Abstract

In the era of globalization, transnational crime is an inevitable trend as the lines between nations become more unified. One form of transnational crime that is very disturbing to various countries is money laundering which has several modes and one of them is international trade transactions. This mode is done through a Letter of Credit (L/C) document as a means. The purpose of this study is to determine the form of regulation against money laundering in the mode of international trade transactions and understand its law enforcement against the mode of international trade transactions. The type of research used is normative juridical research with a statutory approach to find out the overall legal regulations governing the examination of documents in L/C, and a conceptual approach using a way of looking at legal principles in legal theory. The result of this study is that the Government has regulated the use of L/C through Permendag Nomor 94 Tahun 2018, especially for exports of minerals, coal, oil and gas, and palm oil. This regulation requires the use of L/C from domestic banks for certain types of exports and imposes sanctions for violators of this regulation and its enforcement against abuse of the authority of credit facilities by banks through L/C, must immediately prioritize the improvement, improvement, and renewal of the Banking Law accompanied by firm law enforcement and managerial improvement of banking.

Abstract

To ensure that development is carried out for the public interest, the government must carry out development. Therefore, the values ​​of humanity, democracy and justice must be prioritized in land acquisition. To realize a just, prosperous and prosperous society based on Pancasila and the 1945 Constitution of the Republic of Indonesia, this is necessary. The Public Appraisal Service Office (KJPP), which estimates a fair replacement value for community assets (land and buildings) damaged by development, is one of the professions involved in the implementation of land purchases. Law Number 2 of 2012, which regulates the purchase of land for development in the public interest, regulates participation. Compared to ten years ago, Indonesia is now doing a lot more appraisal work. The difficulty of reaching an agreement between the party needing the property (the land acquisition party) and the land owner on the amount of compensation to be received by the land owner is a problem that often arises in the process of determining compensation in land acquisition. Landowners were compensated in ways deemed inappropriate and unfair, and which did not promote the welfare of the environment, leading to legal problems (lawsuits).The normative juridical method with a literature study approach was chosen as the research methodology in this study. The literature study method gathers information from a variety of literary sources, including books, scientific journals, laws and regulations, decision studies, and other materials relevant to the research topic. The purpose of this descriptive research is to describe and explain phenomena related to the research topic.Based on research findings, the calculation of compensation that is correct and fair in land acquisition is necessary for the welfare and prosperity of the people. Law Number 2 of 2012 concerning Land Acquisition for Development in the Public Interest which regulates land acquisition for public purposes has been in effect. Comprehensive and applicable laws and regulations play an important role in this land acquisition, procedures that are as simple as possible, transparent, and have legal certainty based on the principles of integrity and fairness are also important. The government needs to find a solution that can minimize the negative impact on the people whose land is being taken, while maximizing the positive impact on the wider community. The Public Appraiser Service Office must raise the status of the Appraiser Bill so that it is immediately passed into the Appraisal Act by the DPR so that it can carry out its professional responsibilities with legal certainty and without being criminalized by other parties.

Abstract

The renewal of the offense of inclusion in Article 20 of Law Number 1 of 2023 is certainly interesting to discuss further regarding how the renewal of the offense of inclusion will affect the enforcement of criminal law in Indonesia, especially in the field of law enforcement for criminal acts of terrorism, because of the expansion of the meaning of inclusion This will have its own influence on law enforcement. What is the meaning of the expansion of inclusion offenses in Law Number 1 of 2023? How does it affect law enforcement for criminal acts of terrorism? The research method used in this research is a normative juridical research method. The material studied uses primary, secondary and tertiary legal materials. The results of the research show that the expansion of included offenses in Law Number 1 of 2023 concerning the Criminal Code actually has an influence in the form of strengthening the implementation of law enforcement contained in Law Number 15 of 2003 concerning the Eradication of Criminal Acts of Terrorism. The expansion of the offense of participation, especially to the material of encouraging other people to commit criminal acts by giving or promising something, abusing power or dignity, committing violence, using threats of violence, committing misdirection, or by providing opportunities, means or information, where there is a compatibility between the extensions of the offense of participation can certainly work in harmony in maximizing law enforcement efforts in the form of punishment for criminal offenses contained in legal regulations related to terrorism.

