Abstract

Dr. Jelly Leviza, SH, MHum The motif developed by weaving craftsmen in Aceh Besar District is potential to be registered as a copyright, but it is not. This problem leads to imitation or plagiarism to the motif designed by one of the craftsmen; furthermore, the craftsman does not realize the importance of registering the motif he has designed. This is a normative juridical research and is analytically descriptive. Based on the description of characteristics of weaving which is classified into the object of traditional cultural expression, it is concluded that Acehnese weaving motif can be regarded as a traditional cultural expression in accordance with article 38 paragraph (1) letter e of the Law on Copyrights. Weaving can be categorized as the combination of forms of fine arts in two or three dimensions made of textile. Weaving motifs created by the craftsmen in Aceh Besar District are included into contemporary weaving protected by Article 40 paragraph (1) letter j of the Law on Copyrights. Aceh Province Government has improved the craftsmen awareness to register their work copyrights and increase weaving product marketing outside of the area. . The protection for Acehnese weaving motif that has been made by Industry, Trading, Cooperatives, and Small to Medium Enterprises Agency of Aceh Besar Regency by carrying out socialization to particularly weaving production villages to actively supervise new creations, and developing Acehnese weaving products. Aceh Besar Regency Government makes efforts by registering new creations of Acehnese weaving motifs.Keywords: Copyrights, Traditional Knowledge, Weaving Motif.

Keizerina Devi A, SH, CN, MHum3.  Notaris Dr. Suprayitno, SH, MKn Paying BPHTB (Land and Building Right Transfer Tax) is principally anobligation of a taxpayer and is not the obligation of PPAT (Land Title Registrar).PPAT can only help the client to deposit the money to pay the tax. PPAT only triesto provide best service for his client by receiving the client’s money to beentrusted to pay BPHTB. This is a normative legal research, which usessecondary data to answer the problems discussed. The data are obtained fromlibrary research. The theory of liability and justice are employed in this research.The results of the research conclude that the PPAT is obliged to deposit themoney entrusted to him for the payment of BPHTB regarding the right transfer ina sale and purchase deed although it is not stipulated in the prevailing laws andregulations. The PPAT who does not deposit the money entrusted to him will havelegal consequences. He is responsible for the obligation of paying BPHTB, but hedoes not deposit the money to the State or Regional Treasury Fund. Thus, itcauses financial loss to the other party as stated in Article 1365 of the Civil Codeand it is also categorized into an illegal action in penal law i.e. embezzlementpursuant to Article 372 of the Penal Code. Keizerina Devi A, SH, CN, MHum A notary is obliged to act honestly, conscientiously, independently, and impartially; and to protect the interests of related parties in taking a legal action before him pursuant to Article 16 paragraph 1 letter a of the Law No. 2/2014. This is a normative juridical research. It uses secondary data to answer the research problems. Library research is done to obtain the secondary data. The results of the research conclude that legalization of parents’ land in the sale and purchase agreement can be done by firstly ensuring if the land is the parents’ personal or joined property which is included into inheritance for their heirs. The sale and purchase of parents’ house to one of their children is valid and the notary has to know whether or not the house or land is included into inheritance.Keywords: Responsibility, Notary, Land Title Transfer, Parents, Inheritance, Heir’s Approval.

