Abstract

This article discusses the strategy for developing Mitra Sejahtera Village-Owned Enterprises (BUMDes) in Panggang Village with a focus on empowering Micro, Small and Medium Enterprises (MSMEs). Suhuat Village, although rich in natural potential, faces a number of challenges in optimizing its potential. Through the application of SWOT Analysis, this research investigates the internal strengths, operational weaknesses of BUMDes, as well as external opportunities and threats amidst the social and economic dynamics of Suhuat Village. The aim is to provide an in-depth understanding of the condition of BUMDes Mitra Sejahtera, to identify effective strategies for exploiting local potential, overcoming internal obstacles and facing external challenges. Research methods involve literature studies, interviews, document analysis, surveys, and field observations. The results of the SWOT analysis highlight the success of BUMDes in managing natural potential, MSMEs, and collaboration with external parties. The conclusion emphasizes the importance of management training, development of facilities and infrastructure, as well as closer collaboration with the government and related parties. This article is a reference for policy makers and researchers who are interested in empowering the local economy through BUMDes, which can contribute to sustainable development at the village level.

Abstract

SWOT analysis (Strengths, Weaknesses, Opportunities, and Threats) is a critical strategic planning tool for evaluating the potential of villages and Village-Owned Enterprises (BUMDes) in Indonesia. BUMDes is a government initiative in empowering the economy of village communities, utilizing local resources to encourage rural entrepreneurship. This article highlights the results of a SWOT analysis of BUMDes in Kedarpan Village, showing that development prospects have not been optimal in various time periods. SWOT is used to formulate BUMDes management strategies, accelerate development, and improve performance during the COVID-19 pandemic. Kedarpan Village has agricultural and MSME potential which includes superior products such as white pepper and snacks made from cassava. BUMDes, such as Village Internet and chicken farms, play an important role in managing natural resources and empowering communities. This article concludes the need for BUMDes management training and further activities from the village government in building communication networks with external parties. Recommendations involve developing human resource competencies, marketing management, and collaboration with other parties to support sustainable management of Kedarpan Village and BUMDes.

Abstract

There are differences in terms of the naming and practice of marriage initiation funds between the Javanese and Sasak tribes. There are different concepts between the two in terms of practice, of course due to the different social and cultural backgrounds between the Javanese and Sasak tribes. The benefits and urgency are the benchmarks for how important it is to do it and become a custom. In this research, the research methodology used is library research and uses a sociological approach to help the author analyze the benefits and urgency of marriage transition funds. The results found that the funds for marriage steps between the Javanese and Sasak tribes had similarities and differences. The similarity is that this is done to honor or respect and ask permission from the sibling being stepped on, and the step can be in the form of money or other objects. Meanwhile, the difference is in practice, in the Javanese tribe, the person who is stepped over is either an unmarried female sibling or male sibling who is given the step, whereas in the Sasak tribe only unmarried older brothers are given the step. The Javanese tribe's step process has more procedures than the Sasak tribe. The Sasak tribe's concept of giving a handover is from the prospective husband to the unmarried brother of the prospective wife, whereas in the Javanese tribe the handover can tend to be from the younger sibling to the sibling's older brother/sister. The benefit and urgency is to respect each other and avoid misunderstandings, as well as carrying out the customs and culture of each tribe so that they are preserved and the stepping goods are only an entertainment for the person who steps over.

Abstract

The ASEAN-China Free Trade Agreement (ACFTA) has posed significant challenges, benefits, and impacts on Indonesia's trade. In terms of challenges, the implementation of ACFTA has introduced several obstacles, including intensified competition with imported products from China, which could threaten certain domestic industry sectors. The use of qualitative methods is relevant because of its focus on gaining a deep understanding of the implementation of international trade law in Indonesia, using ACFTA as a case study. The objective of this research is to understand how the implementation of International Trade Law, particularly in the context of the ASEAN-China Free Trade Agreement (ACFTA), influences Indonesia's trade policies. The outcomes of this research are strategic steps needed to maximize the benefits of free trade with ASEAN and China while safeguarding domestic industry interests. Successful regional economic integration will bring significant economic benefits to all involved parties and strengthen economic cooperation in Southeast Asia.

Abstract

This study aims to discover the consistency in previous research indicating the positive influence of internal audit on company financial performance. Qualitative methodology with a literature review approach is employed to strengthen arguments with information collected from articles published in national journals. The research identifies several factors influencing the relationship between internal audit and financial performance, including management roles, financial reporting quality, and external environmental factors that can moderate this relationship, providing a more comprehensive understanding of the impact of internal audit on company financial performance.

Abstract

This research aims to determine the form of use of Digital Wallets in the payment system in Indonesia and to determine legal protection for the use of digital wallets in Indonesia. This research uses normative legal research methods. The use of normative research methods in research efforts and writing this article is based on the suitability of theory with the research methods required by the author. 1) Electronic Wallet Operators provide services in the form of online transaction payments so that the process becomes more practical, faster and cheaper. Electronic Wallets are equipped with various features to facilitate online transactions between consumers and business owners or between business actors (B2B). In the mechanism, the Electronic Wallet will be filled in by consumers (deposits) via their banking account with the desired nominal value. Then, if the consumer makes a transaction, the Electronic Wallet will be debited according to the nominal transaction. When making a deposit, this Electronic Wallet can be filled via several payment methods, namely via credit card, mobile banking, internet banking, ATM, debit card, corporate internet banking, branchless banking agent, online virtual account, and Electronic Invoice Presentment & Payment ( EIPP ).  and 2) Dana e-wallet users who suffer losses due to non-compliance with the services they receive can take out loans for their losses legally through court or outside court in accordance with the provisions of the Consumer Protection Law.