Abstract

Basically, the problem of wrongful arrest cases is still quite common, where in practice, law enforcement officers sometimes use violence, coercion or pressure on a suspect during the investigation process. The actions of Law Enforcement Officials can be categorized as unlawful acts. The problem in practice is that the concepts of restitution (compensation) and rehabilitation, especially in cases of wrongful arrest, are still very rarely applied in the field of criminal law. The research method used in this research is a normative juridical research method. The materials studied are primary, secondary and tertiary legal materials. The research results show that basically requests for the right to compensation and rehabilitation can be submitted by the suspect, his family or his attorney. So heirs can also apply for rehabilitation. Likewise with compensation for losses. However, in practice and implementation, the concepts of restitution and rehabilitation, especially in cases of wrongful arrest, are still rarely applied in the field of criminal law. The problem of wrongful arrest, of course, not only needs to be corrected and is homework that needs to be addressed by the government, but also requires concrete solutions whose benefits and justice can be felt directly by the community, especially towards suspects or defendants and/or the families of suspects or defendants who are victims of wrongful arrest. . So in this research, researchers reconstruct an ideal and fair solution for all parties, including law enforcement officials who make mistakes in criminal procedures, as well as for suspects or defendants and/or the families of suspects or defendants who are victims of wrongful arrest.

Abstract

This research departs from the high crime rate caused by terrorism in the territory of the Republic of Indonesia. Meanwhile, Indonesia is a rule of law which aims to create a just and prosperous society. This research aims to: (1) Find out the elements regulated in Article 6 of Law Number 5 of 2018. (2) Find out the forms of accountability or sanctions for perpetrators of criminal acts of terrorism according to Article 6 of Law Number 5 of 2018. This research using Normative research type. The collection of legal materials is carried out using the Statute Approach and Case Approach techniques. The data sources used are primary, secondary and tertiary data. The results of research and discussions show that ratification of the Terrorism Bill (RUU) is an urgent need, especially considering the increasing threat of terror in the country. The existence of the law can be used by the authorities, one of which is that the police can take direct action against individuals who are proven to be affiliated with the ideology of certain terrorist groups.

Abstract

The use of game elements in non-game situations with the aim of increasing positive learning behavior is known as gamification. This paper aims to investigate the concept of gamification in the Indonesian light traffic criminal system. Incorporating gamification components such as points, levels, badges, rankings, and avatars to improve compliance with traffic regulations is a key goal. To understand the potential of gamification in traffic law, this research looked at related literature and regulations. The findings show that gamification can be used to increase awareness and compliance of traffic laws effectively. Gamification elements such as points and badges provide positive incentives, while levels and rankings offer motivating feedback. Avatars help in personalizing the user experience. Gamification in the light traffic criminal system can be a creative way to improve legal compliance by providing road users with a more interactive and engaging approach.

Abstract

The president's decision immediately after being elected is how the state government to be run obtains the majority support in parliament (DPR RI). This confusion is natural considering that the presidential system must involve the people's representative institution as a form of democratic government and simultaneously implement the indirect democratic system. In the context of the power relationship between the president and the House of Representatives, sometimes it causes turmoil when the president/vice president is not supported by the majority of the House of Representatives, even to the point of worrying that impeachment may be carried out. The author uses a qualitative approach with a secondary database-document analysis with an instrumental case study of the 2009-2014 Presidential Administration to find out what are the reasons for the president's upset when he does not have the majority support in Parliament and what is the solution. The results of the study show that the reason for President SBY's upset is that he is worried that there will be a political impasse due to political tensions. The solution to overcome the chaos so that there is no political stalemate, with President SBY's accommodating-compromising attitude towards political parties in Parliament. This attitude is possible because of the pragmatic and transactional attitude as the ideological relationship of political parties which tend to be moderate and centripetal-to to national integration.

