Abstract

Management of regional assets is a crucial aspect of regional governance. Optimizing the utilization of regional assets is expected to increase regional revenues and support local economic development. One form of regional asset utilization is collaboration with the private sector in the development of commercial facilities. However, in practice, the utilization of regional assets often raises legal issues, particularly regarding changes in the status of land rights used in these collaborations. One such polemic case concerns the transfer of the land use rights certificate for land owned by the Bengkulu City Government, used for the construction of the Mega Mall, to a building use rights certificate by the management. This study aims to analyze the legal basis for this change in land rights status, themechanisms that should be followed according to statutory regulations, and the legal implications arising from this change in status for the management of regional assets. The research method used is a normative juridical method with a statutory, conceptual, and case-based approach. The results indicate that the change in the status of use rights to building rights on land owned by the regional government must be carried out through a clear legal mechanism and in accordance with agrarian law and regulations on the management of regional assets. If these changes are not made according to procedure, they could potentially result in losses for the local government and give rise to legal disputes between the local government and the management.

Abstract

Corruption is the most detrimental criminal act to state finances and damages the foundations of social life in Indonesia. The legal issues raised in this study are how the normative regulation of corruption in Indonesian positive law is structured and why law enforcement against corruptors is still not optimal. This study aims to analyze and describe the regulation of corruption in Law Number 31 of 1999 jo. Law Number 20 of 2001, and to analyze factors affecting the effectiveness of its enforcement. The methodology used is normative juridical research with statutory and conceptual approaches. The results show that corruption regulations in Indonesia have comprehensively regulated various forms of corruption. However, its enforcement remains hindered by weak inter-agency coordination, judicial inconsistency, and low deterrent effects. Synergy between KPK, Prosecutors, and Police, along with reform of the evidence system, is needed to optimize anti-corruption efforts.

Abstract

The Mega Mall Bengkulu case has become an important study in the realm of Indonesian agrarian law, which highlights the practice of converting land status from Land Management Rights (HPL) owned by the Bengkulu City Government as a form of management rights over state or regional land according to Article 35 of the UUPA to a Building Use Rights Certificate (HGB) under the private name of PT Trigadi Benggawan (now PT Tigadi Lestari) through Cooperation Agreement Number 640/228/B.VII/2004 along with the 2005 addendum which is suspected to be legally flawed. The conversion is suspected of violating Article 43 of the UUPA, which requires the approval of the competent authority and full compensation, as well as Article 16 of the UUPA concerning land area limitations, because the process sidesteps the role of the regional DPRD and ignores the doctrine of the social function of land as stipulated in Article 6 of the UUPA, which emphasizes land use for the welfare of the wider community, not merely individual interests. This article examines the legal consequences of converting HPL to HGB within the agrarian law framework, including the criminal risks under Article 50 of the UUPA due to the abuse of authority to issue certificates, the lack of state administrative oversight based on Government Regulation Number 40 of 1996 concerning Land Management Rights, and the broad impact on the sustainability of regional assets amidst rampant corruption in the property sector. Furthermore, the discussion includes proposed improvements such as strengthening HPL licensing regulations at the regional level, implementing certificate digitization by the National Land Agency (BPN) to increase transparency, DPRD participation in asset transfer transactions, and implementing agrarian sanctions integrated with corruption crimes to prevent similar incidents, in order to strengthen the social function of land as a foundation for national agrarian justice.

Abstract

This study examines in depth the mechanism of land legal status transfer from Right of Use in the name of the Bengkulu City Government to Building Use Rights (HGB) over Management Rights (HPL), as well as through other cooperation mechanisms implemented by the management of Mega Mall Bengkulu. This change in land status is a strategic legal instrument in optimizing Regional Property (BMD), with the aim of increasing Regional Original Income (PAD) and supporting economic and social development at the local level. This transfer of rights reflects how public assets can be utilized legally and commercially, without eliminating local government ownership of the land, while maintaining social functions and public interests. The research method used is normative juridical, with an approach of studying laws and regulations, legal document analysis, and case studies. This study focuses on the conformity of the procedure for the transfer of Right of Use to HGB with Government Regulation Number 27 of 2014 concerning Management of State/Regional Property, implementing regulations, and derivative regulations related to regional asset management and cooperation with the private sector. The analysis also emphasizes transparency, accountability, legal certainty, and post-transfer monitoring mechanisms to ensure the land continues to provide maximum benefits to local governments and the community. The results show that the transfer of rights from Right to Use of BMD to HGB does not eliminate city government ownership, but rather grants temporary use rights to private parties for a certain period. This transfer provides opportunities for local governments to optimally utilize public assets, but also poses challenges in terms of monitoring the validity period of rights, legal certainty when the contract expires, and protection of public interests. This study found that the success of the transfer of rights is highly dependent on transparency of cooperation agreements, fair asset valuation, and professional contract management. In addition, the study emphasizes the importance of social and environmental evaluations in the use of BMD for commercial purposes. Land management must consider the impact on the surrounding community, the social function of the land, and the balance between economic development and the public interest. The implementation of periodic monitoring mechanisms, monitoring the fulfillment of developer obligations, and determining socio-economic contributions and public facilities are important factors in maintaining the sustainability of land benefits for the community. This article concludes that the transfer of the Right to Use (Hak Pakai) from a BMD to a HGB (Hak Pakai) for Mega Mall Bengkulu is an effective strategy in public asset governance, with the caveat that the entire process must be carried out in accordance with the law, principles of transparency, and accountability. The success of this transfer is not only economically beneficial but also strengthens local government governance, safeguards public interests, and serves as a model for professional and sustainable regional asset management. Therefore, this transfer of rights can serve as an example for other local governments in maximizing the use of public assets for inclusive, efficient, and equitable urban development.

Abstract

Penology and panitentiary are branches of criminal law that study the objectives of punishment and the rehabilitation system for criminal offenders. In the Indonesian legal context, these concepts are reflected in the correctional system, which aims not only to impose punishment but also to provide rehabilitation so that inmates can reintegrate into society. This article aims to analyze the implementation of the concepts of penology and panitentiary in the Indonesian correctional system. The method used in this paper is normative legal research with a statutory and conceptual approach. The results of the study indicate that the Indonesian correctional system has essentially adopted the principles of penology and panitentiary, which emphasize rehabilitation, rehabilitation, and social reintegration for inmates. However, in practice, various obstacles remain, such as limited facilities and infrastructure, overcrowding in correctional institutions, and limited optimal rehabilitation programs. Therefore, efforts are needed to improve the quality of the correctional system so that the goals of humanistic and rehabilitation-oriented punishment can be effectively achieved.
