Abstract

Corruption remained one of the most serious threats to good governance and sustainable development in Indonesia because it caused substantial state financial losses and undermined public trust in government institutions. Asset confiscation was recognized as an essential legal mechanism not only to punish offenders but also to recover assets derived from corruption and restore state financial losses. This study examined the legal framework governing asset confiscation, analyzed its implementation within Indonesia's criminal justice system, and evaluated its effectiveness in supporting state asset recovery. The study employed a normative legal research method using statutory, conceptual, and case approaches. Data were collected through a comprehensive review of legislation, judicial decisions, legal doctrines, and scholarly publications and were analyzed qualitatively using descriptive legal analysis. The findings indicated that Indonesia had established a comprehensive legal framework regulating asset confiscation through national legislation and international legal instruments. However, the implementation of asset confiscation remained constrained by practical challenges, including difficulties in tracing illicit assets, ownership disputes, lengthy execution procedures, cross-border asset transfers, and limited institutional coordination. These challenges reduced the effectiveness of recovering state financial losses despite the availability of adequate legal regulations. The study concluded that strengthening institutional coordination, improving asset-tracing mechanisms, accelerating execution procedures, and enhancing international cooperation were essential to optimizing asset recovery. Effective implementation of asset confiscation was therefore found to be a strategic instrument for strengthening anti-corruption law enforcement, improving legal certainty, promoting accountability, and protecting state financial interests.

Abstract

Environmental crime has become one of the most significant challenges to environmental protection because it has caused extensive ecological degradation, biodiversity loss, and long-term threats to sustainable development. The existing environmental criminal justice system has predominantly relied on punitive sanctions, which have not adequately restored damaged ecosystems or strengthened long-term environmental responsibility. This study aimed to reconstruct a comprehensive normative framework for environmental crime prevention by integrating restorative justice with ecotheological principles. The study employed a normative legal research approach using statutory, conceptual, comparative, and philosophical analyses. Data were collected through library research from legislation, judicial decisions, international legal instruments, and scholarly publications concerning environmental criminal law, restorative justice, environmental ethics, and sustainability. The collected legal materials were analyzed qualitatively using prescriptive legal reasoning to identify conceptual limitations and formulate a reconstructed legal framework. The results showed that the prevailing retributive justice model remained insufficient to address the multidimensional impacts of environmental crime because it primarily emphasized punishment rather than ecological restoration and community recovery. The reconstructed framework integrated ecological restoration, moral responsibility, community participation, intergenerational justice, and sustainable environmental governance into a unified legal approach. The study concluded that integrating restorative justice with ecotheological principles provided a more comprehensive normative framework for environmental crime prevention by promoting ecological recovery, ethical accountability, and sustainable environmental governance.

Abstract

Interfaith marriage remains one of the most contested issues in the Indonesian legal system due to the interaction between religious law, statutory regulations, constitutional principles, and human rights norms. The absence of explicit legal provisions governing interfaith marriage has created legal uncertainty regarding marriage validity, registration, and the legal protection afforded to interfaith couples. This study aims to analyze the legal certainty of interfaith marriage in Indonesia by examining the harmonization of religious law, constitutional principles, and international human rights. The research employed a normative legal research method using statutory, case, conceptual, comparative, and philosophical approaches. Legal materials were collected through library research from legislation, Constitutional Court decisions, judicial precedents, international legal instruments, and recent scholarly publications and were analyzed qualitatively using doctrinal legal interpretation and prescriptive legal reasoning. The findings indicate that the existing legal framework has not yet provided comprehensive legal certainty due to inconsistent statutory interpretation and administrative implementation. Constitutional Court Decision Number 68/PUU-XII/2014 reaffirmed the constitutional role of religious law in determining the validity of marriage while highlighting the continuing need to balance religious values with constitutional guarantees and human rights. The study concludes that harmonizing marriage law, constitutional jurisprudence, religious legal principles, and international human rights standards is essential to strengthen legal certainty, ensure equal legal protection, and develop a more coherent family law system in Indonesia.