Keizerina Devi A, SH, CN, MHum A brand is a sign which is exposed graphically as an image, logo, name, words, letters, figures, and color structure, in the form of 2 and/or 3 dimensions, sound, holograms, or combination of 2 or more elements to differentiate goods and/or service produced by people or legal entity in commercializing goods and/or services. The research used juridical normative method by conducting library research while the nature of the research was descriptive analytic.The result of the research shows that a registered brand which has not been used for three years consecutively can be claimed to be eliminated by the third party since the date it was first registered by the Directorate of Brand. The procedure is that the third party files a claim to the commercial court and to the Supreme Court. The conclusion is that a brand which has not been used by its owner for three years consecutively is by giving balanced and fair legal protection to its holder, and third party that wants to file a claim should have good faith. Child care covers various aspects, namely education, living costs for health, peace and all aspects related to their needs. Today child custody is often a problem before or after a husband and wife conflict, even if it is not uncommon for ex-husbands and ex-wives to fight for their children's custody, because children are the hopes of parents who are difficult to separate. The problem raised in this study, namely how the legal arrangements for child custody in the event of a divorce between husband and wife according to the Compilation of Islamic Law, how the judge's legal considerations in granting child custody permission in the Lubuk Pakam Religious Court Decision Number 706/Pdt.G/2018/PA. Lpk, and the Decision of the Lubuk Pakam Religious Court Number 943/Pdt.G/2014/PA. Keizerina Devi A, SH, CN, MHum Perseroan Terbatas (PT) merupakan perusahaan yang oleh Undang-Undang dinyatakan sebagai perusahaan yang berbadan hukum alam mendirikan suatu PT harus terdapat 2 orang atau lebih dalam mendirikannya. Sebenarnya tidak ada permasalahan jika pemegang saham adalah suami isteri apabila ada perjanjian perkawinan, akan tetapi permasalahan itu timbul telah terjadinya perceraian tanpa adanya perjanjian kawin seperti dalam kasus putusan Nomor 2705K/Pdt/2016.Penelitian ini dimaksudkan untuk mencari akibat hukumnya jika Perseroan Terbatas (PT) didirikan oleh suami dan istri, perlindungan hukum pada pemegang saham suami dan istri saat terjadi perceraian dan analisis hukum terhadap dasar pertimbangan hakim dalam menyelesaikan dan memutus perkara di dalam putusan Nomor 2705K/Pdt/2016.Tesis ini menggunakan jenis penelitian normatif dengan penelitian yang bersifat deskriptif analitis. Data yang dipergunakan adalah data sekunder dengan metode pengumpulan data melalui penelitian kepustakaan. Metode analisis yang digunakan adalah analisis data kualitatif dengan penarikan kesimpulan secara deduktif.Kata Kunci : Perceraian, Pemegang Saham, Harta Perusahaan.

Keizerina Devi A, SH, CN, MHum Board of directors as the organ of a company often makes speculative business decision which tends to cause financial loss. It has implication on their liabilities. The research problems are how business judgment rule is legally regulated according to UUPT (Law on Limited Liability Company), how the liability of board of directors of PT Penanaman Modal Asing (Foreign Investment Limited Liability Company) when it endures financial loss, and how the defense of the directors of PT. Penanaman Modal Asing is made by implementing the principles of business judgment rule in the case of PT ICI Paints Indonesia.The research is done by employing normative juridical method with descriptive analysis. The research materials consist of primary, secondary, and tertiary legal materials. The data are collected from library research using documentation study. They are analyzed qualitatively and the conclusion is drawn by applying deductive reasoning method.

A sale and purchase is a mutual agreement in which a seller promises to hand over his ownership rights over something, and a buyer promises to pay for the price consisting of an amount of money as a reward from the ownership right acquisition. The objective of the research is to discover the position of the land title that is verbally acquired pursuant to the positive law in Indonesia, to study the legal protection for the verbal sale and purchase of land title when the seller defaults, and to analyze the juridical and non-juridical consideration of the judge in the ruling No.114/PDT/2015/PT.MDN. This is an analytical descriptive research with normative juridical approach. Zamakhsyari Bin Hasballah Thaibm LC, MA, PhD3.  Notaris Dr. Suprayitno, SH, MKn A loan transfer or subrogation is the replacement of creditor’s rights by a third party by paying the debtor’s remaining debt to the initial creditor. The loan transfer from a conventional bank to sharia bank applies the principle of Qardh, sharia bank firstly pays off the debtor’s remaining debt before making the deed. The deed transfers the debts and collateral between the debtor and conventional bank. This is an analytical descriptive research with normative juridical approach. Qualitative analysis method is employed to process and analyze the data resulted from the research. The conclusion is drawn by applying deductive reasoning method through normative framework. The research results demonstrate that there are two factors influencing the loan transfer from a conventional bank to a sharia bank, namely internal and external factors. Internal factors consist of profit from pricing, needs for plafond addition, products with more interesting installment, easy requirements, profit share basis (nisbah), and banking promo.Keywords: Loan Transfer, Collateral, Mortgage, Conventional Bank, Sharia Bank

Abstract

Keizerina Devi A, SH, CN, MHumA spoken agreement used the ground of the relationship between parties, in which they have made a mutual agreement, in accordance with the prevailing laws and regulations is stated to be legally valid, but it has soft legal force in the court because it does not have any written evidence, so when it is claimed to the court, it cannot provide evidence. All parties in the court shall present some proof such as: evidence, witness, presumption, confession, and an oath. A spoken agreement can annul an authentic deed of the sale and purchase contract when it does not meet the subjective requirements, the heirs have not obtained a renewed permit as the holder of the land use. Thus; the concerned person can renew the permit use the land by submitting an application to the Mayor or regional authorities. A land use holder is prohibited to transfer the land use permit to another party without firstly obtaining a written notice.Keywords: Spoken Agreement, Legal Force, Certificate
