Madania: Jurnal Kajian Keislaman is a peer-reviewed international journal focusing on Islamic studies. The journal provides a platform for disseminating the latest research and scholarly discussions on Islam and Muslim culture in a broad sense, encompassing theoretical and empirical investigations of themes relevant to Muslim societies globally and beyond. Madania publishes articles under six main topics: Islamic Law – Discussions on fiqh, legal theory, and contemporary issues in Islamic jurisprudence. Islamic Education – Research on pedagogical theories, practices, and innovations in Islamic education. Islamic Economy – Analyses of Islamic financial systems, economic theories, and practices. Islamic Theology, Philosophy, and Psychology – Studies exploring theological debates, philosophical perspectives, and psychological dimensions of Islamic thought. Islamic Communication – Research on communication ethics, media studies, and the role of communication in Islamic contexts. Study of the Qur’an and Hadith – Investigations of textual analysis, interpretations, and the application of Islamic scriptures. Madania accepts two types of articles: Research Articles: Scholarly reports presenting the results of quantitative or qualitative studies that contribute to the advancement of knowledge in Islamic studies across the six themes. Conceptual Articles: Papers offering theoretical perspectives, models, or philosophical analyses relevant to Islamic studies, engaging with contemporary theories and frameworks. All submissions to Madania undergo a rigorous double-blind peer-review process to ensure high standards of quality and academic integrity. The journal is committed to publishing original, innovative, and impactful research that addresses contemporary challenges in the Islamic world.

Abstract

In a view of Muslim scholars, naskh(abrogation) is one of the metods in undertaking ta`ârudh al-Adillah. Nevertheles, there are disputes on meaningand existence of naskh in the Qur’an and Hadis and the influence in applying istinbath al-hukm (deducing Islamiclaw) among them. The present paper is aimed at describing the function of naskh as one of the elsaticityelements in the Islamic law. In developing islamic law, to appear the elasticity, the real meaning of naskh is toabrogate a law from a side to another one. Naskh, on the other hand, also stands for tentative abrogation and itcan be applied recently in other way based on apropriate situation, condition, and motivation

Abstract

Islamic teachingpreached by Muhammad saw contained verious norms- moral norm, legal norm, and social norm- have beeninstitutionalized in the Islamic community as well as partly transformed into social institutions. The morerevelations received by Muhammad the more norms conveyed to humans, and the more types of socialinstitutions arise. When Muhammad was in Mecca while performing education institutions, he focused hisattention on engrafting social norms. Dealing with marriage circumstances, a lot of changes of legal normswere regulated by the Marriage Code of Number 1 1974. The changes do not mean an old thing changes to newor a current thing differs from the past. The change often means to replace something to another one whichhas been exactly existed but not popular. Allowing woman becomes a judge, for instance, is one of the lawchanges that the former law did not allow her as a judge because of following certain sect. According to othersects, such allowing is not something new, but it has been existed since classical Islamic era. The change alsomeans adopting certain concept and it is modified then. Adopted child is forbidden in Islam, but the Islamic LegalCompilation allowed it with modification.

Abstract

The present paper will describe elasticityof Islamic law in responding global and social change. The Islamic law is not only a law given by the will of Lordto all human being, but it has been also a dynamic and flexible law which came gradually in accordance withdevelopment of muslim societies through ijtihad which interpreteds the sacred text, naş, compares analogicallya new case that there is no legal recommended with a legal recommended case based on the mean of Islamiclaw. Historically, through considering public interest and social change logic, the government has a capableof declaring a decision that has relation to the naş argument by political power if needed. it was followed, forinstance, that a male muslim who was allowed to marry a christian woman was forbidden in Umar bin Khatab era

Abstract

al-Wujûh and an-Nazā`ir are material discussion related to thecontext meaning of vocabulary which are covered in the Qur’an. Al-Wujûh is a word has same form of lafaz butdifferent meaning. Besides, al-Nazhâ’ir has different word but it has same meaning although it contains differentemphasis or impression. Some of moslem scholars have observed and discussed about al-Wujûh and an-Nazā`irand they resulted some formula such as “all words in the Qur’an mean this exepct that one” or “all these wordsin the Qur’an mean this one, except that verse” or “ there is word that means this one in the Qur’ran, except inthis verse”, but the third form is rarely used. Abstract

Therelationship between democracy and Islam has been disputed materials among Muslim scholars. One of themsaid that democracy has similar understanding with the concept of Islamic politic, but the other one argued thatboth concepts about politics are different. The present article tries to describe the concept of Islamic politicsand the relation to the democracy. The main question should be answered in this paper is whether the conceptof democracy is equal to Islam or even in dispute. In one side, democracy as a governmental system is not inline with Islam because it does not mention clearly certain formulation of state. Otherwise, having humanityvalues, the democracy has similar concept to Islam because the values and the principles of politic gathered bydemocracy are not contradiction to the principles of Islamic politics.

Abstract

In Islamic politics(fiqh al-siyâsah), one of the material studies is a power. In brief, the Islamic politics includes constitutional law,administrative law, international law, and economic law. In view of the relation, on the other hand, it discusseson the relationship of people and the leader as a concrete ruler in a country, inter-nation, or in their national andinternational economic policy. In Islamic politics, there are many theories formulated by some moslem scholarsthat become guide in a practice. Besides, this Islamic jurisprudence theory, as its real advantage, will gather theproblems that have same reason. This theory also will make easy to social life in political activities. This article isaimed at describing 12 Islamic legal norms which relevantly should be applied now and in the future.

Abstract

The development offinancing of the Islamic banking can not be separated from the role of the accounts officer who became mostimportant marketing personnel on the financial product. By running the functions and role of an account officerat Islamic banking financing the improvement can be realized. It was proven that the increase in 2013 amountedto 80,85% of the total disbursements of Islamic banking or Rp 135, 58 trillion invested in financing activities.Growth is directed to financing the real sector in the form of financing (mudarabah and musharakah), accountsreceivable (murabaha, istisna, and qardh), and in the form of ijarah financing. The development financing in 2013still dominated murabahah receivables amounting to Rp 80,95 trillion or 59.71% followed musharakah financingthat amounted to Rp 25,21 trillion (18.59%) and mudarabah financing amounting to Rp 11,44 trillion (8.44%), andqardh receivables amounting to Rp 11,19 trillion (8.25%). Factor of quality accounts officer was instrumental insupporting the development of Islamic banks, and on the one hand improve the ability of the real sector inemployment.
