Abstract

In Civil Case No. 1/Pdt.G/2020/PN Blt, the Plaintiff came from Batam to Blitar city to meet the Defendants (husband and wife) who were known through Facebook and to follow up on the agreement. Furthermore, the Plaintiff felt regret and wanted to request that her child be returned to the Plaintiff. The objectives of this research are: to find out the juridical consequences of child adoption that is not in accordance with the law, the limits of the rights and responsibilities of single parents towards children who have been adopted with an agreement under the hand, and to find out the legal considerations used by the Panel of Judges regarding the validity of the Child Adoption Agreement under the hand and Granting child custody to adoptive parents based on Decision Number 1/Pdt.G /2020/PN Blt.The research conducted is normative legal research. Researchers use data collection tools in the form of literature studies or documentary studies. The approach used by researchers is the approach of legislation (The Statue Approach), and the case approach (Case Approach). The data analysis method used by researchers is qualitative data analysis which involves an assessment and understanding of legal aspects.The consequences of adopting a child that is not in accordance with the law are the rights and obligations of each party, between the adoptive parents and their adopted child cannot be sued. The limitation of the rights and responsibilities of biological parents towards children who have been adopted with an underhand agreement is that all rights and obligations of biological parents are transferred to adoptive parents. Except for adopted female children who are Muslims, if she is going to get married then the only person who can be her marriage guardian is her biological parents or blood relatives. The panel's consideration was correct. Because even though the agreement was made underhand, the parties involved still fulfilled the elements of the agreement as stipulated in the applicable law, but the adoptive parents still had to fulfill the procedure of legalizing the adoption of children through a court decision. Abstract

A travel agent is a part of a company whose business activities are planning, organizing and selling various types of travel packages. Tourist travel agents have cooperation agreements with partners as an agreement that creates rights and obligations for the parties. It is still common that the facilities received by tourists as consumers are not in accordance with what has been promised by partners when carrying out tour packages. Considering this, the issue discussed is how to regulate legal relations between PT. Bintan Medan Tourism Holidays with partners in organizing tour packages, whether PT. Bintan Medan Tourism Holidays can be held responsible for the partner's negligence in organizing the tour package, what is the mechanism for resolving problems at PT. Bintan Holiday Tour if there is negligence on the part of the partner in organizing the tour package. The research method used is normative juridical research which refers to legal norms which is carried out by means of literature study in order to obtain secondary data in the form of primary, secondary and tertiary legal materials related to the problems studied. This research has a descriptive nature. Writing research through regulations and legal materials related to this writing, in research conducting field studies at PT. Bintan Medan Tourism Vacation, the data analysis method used is a qualitative method obtained from the results of interviews with PT. Bintan Medan Tourism Holidays. The research results found that there was negligence on the part of partners in carrying out tour packages. PT. Bintan Medan Tourism Holidays receives compensation for products or services if there are consumers who suffer losses due to negligence by partners. The partner party will be fully responsible for all forms of losses in accordance with the provisions and will be settled outside of court in accordance with what has been agreed.

Abstract

One of the technological innovations in the financial services sector in the industrial revolution 4.0 that is currently in demand is information technology-based money lending services or known as Fintech P2PL on the Smart Credit application.  Various advantages are available on this platform, but in reality Kredit Pintar has become a polemic because of the low financial literacy and transparency in the public related to risks in online loan agreements that can cause illegal acts against the rights of service users. The problem in this study is how the validity of online money borrowing agreements on the Smart Credit application, how the responsibility of P2PL Fintech operators for user rights in the risk of online money borrowing agreements, and how to protect the debtor's legal protection in online money lending agreements on the Smart Credit application. The method used in this study is normative juridical with a legislative approach. The data sources used consist of primary, secondary, and tertiary legal materials. Data collection techniques and tools are literature studies and data analysis using descriptive techniques. The validity of the online loan agreement on the Kredit Pintar application has met the legal requirements of the agreement in Articles 1320 to 1338 of the Civil Code so that a legal relationship arises to carry out the rights and obligations for the parties. However, in the practice of Fintech P2PL on the Kredit Pintar application, there is no obligation to provide a form of responsibility for mistakes made by one of the parties in entering into an agreement.  Legal protection for debtors on the Smart Credit application can be carried out in a preventive and repressive manner as regulated in Article 29 of POJK Number 77/POJK.01/2016 concerning Information Technology-Based Money Lending Services, namely, transparency in information disclosure by mitigating risks to users and service providers, fair behavior, reliability, confidentiality and data security. Meanwhile, repressive protection based on Article 38 of POJK Number 1/POJK.07/2013 concerning Consumer Protection in the Financial Services Sector, the organizer is obliged to offer compensation or repair of the product or service, if the complaint of the service user proves to be a disadvantaged party.

Abstract

Marketplace merupakan aplikasi atau situs web yang memberi fasilitas jual beli online dari berbagai sumber. Pemilik situs web atau aplikasi tidak memiliki produk apapun dan bisnis mereka hanya menyajikan produk orang lain kepada pengguna kemudian memfasilitasinya. Marketplace juga sudah menyediakan opsi asuransi dalam bentuk digital untuk memberikan perlindungan kepada konsumen apabila barang yang dibelinya mengalami kerusakan dan lain sebagainya. Konsumen yang setuju untuk menggunakan asuransi akan mendapatkan polis dalam bentuk elektronik. Namun pada kenyataannya konsumen mengalami kesulitan pada saat melakukan proses klaim asuransi yang ditawarkan marketplace. Salah satu kasus bermula pada saat konsumen melakukan pembelian terhadap perabotan rumah tangga yang terbuat dari kayu melalui marketplace. Pada saat barang tiba terdapat beberapa kerusakan pada perabotan sehingga konsumen melaporkan pada pihak marketplace dan klaim asuransi disetujui. Akan tetapi, ada kendala karena berat produk yang dikirimkan oleh seller berbeda dengan konsumen sehingga pihak marketplace memerlukan analisa lebih lanjut. Namun hingga tenggat waktu yang ditetapkan klaim asuransi yang diajukan tidak jelas kelanjutannya.

