Abstract

This article analyzes the implementation of advocate obligations under Law Number 18 of 2003 and its impact on the validity of the suspect examination process during the investigation stage. This normative legal research reveals that the obligation of advocate accompaniment is a crucial element of the principles of due process of law and fair trial. The effective presence of an advocate functions as a control against the potential abuse of power by investigators and ensures the fulfillment of the suspect's constitutional rights. Conversely, the ineffectiveness of the advocate's role such as merely formalistic accompaniment directly impacts the weakening of the suspect's rights protection, the fragility of the evidence construction, and potentially creates legal defects in the Investigation Report (BAP). This article concludes that the optimal enforcement of advocate obligations is an absolute prerequisite for realizing a valid, fair, and integral investigation process.

Abstract

Tingginya kasus kekerasan seksual di Indonesia sering kali tidak dilaporkan karena stigma sosial dan keraguan mengenai hukum. Penerapan Undang-Undang Nomor 12 Tahun 2022 (UU TPKS) merupakan langkah maju dalam hukum yang mengubah paradigma perlindungan dari fokus pada pelaku menjadi fokus pada korban. Penelitian ini mendalami bentuk perlindungan hukum yang bersifat normatif dalam UU TPKS dan menilai tantangan dalam pelaksanaannya melalui pendekatan hukum normatif dengan fokus pada legislasi dan konsep-konsep yang ada. Teori Perlindungan Hukum serta Teori Hukum Progresif dijadikan alat analisis. Temuan penelitian menunjukkan bahwa secara normatif, UU TPKS memberi fondasi perlindungan yang menyeluruh melalui tiga pilar hak (penanganan, perlindungan, pemulihan) dan pengakuan terhadap 9 jenis kekerasan seksual. Namun, dalam pelaksanaannya, terdapat jarak yang cukup signifikan. Meskipun laporan ke LPSK meningkat (naik sebesar 58% antara 2022-2024), tingkat penerapan UU TPKS oleh Aparat Penegak Hukum (APH) sangat minim (di bawah 0,4% pada 2022). Kendala utama berasal dari inersia APH yang terjebak dalam positivisme hukum, keterlambatan tujuh regulasi pendukung, dan stigma sosio-kultural. Dapat disimpulkan bahwa perubahan undang-undang tidak akan cukup tanpa adanya transformasi filosofi APH menuju keadilan yang lebih substantif.

Abstract

Drug abuse is a form of social pathology that has a multidimensional impact on public order, public health, and social stability. The main problem is evident in the continued dominance of a punitive approach in national policy, while the rehabilitation aspects required by law have not been implemented proportionally. This study analyzes the criminalization and rehabilitation provisions in Law No. 35 of 2009 on Narcotics and its derivative regulations using a normative juridical method with a legislative, conceptual, and doctrinal approach. The results show that national policy still tends to be repressive and not fully in line with the social pathology paradigm that emphasizes recovery. There is also a discrepancy between legal norms and practice, particularly regarding the placement of drug abusers as subjects of rehabilitation.

Abstract

Corruption in Indonesia can no longer be understood merely as individual legal violations but has evolved into a systemic social pathology that is continuously reproduced through mechanisms of social anomie, dysfunctional social control, and the weakness of criminal law institutions. This normative juridical research analyses why corruption-related criminal law, despite imposing severe penalties up to life imprisonment and the death penalty, persistently fails to break the chain of reproduction of corrupt behaviour. Employing Robert K. Merton’s anomie theory, Emile Durkheim’s theory of social pathology, and Sudarto–Barda Nawawi Arief’s concept of criminal law dysfunction, the study concludes that corruption has become an alternative norm among bureaucratic and political elites, limited reverse proof (Article 37 of the Anti-Corruption Law) and the rare imposition of minimum sentences eliminate deterrent effects, while impunity for corporate actors and politically exposed persons reinforces structural anomie. The research recommends the adoption of full reverse proof, elimination of prosecutorial discretion under Article 4 of the Anti-Corruption Law, and stricter corporate criminal liability provisions in the new Criminal Code that will be gradually implemented from 2026 onward.

Abstract

The rapid development of digital technology has brought both positive and negative impacts on society, particularly for women who often become victims of cyber violence on social media. The legal issue that arises is the lack of law enforcement against perpetrators of cyber violence and the inadequate protection provided for female victims. This study examines the efforts of law enforcement against perpetrators of cyber violence against women on social media, as well as the forms of legal protection given to female victims in such cases. The research employs a normative juridical method with a statutory and conceptual approach, complemented by case studies of several reports of cyber violence in Indonesia. The findings indicate that although there are existing legal foundations, such as Law Number 19 of 2016 concerning Electronic Information and Transactions (ITE Law) and Law Number 12 of 2022 concerning Sexual Violence Crimes (TPKS Law), their implementation still faces challenges, including limited public understanding of technology, difficulties in proving cases, and the lack of gender awareness among law enforcement officers. Therefore, it is necessary to enhance the capacity of law enforcement authorities, improve regulatory frameworks, and strengthen comprehensive protection mechanisms for victims.

Abstract

Sexual harassment cases in Indonesia not only cause physical and psychological harm to victims but also reveal persistent gender inequalities within the country’s legal system and social culture. This study aims to explore how social stigma and gender bias influence the treatment of female victims of sexual harassment and contribute to revictimization—situations where victims are blamed or further harmed during legal processes. Using a qualitative socio-legal approach, the research analyzes legal documents, case studies, and interviews with victims, legal advocates, and law enforcement officers. The findings indicate that legal proceedings often reinforce stigma against victims through moral judgments and questions that implicitly blame women. Revictimization arises from the dominance of patriarchal values that shape legal actors’ perceptions of victims’ credibility. This study highlights the urgent need for gender-sensitive legal reforms, greater empathy and awareness among law enforcement officers, and a broader social paradigm shift to ensure that female victims of sexual harassment receive fair and nondiscriminatory access to justice.

