Abstract

Dosen Pembimbing:1.  Prof. Dr. Budiman Ginting, SH, MHum'2.  Notaris Dr. Suprayitno, SH, MKn3.  Dr. T. Keizerina Devi A, SH, CN, MHum SKMHT (Hypothecation Imposition Letter) is used to make a hypothecation Certificate when its giver cannot be present. Guaranty imposition tends to reveal bad intention by falsifying SKMHT. The objective of the research is to analyze the forgery based on the problems of how about guaranty imposition can be done by using power of attorney of SKMHT, how about the legal consequence of the collateral which is imposed by Hypothecation through falsified SKMHT certificate, and about the judge’s legal consideration concerning the Verdict No. 395/Pdt.G/2011/PN.Jkt.Sel. The data were analyzed qualitatively by using figures, but is based on legal provisions and respondents’ answers in order to solve the problems in the research. The result of the research shows that SKMHT is a special power of attorney is used to make APHT (assignment of hypothecation certificate); principally, assignment of hypothecation has to be done by its giver and its receiver before a PPAT (official empowered to draw up land deeds) in making APHT, but when its giver cannot be present before PPAT, he is required to appoint another man on behalf of him in making SKMHT.Keywords: Deed, Power of Attorney for Hypothecation Imposition, Imposition

Abstract

The problems of allocation of an inheritance will never cease when they are analyzed based on the system of kinship which is practiced either by a certain traditional community or by the community that follows the bonds of matrimony with different kinship such as in interracial marriage. The research used descriptive analytic method which described, explained, and analyzed inheritance system in the intermarriage between a Bataknese and a Minangkabaunese.The result of the research showed that the existence of various kinds of ethnic groups in Indonesia had caused intermarriages with different kinship so that the allocation of inheritance from parents to their children would change. The allocation of inheritance in the community that practices patrilineal system has changed in which the allocation of inheritance in the intermarriage of the patrilineal community usually uses individual inheritance system of the Adat Law although some of them use inheritance system based on the Islamic Law. The allocation of inheritance in the community that practices matrilineal system, although the parties concerned come from matrilineal kinship system, when there is intermarriage, the kinship system is not used. The allocation of inheritance is done according to the agreement of the heirs as what is practiced in the patrilineal system. This system has also been changed in the inheritance allocation system which is done either according to the mutual agreement or to the Islamic Law.Keywords: Inheritance System in Bataknese and Minangkabaunese

Abstract

In practice, a covernote is made by a reliable Notary/PPAT in disbursingfunds in a credit contract. Covernote is not regulated in the Notarial Act ad in theGovernment Regulation on PPAT, or in the Law on Banking. The researchproblems are how about the authority of a Notary/PPAT to issue covernote for theinterest of stakeholders in a credit contract, how about the legal certainty ofcovernote issued by a Notary/PPAT to disburse credit in banking credittransaction, and how about the liability for a Notary and debtor when theNotary/PPAT cannot settle the case of the Hypothecation on time specified in thecovernote.The research used juridical normative and descriptive analytic method.Primary data were gathered by conducting interviews, secondary data wereobtained from Law No. 30/2004 on Notarial Position, Law No. 4/1996 onHypothecation, PP No. 37/1998 on the Regulation on the Position of the OfficialEmpowered to Draw Up Land Deeds, law No. 7/1992 on Banking, and Law No.10/1998 on the Amendment of Law No. 7/1992 on Banking. SaidinIn order to provide the insurance of legal certainty and protection for people’s land justly and equally, and to encourage national economic growth and people’s economy in particular, it is necessary to conduct accelerated complete land registration in all parts of the Republic of Indonesia. PTSL (Complete Systematic Land Registration) is a program conducted by the Ministry of Agrarian Affairs and Spatial Planning/ Head of Indonesian National Land Office to increase the number of land registration and certificate issuance in Indonesia. The conduct of this program is stipulated in the Regulation of the Minister of Agrarian Affairs and Spatial Planning/ Head of Indonesian National Land Office No. 6/2018 on Complete Systematic Land Registration. In practice, there are some obstacles encountered in its implementation; thus, some field target planning in a region cannot be achieved. The capacity and the authority to do the transfer are in the hand of a profession/position which is known in the Indonesian law as PPAT (Officials Empowered to Draw up Land Deeds) who have the authority to draw up authentic deeds in Land Title or Apartment Ownership. This profession does not belong to the position in the State’s structure but it is an independent profession. It means that the position of a PPAT does not depend on any party and even on the State. In doing his job, a PPAT obtains earnings/fee based on the products he has yielded, authentic deeds.The deed of a PPAT is made as evidence that a certain legal act has been carried out concerning Land Title and Apartment Ownership. One of types of Deed made before a PPAT is Sale & Purchase Contract. Buy and sell are an agreement in which a party binds himself to submit a certain thing and the other party pays for it. Sale & Purchase contract made before a PPAT is the formulation from the parties which is embodied in it. In the transaction, the delivery of goods and its payment are done transparently and in cash. Therefore, the goods which will be delivered, along with the price are mentioned in the Deed so that in the formulation of the Sale & Purchase contract, a PPAT is required to use prudential principles in embodying the willingness of the parties to the Deed in order to be protected against any claim from the authorities.Keywords: Officials Empowered Draw up Land Deeds, Authentic Deed, Sale & Purchase

