Abstract

Dr. Yefrizawati, SH, MHum The principle of freedom to make contracts or what is called Al-Hurriyah in Islamic Laws which means that all concerned parties are free to make contracts, to decide with whom and the object of the contract, and to determine how to make settlement in the future as long as it is not contrary to Islamic Sharia Laws. Mudarabah (sharing the profit and loss with venture capital) financing contract is a contract between shahibul maal (financer) who provides 100% of capital to mudarib (working partner) for a productive business. The mudarabah financing contract done by the sharia cooperative is unilaterally determined as shahibul maal. The research problems are how mudarabah financing contract is regulated based on Islamic Laws, how the principle of freedom to make contracts is implemented in form of a standard contract in the Sharia Cooperative of the Al Ikhlas Motherhood in Sukadono in accordance with Islamic Laws, and how about the legal protection for the members involved in the contract.This is a normative and empirical juridical research which is analytically descriptive. It uses primary data collected from interviews and questionnaires, and secondary data collected from primary, secondary, and tertiary legal materials. This research is done in Sharia Cooperative of the Al Ikhlas Motherhood in Sukadono, Jalan Tanjungn Permai No. 303, Deli Serdang. The analysis used is qualitative data analysis.Mudarabah financing contract is regulated in a verse of the Quran i.e. Surah Al- Muzzammil verse 20, Hadith in Ibnu Majah No. 2280, Ijma’, a number of Sahabah handed to a mudarib the property of orphand as mudarabah, Fatwa DSN-MUI No. 07/DSN-MUI/IV/2000 on Mudarabah Financing (Qiradh), stating that mudarabah financing contract is an agreement between shahibul maal who gives100% of capital to mudarib for a productive business. The principle of freedom to make contracts in the mudarabah financing contract in form of a standard contract according to Islamic Laws that is done by the Sharia Cooperative of the Al Ikhlas Motherhood in Sukadono is not implemented, because in spite of the members’ willingness, the standard contract is contrary to Islamic Laws. The legal protection for the members involved in the mudarabah financing contract done by the Sharia Cooperative of the Al Ikhlas Motherhood in Sukadono, Tanjung Gusta, is the khiyar i.e. khiyar asy-syart, meaning that when there is a dispute and it cannot be settled by a discussion, it can be settled by the Religious Court.Keywords: Al-Hurriyah, Sharia Cooperative, Mudarabah Contract

Dr. Yefrizawati, SH, MHum Anak adalah seseorang yang belum berusia 18 (delapan belas) tahun, termasuk anak yang masih dalam kandungan. Setiap anak berhak untuk mendapatkan perlindungan dan kesejahteraan bagi anak angkatnya, sesuai dengan ketentuan peraturan perundang-undangan. Adapun Rumusan masalah penelitian ini yaitu faktor-faktor apakah yang menjadi penyebab terjadinya perlakuan penelantaran anak oleh orang tua angkatnya, bagaimana bentuk perlindungan hukum terhadap anak yang ditelantarkan orang tua angkatnya, serta bagaimanakah pelaksanaan perlindungan hukum yang dilakukan Dinas Pemberdayaan Perempuan dan Perlindungan Anak Provinsi Sumatera Utara terhadap anak sebagai korban penelantaran yang dilakukan oleh orang tua angkatnya. agar dapat tumbuh menjadi pribadi yang kuat baik secara fisik maupun mental serta terbebas dari tindak kekerasan, eksploitasi dan penelantaran. Prinsipnya anak-anak harus mendapat perlindungan atas hak-hak mereka agar dapat tumbuh dan berkembang secara wajar dan berkesinambungan. Orangtua angkat bertanggungjawab dalam memberikan perlindungan. Penelitian ini menggunakan penelitian hukum empiris yang bersifat dekriptif analitis.Kata Kunci : Perlindungan Hukum, Anak Angkat, Penelantaran

Keizerina Devi A, SH, CN, MHum The conclusion is that the position of a certified Notary as a mediator in and outside the Court does not violate Law No. 30/2004 on Notarial Position, Law No. 2/2014 on the Amendment of Law No. 30/2004 on Notarial Position, the Notarial Code of Ethics/2015, the Supreme Court’s Ruling No. 1/2016 on the Procedure of Mediation in Court, and the Guidance for Mediator’s Behavior No. 108/KMA/SK/VI/2016 since they do not firmly prohibit two positions for a Notary as a mediator. Even though the profession for a Notary as a mediator is under the official institutions, the Supreme Court and the Court; his fee does not come from these institutions but from the conflicting parties that appoint him as a mediator. It is recommended that a Notary be given legal certainty and legal protection in order to maintain him as a certified mediator in and outside the Court and at the same time as legal umbrella and a rule of thumb for him as a certified mediator in and outside the Court.Keywords: Position, Notary, Certified Mediator