Abstract

This study examines in depth the role of the Legal Bureau of the Regional Secretariat of Bengkulu Province in the process of drafting Regional Regulations (Perda), referring to Bengkulu Governor Regulation Number 21 of 2024 concerning the Position, Organizational Structure, Duties and Functions, and Work Procedures of Regional Apparatus. This governor regulation provides a legal basis for the authority of the Legal Bureau as an implementing element of governmental affairs that holds strategic functions in planning, drafting, harmonizing, supervising, and documenting regional legal products. Using a normative–qualitative research method with statutory, conceptual, and documentation approaches, this study comprehensively analyzes the role of the Legal Bureau at each stage of Perda formation, starting from the formulation of the Regional Legislation Program (Prolegda), facilitation of academic paper preparation and draft regional regulations, implementation of horizontal and vertical harmonization, assistance in joint discussions with the Regional House of Representatives (DPRD), to the stages of promulgation, numbering, and documentation through the Regional Legal Documentation and Information Network (JDIH). The findings indicate that the Legal Bureau plays a highly decisive role in ensuring the quality of regional regulations, particularly by ensuring the conformity of draft regional regulations with the principles of statutory drafting and their consistency with national regulations. Nevertheless, several challenges—such as limited human resources with expertise in legislative drafting, suboptimal cross-agency coordination, and the workload associated with managing the JDIH—continue to hinder the effective execution of its functions. These findings emphasize the importance of institutional strengthening, capacity building for government personnel, and the development of digital systems to support the Legal Bureau’s effectiveness in the future.

Abstract

Kementerian Ketenagakerjaan memiliki peran yang sangat penting dalam menjaga dan mengawal hak-hak pekerja, terutama di era modern saat ini yang ditandai dengan perubahan cepat dalam dunia kerja. Perkembangan teknologi dan globalisasi membawa berbagai tantangan baru seperti munculnya jenis pekerjaan fleksibel, penggunaan platform digital, serta perubahan pola kerja yang memerlukan penyesuaian kebijakan ketenagakerjaan. Artikel ini membahas peran strategis Kementerian dalam menyesuaikan berbagai kebijakan dan program agar tetap relevan dengan kebutuhan pekerja dan pengusaha. Lalu arrikel ini juga menyoroti bagaimana Kementerian meningkatkan akses perlindungan hukum dan layanan pengaduan bagi pekerja agar hak mereka tidak terabaikan. Dengan pendekatan yang komprehensif, penelitian ini menggambarkan upaya dan langkah-langkah yang diambil untuk menciptakan kondisi kerja yang adil dan berkelanjutan. Hasil kajian menunjukkan bahwa langkah-langkah adaptif dan inovatif dari Kementerian sangat diperlukan agar perlindungan hak pekerja dapat berjalan efektif, sekaligus meningkatkan kesejahteraan tenaga kerja di Indonesia di tengah perubahan era digital.

Abstract

Child prostitution tied to human trafficking stands out as one of the gravest and most intricate social issues plaguing Indonesia. It highlights the extreme susceptibility of children to sexual abuse while revealing underlying societal flaws, such as widespread poverty, inadequate educational opportunities, crumbling family units, and the decline of ethical and communal standards. As outlined in the document, this exploitation occurs via multiple methods, including luring victims with deceptive job offers, transporting them between locations, abusing them in local brothels or entertainment spots, and newer trends like online solicitation via social media and secure digital channels. These operations typically involve coordinated groups of recruiters, middlemen, exploiters, and clients. Viewed through a human rights lens, child prostitution is a serious infringement on children's basic dignity and rights, as protected by the Convention on the Rights of the Child (CRC), Indonesia's Child Protection Law, and the Anti-Human Trafficking Law. Affected children are deprived of safeguards, schooling, healthcare, safety, and the chance to mature normally. The discussion stresses the government's duty to uphold, safeguard, and ensure these rights, yet execution is hindered by ineffective policing, poor collaboration among agencies, and insufficient support for victim recovery and reintegration. The study determines that child prostitution within human trafficking reflects a breakdown in societal structures and shortcomings in child welfare systems. Consequently, a comprehensive strategy is imperative, combining prevention via education and financial support, rigorous prosecution of trafficking rings, and thorough rehabilitation for survivors. Reinforcing compassionate principles and widespread societal consciousness is crucial to ending the cycle of abuse and securing complete rights-based protection for children.

Abstract

The criminalization of human rights defenders in Indonesia remains a serious issue. Amnesty International Indonesia's report in the first half of 2025 recorded more than a hundred cases of attacks and criminalization against human rights defenders, including journalists, indigenous peoples, and environmental activists. This situation demonstrates the state's weak protection of human rights defenders and the increasing urgency of the media's role in public advocacy. This article aims to analyze how the media can play a role in preventing the criminalization of human rights defenders through advocacy strategies, while offering a concept of protection that can strengthen their position before the law. This study uses a normative juridical method with a conceptual and case approach, namely analyzing relevant national and international legal instruments and examining the practice of criminalizing human rights defenders through media coverage. The results of the study show that the media has a dual role, namely as a means of advocacy to pressure the state to be accountable and as a space for shaping public opinion that protects human rights defenders from negative stigma. The concept of protection offered is the optimization of the media as an advocacy actor based on the principles of transparency, accountability, and public participation.