SaidinAdoption is a legal act which transfers a child from their parents’ authority, legal guardian, or other people who are liable for their caring, education and raising the child in to an adopted family. It is no longer a strange thing in today’s Indonesian society because adopting child has been frequently done in Indonesia.The results of the research demonstrate that the factors that encourage child adoption in Mandailing community in Panyabungan Utara Subdistrict is to pass on and maintain a lineage of the family who does not have any biological child, to maintain marital bond so that a divorce can be prevented. Keizerina Devi A, SH, CN, MHum Developing oil palm plantation needs a wide area, and this usually brings about conflicts. In this respect, PT. Peniti Sungai Purun is involved in conflict with the people surrounding the area since they complain about the distribution of the land concerning plasma model patnership at purun kecil village and peniraman village. The people claim that the oil palm plantation is unwise and lacks of consideration towards the people’s rights.The reseacrh problems were how about legal provision about the regulation on land ownership at PT. Peniti Sungai Purun, how about the obstacles in settling the dispute by PT. Peniti Sungai Purun as the leasehold holder againts the people’s complaint, how about legal certainty of PT. Abstract

Dispute in land at the area of 260 ha between TNI AU, in this instance, Lanud Suwondo and tillers at Kelurahan Sari Rejo, Medan Polonia Subdistrict, has not yet settled. Each party claims that they control the land so that they are in conflict. The research used juridical normative method by analyzing legal provisions such as UUPA No. 5/1960, PP No. 24/1997 on Land registration, and the Supreme Court’s Ruling No. 229.K/PDT/1991. The nature of the research was descriptive analytic by describing and analyzing the research problems and finding the correct answers as their solution. The legal consequence of the Supreme Court’s Ruling No. 229.K/Pdt/1991on both the conflicting parties is that TNI AU, in this instance, Lanud Suwondo is required to comply with the Supreme Court’s Ruling No. 229.K/Pdt/1991 which has accepted the claim of 87 plaintiffs for the tillers by handing in the land at the area of 5.6 hectares to the 87 tillers.Keywords: Land Dispute, TNI AU, in this Instance, Lanud Suwondo, Tillers, Kelurahan Sari Rejo

Abstract

Istilah simulasi dalam Bahasa Belanda dapat disebut juga “Schijnhandeling”yang diterjemahkan dalam Bahasa Indonesia dengan perkataan “perbuatan purapura/perbuatan semu”, yaitu perbuatan dimana dua orang atau lebih bahwamereka keluar menunjukkan seolah-olah terjadi perjanjia antara mereka, namunsebenarnya secara rahasia mereka setuju bahwa perjanjian yang nampak keluar itutidak berlaku, ini dapat terjadi dalam hal hubungan hukum antara mereka tidakada perubahan apa-apa atau bahwa dengan perjanjian pura-pura itu akan berlakuhal lain. Penelitian ini bersifat yuridis normatif. Hasil penelitian ini menunjukkanbahwa perjanjian simulasi yang dilakukan oleh kedua belah pihak dalampenelitian ini hanya berlaku bagi mereka yang membuatnya dan tidak berlakubagi pihak ketiga. Sehingga Majelis Hakim Mahkamah Agung dalam putusannyamenyatakan bahwa berdasarkan bukti otentik berupa akta notaris telahmembuktikan adanya hubungan hukum berupa pengikatan jual beli objeksengketa, sehingga bukti berupa akta otentik tersebut adalah sah dan mempunyaikekuatan pembuktian sempurna di Pengadilan.Keyword : Perjanjian, Simulasi, Pengikatan Jual Beli

There is the similarity between a Notary and thescribe in Verse 282 of Surah Al-Baqarah. The scribe in Verse 282 of Surah Al-Baqarah should comply with the procedures and ethics which are determined byAllah the Almighty: he has to be honest, impartial, and not to harm other people.The same is true to a Notary who has to comply with the law on NotarialProfession and Notarial Code of Ethics. The principles of Notarial Professionhave been regulated long time ago in Islam by the order to record buy and sellingtransaction, particularly debt and credit.Some prohibitions for a scribe in Verse 282 of Surah Al-Baqarah, amongothers, are: the prohibition to record a transaction unjustly and partially and torecord a transaction which is not in accordance with the principles of recording.It is suggested that he should not be reluctant to record as it is ordered by Allahthe Almighty, and that he should not reduce his debt. The witnesses should not bereluctant (to give information) when they are asked to witness. You should alwaysrecord the debt even though it is little or biguntil you can pay it off.
