Abstract

Penelitian ini mengkaji diskrepansi dalam putusan hakim terkait izin poligami di Pengadilan Agama Baturaja Kelas IA. Penelitian ini dilatarbelakangi oleh dugaan adanya diskrepansi dalam putusan hakim terkait izin poligami di Pengadilan Agama Baturaja Kelas IA, khususnya dalam Putusan Nomor 19/Pdt.G/2024/Bta. Dugaan ini muncul karena pentingnya konsistensi pertimbangan hukum dalam perkara izin poligami, mengingat putusan hakim tidak hanya mencerminkan penerapan hukum positif, tetapi juga turut mempertimbangkan kondisi sosial dan keadilan substantif. Tujuan dari penelitian ini adalah untuk memahami bentuk-bentuk diskrepansi yang mungkin ditemukan dalam pertimbangan hakim saat memberikan putusan pengabulan izin poligami serta menganalisis faktor-faktor yang memengaruhi adanya diskrepansi tersebut terhadap hasil putusan. Rumusan masalah dalam penelitian ini meliputi identifikasi terhadap bentuk-bentuk diskrepansi dalam pertimbangan hakim dan pengaruh faktor-faktor diskrepansi terhadap putusan pengabulan izin poligami di Pengadilan Agama Baturaja. Penelitian ini menggunakan pendekatan kualitatif dengan metode normatif. Data dikumpulkan melalui studi dokumen terhadap salinan putusan, wawancara dengan dua hakim, studi kepustakaan, serta observasi tidak langsung. Hasil penelitian ini menunjukkan bahwa dalam Putusan Nomor 19/Pdt.G/2024/PA.Bta yaitu: 1) Bentuk diskrepansi dalam pertimbangan hakim tidak ditemukan dalam putusan tersebut, karena seluruh pertimbangan didasarkan pada fakta persidangan dan norma hukum yang relevan. Hakim menggunakan pasal-pasal dalam Undang-Undang Nomor 1 Tahun 1974 dan Kompilasi Hukum Islam secara tepat dan proporsional sesuai kebutuhan perkara. 2) Sebab-sebab pertimbangan seperti kondisi rumah tangga, bukti keterangan saksi, dan kemampuan suami secara ekonomi menjadi dasar utama dikabulkannya izin poligami. Hakim tidak bergantung pada keberadaan izin tertulis dari istri, melainkan menilai secara objektif sikap dan ketidakhadiran istri sebagai indikator penting. Oleh karena itu, kesimpulan dari penelitian ini adalah bahwa tidak terdapat diskrepansi dalam putusan yang diteliti, dan pertimbangan hukum hakim telah mencerminkan prinsip kepastian hukum, keadilan, dan kemanfaatan.

Abstract

Digital transformation is a determining factor in driving the modernization of education services in the era of smart governance, where information technology serves as a strategic instrument to increase effectiveness, transparency, and accountability in the delivery of public services. A governance approach based on digital intelligence demands integration between public administration principles and educational management practices to build an adaptive, data-driven education governance system that is able to respond to the dynamics of community needs. This article examines the role of digitalization not only as a technical tool but also as a transformational force that reshapes the structure, processes, and direction of education policy. The analysis findings indicate that the effectiveness of digital transformation in the education sector is determined by four main factors: policy alignment between agencies and across levels of government, the availability and equitable distribution of digital infrastructure, increased competency and digital literacy of human resources, including civil servants and educators, and an organizational culture that supports innovation, collaboration, and evidence-based decision-making. The connection between public administration and educational management is a crucial foundation for realizing inclusive, effective, and sustainable education governance. This article provides a theoretical contribution to developing an understanding of the digitalization of education services and offers policy implications for the government in strengthening smart governance practices.

Abstract

The focus of this research is to analyze the relevance of the Marsiadapari tradition as local wisdom of the Toba Batak in the context of modern challenges. This tradition can be integrated with new technology-based cultures. Using Armada Riyanto's intersubjective metaphysical approach, marsiadapari is understood as a relational practice that emphasizes equality, responsibility, and solidarity between humans. The marsiadapari tradition is no longer limited to an agrarian context, but has undergone changes into new forms such as social solidarity, economic cooperation, nomadic communities, and digital collaboration. The method used in this research is a literature study with a qualitative approach. This research has obtained results that the values ​​contained in the marsiadapari tradition remain relevant in facing the challenges of modern individualism, especially when technology tends to create social isolation. The integration of marsiadapari with digital culture opens new spaces for broader and more inclusive relationships, while maintaining the communal identity of the Toba Batak people.

Abstract

Penelitian ini menganalisis strategi pemenangan Partai Kebangkitan Bangsa (PKB) dalam Pemilihan Legislatif (Pileg) 2024 di Kabupaten Bekasi. Menggunakan pendekatan kualitatif dengan metode studi kasus, penelitian ini berfokus pada empat dimensi strategi politik menurut Peter Schroder, yaitu strategi organisasi, strategi kandidasi, strategi kampanye dan komunikasi politik, serta strategi mobilisasi pemilih. Data diperoleh melalui wawancara mendalam, observasi, dan studi dokumentasi. Hasil penelitian menunjukkan bahwa keberhasilan PKB meningkatkan perolehan kursi dari satu menjadi tujuh kursi DPRD Kabupaten Bekasi merupakan hasil dari konsolidasi organisasi yang sistematis, seleksi kandidat berbasis kedekatan sosial, kampanye kultural-religius yang kontekstual, serta mobilisasi pemilih berbasis jaringan sosial-keagamaan. Temuan ini menegaskan bahwa adaptasi strategi nasional ke dalam konteks lokal menjadi faktor kunci keberhasilan partai politik dalam sistem pemilu proporsional terbuka.

