Abstract

This study examines the concept of formality in contracts in a general manner by presenting the opinions of legal jurists, discussing them, and giving preference to the view the researcher considers most appropriate. It also clarifies the evidences for the legitimacy of formality in Islamic law, its significance, forms, means, and types, identifies the main contracts that fall within its scope, and explains the effects of non-compliance with formality in both Islamic law and positive law. The study concludes with several findings, the most important of which are that formality constituted the basis of contracting in Roman law, where emphasis was placed on the external form without regard to the concurrence of wills, and that it was also known among the Arabs through certain acts and gestures indicating the mutual consent of the parties. Positive law has tended to require adherence to formality alongside the realization of mutual consent, considering direct non-compliance with formality a cause for the nullity of the contract, while maintaining its validity in cases of indirect non-compliance. Islamic law, on the other hand, establishes mutual consent and the concurrence of wills as the foundation of a contract, subject to its conformity with the rules of Sharia, and does not impose specific formal requirements except when necessary or required to safeguard rights. In this way, Islamic law adopts a balanced position between the various theories, combining the validity of contract formation with the assurance of protecting rights.

Abstract

The word iqra' in QS. Al-'Alaq verse 1 is one of the words that is interesting to study. Why the word iqra' became the first revelation revealed to the Prophet Muhammad SAW, who was ummi, and the ambiguity of the object that must be read, raises profound questions about the hidden meaning in that word. This study aims to reveal the deeper meaning of the word iqra' through the kaidah insya' talab amr in the science of ma'ani Al-Qur'an, and its implications in Islamic da'wah methods. This study uses the library research method with an approach based on the science of ma'ani Al-Qur'an. The results of the study show that the rule of insya' talab amr requires the implementation of a task by a higher party to a lower party. The phrase iqra' in the Qur'an is mentioned 16 times in 8 surahs with different derivations, which shows the importance of this command in various contexts. The word iqra' (read) is a form of fiil amr which, in the study of ma'ani science, is included in the insya' talab rule, which demands that something be done. In addition to the literal meaning of "read," the word iqra' has multiple meanings, including commands to study, collect, convey, examine, recite, explore thoroughly, and compile. The results of the study show that the command iqra' not only encouraged the Prophet Muhammad SAW to read in the literal sense, but also to understand, practice, and spread knowledge. This reflects the importance of knowledge, education, and the dissemination of information as fundamental elements in Islamic preaching, which emphasizes that the methods of Islamic preaching must be rooted in education and the comprehensive dissemination of knowledge, in accordance with the command iqra' which became the basis of the Prophet Muhammad SAW's preaching.

Abstract

Generation Z (Gen Z) in the Organization of Islamic Cooperation (OIC) countries faces challenges related to high NEET (Not in Education, Employment, or Training) rates due to a mismatch between skills and labor market demands, limited access to capital, and a lack of inclusive job opportunities. Meanwhile, the potential of Islamic social finance (Zakat, Waqf) and the growth of digital platforms remain underutilized in empowering youth. This research explores the role of platforms such as Coursera/Udemy in promoting the financial integrity of Gen Z and creating jobs. Additionally, it examines the role of dropshipping on Tokopedia and Trendyol in enhancing the financial integrity of Gen Z and creating job opportunities. The study adopts a mixed-methods approach, including case studies of Zakat-based digital training programs in Indonesia and Turkey, a survey of 150 Gen Z entrepreneurs engaged in dropshipping on Souq, Tokopedia, and Trendyol, and secondary data analysis from social financial institutions and e-commerce platforms. Results show that 72% of Coursera/Udemy participants funded by Zakat successfully started dropshipping businesses, with an average income increase of 35%. Collaboration between Waqf institutions and Trendyol has created 500 jobs for Gen Z in rural areas of Turkey. The main challenges include the digital literacy gap (45% of participants in remote areas) and e-commerce regulations that do not fully support Sharia-compliant SMEs. This study recommends policy synergies between OIC governments, social financial institutions, and digital platforms to expand Zakat/Waqf-based training schemes and facilitate Gen Z's access to an inclusive e-commerce ecosystem.
