Abstract

Dosen Pembimbing:1.  Prof. Dr. Syafruddin Kalo, SH, MHum2.  Notaris Dr. Rudy Haposan, SH, MKn3.  Dr. T. Keizerina Devi A, SH, CN, MHum Peran Notaris dalam membuat akta dilatarbelakangi oleh pasal 1866 KUHPerdata yang menyatakan alat-alat bukti terdiri dari atas: alat bukti tertulis atau surat, kesaksian, persangkaan, pengakuan, sumpah, keterangan ahli dan pemeriksaan setempat. Akta Notaris merupakan salah satu alat bukti tertulis yang memiliki kekuatan pembuktian yang sempurna karena tidak memerlukan pembuktian lainnya pada saat diajukan dalam suatu hukum acara perdata. Meskipun demikian, ada kalanya ketentuan-ketentuan dalam Undang-Undang Jabatan Notaris (UUJN) dilanggar oleh Notaris yang mengakibatkan akta yang dibuatnya menjadi akta dibawah tangan. Hal ini tentu saja dapat merugikan para pihak yang menandatangani akta tersebut. Berkaitan dengan hal tersebut, penelitian dilakukan dan menghasilkan kesimpulan bahwa seiring dengan berkembangnya teknologi, kekuatan pembuktian akta Notaris tidak bisa sempurna seperti dulu jika tidak dibantu dengan alat bukti lainnya seperti foto dan media elektronik lainnya.

The land that is reclaimed is called reclamation or landfill. In accordance with the Law, reclamation is defined as the activity that is done to increase the use of the land resources observed from enviromental and economical social views by means of land encirclement and drainage. In case the Government of DKI Jakarta Province wants to carry out reclamation of G Island to PT. Muara Wisesa, they have to prevent the rights of the people at Teluk Jakarta Utara form being violated. Dr. Rosnidar Sembiring, SH, MHum A marriage causes legal relation between husband and wife who yield children and between parents and their children. It can also have the impact on their joint property. A mixed marriage usually occurs in our society; for example, a marriage between a Bataknese who follows patrilineal kinship and a Minangkabaunese who follows matrilineal kinship. Inheritance for a son will be different from that for a daughter since their parents follow different types of kinship: the father is a Bataknese and the mother is a Minangkabaunese, and vice versa. This will cause dispute in the distribution of inheritance. The research problems are which inheritance adat law used in a mixed marriage between a Bataknese and a Minangkabaunese and how about the inheritance distribution for sons and daughters in the mixed marriage a Bataknese and a Minangkabaunese at Kelurahan Tegal Sari III, Medan Area Sub-district.Keywords: Inheritance Rights of Son and daughter, Mixed Marriage, Batak-Minangkabau

Keizerina Devi A, SH, CN, MHum3.  Abdul Rahim Lubis, SH, MKn Perlindungan hukum terhadap pemegang sertipikat hak atas tanah tidak dipisahkan dengan hak asasi manusia. Jenis penelitian hukum normatif dengan menggunakan metode pendekatan yuridis dengan spesifikasi penelitian yang digunakan adalah bersifat deskriptif analitis yang bertitik tolak dari sumber data sekunder. Hasil alat pengumpulan data berupa studi kepustakaan dan wawancara.Kekuatan hukum dari kepemilikan atas tanah yang telah bersertifikat didasarkan atas pendaftaran tanah yang diselenggarakan dalam rangka memberikan jaminan kepastian hukum di bidang pertanahan.Faktor-faktor penyebab sengketa tanah bersertifikat berdasarkan kasus di dalam Putusan Mahkamah Agung Republik Indonesia Nomor 506 PK/ Pdt/ 2010 Tanggal 31 Mei 2011 antaranya adalah faktor ketentuan hukum peraturan perundang-undangan, faktor sumber daya manusia, dan faktor teknis.Berdasarkan fakta hukum di persidangan, terbukti bahwa Arifin Wijaya (Tergugat) telah melakukan Perbuatan Melawan Hukum dan dihukum untuk mengosongkan/ menyerahkan tanah seluas 22.943,73 m2 yang terletak di Propinsi Sumatera Utara, Kabupaten Deli Serdang, Kecamatan Perbaungan, Desa Lubuk Bayas.Kata Kunci : Kekuatan hukum tanah bersertifikat hak milik, faktor penyebabsengketa tanah, dan kepastian hukum sertifikat hak atas tanah

Keizerina Devi A, SH, CN, MHum A foundation as an independent legal subject can take legal actions such as buying and selling. The transfer of the assets belonging to a foundation, in this case, land and building, still finds impediment in its process at the Land Office. Land Office still argues that, if the transfer goes on, it will violate Article 5 paragraph 1 of the Foundation Law. This thesis employs the normative juridical research method which is analytically descriptive. The data used to answer the research problems are secondary data. The results of the research demonstrate that, the property of the foundation is obliged to be used in accordance with the purpose and objectives of the foundation and if it is dissolved, according to Article 68 in the Law No. 28/2004 on the Amendment to the Law No. 16/2001 on Foundation, all assets shall be handed over to another foundation which shares similar purpose and objectives.Keywords: Exercise, Transfer, Rights over Land, Foundation

