Abstract

The development of aerospace technology has advanced rapidly over the past decades, resulting in significant changes in the utilization of airspace and outer space. These advancements include innovations such as unmanned aerial vehicles, communication satellites, and flight technologies capable of operating in the boundary area between the atmosphere and outer space. Nevertheless, these technological developments give rise to complex legal challenges due to fundamental differences between the air law regime, which recognizes full state sovereignty over national airspace, and the space law regime, which is based on the principles of freedom and the prohibition of national appropriation. This study employs a normative legal research method using statutory and conceptual approaches to examine the legal implications of aerospace technological developments on both legal regimes. The findings indicate that the rapid advancement of aerospace technology requires the harmonization and adaptation of existing legal frameworks to ensure their continued relevance in protecting state sovereignty and national interests in the modern era.

Abstract

Cyberbullying is a form of digital bullying that is increasingly prevalent in the information technology era, involving actions such as insults, threats, and defamation through electronic media. A legal analysis of this phenomenon in the Electronic Information and Transactions Law (ITE Law) Number 19 of 2016 in conjunction with Law Number 1 of 2024 shows the main provisions in Article 27 paragraph (3), Article 45 paragraphs (3) and (4), and Article 45B which criminalizes the electronic distribution of content containing insults, threats, or persecution. Perpetrators can be subject to imprisonment of up to 6 years and/or a fine of IDR 1 billion, with a normative legal approach that integrates the Criminal Code as a complement. However, implementation challenges include the weakness of digital evidence, freedom of expression, and the need for restorative justice for child victims. This study recommends a revision of the ITE Law to clarify the definition of cyberbullying and victim protection mechanisms, for the sake of effective law enforcement in Indonesia.

Abstract

This study outlines the urgency of legal protection for children who are victims of violence in the context of romantic relationships with significant age differences. In such relationship dynamics, the age difference is not merely a statistical figure, but a determinant factor that creates unequal power relations. The chronologically more mature party generally has dominance in emotional, economic, and life experience aspects, which is then used as an instrument to control, dominate, and even manipulate the child who is still psychologically developing. Furthermore, this striking age difference fundamentally invalidates the validity of the child's consent. Legally and psychologically, the consent given by children in unequal relationships is often false, born of invisible psychological pressure, a sense of dependency, or the child's inability to identify forms of exploitation. This leaves children in a highly vulnerable position to a wide spectrum of violence, ranging from physical violence and psychological trauma to sexual exploitation, often disguised as a romantic relationship.

Abstract

This analysis focuses on a legal review of the handling of foreign vessels that pass through Indonesian waters without permission, with reference to international maritime law provisions. The urgency of this study is based on Indonesia’s geographical position as an archipelagic country with vast seas and vital global shipping lanes. The activities of foreign vessels that do not comply with regulations risk disrupting sovereignty, maritime security, and the sustainability of marine resources. In terms of methodology, this study uses a normative legal approach, which combines analysis of legislation and legal concepts. As an archipelagic country, Indonesia has the legal legitimacy to conduct surveillance, control, and law enforcement actions against foreign vessels that do not comply with regulations in its waters. Existing national regulations further strengthen Indonesia’s jurisdiction in protecting its sovereignty and maritime interests. Therefore, it is necessary to improve the maritime surveillance system and synergy between law enforcement agencies to ensure the protection of Indonesia’s territorial waters is optimal in accordance with international legal standards.

Abstract

Corruption remains one of the most serious legal problems in Indonesia, particularly in the management of public resources and regional assets. One of the cases that attracted public attention is the alleged corruption related to the management of regional assets connected to Mega Mall Bengkulu. This study aims to analyze the juridical aspects of alleged corruption crimes in the management of regional assets in the Mega Mall Bengkulu case. The research method used is normative juridical research with a statutory approach, conceptual approach, and case approach. The results show that irregularities in agreements, misuse of authority, and lack of transparency in asset management may potentially lead to state financial losses. Such actions can fulfill the elements of corruption crimes as regulated in Law Number 31 of 1999 in conjunction with Law Number 20 of 2001 concerning the Eradication of Corruption Crimes. Therefore, strengthening supervision and transparency in regional asset management is necessary to prevent corruption practices in local government administration.

Abstract

Issues regarding the management of land originating from Regional Property (BMD) often create legal conflicts if there are changes in land rights status not according to agrarian law provisions. One case attracting public attention is the status transfer of Bengkulu Mega Mall land from Right to Manage (HPL) or regional property use rights to Building Use Rights Certificate (SHGB). This change raises legal issues, including alleged corruption and state financial losses. This study aims to analyze the land status transfer based on the Indonesian agrarian law perspective. The research method used is normative legal research with statute and case approaches. The results indicate that the land status change is suspected not fully compliant with land law provisions, particularly regarding the relationship between HPL and HGB. Furthermore, land management by private parties without clear contributions to the local government contradicts the principle of the social function of land in the Basic Agrarian Law.

Abstract

This research aims to conduct an in-depth juridical review of the conflict between the Regional Government of Bengkulu City and the management party in the dispute over the utilization of regional assets at Mega Mall Bengkulu, where the essence of the problem stems from the lack of synchronization between the implementation of the Build-Operate-Transfer (BOT) agreement and current regulations regarding the Management of Regional Property. Utilizing a normative legal research method that emphasizes a statutory and case-based approach, the legal arguments in this study construct that the dispute arose due to substantial weaknesses in old contractual clauses that failed to accommodate the principle of asset value escalation, thereby creating a disparity between the fixed contributions received by the regional government and current market appraisal values, which ultimately leads to potential losses in regional finances. Furthermore, this analysis demonstrates that the position of the Bengkulu City Government in this legal relationship is not merely private as a contractual partner, but also carries a public obligation under Government Regulation No. 28 of 2020 to optimize state assets; thus, the act of renegotiation or contract termination against a management party deemed to be in breach of contract (wanprestatie) regarding Regional Original Revenue (PAD) obligations is legally valid, provided it is conducted through proper legal procedures. This study concludes that the resolution of such conflict requires a redefinition of the contractual relationship through a contract addendum that prioritizes the principles of distributive justice and legal certainty, in order to guarantee investment continuity while simultaneously protecting the regional economic rights that have been neglected due to unaccountable asset management.