Dr. Idha Aprilyana Sembiring, SH, MHum The land that has been registered must have authentic evidence in written form. This authentic evidence is made in form of land title certificate. With the issuance of land title certificate, the State juridical acknowledges the ownership of a piece of land to those whose names are written in its certificate. Thus, the land title ownership cannot be claimed by any other parties. By the enactment of the Agrarian Act, the government provides as fair rights as possible for all Indonesian people concerning land problems; however, the land has to have social functions to be useful for social welfare for the owner and the society. The research problems are 1). How the legality of the title ownership over the land that is occupied by a daughter in law is, according to the law implemented in Indonesia, 2) How the legal protection for the land title holder over the certified land that is occupied by a daughter in law and how the legal consequences are, and 3) How the legal consideration of the judge is, in the Verdict of the Supreme Court No. 1648 K/Pdt/2015.This research employs normative juridical method with descriptive analysis. The data were collected through library research and field research, by conducting document study and guided interviews. They were then analyzed qualitatively. Notaris Dr. Tony, SH, MKn  Rapid development of information technology influences legal profession such as notarial profession, especially in the concept of cyber-notary in which a Notary has the authority to certify electronic transaction, using electronic signature. However, a subscriber's electronic signature is very vulnerable to be misused so that he needs legal protection. The objective of the research was to find out legal status of using an electronic signature in notarial position in electronic transaction and legal protection for a Notary and a subscriber. The research used juridicial normative method which was referred to library research and other secondary data which were related to the subject matter of the research. It is found that electronic signatures have not been applied in using Notarial deed since it is not recognized in the legal provisions concerning electronic signature in making electronic Notarial deed. This is because a Notarial deed which is signed electronically does not have any legal force as evidence since it is considered as an underhanded certificate. So far, there has not been legal provision concerning the use of electronic signature in an authentic deed. Rapid development information technology has the effect on personal data which is vulnerable to the misuse when it is not legally protected. In practice, Notaries do not use electronic signatures in their deeds since there is no regulation which regulates the use of electronic signatures so that they do not have legal ground to do their authority since they are not protected by law. One of the elements of capacity in laws on agreement is age eligibility. Age limitation has caused legal uncertainty because it is regulated differently in some laws and regulations. An agreement is valid when all parties are 21 years old and/or married. Therefore, the panel of judges in Kisaran District Court that verify, hear and decide, pronounce the ruling for the civil case no. 07/Pdt.G/2010/PN-Kis on construction sharing agreement between Jamiluddin S and Segar as the Director of CV. Putra Mandiri grounded on the argument that Jamiluddin S was not capable of taking legal actions because he was not 21 years old yet when making the agreement. The research problems are how the validity of a legal action in a construction sharing agreemnt is, if it is taken by a minor, how about the consequences of a minor legal action in a construction sharing agreement for a notarial deed, and how the case of the construction sharing agreement made by a minor before a notary is settled by Kisaran District Court. Dr. Yefrizawati, SH, MHum Article 1666 of the Civil Code states that Grant is “an agreement in which a grantor gives an object that is complimentary and cannot be taken back for the benefit of the grantee. The plaintiffs mention, in the civil lawsuit filed in Malang Religious Court No. 1000k/pdt.g/2011/pa.mlg, that the defendant has forcefully and without any notice granted their other child a piece of land which title is directly transferred afterwards.The results of theresearch demonstrate that the lawsuit filed by the plaintiffss is caused by themselves , in this case parents, do not know that the the deed they have signed is a deed of grant, in which it states the grant of a certified land. The judge objects the plaintiffs’ lawsuit because the deed made by the Notary contains statement that any dispute in the future shall be settled by the District Court.Keywords: Grant Cancellation, Transferred Land Title, Grant

A Notary who has been appointed and taken an oath is required to do his job seriously as it is stipulated in Article 7, paragraph 1 of UUJN (Notarial Act). He becomes the object of supervision by MPD. He becomes the object of supervision by MPD. Prof. Dr. Saidin, SH, MHum According to Article 37 paragraph 1 of the government regulation no. 24/1997 on Land Title Registration, it is stated that the transfer of land title and ownership rights over a unit of flats can only be registered if it is made in a deed by a Land Title Registrar. Every transfer of land title is obliged to be registered to the local National Land Office, and its registration has to meet all provisions in the Regulations of Ministry of Agrarian/Head of National Land Office No. 3/1997 on the Provisions of Implementation of the Government Regulations No. 24/1997 on Land Registration. However, in practice, land title transfer is frequently preceded by a Sale and Purchase Contract and Power of Attorney to Sell. This research studies how the legal status of the sale and purchase contract and power of attorney to sell is in the land title transfer pursuant to the prevailing laws and regulations, how the legal consequences for the land title that is transferred based on a sale and purchase deed sourced from a sale and purchase contract and power of attorney to sell that has been annulled, and how the analysis of the Verdict of the Supreme Court No. 1681k/pdt/2015 related to the land title transfer based on a sale and purchase deed sourced from a sale and purchase contract and power of attorney to sell that has been annulled. The analysis of the Verdict of the Supreme Court No. 1681k/pdt/2015 pronouncing that the legal action made by the Cassation Applicant/Plaintiff and I Nyoman Widajaya had legal defects and is null and void before the law has been appropriate. Abstract

Hamdan, SH, MHum A notary has to be truthful, honest, careful, independent, and impartial as stated in Article 16 paragraph (1) letter and a Article 4 of Law on Role of Notary. A noatry who is untruthful is sanctioned. Notary's untruthfulness in carrying out his duties as a public official can result in fraudulent statements in authentic deeds, notary in making Articles of Association of a company and changes to it, how about the position of the Deed of Minutes of Shareholder Meeting containing legal defects observed from the perspective of the Law No. 40/2007. This is a normative juridical research which is analytically descriptive. It uses secondary data collected through library research. The data are analyzed by Qualitative analysis and the conclusion is drawn deductively. The results of the research demonstrative that the authority of a notary makiing Articles of Association and changes to it is used in form of a noatrial deed as stipulated in the provision of the Law notarial authentic deeds is not subject to the Law on Role of Notary and the procedures of making decisions in Shareholder Meeting is pursuant to the Law on Limited liability companies, so that the deeds made are null and void. The legal consequences for such deeds have impacts on notary's liability for his actions in which he is sentenced with criminal sanction.