Abstract

This study examines Indonesia’s economic interests in its decision to become a full member of BRICS in 2025, focusing on the period from 2018 to 2025. Indonesia’s membership in this alliance is influenced by global dynamics that reveal the limitations of the international economic order, which developed countries have dominated. This study aims to identify Indonesia’s strategic motivations in the context of economic diplomacy and how the government uses the BRICS forum to pursue its national interests. This study uses a descriptive qualitative approach through a literature review and analyzes the cooperation and negotiation processes carried out by Indonesia. Economic diplomacy theory is the primary framework for explaining how states combine political and economic instruments to achieve national prosperity and strategic stability, supported by the concepts of national interests, cooperation, and negotiation. The findings reveal that Indonesia uses BRICS as an alternative financing channel for development, export market diversification, and strengthening its bargaining position in global forums. However, this membership also presents challenges, such as the dominance of major powers within BRICS, potential tensions with regional organizations, and risks associated with foreign debt management. The main contribution of this study is a comprehensive analysis of Indonesia’s economic diplomacy strategy within the context of South-South cooperation, which has not been extensively examined in previous research.

Abstract

Pancasila Industrial Relations (HIP) is the foundation of Indonesian employment, prioritizing deliberation and consensus. However, its implementation faces significant challenges with the normalization of the outsourcing system and flexible work practices in the Job Creation Law. This paper analyzes the resilience of HIP through the advocacy movement of labor unions in responding to uncertainty about employment status. Using a juridical-normative approach, this paper examines how the Constitutional Court's ruling on the judicial review of the Job Creation Law has become a new instrument for labor unions to fight for legal certainty. The results show that collective advocacy remains a key bulwark in maintaining the balance between company productivity and workers' normative rights amidst the current liberalization of the labor market.

Abstract

Business feasibility analysis is an activity that studies in depth about a business or business being run, in order to determine whether or not the business is feasible to run. The Satya Gemilang Women Farmers Group in Sindangsari Village manages a household-scale banana chips business with a simple production process. This business is a source of additional income for the women of the Satya Gemilang Women Farmers Group (KWT). This study aims to analyze the feasibility and profitability of the banana chips business managed by the Satya Gemilang Women Farmers Group (KWT) in Sindangsari Village, Sajira District, Lebak Regency. This study was conducted in January 2026 with the research methods used being descriptive and quantitative analysis. Data analysis was carried out using the R/C ratio and profitability techniques. The results of the study indicate that the KWT Satya Gemilang banana chips business has promising prospects and provides financial benefits with a net income of Rp 734,500/per month. Based on the analysis results, the R/C ratio value of 1.25 indicates that it meets the financial feasibility requirements, which means the income generated is sufficient to cover production costs and generate profits. The profitability level of the KWT Satya Gemilang banana chips business is 20.55%.

Abstract

Global climate change constitutes a multidimensional challenge that requires a collective response from the international community through the framework of international law. This study aims to analyze state responsibility in addressing climate change based on the principle of Common but Differentiated Responsibilities (CBDR) in international law. The research employs a normative legal method using statutory, conceptual, and analytical approaches toward the principal international legal instruments, namely the United Nations Framework Convention on Climate Change, the Kyoto Protocol, and the Paris Agreement. The findings indicate that the CBDR principle serves as the normative foundation of the international climate regime by emphasizing common responsibility among all states while differentiating obligations based on historical emissions and respective national capabilities. The principle has evolved from a strict differentiation model under the Kyoto Protocol to a more universal and participatory approach under the Paris Agreement. Although CBDR provides a framework for global climate justice, its implementation continues to face challenges related to climate finance, technology transfer, and compliance mechanisms. Strengthening accountability and enhancing national ambition are therefore essential to ensure the effective fulfillment of state responsibility in confronting the global climate crisis.

Abstract

This study examines the application of onomatopoeia in Dog Man: Big Jim Begins, utilizing the classification proposed by Körtvélyessy and Štekauer (2024) in Onomatopoeia in the World’s Languages. A qualitative descriptive technique discovered and categorized 87 samples into the following groups: water (5), air (11), mammals (2), body (26), vehicles (2), tools of war and destruction (26), and mechanical and electronic equipment and devices (15). Auditory signals from the body and instruments of war and destruction were predominant. Findings demonstrate that onomatopoeia substantially enriches the comic's ambiance, depicts activities, and communicates character emotions, so rendering the narrative more captivating and comprehensible. This comprehensive taxonomy provides profound insights into how sound effects enhance storytelling in comics.

Abstract

Transforming the economy based on knowledge leads to redefining industrial relations as more than merely physical but also intellectual energy. This research explores the juridical and sociological challenges behind the redistributing of the economic value of IP generated by a worker in Indonesia. The urgency of this research was triggered by the plan to revise the Indonesian Labor Law by the Indonesian Parliament in March 2026. Using the normative-comparative legal research method, this study compares the Work Made for Work doctrine in the US with Arbeitnehmererfindergesetz system in Germany. The data obtained concludes that there is a lack of regulation that often causes the employer dominant position at worker-employer relations, which disregards the worker’s moral and economic right. As a solution, this research suggests an alternative academic script that calls for more power in CBA in three pillars: economic justice, legal certainty, and power balance between parties. The conclusion of this research encloses the idea that the labor law should enforce the CBA as a balance instrument that secures the equal benefit between workers and employer in quest of competitive and harmonious industrial climates.
