiduciary guarantee, it needs government support to regulate the IPR valuation mechanism. This research applies normative legal research problem formulation: First, How is the Implementation of IPR as a fiduciary guarantee according to Bank Indonesia Regulation with Government Regulation on Creative Economy? Second, How is the Implementation of Prudential Principles of Fiduciary Financing of IPR as Fiduciary Guarantee? The results of this study found that the government emphasized the utilization of IPR in PP No. 24 of 2022 to provide access to IPR as a guarantee of financing. Bank Indonesia Regulation No.9/6/PBI/2007 as a rule for assessing the quality of assets of banking institutions guided by the prudential principle aims to minimize risk and does not find IPR as a collateral asset. The results of this study provide a view of the potential of the creative economy. PP No. 24 of 2022 states that the economic value of IPR is based on: (a) cost approach, (b) market approach, (c) income approach, (d) valuation based on applicable standards, so it can be used as a general reference to create an independent asset valuation institution in coordination with Banking Institutions.

Abstract

Interfaith marriage remains a complex legal issue in Indonesia, particularly when conducted abroad by Indonesian citizens. The Indonesian legal framework, primarily governed by Law No. 1 of 1974 on Marriage, does not explicitly recognize or regulate interfaith marriages, leading many couples to solemnize their unions overseas to circumvent domestic legal constraints. This practice raises crucial questions about the legal recognition, registration, and civil implications of such marriages within the Indonesian legal system. Despite increasing global mobility and pluralistic societies, existing scholarship largely focuses on interfaith marriage from a domestic perspective, leaving a gap in understanding transnational legal challenges. This study aims to provide a comprehensive juridical analysis of interfaith marriages involving Indonesian citizens abroad by examining their validity, registration mechanisms, and implications on citizenship, inheritance, and family status under Indonesian law. By comparing international practices and highlighting legal inconsistencies, the study offers policy recommendations to enhance legal clarity and protection. The novelty lies in addressing the transnational dimension of interfaith marriages—a subject rarely explored in-depth within Indonesian legal scholarship—thus contributing to the reform of family law in a globalized context.

Abstract

Growing awareness of climate change and social justice is shifting people’s desires towards more sustainable and ethical choices. Indonesia is one of the world’s largest carbon emitters, grappling with rapid economic growth and environmental challenges. The country relies heavily on fossil fuels, which produce greenhouse gas emissions from coal-fired power plants. Rising global temperatures illustrate the urgent need for climate action, exemplified by the Paris Agreement, which aims to limit warming to 1.5-2 degrees Celsius. To combat climate change, countries must transform their economies and policies. Indonesia’s commitments include targets to significantly reduce greenhouse gas emissions by 2030 and achieve net-zero emissions by 2060. The implementation of a carbon tax, as part of the Tax Regulation Harmonization Law, is critical in curbing emissions. A carbon tax creates financial incentives for businesses and individuals to adopt sustainable practices and invest in renewable energy. This study uses qualitative normative legal analysis to evaluate the effectiveness of Indonesia’s carbon tax policy by emphasizing the principle of sustainability. Ultimately, the implementation of a carbon tax not only aims to reduce emissions but also encourages sustainable living while aligning with international climate agreements and sustainable development goals.

Abstract

The difference of opinion among judges regarding the obligation to use Indonesian in rental agreements, as seen in District Court Decision Number 101/Pdt.G/2016/PN.Jkt.Sel and Supreme Court Decision Number 3230 K/Pdt/2018, creates legal uncertainty. This stems from confusion in interpreting whether the use of Indonesian is a halal causa requirement or merely a formality. This research employs a normative juridical method with statutory, conceptual, and case approaches. The findings indicate that halal causa relates to the substance of an agreement, not the language used. The South Jakarta District Court mistakenly viewed the obligation to use Indonesian as a halal causa requirement, while the Supreme Court misinterpreted it as a mere formality. In reality, the use of Indonesian is a formality condition, not a halal causa requirement. When drafting business agreements, parties must understand the validity conditions and legal requirements. To prevent inconsistencies, improving judicial decision-making quality is essential.

Abstract

 In Islamic law, Muslims are required to consume halal food and beverages including medicines in general. 80% of Indonesia's population is Muslim and the guarantee of religious freedom by the Constitution makes Law No. 33 of 2014 on Halal Product Warranty is a must. In Law No. 33 of 2014 on Halal Product Guarantee it is explained that every food, beverage, cosmetics, and medicines circulating in the community must have halal certificate. In fact, in 2017 only 110 trademarks are certified halal. Therefore, it is necessary to rematerialize Law No. 33 of 2014 on Halal Product Guarantee by make use of Indonesian Council of Ulama (MUI) as an Islamic fatwa institution in Indonesia to provide a Halal Conditional fatwa as a solution of the implementation of Law No. 33 of 2014 on Halal Product Guarantee.