Abstract

This study aims to determine the factors behind the rampant acts of violence by conventional motorcycle taxi drivers against online transportation drivers and to determine the forms of violence experienced by online transportation drivers and the resolution of efforts to overcome them. This study uses an empirical research type, the location of this research is in the Makassar City area and the Makassar Police Headquarters, South Sulawesi Province, located on Jalan Ahmad Yani, by conducting two data collection techniques through literature and field collection techniques such as interviews and observations. The results of this study are the factors behind the rampant acts of violence by conventional motorcycle taxi drivers against online transportation drivers, namely based on factors of jealousy, fighting over passengers, envy, differences in services provided by each online transportation driver with conventional motorcycle taxis and differences in fares and ease of using transportation. While the form of violence experienced by online transportation drivers and the resolution of efforts to overcome it is because online transportation drivers and conventional motorcycle taxis often argue, which usually ends in chaos. Online drivers' motorbikes were also damaged and helmets confiscated for violating conventional motorcycle taxi base areas with agreed pick-ups. At some point, traditional motorcycle taxis lost their market share compared to online transportation, forcing a decrease in passenger volume, but mediation between the two parties involved was able to resolve violent violations in the Makassar City area without having to take legal action. The agreement reached by both parties during the mediation process was the final result.

Abstract

The purposes of this study are: 1) To analyze the process of implementing operational assistance in handling high-intensity security disturbances in Papua by Battalion B Pelopor Brimob Parepare, and 2) To analyze the factors that hinder the implementation of operational assistance in handling high-intensity security disturbances in Papua by Battalion B Pelopor Brimob Parepare. This type of research is empirical legal qualitative research. To obtain the data and information needed, the researcher chose the research location at Battalion B Pelopor Brimob Pare-pare which is located on Jl. Chalik No.3, Sumpang Minangae, Kec. Bacukiki Bar.Pare-pare City. The type of data used in this study was qualitative data consisting of primary data and secondary data. The conclusions of this study are 1) The process of implementing operational assistance by Battalion B Pelopor Brimob Parepare in handling high-intensity security disturbances in Papua were by: Identifying and analyzing the types of high-intensity security disturbances that occurred in Papua, Formulating appropriate operational strategies and plans to provide assistance in handling these security disturbances, Coordinating and mobilizing personnel and resources needed to carry out operations in the field, Monitoring and evaluating the effectiveness of actions taken in handling security disturbances, and Making adjustments and improvements to personnel capabilities and operational readiness on an ongoing basis. 2) Factors that hinder the implementation of operational assistance in handling high-intensity security disturbances in Papua by Battalion B Pelopor Brimob Parepare were: difficulty in coordinating with leaders of conflicting groups, lack of troops who will be on duty in Papua, and punishments that have not provided a deterrent effect.

Abstract

The objectives of the study are: 1) To determine the legal certainty of the transfer of receivables (cession) without the consent and knowledge of the debtor in relation to the Civil Code, 2) To determine the procedure for the transfer of receivables (cession) of creditors to third parties as new creditors based on the Civil Code. This type of research is Normative research, namely a study that traces secondary materials, literature books, magazines, journals and laws and regulations as well as other legal documents to see the real conditions of the implementation of laws and regulations. In this study, Library Research was used, descriptive data analysis techniques, namely the author first describes the application of the material law that is applied. The conclusion of this study is 1) Cessie can be carried out based on a credit agreement made, as long as there is a clause regarding cession in the agreement. However, the clause must not conflict with Article 613 of the Civil Code, where cession must be with the knowledge or consent of the debtor in writing and is evidenced by the existence of a deed of transfer of receivables, either authentic or underhand. However, on the other hand, it can give rise to an opinion that the agreement is null and void because it does not comply with the objective requirements as stated in Article 1320 of the Civil Code, for the validity of an agreement four requirements are required, namely Agreement, Competence, Concerning a certain matter and A lawful cause. 2) The procedure for transferring receivables (cession) from a creditor to a third party as a new creditor based on the Civil Code can be carried out by transferring receivables (cession) to a third party according to the Civil Code. When a receivable is transferred, of course the creditor party also changes from the old creditor to the new creditor so that in terms of changing creditors, cession is also included in contract law, so it is also regulated by the third book of the Civil Code.

Abstract

In this study, the researcher used field research method. The type of descriptive qualitative research using data collection methods in this study is Observation, interviews and documentation with the aim of describing the sanctions for violators and the efforts of the village head in implementing a smoke-free area for the community in Bone-bone Village, Enrekang Regency. The results of this study indicate that the objectives of Village Regulation Number 1 of 2009 concerning the Smoke-Free Area in Bone-bone Village have been quite successful. This can be seen from the results of the study which show that 1) There is public awareness of the dangers of smoking, and there is a decrease in the number of smokers. 2) However, it is proven that there are still some people who smoke secretly such as in the garden and at home. 3) In addition, many people in Bone-Bone Village are aware of the impact of this regulation according to Maqashid al-Syariah, because Islam emphasizes the importance of maintaining health and avoiding all its harms. 4) And the impact of implementing the smoke-free area policy on health, economy, education, social relations in the community is quite positive. The implications of this study are 1) it is expected to provide theoretical benefits, as a material that can provide information to readers and can also be used as literature or references for other researchers. 2) which always provides a deep understanding of the impact or dangers of smoking are very positive steps.