Abstract

Perdagangan orang atau TPPO telah menjadi masalah global yang signifikan dan memiliki sejarah panjang terkait praktik perbudakan serta eksploitasi manusia. Dalam perkembangannya, perdagangan manusia tidak hanya mencakup perbudakan tradisional, tetapi juga eksploitasi seksual, pekerja paksa, perbudakan modern, dan perdagangan organ. Praktik-praktik ini menimbulkan dampak buruk yang mendalam bagi korban, baik secara fisik, mental, maupun sosial.Secara definisi, perdagangan orang adalah tindakan perekrutan, pengangkutan, penampungan, atau penerimaan seseorang dengan menggunakan ancaman, kekerasan, atau penyalahgunaan kekuasaan demi tujuan eksploitasi. Tulisan ini memuat permasalahan berupa Modus kejahatan Perdagangan orang serta peran Pemerintah Provinsi sebagai Gugus Tugas dalam upaya penanggulangan Perdagangan orang. Jenis penelitian yang penulis gunakan yakni penelitian Hukum Normatif serta menggunakan data sekunder. Hasil penelitian menunjukan bahwa Di Indonesia, tindak pidana ini diatur melalui Undang-Undang Nomor 21 Tahun 2007 tentang Pemberantasan Tindak Pidana Perdagangan Orang. Undang-undang ini menyediakan kerangka hukum dan sanksi berat bagi pelaku, termasuk hukuman penjara dan denda besar. Di tingkat internasional, TPPO diatur dalam Protokol Palermo yang disusun oleh Perserikatan Bangsa-Bangsa (PBB) sebagai panduan global dalam menangani kejahatan ini. Modus operandi TPPO bervariasi dan terus berubah. Beberapa modus yang umum termasuk penipuan melalui tawaran pekerjaan fiktif, penculikan, serta manipulasi emosional. Dalam beberapa kasus, pelaku mendekati korban melalui media sosial dengan berbagai janji palsu. Ada juga pelaku yang memalsukan dokumen untuk membawa korban ke luar negeri. Di tingkat global, perdagangan orang melibatkan jaringan rumit yang mencakup negara asal, transit, dan tujuan. Jaringan ini memanfaatkan celah hukum dan perbedaan kebijakan antarnegara. Korban sering kali dieksploitasi di negara tujuan, terutama dalam sektor-sektor seperti hiburan, perkebunan, konstruksi, dan pekerjaan rumah tangga. Organisasi kriminal internasional sering berada di balik praktik ini, memanfaatkan kondisi kemiskinan, konflik sosial, dan kurangnya pendidikan sebagai faktor yang memudahkan perekrutan korban.Pemberantasan TPPO membutuhkan kerja sama internasional yang kuat, termasuk penguatan regulasi, peningkatan kesadaran publik, serta pemberdayaan korban agar mereka dapat terbebas dari siklus eksploitasi.

Abstract

Arbitration is one of Alternative Dispute Resolution. Arbitration itself serves as a dispute resolution method, particularly for business actors within the corporate sphere. Not infrequently, the efforts to resolve such disputes lead to results that are not accepted by the petitioners, which then triggers follow-up actions. These actions culminate in a mechanism known as the annulment of the arbitration award. This thesis analyzes the legal consequences of the Constitutional Court Decision Number 15/PUU-XII/2014 on Article 70 of Law Number 30 of 1999, as well as the legal considerations of the Constitutional Court judges in Decision Number 15/PUU-XII/2014 concerning Article 70 of Law Number 30 of 1999. The research method used in this study is normative legal research, employing both legislative and case approaches. The result of this research shows that the legal consequence of the Constitutional Court Decision Number 15/PUU-XII/2014 on Article 70 of Law Number 30 of 1999 is the increased discretion of judges in deciding on the annulment of arbitration awards in court. Furthermore, the Constitutional Court judges in the ruling of MK Decision Number 15/PUU-XII/2014 declared that Article 70 is in conflict with the 1945 Constitution and has no binding legal force.

Abstract

This research aims to provide in-depth insight into the role of the principle of good faith in Memorandums of Understanding (MoU) in Indonesia and how this principle supports fair and sustainable relations between the parties. The principle of good faith is the legal principle that underlies the formation, implementation and cancellation of agreements, including MoUs. In the context of the MoU, the principle of good faith provides an ethical and legal basis that must be adhered to by the parties involved. This research explains how the principle of good faith influences the process of forming an MoU by emphasizing the importance of transparency, good intentions and mutual understanding between the parties. Apart from that, the principle of good faith also plays an important role in ensuring parties comply with their commitments in accordance with the objectives of the agreement. Within the framework of contract law in Indonesia, this study explains the relevance of the principle of good faith to applicable regulations. Thus, this journal provides an understanding of contract law in Indonesia and the principles underlying it.