Keizerina Devi A, SH, CN, MHum Lately, the management of a corporation has gotten public criticism for its unprofessionalism, inefficiency, and no transparency so that it is usually not survived. The problem is what makes their performance inefficient and not optimal. The research problems are how about the position and the role of Directors in managing a corporation, how about their liability for a cooperative agreement which causes the State’s loss, and how about the Panel of Judges’ consideration in handing down the Supreme Court’s Ruling No. 77PK/Pid.Sus/2015 stipulated in Law No. 40/2007 on Corporation concerning Directors’ Liability for a Cooperative Agreement which causes the State’s loss. The research used juridical normative and descriptive analytic method. The data were obtained from primary, secondary, and tertiary legal materials. They were gathered by conducting library research and understanding the Supreme Court’s Ruling No. 77PK/Pid.Sus/2015 and analyzed systematically qualitatively while conclusion was drawn deductively.Keywords: Liability, Directors, State’s Loss

Keizerina Devi A, SH, CN, MHum3.  Dr. Jelly Leviza, SH, MHum Industrial design is one of Intellectual Property Rights with aesthetics protected by the Law No. 31/2000 on Industrial Design. However, the Law only protects the registered industrial designs at the Directorate General of Intellectual Property Rights. In accordance with Article 2 paragraph (1) of the Law on Industrial Design which states that the right over an industrial design is only granted to a new one. The designer will receive an Exclusive Right if he registers it. This right is only owned by someone who has an Exclusive Right and other people are prohibited to make, use, sell, import and distribute the product that has been granted a right over the Industrial Design. The research problems are how the efforts of the legal protection for intellectual property rights can be obtained by a designer of an industrial design, how about the registration and annulment of an industrial design in Indonesia which puts priority to novelty principle based on the Law on Industrial Design, and how about the legal protection for the exclusive rights of the owner of the Industrial Design who finds similarities between his design and another design which has already been registered regarding the ruling No: 07/HKI.Desain.Industri/2015/PN-Niaga.Sby. Although the industrial design has been registered, it still has similarities with other designs that cause financial loss to other parties. In fact, the Directorate General of Intellectual Property Rights directly receives the registration of an industrial design if the formal requirements are met. If there is not any refusal from other parties at the time the announcement, the certificate for the industrial design can be issued.A substantive or further inspection is required, but the substantive inspective is conducted only when there is a party files an objection or lawsuit to the court.Keywords: Industrial Design Registration, Exclusive Rights, Novelty

Prof. Dr. Muhd Yamin, SH, MS2.  Prof. Dr. Syafruddin Kalo, SH, MHum3.  Dr. Edy Ikhsan, SH, MA A certificate is issued to insure the benefits of the right owner in accordance with the juridical and physical data that have been registered or recorded in the land registry. Land title certificate is useful for the right owner to the third party that they are the owner of the land concerned. The example of this problem is the Case in the Verdict No. 327 K/2016/PTUN. The objective of the research is to find out the causes of the issuance of Land Title Certificate in Selayang Village, the legal protection for the plaintiff against the issuance of the land title certificate, and the judge’s legal consideration in pronouncing the case in the Verdict of the Supreme Court. This thesis employs normative juridical research with analytical description. It is concluded that the legal consideration of the Panel of Judges concerning this case is that Medan State Administrative Court has revoked its Ruling. The Ruling of Medan State Administrative Court is expected to provide legal certainty for the status of the legal object and the land, similar to the case which states that the Plaintiff wins at the level of Cassation and annuls the Land Title Certificate.Keywords: Administrative Dispute, Legal Protection, Judge’s Consideratio

Keizerina Devi A, SH, CN, MHum3.  Dr. Mahmul Siregar, SH, MHum A Notary is a public official who has the authority to draw up authentic deeds and has other authorities as stipulated in Article 1 of Law No. 30/2004 on Notarial Position as it is amended to Law No. 2/2014 on the amendment of Law No. 30/2004 on Notarial Position. The research used juridical normative and descriptive analytic method. The result of the research shows that legal certainty which firmly prohibits a nominee contract is stipulated in Article 33, paragraphs 1 and 2 of Law No. 25/2007 on Capital Investment. Abstract

Keizerina Devi A, SH, CN, MHum3.  Dr. Jelly Leviza, SH, MHum Stock divestment is taking over some stocks of foreign investment to the other party, done either directly or by an auction in order to improve social welfare. The objectives of the research are to analyze the divestment agreement made in a contract of work between the Government of the Republic of Indonesia and PT. Newmont Nusa Tenggara based on the perspective of the prevailing laws and regulations in Indonesia, to analyze the mechanism of stock divestment that has to be done by PT. Newmont Nusa Tenggara as stated in the content of the work contract with the Government of Indonesia, and to analyze the legal consequences of the default done by PT. Newmont Nusa Tenggara that does not divest their stocks in accordance with what is mandated in the Law No. 4/2009 on Mineral and Coal Mining.This is a normative juridical research with analytical descriptive approach. The main data are sourced from secondary data collected by conducting library research. They are collected through document study, and are analyzed qualitatively.The results of the research demonstrate that the agreement made concerning stock divestment in the work contract is made in the provisions in Article 112 of the Law No. 4/2009 and Article 24 concerning national benefit promotion, particularly Article 24 Paragraph (4) of the contract content. The mechanism of the stock divestment that has to be undergone by PT. Newmont Nusa Tenggara is stipulated in the Regulation of the Minister of Energy and Human Resources No. 27/2013 on Procedures and Determination of Stock Divestment Price, and Investment Changes in Mineral and Coal Mining Companies. The legal consequences for the default done by PT. Newmont Nusa Tenggara for not divesting its stocks is that Government of the Republic of Indonesia shall file a lawsuit to International Arbitrary and issue four final decisions winning the lawsuit filed by Government of the Republic of Indonesia concerning the dispute over divestment.Keywords: Stock Divestment, Mining Company, Work Contract.