Abstract

Law Number 17 of 2023 concerning health has regulated the position of MKDKI in resolving medical disputes. The MKDKI's authority in the Health Law has been expanded to relate to violations of doctor's discipline, enforcing decisions regarding unlawful acts that can be subject to criminal sanctions, and enforcing accountability for actions/deeds that cause civil harm to patients. Based on this authority, MKDKI is similar to an institution that acts on the principles of fast, simple and low-cost justice. To study the MKDKI model, normative juridical research or doctrinal research is used. The study that will be discussed concerns the interpretation of the legal principles of law enforcement regarding alleged medical malpractice which contains violations of criminal law. The results of the research state that the MKDKI's authority, which is based on the process of resolving medical disputes using the principles of fast, simple and low cost, is less effective. Supreme Court Decision Number: 890K/Pid.Sus/2017 is an example of a legal solution that actually harms doctors. It is necessary to transform MKDKI into a strong institution, with a pattern of resolving medical disputes using fast, simple and low-cost principles. A medical dispute resolution model based on the principles of fast, simple and low cost will only emerge if a Medical Court is established. MKDKI as Medical Justice aims at enforcing acts that violate criminal law and enforcing responsibility for actions/deeds that cause civil harm. The MKDKI's independence, such as independent judicial power, to the MKDKI's objection filing system which adopts an appeals filing system within the judiciary, further emphasizes the need to transform the MKDKI as a judicial institution.

Abstract

Kebijakan pemerintah akibat penyebaran Covid-19 menimbulkan dampak perekonomian yang melemah karena pembatasan aktivitas masyarakat yang juga berdampak pada kegiatan bisnis termasuk pelaksanaan kontrak bisnis. Pelaksanaan hak dan kewajiban kontrak bisnis terhambat bahkan timbul kemungkinan tidak terlaksana yang mengakibatkan wanprestasi. Metode penelitian yang digunakan adalah penelitian hukum normative dengan pendekatan perundang-undangan dan pendekatan konseptual. Teknik pengumpulan bahan hukum yang diterapkan pada penelitian ini yaitu studi pustaka yang berupa literatur, jurnal maupun hasil penelitian terdahulu serta studi dokurnen. berupa kumpulan dokumen resmi dengan penafsiran dan pengkajian melalui peraruran perundang-undangan berdasarkan sumber hukum primer dan sekunder. Penelitian ini bertujuan untuk mengetahui akibat hukum renegosiasi terhadap pelaksanaan kontrak bisnis dan peran pernerintah dalam upaya penyelesaian wanprestasi kontrak bisnis selama masa pandemi. Hasil penelitian menunjukkan bahwa Akibat hukum renegosiasi terhadap pelaksanaan kontrak bisnis selama masa Pandemi Covid-19 menimbulkan itikad baik dari para pihak dalam kontrak dimana kedua pihak bertindak dengan rnempertimbangkan kepentingan pihak yang lain begitu pula dengan masa pandemi saat ini dimana kreditur harus memperhatikan kepentingan debitur dan peran Pernerintah dalam upaya penyelesaian wanprestasi kontrak bisnis selama masa pandemi adalah dengan melakukan kebijakan yang bersifat countercyclical.

Abstract

Latar belakang penulisan makalah ini adalah tentang keberadaan Kompilasi Hukum Islam sebagai salah satu hukum positif nasional yang sudah mengadopsi nilai kesetaraan gender dengan tetap menjaga nilai-nilai sakral dan nilai-nilai profane. Tetapi penyerapan nilai-nilai kesetaraan gender ini belum dipandang cukup oleh kalangan feminis Islam liberal dengan menuntut adanya penggantian pasal 79 tentang kedudukan suami sebagai kepala keluarga dan istri sebagi ibu rumah tangga. Padahal kedudukan suami sebagai kepala keluarga dan istri sebagai ibu rumah tangga itu bersifat sakral didukung oleh surat an-Nisa ayat 34. Kelompok feminis Islam liberal memahami pasal 79 secara terpisah tanpa menghubungkan dengan pasal lainnya dalam Bab XII tentang hak dan kewajiban, sehingga menimbulkan kesalahpahaman bahwa pasal 79 memberi kewenangan suami sebagai kepala keluarga pada setiap laki-laki tanpa syarat-syarat yang harus dipenuhi. Metode penelitian yang digunakan adalah yuridis normatif. Hasil dari penelitian menyatakan bahwa kedudukan suami sebagai kepala keluarga diperoleh melalui dalalah mantuq dalam surat an-Nisa ayat 34. Oleh karena itu batas-batas penerapan nilai kesetaraan gender dalam keluarga hanyalah dimaksudkan untuk membentuk karakter profesional di dunia public, sementara di dalam keluarga relasi antar anggota keluarga adalah kasih sayang dan saling membantu, karena keluarga adalah institusi gemeinschaft dan bukan geseelschaft. Itulah kandungan pasal 79 patut dipertahankan dalam keluarga.