Abstract

The conversion of land rights from Right of Use (Hak Pakai) attached to Regional Government Property (Barang Milik Daerah/BMD) into Building Use Rights (Hak Guna Bangunan/HGB) represents a juridical issue in the Indonesian agrarian legal system. The development of Mega Mall in Bengkulu City illustrates problems in the management and utilization of regional land assets that may create legal uncertainty and potentially cause regional financial losses if not conducted in accordance with the law. This study aims to analyze the legal mechanism for converting BMD Right of Use into Building Use Rights, identify the legal problems that arise, and formulate its juridical implications. This research employs statutory and conceptual approaches. The results show that such conversion must follow the mechanisms regulated in the Basic Agrarian Law, Government Regulation Number 40 of 1996, Government Regulation Number 28 of 2020, and the Minister of Home Affairs Regulation Number 19 of 2016. Any deviation from these mechanisms may lead to legal uncertainty, land disputes, and legal liability for authorized officials.

Abstract

Artikel ini menganalisis proses peralihan status sertifikat hak pakai atas barang milik daerah (BMD) aset Pemerintah Kota Bengkulu menjadi sertifikat hak milik (SHM) untuk Mega Mall Bengkulu. Berdasarkan Undang-Undang Pokok Agraria (UUPA) No. 5/1960 dan Peraturan Menteri Agraria dan Tata Ruang atau Kepala BPN No. 13/2017, BMD dikuasai negara dan hanya dapat diberikan hak pakai terbatas. Namun, praktik peralihan ke SHM sering terjadi melalui pelepasan hak pengelolaan (HPL) atau jual beli aset daerah, yang menimbulkan kontroversi yuridis. Penelitian ini menggunakan pendekatan normatif dengan analisis kualitatif dokumen sertifikat, putusan pengadilan, dan literatur agraria. Temuan menunjukkan peralihan status Mega Mall Bengkulu melibatkan Keputusan Gubernur Bengkulu No. 123/2020, yang dimana BMD dilepas menjadi aset swasta via lelang, menghasilkan SHM No. 00123/2021. Resiko hukum mencakup pelanggaran Pasal 41 UUPA dan potensi sengketa restitusi lahan adat. Rekomendasi mencakup penguatan regulasi pelepasan BMD untuk mencegah abuse of power dan memastikan transparansi. Implikasi teoritis memperkaya diskursus hak pengelolaan negara dalam pembangunan komersial, sejalan dengan restorative justice dalam penyelesaian konflik agraria.

Abstract

Peralihan status hak atas tanah yang merupakan aset pemerintah daerah seringkali menimbulkan permasalahan hukum, terutama apabila proses perubahan status tersebut tidak dilakukan sesuai dengan ketentuan peraturan perundang-undangan yang berlaku. Salah satu kasus yang menjadi perhatian adalah peralihan status sertifikat tanah pada kawasan Mega Mall Kota Bengkulu yang semula merupakan tanah dengan status Hak Pakai sebagai Barang Milik Daerah (BMD) milik Pemerintah Kota Bengkulu, kemudian berubah menjadi Sertifikat Hak Guna Bangunan (HGB) yang dikuasai oleh pihak pengelola Mega Mall. Perubahan status hak atas tanah tersebut menimbulkan berbagai persoalan hukum, khususnya terkait pengelolaan aset daerah, kewenangan pemerintah dalam mengalihkan hak atas tanah, serta potensi kerugian terhadap keuangan dan kekayaan daerah. Penelitian ini bertujuan untuk menganalisis proses peralihan status sertifikat hak pakai yang merupakan aset pemerintah daerah menjadi hak guna bangunan milik pihak swasta, serta menelaah kesesuaiannya dengan ketentuan hukum agraria di Indonesia, khususnya yang diatur dalam Undang-Undang Pokok Agraria (UUPA) serta peraturan terkait pengelolaan barang milik negara dan daerah. Metode penelitian yang digunakan dalam kamian ini adalah metode penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan kasus, yaitu dengan menelaah berbagai peraturan hukum yang berkaitan dengan hak atas tanah, pengelolaan barang milik daerah, serta dokumen dan informasi yang berkaitan dengan kasus Mega Mall Kota Bengkulu. Hasil kajian menunjukkan bahwa perubahan status hak atas tanah dari Hak Pakai sebagai aset pemerintah daerah menjadi Hak Guna Bangunan yang dikuasai oleh pihak swasta menimbulkan persoalan dalam aspek legalitas penguasaan tanah serta berpotensi menimbulkan konflik kepentingan dalam pengelolaan aset daerah. Selain itu, perubahan status tersebut juga memunculkan indikasi adanya ketidaksesuaian dengan prinsip pengelolaan barang milik daerah yang seharusnya dilakukan secara tertib, transparan, dan akuntabel. Oleh karena itu, kasus ini menjadi penting untuk dikaji sebagai bentuk evaluasi terhadap praktik pengelolaan aset daerah serta sebagai upaya untuk memperkuat pengawasan dan kepastian hukum dalam pengaturan hak atas tanah yang berkaitan dengan kepentingan pemerintah daerah dan masyarakat.