Abstract

Social entrepreneurship has emerged as an innovative approach to addressing social and environmental challenges while simultaneously creating sustainable economic value. Among the factors influencing individuals' willingness to engage in social entrepreneurship, social awareness is considered an important psychological determinant, particularly for Generation Z, who are characterized by high digital literacy and increasing concern for social issues. This study aimed to examine the effect of social awareness on social entrepreneurial intention among Generation Z. A quantitative research approach with an explanatory design was employed. Data were collected through an online questionnaire from 80 Generation Z respondents selected using purposive sampling. The collected data were analyzed using descriptive statistics and simple linear regression analysis with IBM SPSS Statistics 26. The results revealed that social awareness has a positive and statistically significant effect on social entrepreneurial intention (β = 0.684, p < 0.001). The coefficient of determination (R² = 0.468) indicated that social awareness explained 46.8% of the variance in social entrepreneurial intention, while the remaining variance was influenced by other factors not included in the model. These findings suggest that individuals with higher levels of social awareness are more likely to develop stronger intentions to establish social enterprises that generate both economic and social value. The study contributes to the growing literature on social entrepreneurship by highlighting the importance of strengthening social awareness through entrepreneurship education, community engagement, and sustainability-oriented learning programs. The findings also provide practical implications for universities and policymakers in promoting socially responsible entrepreneurship among Generation Z.

Abstract

Marriage registration has played a fundamental role in ensuring legal certainty and protecting the rights of spouses within the Indonesian legal system. Nevertheless, the continued prevalence of unregistered marriages has weakened women's legal position and limited their access to legal protection, particularly regarding marital status, property rights, inheritance, maintenance, and the civil rights of children. This study aimed to analyze the role of marriage registration in strengthening women's legal protection under Law Number 16 of 2019 concerning the Amendment to Law Number 1 of 1974 on Marriage. The study employed a normative legal research method using statutory, conceptual, comparative, and philosophical approaches. Legal materials were collected through library research from legislation, judicial decisions, official legal documents, and contemporary scholarly publications and were analyzed qualitatively using prescriptive legal reasoning. The analysis showed that marriage registration functioned not merely as an administrative obligation but as a preventive legal mechanism that established legal certainty and enhanced the protection of women's rights. The findings further indicated that effective marriage registration strengthened legal recognition of marital status, safeguarded property and inheritance rights, facilitated access to judicial remedies, protected children's civil rights, and promoted gender equality. The study concluded that strengthening the implementation of marriage registration under Law Number 16 of 2019 provided a more comprehensive framework for protecting women's legal rights, improving access to justice, and reinforcing legal certainty within Indonesia's family law system.

Abstract

Unregistered marriages (nikah siri) continue to create significant legal challenges in Indonesia, particularly concerning the legal status and civil rights of children. Although Indonesian law recognizes the religious validity of marriage, the absence of official registration often results in legal uncertainty regarding children's civil status, paternal affiliation, inheritance rights, guardianship, maintenance, and access to constitutional protections. This study aimed to analyze the legal implications of unregistered marriages on the status of children within the Indonesian legal system and to evaluate the effectiveness of legal protection following Constitutional Court Decision Number 46/PUU-VIII/2010. The study employed a normative legal research method using statutory, case, conceptual, and comparative approaches. Legal materials were obtained through library research from legislation, Constitutional Court decisions, international legal instruments, and recent scholarly publications and were analyzed qualitatively using doctrinal legal interpretation. The findings indicate that marriage registration serves not merely as an administrative requirement but as a fundamental legal mechanism that ensures legal certainty and strengthens the protection of children's constitutional and civil rights. Furthermore, Constitutional Court Decision Number 46/PUU-VIII/2010 has expanded legal protection by recognizing civil legal relationships between children born from unregistered marriages and their biological fathers, subject to legally admissible proof. However, inconsistencies in legal interpretation and implementation continue to hinder effective protection. The study concludes that harmonizing family law and administrative regulations is essential to ensure legal certainty, equal protection, and the best interests of children.
